The Effect Of The Housing Support Policy For The Disabled And Factors Affecting Policy Satisfaction In South Korea, Hee Bum Lee Jan 2017

The Effect Of The Housing Support Policy For The Disabled And Factors Affecting Policy Satisfaction In South Korea, Hee Bum Lee

MPA/MPP/MPFM Capstone Projects

The Korean government has recently recognized the importance of residential environment for the disabled, and has begun to establish various housing support policies as a social safety net. In this context, the Korean government has enacted the Housing Support Act for the Underprivileged (HSAU) which includes the disabled in 2012. The goal of this legislative action is to strengthen the Housing Support Policy for the Disabled (HSPD) and establish a legal basis for HSPD (NLIC, 2017). The purpose of this study is to analyze whether the introduction of HSAU has a positive effect on the policy satisfaction for the disabled. …

The Price Of Judicial Economy In The Us, Bruce A. Green Jan 2017

The Price Of Judicial Economy In The Us, Bruce A. Green

Faculty Scholarship

In the US, courts widely perceive that judicial scarcity is a common problem threatening the fair and timely resolution of disputes. Courts cite the attendant interest in judicial economy to justify interpreting the procedural and substantive law to reduce the judicial workload or accelerate the resolution of cases. But courts’ assumption that there are too few judges to handle the current caseload is hard to substantiate. First, it may not be possible to infer from excessive judicial backlogs or other perceived judicial deficiencies that a shortfall of judges is to blame. Second, even when one confidently perceives that a judicial …

Introducing Sts Scholarship To The Gun Policy Debate In United States Society, Caroline Skinner

Scripps Senior Theses

The following thesis will merge the field of legal studies with the field

of Science, Technology, and Society, and will focus on issues surrounding the

gun control debate. The goal is to ultimately bring new light to this hot-

button legal topic through the use of STS scholarship. STS tools and theories,

which have previously been absent from most gun control discussions, have

much to contribute to the discourse in terms of motivating the need for gun

control, fully understanding the user-gun relationship, breaking down

misconceptions about the technology and its role in society, and further

understanding the complex societal …

A New Balance Of Evils: Prosecutorial Misconduct, Iqbal, And The End Of Absolute Immunity, Mark C. Niles Jan 2017

A New Balance Of Evils: Prosecutorial Misconduct, Iqbal, And The End Of Absolute Immunity, Mark C. Niles

Faculty Publications

Criminal prosecutors wield immense power in the criminal justice system. While the majority of prosecutors exercise this power in a professional manner, there is compelling evidence of a serious and growing problem of prosecutorial misconduct in this country. Although much prosecutorial misconduct results in the violation of the constitutional and other legal rights of criminal defendants, prosecutors are protected from any liability arising from these violations in all but the most exceptional cases by the defense of absolute immunity. The US. Supreme Court has justified the application of absolute prosecutorial immunity, in part, by noting that other means of incentivizing …

Presidential Human Rights Talk, Margaret E. Mcguiness Jan 2017

Presidential Human Rights Talk, Margaret E. Mcguiness

Faculty Publications

In response to Professor Harold Hongju Koh's March 2017 keynote at Washburn University, "The Trump Administration and International Law," this essay examines the diplomatic and political rhetoric deployed by past presidents in support of human rights to argue that such "presidential human rights talk" represented an important element of U.S. human rights policy and promoted the transnational transmission of human rights norms. President Trump's complete abandonment of presidential human rights talk signals an end to what remains of American "human rights exceptionalism." Combined with Trump's "America First" approach to foreign policy, which rejects the value of the international institutions the …

Incorporating Social Justice Into The Law School Curriculum With A Hybrid Doctrinal/Writing Course, Rosa Castello Jan 2017

Incorporating Social Justice Into The Law School Curriculum With A Hybrid Doctrinal/Writing Course, Rosa Castello

Faculty Publications

Educating future lawyers is about more than just teaching them substantive law. We are preparing professionals who will go out into our world and shape and affect it in deep and impacting ways. They will make law, enforce law, determine policy, defend people, advocate, and influence lives and businesses. Therefore, any thorough law school education should teach social justice and encourage students to become more engaged in activism.

One way to incorporate social justice into the law school curriculum is to offer specific courses focused on social justice. However, administrators may be concerned about demand for such classes or ability …

Religious Accomodation, Religious Tradition, And Political Polarization, Marc O. Degirolami Jan 2017

Religious Accomodation, Religious Tradition, And Political Polarization, Marc O. Degirolami

Faculty Publications

A religious accommodation is an exemption from compliance with the law for some but not for others. One might therefore suppose that before granting an accommodation, courts would inquire about whether a legal interference with religious belief or practice is truly significant, if only to evaluate whether the risk of political polarization that attends accommodation is worth hazarding. But that is not the case: any assessment of the significance of a religious belief or practice within a claimant’s belief system is strictly forbidden.

Two arguments are pressed in support of this view: (1) courts have institutional reasons for acquiescing on …

Dismissals As Justice, Anna Roberts Jan 2017

Dismissals As Justice, Anna Roberts

Faculty Publications

More than a third of our states have given judges a little-known power to dismiss prosecutions, not because of legal or factual insufficiency, but for the sake of justice. Whether phrased as dismissals “in furtherance of justice” or dismissals of de minimis prosecutions, these exercises of judicial power teach two important lessons.

