Theorizing Time In Abortion Law And Human Rights, Joanna Erdman
Theorizing Time In Abortion Law And Human Rights, Joanna Erdman
Articles, Book Chapters, & Popular Press
The legal regulation of abortion by gestational age, or length of pregnancy, is a relatively undertheorized dimension of abortion and human rights. Yet struggles over time in abortion law, and its competing representations and meanings, are ultimately struggles over ethical and political values, authority and power, the very stakes that human rights on abortion engage. This article focuses on three struggles over time in abortion and human rights law: those related to morality, health, and justice. With respect to morality, the article concludes that collective faith and trust should be placed in the moral judgment of those most affected by …
Internet Surveillance, Regulation, And Chilling Effects Online: A Comparative Case Study, Jonathon Penney
Internet Surveillance, Regulation, And Chilling Effects Online: A Comparative Case Study, Jonathon Penney
Articles, Book Chapters, & Popular Press
With internet regulation and censorship on the rise, states increasingly engaging in online surveillance, and state cyber-policing capabilities rapidly evolving globally, concerns about regulatory “chilling effects” online — the idea that laws, regulations, or state surveillance can deter people from exercising their freedoms or engaging in legal activities on the internet have taken on greater urgency and public importance. But just as notions of “chilling effects” are not new, neither is skepticism about their legal, theoretical, and empirical basis; in fact, the concept remains largely un-interrogated with significant gaps in understanding, particularly with respect to chilling effects online. This work …
Human Rights Education In Patient Care, Joanna Erdman
Human Rights Education In Patient Care, Joanna Erdman
Articles, Book Chapters, & Popular Press
This article explores how human rights education in the health professions can build knowledge, change culture, and empower advocacy. Through a study of educational initiatives in the field, the article analyzes different methods by which health professionals come to see the relevance of human rights norms for their work, to habituate these norms in everyday practice, and to espouse these norms in advocacy for social justice. The article seeks to show the transformative potential of education for human rights in patient care.
Away From The Library, David H. Michels
Away From The Library, David H. Michels
Articles, Book Chapters, & Popular Press
"I use Google for my research, I don't use the library." "Can you teach my students to do legal research only with tools they can access after they leave University?" This paper is about me, the librarian, irritated by the assertion and puzzled by the request. It captures just two of many events on a long and incomplete journey of reimagining librarianship and my changing role as librarian. I would test the assertion, plan the classes, and share those experiences. However, I would be dishonest if I did not also share that I am apprehensive about the results of my …
Protecting Urban Spaces Of Intangible Cultural Heritage And Nighttime Community Subcultural Wealth: A Comparison Of International And National Strategies, The Agent Of Change Principle, And Creative Placekeeping, Sara Gwendolyn Ross
Articles, Book Chapters, & Popular Press
Working towards an equality of differences of a city’s diverse cultures and subcultures requires an examination of the realities of how municipal and provincial legal frameworks governing the city space—such as urban planning policies, zoning decisions, and bylaw enforcement—play out within the microcosm of the everyday neighborhood, where conflicting life patterns must coexist even when they are at odds. Drawing on an urban legal anthropology and urban legal geography methodology assessing the realities of the life of subcultural communities in the city space, this paper’s objective is to explore potential paths towards an equitable regard and valuation of the different …
Making A Music City: The Commodification Of Culture In Toronto’S Urban Redevelopment, Tensions Between Use-Value And Exchange-Value, And The Counterproductive Treatment Of Alternative Cultures Within Municipal Legal Frameworks, Sara Gwendolyn Ross
Articles, Book Chapters, & Popular Press
English Abstract
