Change And Continuity In The Role Of State Attorneys General In The Obama And Trump Administrations, Paul Nolette, Colin Rovost
Change And Continuity In The Role Of State Attorneys General In The Obama And Trump Administrations, Paul Nolette, Colin Rovost
Political Science Faculty Research and Publications
During the Trump Administration, state attorneys general (AGs) have become entrenched as integral policymaking actors in the United States. Their expanding policymaking role fits broader patterns of polarized politics, as partisan coalitions of AGs are increasingly willing to sue the federal government, a trend that gathered steam in the Obama Administration and has reached a crescendo in Trump’s first year. However, state AGs do cooperate, particularly in corporate litigation to address allegedly widespread, illegal behavior. Utilizing a comprehensive dataset of multi-state lawsuits and Supreme Court amicus briefs, we identify continuity and change in how AGs have employed their powers, by …

Social Media In A High School English Class: A Collective Case Study, Angela M. Wells
All Theses And Dissertations
This qualitative collective case study sought to describe the perceptions and experiences of an 11th-grade English teacher and her students when incorporating social media into the classroom. The teacher introduced social media into four classrooms, wherein the students answered questions and interacted with each other on a discussion board. The teacher’s fifth classroom remained a traditionally taught class, wherein the teacher lectured about class material. After six weeks of instruction, the researcher interviewed the teacher and provided anonymous surveys to the students to determine their perceptions and experiences when incorporating social media into the classroom. The researcher analyzed and coded …
Briefing The Supreme Court: Promoting Science Or Myth?, Melissa Hamilton
Briefing The Supreme Court: Promoting Science Or Myth?, Melissa Hamilton
Emory Law Journal Online
The United States Supreme Court recently ruled in Packingham v. North Carolina that the state's law banning registered sex offenders from using social networking sites was unconstitutional on First Amendment grounds. An issue that has arisen in the case is the state's justification for the ban. North Carolina and thirteen other states represented in a friend of the court brief make three claims concerning the risk of registered sex offenders: (1) sex offenders have a notoriously high rate of sexual recidivism; (2) sex offenders are typically crossover offenders in having both adult and child victims; and (3) sexual predators commonly …

Driven By Dreams: Immigrant Stories Of Education, A Gatekeeper Exam And A High School Diploma, Cindy H. Linzell
Department of Teaching, Learning, and Teacher Education: Theses and Other Student Research
High school in the United States is an important time in any student’s life. For many students, the four years of high school are framed with classroom success and the earning of a high school diploma. For others, it is a very difficult time in their lives.
In the state of Nebraska, students are not permitted to continue their education in a public school setting past the age of 21. This age limit creates a deadline where the passing of classes and graduation tests becomes crucial if these students hope to earn their high school diploma. While the majority of …
Global Cybersecurity, Surveillance, And Privacy: The Obama Administration's Conflicted Legacy, Peter Margulies
Global Cybersecurity, Surveillance, And Privacy: The Obama Administration's Conflicted Legacy, Peter Margulies
Indiana Journal of Global Legal Studies
To analyze the Obama administration's cyber efforts, this Article proposes a paradigm of stewardship with both discursive and structural dimensions. Discursive stewardship refers to the Executive's openness to dialogue with other stakeholders. Structural stewardship refers to the domestic and transnational distribution of decisional authority, including checks and balances that guard against the excesses of unilateral action. The Article concludes that the Obama administration made substantial progress in each of these realms. However, the outsized role of law enforcement agendas and dearth of clearly articulated checks on transnational surveillance drove headwinds that limited forward movement.

