Everyday Aesthetics And Everyday Behavior, Ossi Naukkarinen Jan 2017

Everyday Aesthetics And Everyday Behavior, Ossi Naukkarinen

Contemporary Aesthetics (Journal Archive)

This article addresses everyday aesthetics from the point of view of everyday behavior. I suggest that the ordinary daily interaction of people with each other is one of the most important areas of everyday aesthetics. I present an interpretation of the concepts of both the everyday and aesthetics, and argue that in the context of everyday social relationships, it is wise to understand everyday aesthetics in a way that emphasizes the very everydayness of aesthetics, not its opposite, namely non-everyday or extraordinary aesthetics. This does not mean that extraordinary aesthetics would not have its place in other contexts, but it …

Autonomania: Music And Music Education From Mars, Thomas A. Regelski Jan 2017

Autonomania: Music And Music Education From Mars, Thomas A. Regelski

Contemporary Aesthetics (Journal Archive)

Traditional aesthetic theory has posited an account of music, and the other arts, as autonomous of social meanings, relevance, and conditions. In the case of music, “absolute music” is sequestered from social and other roots that bring music into being in the first place. The typical claim, thus, is that classical music is music for its own sake, divorced from the many and highly evident social dimensions that it serves. It ignores all other genres of music, most of which are more appreciated than can be accounted for by the theory of autonomania. This aesthetic theory of music, one of …

Challenging Queer As “Neoliberal”: The Radical Politics Of South Asian Diasporic Lesbian Representational Culture, Sri Craven Jan 2017

Challenging Queer As “Neoliberal”: The Radical Politics Of South Asian Diasporic Lesbian Representational Culture, Sri Craven

Women, Gender, and Sexuality Studies Faculty Publications and Presentations

This essay contributes to transnational feminist and queer interests in neoliberalism, sexual politics and representational cultures that all circulate globally today. It reads Deepa Mehta’s film, Fire (1996), and Suniti Namjoshi’s literary venture, Goja: An Autobiographical Myth (2000). Each processes the question of lesbian visibility as a question of female labor and class relations among women. By analyzing representations of lesbian life in the context of laboring female bodies, the article challenges the dismissal of queer politics as neoliberal in India. Sexual identity politics, as critics argue, often dovetails with neoliberalism’s project of protecting elite and bourgeois subjects’ interests at …

National Electoral Winners And Losers: Satisfaction With Democracy Predicated On Institutional Context, Casey Newman Knott Jan 2017

National Electoral Winners And Losers: Satisfaction With Democracy Predicated On Institutional Context, Casey Newman Knott

LSU Master's Theses

How does being an electoral winner or loser shape a citizen’s satisfaction with democracy? More importantly, how does the voter’s institutional context moderate this relationship? In this paper, I demonstrate that the institutional context of a democracy interacts with a citizen’s national- level electoral loser status to moderate the relationship between the individual’s status as a loser and her satisfaction with democracy in her country. I also explore the way winning and losing at different levels of representation interact to formulate satisfaction with democracy. Using cross-sectional survey data from the Comparative Study of Electoral Systems nested in 75 different country-election …

How American Is The American College Fraternity? Examining The European Legacy Within The U.S. Greek System, Andrew Thomas Bell Jan 2017

How American Is The American College Fraternity? Examining The European Legacy Within The U.S. Greek System, Andrew Thomas Bell

LSU Master's Theses

In this study, a cultural dissemination model is used to identify the cultural markers a fraternalism across multiple educational environments all in an attempt to answer the question “How American is the American college fraternity?” Aspects of modern fraternities and sororities were broken down and their historical predecessors were identified in order to track cultural dissemination, or diffusion. “Diffusion is the spread of culture traits and, as Wissler (140,146) and Bartlett (7) have demonstrated, this spread may be either conscious or unconscious” (Willey & Herskovits, 1927, p. 263). Primarily systems the broad European Fraternalism, European Universities (German and English), American …

Courtesy Paratexts, Informal Publishing Norms And The Copyright Vacuum In Nineteenth-Century America, Robert Spoo

