Cultivating Leaders Of Indiana: Global Collaborations And Local Impacts, Jennifer Sdunzik, Annagul Yaryyeva Oct 2017

Cultivating Leaders Of Indiana: Global Collaborations And Local Impacts, Jennifer Sdunzik, Annagul Yaryyeva

Purdue Journal of Service-Learning and International Engagement

“Cultivating Leaders of Indiana” was developed to establish connections between the Purdue student body and the Frankfort, Indiana, community. By engaging high school students in workshops that focused on local, national, and global identities, the goal of the project was to encourage students to appreciate their individuality and to motivate them to translate their skills into a global perspective. Moreover, workshops centering on themes such as culture, citizenship, media, and education were designed to empower project participants to embrace their sense of social value and responsibility, not only in their immediate communities, but also globally.

The Corporation As Sovereign, Allison D. Garrett Oct 2017

The Corporation As Sovereign, Allison D. Garrett

Maine Law Review

In the past two hundred years, sovereignty devolved from the monarch to the people in many countries; in our lifetimes, it has devolved in several significant ways from the people to the corporation. We are witnesses to the erosion of traditional Westphalian concepts of sovereignty, where the chess game of international politics is played out by nation-states, each governing a certain geographic area and group of people. Eulogies for the nation-state often cite globalization as the cause of death. The causa mortis is characterized by the increase in the power and normative influence of supranational organizations, such as the United …

Legal Formalism Meets Policy-Oriented Jurisprudence: A More European Approach To Frame The War On Terror, Julien Cantegreil Oct 2017

Legal Formalism Meets Policy-Oriented Jurisprudence: A More European Approach To Frame The War On Terror, Julien Cantegreil

Maine Law Review

Myres S. McDougal, the leader of the New Haven School of International Law (NHSIL), advanced a comprehensive and iconoclastic conception of international law and its goals, one whose continuing influence is well-known today: a visceral rule-skepticism that even his least fervent disciples would never renounce. McDougal’s conception of international law and its goals is fundamentally different from the normativist view of Hans Kelsen, which has been and continues to be enormously influential throughout continental Europe, particularly in France. In the portion of his 1953 course at The Hague Academy of International Law devoted to Kelsen’s canonical Legal Technique in International …

Looking Backward To Address The Future? Transitional Justice, Rising Crime And Nation Building, James L. Cavallaro Oct 2017

Looking Backward To Address The Future? Transitional Justice, Rising Crime And Nation Building, James L. Cavallaro

Maine Law Review

This is not an Article about the Nazi regime’s war on crime, nor does it analyze the possible lawlessness of the Weimar Republic. It does, however, consider the role of crime in transitional states. As such, the observation above is relevant to the issues examined in the pages that follow. Crime and the manipulation of the fear it promotes were essential to the rise of Nazism, the fall of the Weimar Republic, and the historical record of both regimes. I contend that we must recognize the vital role of street crime in the stability and instability of newly democratic and …

The Legal Architecture Of Nation-Building: An Introduction, Charles H. Norchi Oct 2017

The Legal Architecture Of Nation-Building: An Introduction, Charles H. Norchi

Maine Law Review

In the future, a historian studying the early twenty-first century will observe a trend: numerous lawyers applying their skill sets to the problems of pathological states. Our future historian will note that the topography of the post-Cold War international system was marked by weakly-governed states failing. Fragile states eroded, frayed, and disintegrated under stress, and their internal social processes became highly susceptible to external forces. Powerful non-state actors, including private armies, operated within the porous boundaries of entities that were once functioning polities. Legal authority became divorced from political control as non-state actors wielded naked power, challenging formal state structures …

Doing Deals With Aristotle—Today, Chapin F. Cimino Oct 2017

Doing Deals With Aristotle—Today, Chapin F. Cimino

Seattle University Law Review

This analysis proceeds in six steps. In Part I, this Article sets the stage by describing the problem: while contracting behavior is increasingly complex, contract law and theory remain stubbornly uni-faceted. That is, while contracting and contractors are ever more modern, contract law and theory are ever more traditional. The greater the divide, the less useful contract theory is to contract law, and the less useful contract law is to contractors. This trend does not bode well for the future of contract law or theory. The question is how much of a crisis contract law will have to endure before …

