Pretrial Attitudes And Their Influence On Interpretation Of Case Evidence And Mock Juror Decision-Making In Insanity Defense Cases, Justine M.L. Gonzales Jan 2017

Pretrial Attitudes And Their Influence On Interpretation Of Case Evidence And Mock Juror Decision-Making In Insanity Defense Cases, Justine M.L. Gonzales

Honors Papers

Pretrial attitudes (attitudes held preceding any case-specific information) towards the insanity defense are known to influence jurors’ decision-making about a case. However, the impact of pre-trial attitude on decisions across different types of evidence was an open question that the present study addressed. Through Amazon Mechanical Turk, participants indicated their pretrial support for the insanity defense. Participants served as mock jurors and rated the likelihood of giving the defendant not guilty by reason of insanity (NGRI) as well as perceived responsibility for the defendant’s actions, they gave these ratings after introducing seven different pieces of evidence (baseline case vignette, mother …

Burdens Of The Body Weigh More Than We Know: How Weight Impacts Judgments Of A Simulated Vehicular Pursuit, Holly Lonergan Jan 2017

Burdens Of The Body Weigh More Than We Know: How Weight Impacts Judgments Of A Simulated Vehicular Pursuit, Holly Lonergan

Undergraduate Review

The purpose of this project was to replicate research on embodied cognition and extend it to the judgments related to law enforcement, specifically decisions associated with the use of force. Excessive use of force by police officers is often characterized as an act driven by racism and ethnic and social biases. However, decisions are far more complex and are shaped by many psychological and environmental factors. The current study examined how one of these factors, the perception of physical or metaphorical weight, may influence judgments about suspect dangerousness and incident severity. Participants were randomly assigned to one of four conditions …

The Reintegrative State, Joy Radice Jan 2017

The Reintegrative State, Joy Radice

Scholarly Works

Public concern has mounted about the essentially permanent stigma created by a criminal record. This is no small problem when the U.S. criminal history database currently stores seventy-seven million criminal records, and poor people and people of color constitute a severely disproportionate number of them. A criminal record makes it harder for people to find housing, get hired, attend college, and reunite with their families. Yet these very things have the greatest chance of helping people lead law-abiding lives and reducing recidivism. Scholars, legislators, and advocates have confronted this problem by arguing for reforms that give people with a conviction …

Mandation Of Two Police Officers Per Patrol Unit And The Impact Of Diversity, Jolito Rivera Jan 2017

Mandation Of Two Police Officers Per Patrol Unit And The Impact Of Diversity, Jolito Rivera

Bridges: A Journal of Student Research

The purpose of this research is to explore the operation of police patrol units. Many police patrol units currently lack diversity as well as accountability on police officers. The first phase of correcting the deficits of the patrol units is identifying pros and cons of the current police patrolling methods. The second phase involves alternative solutions that could be put in place to create safer and more efficient police patrolling units. I analyze these solutions to determine why they would be positive and what restrictions prevent them from being feasible. In the final phase of the paper, I present a …

Can We Protect The Innocent Without Freeing The Guilty? Thoughts On Innocence Reforms That Avoid Harmful Tradeoffs, Paul Cassell Jan 2017

Can We Protect The Innocent Without Freeing The Guilty? Thoughts On Innocence Reforms That Avoid Harmful Tradeoffs, Paul Cassell

Utah Law Faculty Scholarship

It is fundamentally important that the criminal justice system accurately separate the guilty from the innocent. But many recent reform measures from the innocent movement rest on shaky ground. Protecting against wrongful convictions can create tradeoffs. If poorly crafted, a reform measure might not only prevent convicting innocent persons but also guilty persons, allowing dangerous criminals to avoid incarceration and continue to victimize innocent persons. From a public policy perspective, these tradeoffs create concern that reform measures may be cures worse than the disease.

With this caution in mind, it is possible to craft reforms that help to protect the …

The Economics Of Policing Research, Laura Huey Jan 2017

The Economics Of Policing Research, Laura Huey

Sociology Publications

In 2012, provincial, territorial and federal governments of Canada reached consensus on an important policy issue: public policing costs were escalating and something needed to be done about ‘the economics of policing’. They also discovered that, as a result of the federal government’s chronic defunding of policing research, they had very little Canadian knowledge upon which to draw. The focus of the present paper is on how both the ‘economics of policing’ crisis, and policy-makers’ inability to utilize domestic research to resolve it, were generated by successive governments sharing an ideologically-informed view of the relative importance of criminal justice research.

Transforming Societies After Violence: Conceptualizing And Contextualizing Transitional Justice In Africa, Jennifer Moore Jan 2017

Transforming Societies After Violence: Conceptualizing And Contextualizing Transitional Justice In Africa, Jennifer Moore

Faculty Book Display Case

This chapter first analyses three facets of transitional justice -- the criminal-retributive, the historical-reconciliative, and the social-redistributive -- and identifies some of the synergies and tensions among them. The second section shines a spotlight on the post-independence, conflict, and post-conflict histories of Uganda, Sierra Leone, and Burundi, generally characterizing their distinct approaches to transitional justice, and the differing degrees of attention they devote to the various strands of justice. For each of the three countries, the text points to the work of a community-based civil society organization, and spotlights its approach to post-conflict transition in that country. The final section …

After The Crash: Examining Pedagogical Approaches To Teaching Business Ethics, Colette Murphy, Dr. Noel Murray Jan 2017

After The Crash: Examining Pedagogical Approaches To Teaching Business Ethics, Colette Murphy, Dr. Noel Murray

Irish Business Journal

Research has shown that business students are less ethical than students in other disciplines (Segal et al., 2011), which is a worrying finding, considering that unethical business practices are seen as a major feature leading to the world economic recession in 2008. However, business schools across the globe have consistently taught the subject of ethics in order to instil an ethical mind-set in their graduates. The way business ethics is embedded in the curriculum has been the subject of much debate, with a range of pedagogical approaches taken. This paper examines the current teaching of ethics, by examining two business …

The Effect Of Contact Type On Perceptions Of Sex Offender Recidivism Risk, Donald Walker Jr. Jan 2017

The Effect Of Contact Type On Perceptions Of Sex Offender Recidivism Risk, Donald Walker Jr.

ETD Archive

Prior research has found that the general public perceives sex offenders negatively as a whole (Edwards & Hensley, 2001). These perceptions have enabled sex offender management policies that create ironic conditions for sex offender rehabilitation and reintegration (Hanson, & Harris, 2000). More recent research has found that when sex offenders are presented as subcategories the public has more varied, though still negative attitudes toward sex offenders (King & Roberts, 2015). Furthermore, a burgeoning area of research has developed around the differentiation of child sex offenders based on the contact that they have had with their victims: non-contact, contact-only, and mixed-contact. …