Courts And Executives, Jeffrey L. Yates, Scott S. Boddery

William Howard Taft was both our twenty-seventh president and the tenth Chief Justice of the U.S. Supreme Court -- the only person to have ever held both high positions in our country. He once famously commented that "presidents may come and go, but the Supreme Court goes on forever" (Pringle 1998). His remark reminds us that presidents serve only four-year terms (and are now limited to two of them), but justices of the Supreme court are appointed for life and leave a legacy of precedent-setting cases after departing the High Court. Of course, presidents also leave a legacy of important …
Alternatives To Immigration Detention, Fatma E. Marouf
Alternatives To Immigration Detention, Fatma E. Marouf
Cardozo Law Review
The United States places over 440,000 people each year in immigration detention, far more than any other country in the world. This Article argues that there are compelling humanitarian and financial reasons to utilize more alternatives to detention. It examines the strengths and limitations of existing alternatives, including the need to develop more community-based case management programs and to rely less on electronic monitoring. The Article then sets forth several legal arguments under the Constitution, Rehabilitation Act, and international human rights law for requiring greater consideration of alternatives to detention.
Why It’S Not Ok For Doctors To Participate In Executions, Robert F. Johnson
Why It’S Not Ok For Doctors To Participate In Executions, Robert F. Johnson
Peer Reviewed Articles
A plea for direct physician participation in executions was presented by Sandeep Jauhar in a New York Times Op-Ed (“Why It’s OK for Doctors to Participate in Executions”—April 21, 2017). Jauhar’s article is not a discussion of the ethics of capital punishment. He describes his own opposition “as a matter of principle, as a doctor.” However, since capital punishment is legal in 31 states, with required physician participation in several, he acquiesces to a utilitarian stance rather than the principled approach he acknowledges is expected of a physician in this circumstance.

A Mixed-Methods Study Of Sexual Assault In Lesbian, Gay, And Bisexual Adults In The U.S., Sasha Nichole Canan
A Mixed-Methods Study Of Sexual Assault In Lesbian, Gay, And Bisexual Adults In The U.S., Sasha Nichole Canan
Graduate Theses and Dissertations
Background. Previous research finds that (1) lesbian and bisexual (LB) women as well as gay and bisexual (GB) men have higher rates of rape victimization compared to their heterosexual (H) peers and (2) perceived familial support reduces the impact of some of rape’s negative health outcomes in heterosexual victims. However, specific contextual factors regarding rape and assessment of familial support for LGB victims are severely lacking. Also, measurements of sexual assault victimization have yet to be validated in this population.
Methodology. The current study used a mixed-methods design that included two phases of data collection. Phase 1 was a national …

Attending To Systemic Racism : Advancing Public Health's Approach To Youth Violence Prevention., Billie Faith Castle
Electronic Theses and Dissertations
This dissertation examines how the field of public health addresses the impact of systemic racism on health and how that informs public health’s approach to youth violence prevention. Beginning with an overview of youth violence, it breaks down the concepts of race and racism and how they are addressed within the science. It also reviews concepts that contribute to risk and protective factors of youth violence. The dissertation is written from a Critical Race Theory approach, argues that the social environment contributes to why youth violence is pervasive in certain neighborhoods, and promotes action from a macro-level approach. Seven chapters …
Mental Health And Substance Use Disorders And Treatment Receipt Among Pregnant Women In The United States, 2008-2014 : Trend Analysis, Likelihood Of Treatment Receipt, And Ethnic Disparities In Mental Health Treatment., Taghreed Nayel Salameh
Electronic Theses and Dissertations
The purposes of this dissertation were to examine trends from 2008 to 2014 in mental health and substance use disorders and treatment receipt, and explore factors associated with treatment receipt in pregnant women aged 18-44 years in the United States. A systematic review showed that illicit drug use disorder increased in pregnant women over the past decade. Despite the increase in treatment admissions for these disorders from 1992 to 2012, the overall treatment admission rate for pregnant women remained relatively stable (4%). In a trend study, compared mental health and substance use disorders and treatment receipt across Matched groups of …

