Teaching While White: White Identity Development And Antiracism For Educators, Amber Mackenzie Taylor May 2017

Teaching While White: White Identity Development And Antiracism For Educators, Amber Mackenzie Taylor

Master's Projects and Capstones

This project explores the use of mindfulness in antiracist professional development for educators, documenting the development and implementation of workshop curriculum across three conference settings. The purpose of the project was to engage White educators in the important inner work of understanding White racial conditioning and actively challenging the institutional and structural racism inherent in our education system. Beginning with an understanding of race, racism and Critical Race Theory, the curriculum was designed to support White educators in developing their own racial identities to further their own personal development. The workshop focuses on White Identity development (Helms, 1990) to support …

Teaching A Human Rights Education Through Youth Athletics, Jacob J. Beaman May 2017

Teaching A Human Rights Education Through Youth Athletics, Jacob J. Beaman

Master's Projects and Capstones

Throughout my research and work in education I realized there is often a disconnect between schooling and students especially in low-income areas. It can be incredibly difficult to feel confident at school when the curriculum is not relatable to your experiences and life. In this paper I explore how an athletic program can be used to teach a Human Rights Education to fill in the gaps the traditional school day may not provide. I used a Human Rights Education framework with the teacher/coach as a facilitator and a Critical Race Theory lens examining intersectionality, counter-story telling, and interest convergence in …

End Of Life Care For The Incarcerated, Codie Robinson May 2017

End Of Life Care For The Incarcerated, Codie Robinson

Dialogue & Nexus

As the prison population ages, a new need has come to light – caring for those who are in the final stage of life. This paper will examine the current end of life services provided to those in prison throughout the United States. After a general awareness of the system is presented, a more complete discussion of end of life care for prisoners will be considered, in light of ethics, social justice, and the Christian perspective. The two care options presented, hospice care and compassionate release, are observed through these lenses. In order to make a decision on how to …

Knowledge-Based Interventions Are More Likely To Reduce Legal Disparities Than Are Implicit Bias Interventions, Patrick S. Forscher, Patricia G. Devine May 2017

Knowledge-Based Interventions Are More Likely To Reduce Legal Disparities Than Are Implicit Bias Interventions, Patrick S. Forscher, Patricia G. Devine

Psychological Science Faculty Publications and Presentations

We should note at the outset that this chapter is different from most others in this volume. Neither author is an expert of the law, legal proceedings, or the criminal justice system more generally. Instead, we are both psychological scientists who specialize in race and unintentional forms of bias. Our goal in this chapter is to review the extant work on implicit bias and interventions to change implicit bias. Though the work in this area is ever burgeoning, the evidence regarding the effectiveness of implicit bias interventions is rather mixed and the goals for the specific research efforts are quite …

Forming A Therapeutic Response To Adolescent Impulsivity, Kira M. Hansen May 2017

Forming A Therapeutic Response To Adolescent Impulsivity, Kira M. Hansen

Counseling

Utilizing a biopsychosocial perspective, this paper addresses the impact, causes, and treatment of adolescent impulsivity. Specifically, the defining features of impulsivity are identified, and the implications that impulsivity has on adolescent criminal behaviors, treatment participation, and quality of life measures are addressed. As a result of this paper's findings, a therapeutic integration of Dialectical Behavior Therapy and working memory training is proposed in order to meet treatment needs that have gone unaddressed, and this integrated model is presented in the form of a group treatment manual.

Meeting Of The Minds And Bodies: Contract Law And The Mutuality Of Sexual Exchanges, Kelly Jo Popkin May 2017

Meeting Of The Minds And Bodies: Contract Law And The Mutuality Of Sexual Exchanges, Kelly Jo Popkin

DePaul Journal of Women, Gender and the Law

Though it may seem like an obvious analogy, a comparison of consent to sex and consent to contract has rarely been explored in such detail. The legal concepts protecting bargainers to a contract can be applied to analyses of sexual coercion in consent to sexual encounters, thereby affording survivors with greater protection against instances of sexual violence that seem to consistently slip through the cracks of our criminal justice system. More importantly, this analysis has never before been applied to the Title IX campus sexual assault adjudication process and policies. As a procedure involving civil law, rather than criminal law, …

