Finding Justice, Laurie L. Levenson
Finding Justice, Laurie L. Levenson
ConLawNOW
In this essay memoralizing remarks presented on Constitution Day, Professor Laurie Levenson reflects on her transition from federal prosecutor to defense attorney as founder of Loyola Law School’s Project for the Innocent. She recounts the stories of two clients freed by the work of the Project. She then discusses how this work revealed blind faith in the Constitution is not enough to ensure that only the guilty are convicted. We need to do better. Levenson argues that we need to realize that constitutional rights only protect individuals if both prosecutors and defense lawyers want those rights to work. A prosecutor …

Beyond The Money: Expected (And Unexpected) Consequences Of America's War On Drugs, Cynthia Brown
Lincoln Memorial University Law Review Archive
The purpose of this paper is to provide a high-level survey of our nation’s prohibition policies within the context of the costs of the law enforcement efforts upholding those policies. The discussion will offer a cursory review of the economic expense of the war on drugs with tangential coverage of the constitutional, institutional and intangible expenses that are inseparable from an assessment of the costs of America’s drug control efforts. Part I provides a historical review of illicit drug use in the United States, while Part II supplies the evolution of the country’s efforts to codify its drug control policies. …

Civil Liberties V. National Security: A Study Of Hispanic Students' Public Opinion, Carlos Alvarez
Theses and Dissertations
The purpose of this study is to understand Hispanic students’ public opinion on whether they want to protect their civil liberties or prefer more national security to respond to terrorism. I sent an electronic survey to 900 students attending a South Texas university with 193 completed surveys returned. I replicated eight individual counter-terrorism measures from Welch (2015), and derived a component dependent variable using a data reduction technique called principal component analysis. In this study, my independent variables are measures of nationalism, ethnocentrism, and political affiliation. Political affiliation was significantly related to the support for counter-terrorism policy, and the gender …

Surveillance has been considered an effective technique for detection and deterrence of wrongdoings by rogue entities in our society. However, the mechanism comes with a price – reduced level of privacy and trust. It also raises ethical issues regarding its deployment and use. In this paper, we present the impact of surveillance on modern society and its ethicality in the light of known ethical theories. This leads to our main discussion about the tradeoff between safety through surveillance and sacrificing people’s privacy, with a focus on ethics of using such techniques. In these contexts, we consider both private and public …

Luis Saavedra, Melissa García Vélez, and Marlen Fernández were among the cofounders of the Lehman College DREAM Team, the first official group organized by and specifically for undocumented students at the City University of New York (CUNY). From their first semester on campus, until they graduated in 2014, Luis, Melissa, and Marlen worked tirelessly on campus, around the city, regionally, and at the federal level, demanding better services for undocumented students at the college and throughout the CUNY system, while also helping college and high school students mobilize on their own campuses. They engaged with national activist groups and debates, …

ABSTRACT
Urban Legal Education and Academic Development: The Effects of a Civics-Based Educational Program on Urban Youth
There is a critical need for urban youth to have working knowledge of the legal and civic nuances of their communities and political state that affects their daily lives. The pressing problems of the daily existence that these students face inhibit them from utilizing this understanding to exhibit appropriate behavior and engage in civil discourse. Urban Legal Education and Academic Development (ULEAD) provided these students with the knowledge of the functions of the legal and civic processes that facilitate behavior modification to allow …

Demeanor, Race, And Police Perceptions Of Procedural Justice: Evidence From Two Randomized Experiments, Justin Nix, Justin T. Pickett, Scott E. Wolfe, Bradley A. Campbell
Criminology and Criminal Justice Faculty Publications
President Obama’s Task Force on 21st Century Policing recently endorsed procedural justice as a way to restore trust between police and communities. Yet police–citizen interactions vary immensely, and research has yet to give sufficient consideration to the factors that might affect the importance officers place on exercising procedural justice during interactions. Building on research examining “moral worthiness” judgments and racial stereotyping among police officers, we conducted two randomized experiments to test whether suspect race and demeanor affect officers’ perceptions of the threat of violence and importance of exercising procedural justice while interacting with suspicious persons. We find that suspect race …

The colonization of decomposing remains by necrophagous insects such as blow flies is of forensic importance because the progression through the various stages of insect development can be correlated to time of death. The ability to infer this information hinges on accurate determination of the fly species that are associated with the entomological evidence collected. This evidence can include eggs, larvae, pupae, and puparial casings. Determination of the egg’s identity is particularly challenging because the eggs of multiple species are morphologically very similar. We report here that the species identity of fly eggs can be determined from their chemical fingerprint …

Sexual Risk Behaviours Associated With Unlicensed Driving Among Young Adults In Miami’S Electronic Dance Music Nightclub Scene, Mance E. Buttram, Steven P. Kurtz, Roddia J. Paul
CAHSS Faculty Articles
Literature indicates that unlicensed driving (UD) offenders report substance use risk behaviours, yet data related to sexual risk behaviours is unknown. This study examined sexual and other risk behaviours among young adults in Miami, Florida, comparing UD and non-UD offenders (n = 498). Compared with others, UD offenders were more likely to report group sex history, being high for sex half the time or more, purchasing sex and sexually transmissible infection history. Results suggest that locating sexual risk reduction interventions inside of the justice system would benefit UD offenders.
Future Prisons And Personalized Trajectories, Cisca Joldersma
Future Prisons And Personalized Trajectories, Cisca Joldersma
Journal of Prison Education and Reentry (2014-2023)
In the near future, imprisonment may no longer be the ultimate sanction. Imprisonment may be part of sanctions combined in an offender’s trajectory. These trajectories will become more and more personalized and tailor-made. A trajectory consists of different options: pre-trial options; front-door options; options during stay in prison; pre-release options; and aftercare options. With regard to future prisons, five basic principles can be recognized: human dignity; the avoidance of further damage or harm; the right to develop the self; the right to be important to other people; and a stable and professional organization.