First, judges exercising these dismissals are rebutting the common notion that in the face of over-criminalization and over-incarceration they are powerless to do more than rubber-stamp prosecutorial decision making. In individual cases, they push back against some of the most problematic aspects of our criminal justice system: its …

The Impact Of Racial Stereotyping On Juror Perception Of Criminal Offenders, Tameka T. Price Jan 2017

The Impact Of Racial Stereotyping On Juror Perception Of Criminal Offenders, Tameka T. Price

Walden Dissertations and Doctoral Studies

For decades, research has consistently demonstrated that minorities are overrepresented in the prison population, yet relatively little is known about whether juror perceptions about race and criminal culpability may impact this problem in the United States. Using Hill's folk theory of race and racism as the theoretical foundation, this cross sectional study examined the relationship between perceptions of the race of the defendant and the verdicts to be handed down. Data were collected from a convenience sample of 25 people who self-reported having served on a jury or were eligible for jury service within the past 5 years in a …

Suicidal Behavior In Inmates Through The Pathway Of Psychopathy And Depression, Zsofia Muller-Balazsfi

Walden Dissertations and Doctoral Studies

Prison inmates are more prone to commit suicide than are individuals in the general population. Current scientific research has identified risk factors of suicide in the general population, such as mood disorders, but only a few research studies have examined risk factors that are particularly relevant to the incarcerated population. This study used a quantitative archival research design to examine the effect of primary and secondary psychopathic personality traits on the development of suicidal behavior in the mentally ill male prison inmate population at a U.S. federal prison located in the Southeast. Data on psychopathic traits as measured by the …

Effects Of The Walters Criminal Lifestyle Program On Offenders' Criminal Thinking Styles, Alessandre Singher Singher Jan 2017

Effects Of The Walters Criminal Lifestyle Program On Offenders' Criminal Thinking Styles, Alessandre Singher Singher

Walden Dissertations and Doctoral Studies

Researchers have documented the high prevalence of crime in society and the need for programs to assist in the reduction of crime. Social cognitive and criminal lifestyle theories were the two major theoretical frameworks applied to this study due to their focus on the influence of cognitive change on behavioral modifications. A lifestyle approach in such programs reshapes criminal thoughts and transforms criminal behaviors. The efficacy of a lifestyle program in a community correctional facility outside of federal prison walls, modified to run 3 months with parolees and probationers, lacks evidenced research. Using a 2x3 between groups factorial ANCOVA, archival …

The Policing Strategy Of Racial Profiling And Its Impact On African Americans, Derrick Paul Jones Jan 2017

The Policing Strategy Of Racial Profiling And Its Impact On African Americans, Derrick Paul Jones

Walden Dissertations and Doctoral Studies

Prior literature on racial profiling indicates that African Americans have been mistreated, harassed, and discriminated against by law enforcement because of this controversial policing strategy. The purpose of this qualitative research study was to bridge the gap in knowledge by analyzing the impact of racial profiling on African American adults and discover whether it contributed to unintentional violence in racial and ethnic minority communities. The theoretical framework for this research study was critical race theory. The research question for this study was: How does racial profiling impact African Americans' perception of the police? This phenomenological research study used purposeful sampling …

Capital Punishment Of Unintentional Felony Murder, Guyora Binder, Brenner Fissell, Robert Weisberg Jan 2017

Capital Punishment Of Unintentional Felony Murder, Guyora Binder, Brenner Fissell, Robert Weisberg

Journal Articles

Under the prevailing interpretation of the Eighth Amendment in the lower courts, a defendant who causes a death inadvertently in the course of a felony is eligible for capital punishment. This unfortunate interpretation rests on an unduly mechanical reading of the Supreme Court’s decisions in Enmund v. Florida and Tison v. Arizona, which require culpability for capital punishment of co-felons who do not kill. The lower courts have drawn the unwarranted inference that these cases permit execution of those who cause death without any culpability towards death. This Article shows that this mechanical reading of precedent is mistaken, because the …

"I Have Shakespeare In My Blood": Reading Intervention With Middle School Boys, Leah Guenther Jan 2017

"I Have Shakespeare In My Blood": Reading Intervention With Middle School Boys, Leah Guenther

Mid-Western Educational Researcher

This research investigates the impact of teaching Shakespeare to below-grade-level readers in an English Language Arts classroom on Chicago’s South Side. The students studied are five middle school boys who were observed over a two-year course of study under the same teacher who, after finding success with this method, found herself asking, how is it that underperforming readers were able to make their way into such complicated text? In fact, by the end of the two years, all were reading at or far above grade level. The study argues that focusing on students’ strengths, teacher choice, and using the classics, …

White-Collar Crime: Should You Be Afraid?, Logan Smalley

Williams Honors College, Honors Research Projects

A secondary data analysis was conducted to determine relationships between US State, dollar amount of fraud, and type of savings and loan fraud committed. Using a dataset created by Pontell et al. (1999), this paper investigates the impact of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 on prosecuting those who commit crimes within the savings and loan industry. This paper also includes research into the theoretical components of society's perception into white-collar crime and sociological theories that could explain motives behind white-collar offenses.

Stigma And Reputation: Exploring The Lingering Effects Of Organizational Stigma, Jahnavi Patel

Williams Honors College, Honors Research Projects

Stigmas have been widely used to describe organizations and individuals that have negative reputations or that have engaged in illegitimate practices. Extensive research has been done on the effects of positive reputation and personal reputation. However, there is still much to learn about the effects and consequences of organizational stigmas. The purpose of this paper is to provide a theoretical overview of the consequences of organizational stigmas, particularly in the area of employee mobility, and to help understand the relationship between negative organizational reputation and personal reputation. Contributions of this research, the limitations and directions for future research are discussed …