Meaningful diversity and inclusion within today’s cities requires attention on many fronts, including that of city redevelopment strategies and policies. To that end, this article focuses on culture-led regeneration strategies—specifically, those of Toronto’s “Music City” initiative and “Creative City” strategy—and unpacks the mechanics of using culture and heritage as tools for redevelopment where their commodification can reveal the clash between divergent value interests that exist within spaces of culture in the city. Sustainable urban development must carefully account for these divergences to avoid the displacement and lack of equitable accounting of relationally vulnerable individuals, groups, (sub)cultures, and space. …
From Smokes To Smokestacks: Lessons From Tobacco For The Future Of Climate Change Liability, Martin Zp Olszynski, Sharon Mascher, Meinhard Doelle
From Smokes To Smokestacks: Lessons From Tobacco For The Future Of Climate Change Liability, Martin Zp Olszynski, Sharon Mascher, Meinhard Doelle
Articles, Book Chapters, & Popular Press
In this article, we imagine a future Canada (circa 2030) wherein the world has managed to avoid the worst climate change but nevertheless has begun to experience considerable warming. Governments of all levels, but especially provincial ones, are incurring unprecedented costs to mitigate the effects of climate change and to adapt to new and uncertain climatic regimes. We then consider how legislatures might respond to these challenges. In our view, the answer may lie in the unprecedented story of tobacco liability, and especially the promulgation in the late 1990s of provincial legislation specifically designed to enable provinces to recover the …
Examination Of Witnesses In Criminal Cases, Hannah Steeves
Examination Of Witnesses In Criminal Cases, Hannah Steeves
Articles, Book Chapters, & Popular Press
The newest edition of Examination of Witnesses in Criminal Cases maintains its status as a key text on the topic. Author Earl J Levy, a national leader in the area of criminal law, has worked with the Criminal Lawyers’ Association, taught criminal law courses at various Canadian law schools, and has over 50 years experience as a litigator. The book, now in its seventh edition, contains necessary updates, and improvements have been made to both format and content while maintaining a similar, logical overview as in previous editions.
Money Norms, Julia Y. Lee
Money Norms, Julia Y. Lee
Faculty Scholarship
Money norms present a fundamental contradiction. Norms embody the social sphere, a system of internalized values, unwritten rules, and shared expectations that informally govern human behavior. Money, on the other hand, evokes the economic sphere of markets, prices, and incentives. Existing legal scholarship keeps the two spheres distinct. Money is assumed to operate as a medium of exchange or as a tool for altering the payoffs of different actions. When used to make good behavior less costly and undesirable behavior more costly, money functions to incentivize, sanction, and deter. Although a rich literature on the expressive function of law exists, …
Sexual Health And Multiple Forms Of Discrimination Among Heterosexual Youth, Eric Anthony Grollman
Sexual Health And Multiple Forms Of Discrimination Among Heterosexual Youth, Eric Anthony Grollman
Sociology and Anthropology Faculty Publications
Research suggests that inequality in material conditions contributes greatly to disparities in sexual health among youth; however, scholars have overlooked the effect of one manifestation of social disadvantage—interpersonal discrimination—on sexual health. This article uses data from a nationally representative survey of 15 to 25 year olds (N = 955) to investigate the relationship between interpersonal discrimination and sexual health among heterosexual youth. I examine whether exposure to multiple forms of discrimination (e.g., race and gender) is associated with risky sexual behaviors, as well as STI history, teenage pregnancy, and abortion history. The findings suggest that experiences of multiple forms of …
Do Muslim Village Girls Need Saving? Critical Reflections On Gender And Childhood Suffering In International Aid, Rania Kassab Sweis
Do Muslim Village Girls Need Saving? Critical Reflections On Gender And Childhood Suffering In International Aid, Rania Kassab Sweis
Sociology and Anthropology Faculty Publications
Without contesting the idea that many Muslim girls around the world do constitute victims in very real ways. In this chapter, I want to raise a different set of questions. What does it mean when powerful actors in western-based international NGOs recognize the Muslim village girl as the ultimate savable victim? What gendered and racialized logics are at play in this category's strategic deployment, and what are their tangible effects for both NGOs and village girls who receive aid?
