Cyber-Harassment In Higher Education: A Study Of Institutional Policies And Procedures, Victoria Ann Schaefer-Ramirez
Cyber-Harassment In Higher Education: A Study Of Institutional Policies And Procedures, Victoria Ann Schaefer-Ramirez
Theses and Dissertations
Cyberbullying is a growing phenomenon, causing concern among students, parents, and professionals in the educational community. Although no federal law specifically addresses cyber-harassment in higher education, institutions have a legal obligation to address all claims of harassment, regardless of the location or platform in which the harassing behavior occurs. Recent court cases are setting precedents for obligatory institutional response and potential penalties for lack thereof; conversely, institutions are left to their own devices to employ and develop policy statements and sanctions that prohibit or discourage cyber-harassment behaviors. As the legal and political environment regarding bullying and cyberbullying behaviors continues to …

Title Ix And Procedural Fairness: Why Disciplined-Student Litigation Does Not Undermine The Role Of Title Ix In Campus Sexual Assault, Erin E. Buzuvis
Title Ix And Procedural Fairness: Why Disciplined-Student Litigation Does Not Undermine The Role Of Title Ix In Campus Sexual Assault, Erin E. Buzuvis
Faculty Scholarship
As a matter of civil rights, Title IX mandates that federally funded educational institutions address reports of sexual assault. Often disciplined-student plaintiffs argue unsuccessfully that the college or university’s decision to discipline them is tainted by “reverse” sex discrimination. This Article examines the recent spate of disciplined-student cases in an effort to harmonize Title IX compliance with the procedural rights of students accused of sexual assault. It provides a historical context for Title IX’s application to sexual assault on campuses and the requirements the law imposes on the educational institutions. Next, it describes the role Title IX plays in disciplined-student …

The Icc's Role In Combatting The Destruction Of Cultural Heritage, Mark S. Ellis
Case Western Reserve Journal of International Law
However, the case’s firm grounding in international law, and the clear connection between a category of cultural-property crimes and attempts at cultural erasure, challenges the notion that these are second-rate crimes. The case reinforces the legal principle that attacks on culture, like attacks against people, constitute war crimes subject to international criminal prosecution. The Al Mahdi case will be significant in determining how the international community should best deal with such abhorrent attacks in the future.

A Dog Is Not A Stereo: The Role Of Animal Sentience In Determining The Scope Of Owner Privacy Interests Under Oregon Law, Lora Dunn, David B. Rosengard
Animal Law Review
In 2011, a relatively routine animal neglect investigation spawned a line of litigation that would eventually reach the Oregon Supreme Court. Along the way, this case-State v. Newcomb-raised issues central to both constitutional and animal law, involving inquiry into how animals are situated under the law, the \.Veight of a defendant's privacy versus an animal's interests, and what relevance attaches to animals existing as feeling, sentient creatures. In analyzing Newcomb, this Comment discusses the case facts in Part I, before laying out the arguments heard-and decisions rendered-by the trial and appellate courts in Part II. Part III reads the Oregon …

Differences In Outcomes For Incarcerated And Non-Incarcerated Patients Hospitalized In The Commonwealth Of Massachusetts, 2011-2013: Is “Adequate Care” In Criminal Justice Institutions Enough?, Dean Eric Doering
MUSC Theses and Dissertations
Objective: This study used data from the Healthcare Cost and Utilization Project State Inpatient Databases to identify whether inmates in Massachusetts had any differences in morbidity, mortality, cost, length of stay, and ambulatory care sensitive conditions as compared to a propensity-score matched (1:1 ratio) group of non-inmate patients. Methods: Differences were examined using t tests for continuous variables and Chisquare (χ2) tests for categorical variables. Multiple linear and logistic regression models were used to investigate relationships between the outcome variables and inmate/noninmate status, controlling for age, Charlson Comorbidity Index score, gender, primary payer, race, psychological conditions, suicide, and injuries. Results: …

Capital Sentencing For Children In Virginia In The Wake Of Miller V. Alabama And Montgomery V. Louisiana, Julie Ellen Mcconnell
Law Faculty Publications
Recent United States Supreme Court decisions have declared it unconstitutional to sentence a juvenile to mandatory life in prison without an opportunity for parole. Virginia, a state that abolished parole in 1995, has yet to recognize the federally mandated prohibition against disproportionate punishment imposed on juveniles, particularly in cases where the mandatory minimum sentence is life without parole. This article proposes the General Assembly should amend current laws that reflect the unconstitutionality of these statutes as applied to juveniles.