Support For Political Mobilization And Protest In Egypt And Morocco: An Online Experimental Study, Anthony F. Lemieux, Erin M. Kearns, Victor Asal, James Igoe Walsh
Criminology and Criminal Justice Faculty Publications
Why do individuals engage in or support acts of contentious politics? Building from previous work, this article uses a 2 (high/low grievance) × 2 (high/low risk) × 2 (high/low opportunity) online experimental design to examine the impact of these factors on political action with participants from Egypt (n = 517) and Morocco (n = 462). Participants assumed a first-person perspective as a member of a fictional oppressed ethnic minority group in one of eight vignettes. Participants then indicated the extent to which they would engage in various forms of protest and violence, and how justified such actions were. …

Dangerous Deals: A Case Study Of Nafta As A Criminogenic Policy, Daniel J. Patten
Dissertations
This study examines the creation of a criminogenic policy, NAFTA, and its subsequent social harms that primarily impacted poor rural farmers and indigenous people in Mexico. Previous research into state-corporate crime has focused on crimes committed by one state and one corporation, while little research has investigated the commission of crimes by more than one state operating in collusion. Previous research on human rights violations has emphasized genocide and physical integrity rights, while this study raises attention to “lesser” human rights violations such as abusive working conditions, lack of political participation in policy formation, and limited access to clean air …

Are Dhs Technology Grants For Local Police Departments An Effective Tool Against Terrorism?, Erika Mcginty
Student Theses
This paper examines the effectiveness of allocating funds to the nation’s police departments for the prevention of domestic terrorism, as is done annually through the Department of Homeland Security’s Homeland Security Grants Program. The program, administered by the Federal Emergency Management Administration, has distributed billions of dollars since its 2003 inception in equipment, software, and technology services based on the recipient police agencies’ own risk assessments of local terrorism. Much of the technology desired by police consists of systems of mass surveillance; this thesis focuses on implementations of surveillance video cameras or CCTV, license plate readers, and unmanned aerial vehicles. …

An in-depth review of the use of force policies and practices used by the Las Vegas Metropolitan Police Department (LVMPD) was conducted after the alarming rate of officer involved shootings was publicized by the Las Vegas Review Journal (RJ) in 2011. The 75 recommendations handed down to LVMPD after the review not only helped guide the agency towards procedural and reporting changes, but also paved a way for the agency to begin rebuilding trust in police within the community. This program evaluation focuses on the community engagement efforts put forth by the Bolden Area Command (BAC) community oriented policing (COP) …

Defining Problematic School Absenteeism Using Nonparametric Modeling, Kyleigh Kay Skedgell
UNLV Theses, Dissertations, Professional Papers, and Capstones
Contemporary classification models of school absenteeism often employ a multitier approach for organizing assessment and treatment strategies. Researchers have yet to agree, however, on how to objectively define problematic school absenteeism and identify demarcation points for each tier. The present study aimed to inform a multitier approach by determining the most relevant risk factors for problematic school absenteeism. The most useful targets of assessment for problematic school absenteeism are also addressed. The present study examined problematic school absenteeism defined at three distinct cutoffs: 1%, 10%, and 15% of full school days missed. The present study evaluated interactions among several youth- …
A Cautionary Tale, David Schwendiman
A Cautionary Tale, David Schwendiman
Utah Law Review
It is imperative when talking about accountability and the enforcement of internationally recognized and accepted criminal norms governing conflict, when talking about investigating and prosecuting atrocity crime, not to raise expectations that have little or no chance of being met. Expanding the modes of liability to reach bystanders has the potential to raise such expectations, pushing the range of subjects that victims, survivors and others with an interest in the outcome of atrocity crime investigations and prosecutions expect will be prosecuted out beyond those as to whom there is likely to be political will to prosecute and certainly beyond the …

Bystander No More? Improving The Federal Response To Sexual Violence In Indian Country, Sarah Deer
Utah Law Review
For better or worse, the federal government has taken responsibility for providing for the protection of Native people. So long as the federal government refuses to allow tribes to govern themselves completely and independently, it is imperative that the federal government enact policies empowering Native survivors of sexual assault. The federal government must do more to protect tribal members from sexual predators, to safeguard reservations not only from career criminals but also to ensure that federal agencies like the Bureau of Indian Affairs and the Indian Health Services do not hire men with a history of violence against women or …