Sexual Orientation Differences In Attitudes About Sexuality, Race, And Gender, Eric Anthony Grollman
Sexual Orientation Differences In Attitudes About Sexuality, Race, And Gender, Eric Anthony Grollman
Sociology and Anthropology Faculty Publications
Researchers have extensively documented sociodemographic predictors of race and gender attitudes, and the mechanisms through which such attitudes are formed and change. Despite its growing recognition as an important status characteristic, sexual orientation has received little attention as a predictor of Americans’ race and gender attitudes. Using nationally representative data from the American National Election Survey 2012 Time Series Study, I compare heterosexuals’ and lesbian, gay, and bisexual (LGB) people’s attitudes about sexuality, race, and gender. For most attitudes, LGB people hold significantly more liberal attitudes about sexuality, race, and gender than do heterosexuals, even upon controlling for other powerful …

Research demonstrates that faculty of color in historically white institutions experience higher levels of discrimination, cultural taxation, and emotional labor than their white colleagues. Despite efforts to recruit minority faculty, all of these factors undermine their scholarship, pedagogy, social experiences, promotion and retention.
Gender Differences In Parents' Assessment Of Language Development, Michelle Lacroix
Gender Differences In Parents' Assessment Of Language Development, Michelle Lacroix
Honors Theses and Capstones
This study aims to determine if there is a statistically significant difference between genders in the reporting of their child’s communication abilities. Possible variances between men and women are important to consider because parent-based questionnaires are often used to help identify children who are in need and eligible for the services of a speech-language pathologist. Literature surrounding parental stereotypes and the impact of the parent in development, as well as stigma in relation to the need for speech therapy services is explored. A survey based off of the Ages and Stages Questionnaire, Third Edition was distributed to parents of children …
Livestock-Livelihood Linkages In Uganda: The Benefits For Women And Rural Households?, Elizabeth Ransom, Carmen Bain, Iim Halimatusa'diyah
Livestock-Livelihood Linkages In Uganda: The Benefits For Women And Rural Households?, Elizabeth Ransom, Carmen Bain, Iim Halimatusa'diyah
Sociology and Anthropology Faculty Publications
Livestock are an important component of rural households and gendered livelihood practices throughout sub-Saharan Africa. Widespread within the development literature is the belief in the livestock ladder, with poorer households often owning small stock and wealthier households owning large stock, with the assumption that poor households can utilize livestock to build their asset base and overtime this would allow poorer households to expand from small stock to large stock, in so doing climb the livestock ladder. There is also an assumption in the literature that women are more likely to oversee small stock. In addition, some well-known agricultural development programs …
Repensando A Violência Policial No Brasil: Desmascarando O Segredo Público Da Raça*, Jan Hoffman French
Repensando A Violência Policial No Brasil: Desmascarando O Segredo Público Da Raça*, Jan Hoffman French
Sociology and Anthropology Faculty Publications

Few would argue that the information technology department (ITD) is not an essential part of an organization. It is hard to envision a project that does not need the support of the ITD. Despite this importance, the ITD is not always involved in the management of projects. Often, the ITD is brought into the project late in the planning and development process. In many cases, the inclusion of the ITD in an advanced project stage can result in project failure where early involvement could have prevented it. Why is it that ITDs, while clearly a vital part of project implementation, …

A Conceptual Framework On Self-Employment In Later Life: Toward A Research Agenda, Cal J. Halvorsen, Nancy Morrow-Howell
Harvey A. Friedman Center for Aging
Older adults consistently have a higher rate of self-employment than their younger counterparts, and the rates of self-employment among workers continue to rise as age increases from the “young old” to the “old old.” However, we know relatively little about why older adults decide to pursue self-employment in later life, the self-employment experience itself, and the individual and societal outcomes of this growing type of work. Additionally, we know very little about how age itself is a factor in the decision to pursue this type of work in later life, how age impacts the type of self-employment pursued and its …

Evaluating The Equity Of Access And Achievement Within The Indiana Voucher Program, Jamie L. Garwood
Evaluating The Equity Of Access And Achievement Within The Indiana Voucher Program, Jamie L. Garwood
All-Inclusive List of Electronic Theses and Dissertations
Indiana has developed the most expansive, statewide voucher program in the nation, and the only one not limited to low-income students or targeted communities. The Indiana Choice Scholarship, or voucher program, has grown from 3,911 students in 2011 to almost 30,000 in the first four years (IDOE, 2015a). This rapid growth warrants a thorough and objective evaluation of whether the program is effectively expanding access to at-risk populations, and whether that expanded access is translating into improved academic outcomes in the private schools they select. The design of this study is a two-phase, sequential, mixed-methods analysis to assess whether Indianas …