Comments: When Psychology Answers Constitutional Questions: The Eighth Amendment And Juvenile Sentencing, Emily M. Steiner
University of Baltimore Law Review
While weighing whether or not to turn himself in for murder and surrender to prison, a 23-year-old law student questions the high premium placed on imprisonment as a rehabilitative measure. After finally submitting to imprisonment, however, Rodion Raskolnikov comes to understand the value of atoning for his crimes and how his punishment correlates with societal justice. The balance struck between an appropriate amount of suffering and society’s need for justice is at the heart of Raskolnikov’s character development.
Despite Raskolnikov’s imprisonment and accompanying character transformation, one important question remains unanswered by Fyodor Dostoevsky’s novel: at what point does a punishment …
Provider Perceptions Of People Who Inject Drugs And Harm Reduction Approaches, Ciara Devozza
Provider Perceptions Of People Who Inject Drugs And Harm Reduction Approaches, Ciara Devozza
Theses, Dissertations, and Projects
People who use injection drugs (PWID) continue to face high rates of death and disease, further exacerbated by the ongoing opioid epidemic. Research indicates that stigma toward this population is high among health care providers, which is shown to result in poor health outcomes and ostracize these high-risk patients from treatment. In the U.S., the dominant substance treatment model is abstinence-based, despite evidence from around the world supporting use of harm reduction interventions which focus on goals to reduce the harmful impacts of drug use to individuals and communities. This quantitative study examined nurses’ attitudes toward PWID and nurses’ receptivity …
From Yellow Peril To Model Minority : ǂB Deconstruction Of The Model Minority Myth And Implications For The Invisibility Of Asian American Mental Health Needs, Lynda Anne Moy
Theses, Dissertations, and Projects
The model minority myth is a racial stereotype imposed upon Asian Americans, often depicting them as a successful and high-achieving monolithic group in the United States. This paper examines sociopolitical functions of the term “model minority” and implications for this broad and diverse racial group by reviewing existing literature and conducting an analysis of qualitative interviews with 12 Asian Americans. The findings of this study suggest that while the model minority myth appears to be a positive stereotype, it may lead Asian Americans to experience distress through (a.) a sense of confinement, (b.) treatment as foreigners, and (c.) …
Innocent Until Proven Guilty : ǂB Not For The Families Vicarious Incarceration Within A County Jail, Molly O'Connor
Innocent Until Proven Guilty : ǂB Not For The Families Vicarious Incarceration Within A County Jail, Molly O'Connor
Theses, Dissertations, and Projects
When an individual goes to jail, family members are often left in the shadow of the incarceration. This qualitative research study contributes to the incarceration literature by focusing on caregivers’ experiences at county jails, and by suggesting the usage of the term vicarious incarceration to fully encompass the levels of impact that incarceration has on the family. Caregivers in the present study engaged in a semi-structured interview modeled after Megan Comfort’s (2009) examination of secondary prisonization at San Quentin. Findings indicate that caregivers visiting a county jail do experience secondary prisonization, both at the jail and within the home. However the …

A 21st Century Economic, Educational And Ethical Mathematics Curriculum Policy, Glen S. Aikenhead
The Mathematics Enthusiast
Reformulating a mathematics curriculum is a political act, contextualized by economic, educational and ethical considerations, among others. This article represents a political rendition of a rationale to update the Saskatchewan, Canada, curriculum so it harmonizes with a cultural understanding of school mathematics (Ernest, 1988). By revisiting the 19th century definition of school mathematics that we generally follow today, its economic, educational and ethical consequences seem contrary to the expectations of 21st century Saskatchewan. The article’s point form organization, uninterrupted by the appearance of references, conforms to the genre of submissions to government committees. However, footnotes will clarify information for readers unfamiliar …

The Government of the Republic of Zambia has fully committed to fulfilling the SRHR of all people by ratifying 11 international instruments of law. This brief is Part 3 of a three-part series entitled “Status of Sexual and Reproductive Health and Rights in Zambia,” reporting on progress, gaps, and existing challenges in SRHR. Using a human rights–based approach, the Government of Zambia and collaborators, with technical facilitation by the Population Council, conducted an assessment of the status of SRHR …
