Despite decades of effort to change disciplinary practices in American schools, racial disparities continue and are most prevalent for Black students, according to national Office Disciplinary Referral data. While Culturally Responsive-Positive Behavior Interventions and Supports (CR-PBIS) is the result of years of adjustments to weave cultural responsiveness into Positive Behavior Interventions and Supports (PBIS) systems and decrease racial disciplinary disparities, the results at K-12 schools have been inconsistent. Cultural Race Theory, which recognizes racism is reflected in all societal systems and is the foundation for this study, may provide a clue as to why racial disciplinary disparities continue. In this brief, authors Lawrence Hamilton, Linda Fogg, and Curt Grimm report on a 2017 survey that asked North Country residents about their perceptions, hopes, and concerns regarding this region. Many of the same questions had been asked on earlier surveys in 2007 and 2010, providing a unique comparative perspective on what has changed or stayed much the same. The authors report that over these years, North Country (northern New Hampshire, Maine and Vermont) residents’ positive views of life in their region have mostly held steady, or in some cases improved, over the past ten years. Canadian Federalism In Design And Practice: The Mechanics Of A Permanently Provisional Constitution, James A. Gardner

This paper examines the interaction between constitutional design and practice through a case study of Canadian federalism. Focusing on the federal architecture of the Canadian Constitution, the paper examines how subnational units in Canada actually compete with the central government, emphasizing the concrete strategies and tactics they most commonly employ to get their way in confrontations with central authority. The evidence affirms that constitutional design and structure make an important difference in the tactics and tools available to subnational units in a federal system, but that design is not fully constraining: there is considerable evidence of extraconstitutional innovation and improvisation …

Effective classroom and behavior management is directly related to student achievement and classroom climate. The purpose of this study was to examine the history of women in the superintendency and the best practices that they have used to weather challenging conflicts to remain in the position. The research question that guided this study was: To what do successful female superintendents in Arkansas attribute their success? This qualitative research ascertained the factors needed for female superintendents in Arkansas to have long-lasting careers in that role, if they desire. Sessions V. Dimaya: Vagueness Doctrine & Deportation Statutes, Matthew Gibbons
Duke Journal of Constitutional Law & Public Policy Sidebar
Sessions v. Dimaya seeks to determine whether the residual clause of a criminal provision, incorporated by reference into a civil immigration law, is void for vagueness. Although there is an instance of the Supreme Court applying the criminal vagueness standard to an immigration statute resulting in deportation, the United States argues that immigration law is not subject to that vagueness standard because it is civil and not criminal. This commentary argues that Sessions v. Dimaya presents the Supreme Court with an opportunity to conform with its precedents, further the principles underlying vagueness doctrine, and appear to apply judicial rules consistently. …

Algorithms, particularly machine learning (ML) algorithms, are increasingly important to individuals’ lives, but have caused a range of concerns revolving mainly around unfairness, discrimination and opacity. Transparency in the form of a “right to an explanation” has emerged as a compellingly attractive remedy since it intuitively promises to open the algorithmic “black box” to promote challenge, redress, and hopefully heightened accountability. Amidst the general furore over algorithmic bias we describe, any remedy in a storm has looked attractive. Foster youth voices have been silenced in schools, work environments, and many other settings.There is very little research around what works well for foster youth and what their assets are. Foster youth have many skills and resources that they use to navigate systems that continually marginalize them. But these are often ignored or overlooked. This project uses youth voices through Testimonios and Community Cultural Wealth to create a training for group home staff.

The Indigenous population of the United States remains a neglected demographic in sociological research. Scholars in other disciplines, and few in sociology, have studied a wide range of issues within the Native Americans populations, including health, socioeconomics, political representation, and law. However, few have researched the emergent controversy over media representations and identity. The New York Court Of Appeals' Expansion Of The Definition Of The Term “Parent” Leaves Future Questions Unanswered, Ilana Sharan

On August 30, 2016, the New York Court of Appeals in Brooke S.B. v. Elizabeth A.C.C., expanded the definition of the term “parent,” overruling the twenty-five-year-old bright line rule that limited standing to seek custody or visitation to traditional parents. In 1991, the New York Court of Appeals decided Alison D. v. Virginia M. where they defined “parent” to include only people who have a biological or adoptive relationship with the child, reasoning that the typical family consisted of a husband and wife. Every day in the United States, thousands of people are waiting in jail postarrest prior to any trial or conviction. Once arrested, these individuals frequently face harsh conditions while they are held for their first appearance to be assigned bail. Thousands of individuals wait more than forty-eight hours to first appear in front of a judicial officer who determines their bail conditions. Innocent people––people who have committed no offense except that of being underprivileged––are pressured into accepting plea bargains because they cannot pay bail. Thousands remain in jail unwilling to accept plea bargains or admit guilt but are detained nevertheless …

In the United States, someone is murdered, raped, robbed, or assaulted every 26 seconds (Federal Bureau of Investigation, 2015). Violent victimization is a uniquely disorienting dilemma because it is the result of harm from another human being. Extensive research has shown that crime victims’ complex emotional and psychological needs are not adequately fulfilled by the dominant retributive system of justice. The other paradigm of justice that has received extensive consideration from theorists and scholars, with research that now covers multiple continents and 3 decades, is restorative justice.

This report presents findings on the targeting practices of programs and providers receiving Medicaid Redesign Team Supportive Housing (MRT-SH) funds, with implications for policy and practice. The report describes who is being enrolled in MRT-SH programs, including demographic, clinical, and other participant characteristics; spending profiles in the 12 months before housing enrollment; and the extent to which programs are enrolling participants who are high need, high cost Medicaid users, relative to similar diagnostic groups in a sample of the general Medicaid population. The Incompatibility Of A Daily School Pledge With A Democratic And Multicultural Education, William Mccorkle, Stephanie M. Madison

The Pledge of Allegiance has become a tradition in schools throughout the United States. The debate on this practice has often been limited due to the ideas of national pride that surround the pledge. This article addresses both the problematic history of the pledge, the protected precedence of teachers and students refusing to state the pledge, the pledge’s international abnormality, and the practical and philosophical concerns of a daily pledge in the public school setting. The article’s contention is that the pledge introduces a shallow view of national loyalty, while simultaneously endangering religious liberty, overlooking the views of marginalized and …