Serving Their Country And Their Communities? An Exploratory Study Of The Impact Of Military Presence On County-Level Crime Rates, Rocio A. Paez Oct 2017

Serving Their Country And Their Communities? An Exploratory Study Of The Impact Of Military Presence On County-Level Crime Rates, Rocio A. Paez

Theses and Dissertations

Criminologists have long established an association between social disorganization factors and crime. The majority of criminological literature on social disorganization, however, has overlooked the role that certain social institutions play into the equation. Specifically, the degree to which military presence, manifested by the exposure to the military institution and its personnel, influences local areas has yet to be examined from a criminological perspective. This dissertation was designed to extend this body of research by envisioning the military as a social institution salient in understanding variation in the of crime and delinquency across communities. To accomplish this, I relied on data …

Hope, Goals, & Homosexuality: An Examination Of Current American Public Opinion On Homosexuality, Joshua K. Miller Oct 2017

Hope, Goals, & Homosexuality: An Examination Of Current American Public Opinion On Homosexuality, Joshua K. Miller

Theses and Dissertations

Over the past five years, American public opinion on homosexuality has rapidly shifted in a more positive direction. Its subjugation exemplifies how an intimate and singular topic can be used to ignite and potentially misguide the American people, resulting in violent demonstration and even death. Although public opinion has shifted towards a greater acceptance of homosexuality, viewpoints are still very polarized. In addition to the available literature, elements from the complete data set of the General Social Survey (1972-2014) were analyzed to better understand this polarization that persists. Subject-specific variables concerning homosexuality were extrapolated and simple Ordinary Least Squares regression …

Adolescent Networks: An Exploratory Study Assessing Bullying Victimization And Outcomes Of Social Capital On School Avoidance, Kristen Nicole Sobba Oct 2017

Adolescent Networks: An Exploratory Study Assessing Bullying Victimization And Outcomes Of Social Capital On School Avoidance, Kristen Nicole Sobba

Theses and Dissertations

Bullying victimization has been found to lead to several detrimental effects including depression, anxiety, poor academic achievement, and, in extreme cases, suicidal tendencies. One consequence that has not been studied as extensively is school avoidance. School avoidance can lead to further emotional problems and school dropout, therefore, addressing ways to deter this problem is imperative for future research. The purpose of this dissertation was to identify correlates of school avoidance in addition to understanding the moderating relationship of bullying victimization and social capital on school avoidance. It was expected that social capital would serve as a buffer to bullying victimization, …

The Crossroads Of A Legal Fiction And The Reality Of Families, Andrew L. Weinstein Oct 2017

The Crossroads Of A Legal Fiction And The Reality Of Families, Andrew L. Weinstein

Maine Law Review

In Adoption of M.A., the Maine Supreme Judicial Court, sitting as the Law Court, held that an unmarried, same-sex couple could file a joint petition for adoption of two foster children in their care. This recent decision is only a fraction of a story that originated a long time ago when same-sex couples began raising children. This Comment begins by examining the role of the state courts and the United States Supreme Court in their exposition of family law relating to adoption by same-sex couples. The United States Supreme Court has periodically weighed in on family law and parenting in …

A Century Of French International Law Scholarship, Emmanuelle Jouannet Oct 2017

A Century Of French International Law Scholarship, Emmanuelle Jouannet

Maine Law Review

In this study of contemporary French scholarship in the field of international law, I aimed to reveal its reality at the dawn of the 21st century, but I quickly discovered that it is difficult to understand the current trends in this area of scholarship without first placing French international legal thought in the broader context of the evolution of international law itself. It seems that the increased stature of international law and its considerable expansion since 1945 are both accepted and problematic. This evolution is not problematic in and of itself; the problem lies in the increased interest it arouses …

Honey, You're No June Cleaver: The Power Of "Dropping Pop" To Persuade, Victoria S. Salzmann

Maine Law Review

Imagine a contentious child-custody hearing in which the husband is testifying about his wife's behavior. If he were to state “she is no June Cleaver,” that testimony would have an immediate impact upon those present. Most people would understand that the husband was making a reference to Mrs. Ward Cleaver, the pearl-clad mother figure from the popular 1950s television show Leave It to Beaver. However, the reference does more than simply call to mind 1950s television. It is a vivid popular-culture allusion that immediately taps into the psyche of anyone familiar with the show. It tells the listener that the …