Prostitution And Sex Work: Situating Ireland’S New Law On Prostitution In The Radical And Liberal Feminist Paradigms, Rebecca Beegan, Joe Moran May 2017

Prostitution And Sex Work: Situating Ireland’S New Law On Prostitution In The Radical And Liberal Feminist Paradigms, Rebecca Beegan, Joe Moran

Irish Journal of Applied Social Studies

Several distinct ideologies have emerged from feminist theory. However, insofar as feminist ideologies differ, they agree in their recognition that women are essentially oppressed. It is in their explanation as to why oppression occurs and how they propose to combat it that differences arise. Competing ideological perspectives and consequent views on issues such as prostitution and sex work have splintered feminist thinking for decades. This paper discusses the two dominant feminist positions, liberal feminism and radical feminism and reviews their differing perspectives which are especially influential in the Irish prostitution and sex work debate. In exploring these perspectives, we will …

Crime Concentration In Ireland In 2012: A Location Quotient Approach, Stephen Brosnan May 2017

Crime Concentration In Ireland In 2012: A Location Quotient Approach, Stephen Brosnan

Irish Journal of Applied Social Studies

The aim of this paper is to investigate spatial patterns of crime in Ireland to develop a better theoretical understanding of the role of geography and opportunity, as well as enabling practical crime prevention solutions that are tailored to specific places. The analysis uses crime data sourced from the Central Statistics Office to analyse crime concentration for a range of crime categories using alternative measures of concentration. The findings of this paper indicate that crime concentrates in particular places in Ireland. The findings may be utilised by An Garda Síochana (Irish police force) to enable practical crime prevention solutions that …

Supports For Offenders With Learning Disabilities In The Irish Judicial System: A Critical Review, Gillian Mcnamee, Ciara T. Staunton Dr

Irish Journal of Applied Social Studies

There is increasing focus on the prevalence of learning disabilities in the criminal justice system. The aim of this paper is to examine the supports and resources currently in place to support people with learning disabilities through each stage of the Irish judicial process. A review of international literature regarding people with disabilities was conducted specifically in relation to the methods used to identify those who are risk of becoming offenders, the process in place when an individual comes in contact with the criminal justice system, other professionals and practitioners who undertake criminal work, their incarceration into a rehabilitation setting …

Downstream Competence Challenges And Legal/Ethical Risks In Digital Forensics, Michael M. Losavio, Antonio Losavio May 2017

Downstream Competence Challenges And Legal/Ethical Risks In Digital Forensics, Michael M. Losavio, Antonio Losavio

Annual ADFSL Conference on Digital Forensics, Security and Law

Forensic practice is an inherently human-mediated system, from processing and collection of evidence to presentation and judgment. This requires attention to human factors and risks which can lead to incorrect judgments and unjust punishments.

For digital forensics, such challenges are magnified by the relative newness of the discipline and the use of electronic evidence in forensic proceedings. Traditional legal protections, rules of procedure and ethics rules mitigate these challenges. Application of those traditions better ensures forensic findings are reliable. This has significant consequences where findings may impact a person's liberty or property, a person's life or even the political direction …

Development Of A Professional Code Of Ethics In Digital Forensics, Kathryn C. Seigfried-Spellar, Marcus Rogers, Danielle M. Crimmins 2184089

Annual ADFSL Conference on Digital Forensics, Security and Law

Academics, government officials, and practitioners suggest the field of digital forensics is in need of a professional code of ethics. In response to this need, the authors developed and proposed a professional code of ethics in digital forensics. The current paper will discuss the process of developing the professional code of ethics, which included four sets of revisions based on feedback and suggestions provided by members of the digital forensic community. The final version of the Professional Code of Ethics in Digital Forensics includes eight statements, and we hope this is a step toward unifying the field of digital forensics …

BACKGROUND: The STTR treatment cascade provides a framework for research aimed at improving the delivery of services, care and outcomes of PLWH. The development of effective approaches to increase HIV diagnoses and engage PLWH in subsequent steps of the treatment cascade could lead to earlier and sustained ART treatment resulting in viral suppression. There is an unmet need for research applying the treatment cascade to improve outcomes for those with criminal justice involvement.

METHODS: The Seek, Test, Treat, and Retain (STTR) criminal justice (CJ) cohort combines data from 11 studies across the HIV treatment cascade that focused on persons involved …

Rape Culture, Victim Blaming, And The Role Of Media In The Criminal Justice System, Lily K. Thacker May 2017

Rape Culture, Victim Blaming, And The Role Of Media In The Criminal Justice System, Lily K. Thacker

Kentucky Journal of Undergraduate Scholarship

Rape culture and the practice of victim blaming are inherently linked phenomena, and both are prevalent in American society. The existence of a rape culture which normalizes sexual violence and blames rape victims for the attacks against them strongly affects the American criminal justice system, influencing both the outcomes of rape trials and the treatment of rape victims. In particular, the media’s methods of discussing and portraying rape are examined as primary sources for the perpetuation of rape culture, and the effects of these media representations of rape on the outcomes of real rape trials are also examined. The problematic …

The Role Of The Prison-Industrial Complex In Demilitarization, Corporate Outsourcing, & Immigration Policy, Shellie Anna Shimmel May 2017

The Role Of The Prison-Industrial Complex In Demilitarization, Corporate Outsourcing, & Immigration Policy, Shellie Anna Shimmel

OSRI Journal of Student Research and Innovation

The traditional system of justice in the United States, based on the goals of retribution, incapacitation, rehabilitation, deterrence, and restitution, has been replaced with a corporate model of mass punishment based on profits, expediency, and the exploitation of free labor. This corporation is known as the “Prison- Industrial Complex,” and is made up of an enormous, interweaving system of correctional institutions, profit-driven corporations, and politicians (Davis, 1998; Schlosser, 1998). Some question whether the creators of the Prison-Industrial Complex could have predicted or anticipated the outcome of their actions (Reinarman & Levine, 2004). I will show their actions were in fact …

In this article we summarize histories of nonlinear, complex interactions among societal, legal, and ecosystem dynamics in six North American water basins, as they respond to changing climate. These case studies were chosen to explore the conditions for emergence of adaptive governance in heavily regulated and developed social-ecological systems nested within a hierarchical governmental system. We summarize resilience assessments conducted in each system to provide a synthesis and reference by the other articles in this special feature. We also present a general framework used to evaluate the interactions between society and ecosystem regimes and the governance regimes chosen to mediate …

Urban Extension: Aligning With The Needs Of Urban Audiences Through Subject-Matter Centers, Brad Gaolach, Michael Kern, Christina Sanders May 2017

Urban Extension: Aligning With The Needs Of Urban Audiences Through Subject-Matter Centers, Brad Gaolach, Michael Kern, Christina Sanders

Journal of Human Sciences and Extension

The educational program model is the principle approach Extension uses to deliver on its mission of “taking knowledge to the people.” However, with county-based faculty fully engaged in long-term program delivery, they may have little or no capacity to address emerging issues faced by urban communities. Urban governments often seek the research capacity of a university in addition to, or instead of, the traditional Extension programming model but sometimes turn first to other urban-serving universities. Washington State University Extension has addressed these challenges by establishing subject-matter centers. This article examines how subject-matter centers can add capacity to traditional Extension offices …

Semantic Vagueness And Extrajudicial Constitutional Decisionmaking, Anthony O'Rourke May 2017

Semantic Vagueness And Extrajudicial Constitutional Decisionmaking, Anthony O'Rourke

William & Mary Bill of Rights Journal

This Article integrates two scholarly conversations to shed light on the divergent ways in which courts and legislatures implement constitutional texts. First, there is a vast literature examining the different ways in which courts and extrajudicial institutions, including legislatures, implement the Constitution’s textually vague expressions. Second, in recent years legal philosophers have begun to use philosophy of language to elucidate the relationship between vague legal texts and the content of laws. There is little scholarship, however, that uses philosophy of language to analyze the divergent ways in which legislatures and courts implement vague constitutional provisions. This Article argues that many …