Articles, Chapters in Books and Other Contributions to Scholarly Works

In response to the failure of U.S. copyright law to protect foreign authors, nineteenth-century American publishers evolved an informal practice called the “courtesy of the trade” as a way to mitigate the public goods problem posed by a large and ever-growing commons of foreign works. Trade courtesy was a shared strategy for regulating potentially destructive competition for these free resources, an informal arrangement among publishers to recognize each other’s wholly synthetic exclusive rights in otherwise unprotected writings and to pay foreign authors legally uncompelled remuneration for the resulting American editions. Courtesy was, in effect, a makeshift copyright regime grounded on …

Active Judging And Access To Justice, Anna E. Carpenter Jan 2017

Active Judging And Access To Justice, Anna E. Carpenter

Articles, Chapters in Books and Other Contributions to Scholarly Works

“Being a good judge in this environment means unlearning what you learned in law school about what a judge is supposed to do. Fairness is doing things a federal judge would never do.” Active judging, where judges step away from the traditional, passive role to assist those without counsel, is a central feature of recent proposals aimed at solving the pro se crisis in America’s state civil courts. Despite growing support for active judging as an access to justice intervention, we know little, empirically, about how judges interact with pro se parties as a general matter, and even less about …

Partisanship, Ideology, And The Sorting Of The American Mass Public, Nicholas T. Davis Jan 2017

Partisanship, Ideology, And The Sorting Of The American Mass Public, Nicholas T. Davis

LSU Doctoral Dissertations

This dissertation is a story about the divisions that characterize the mass public. Specifically, it explores how Americans think about politics, and, in particular, how citizens connect their attitudes, beliefs, and, vitally, ideological identity to their partisan affiliation—a phenomenon known as sorting. Practically, this project proceeds in two parts. In Part 1, I investigate the nature of partisan sorting in the mass public. Chapter 2 reviews the extant scholarly literature regarding partisanship and ideology, or the raw materials of sorting. Drawing on this research, I operationalize two types of sorting in Chapter 3 and compare how different measurement protocols affect …

Influences Of Perceived Social Network Structure Characteristics On College Student's Perceptions Of Social Capital Value And Career Decision-Making Self-Efficacy, Troy Autin Jan 2017

Influences Of Perceived Social Network Structure Characteristics On College Student's Perceptions Of Social Capital Value And Career Decision-Making Self-Efficacy, Troy Autin

LSU Doctoral Dissertations

The collective group of resources that are accessible to an individual because of people within his/her social network is known as social capital. Social capital becomes more valuable when an individual sees that it can help with goal achievement. This is especially true with college-aged students who are deciding on academic major, career path and if should persist or dropout. The purpose of this study was to determine the influence of social network characteristics on the perceived social capital value (SCV) and career decision-making self-efficacy (CDMSE) among freshman college students enrolled at a research university. This present study examined how …

From Products To Politics: Understanding The Effectiveness Of A Celebrity Political Endorsement, Melissa Sanati Jan 2017

From Products To Politics: Understanding The Effectiveness Of A Celebrity Political Endorsement, Melissa Sanati

LSU Doctoral Dissertations

From Scott Baio’s endorsement of Donald Trump to Sarah Silverman’s endorsement of Bernie Sanders and subsequent rejection of the “Bernie or Bust” crowd at the DNC, celebrities have habitually inserted themselves into the political sphere, however, there has been little empirical research on celebrity endorsements of political candidates. Rooted in branding theory, this study seeks to understand the effectiveness of celebrity political endorsements by utilizing advertising effectiveness models. The primary model, derived from work done by Amos, Holmes, and Strutton (2008), translates source factors of a celebrity product endorser to those of a celebrity candidate endorser, such as credibility, attractiveness, …

A Narrative Of A Teacher's Perspective Of Over-Age Students Who Are Out-Of-Grade In The Middle School Classroom, Melissa J. Porter Jan 2017

A Narrative Of A Teacher's Perspective Of Over-Age Students Who Are Out-Of-Grade In The Middle School Classroom, Melissa J. Porter

LSU Doctoral Dissertations

This research sought to understand the impact on the middle school classroom environment of over-age students who are out-of-grade. A qualitative study utilizing a narrative lens examined the stories of the lived experiences of the teachers of these students; a social constructivism theoretical approach explored the teaching and best practices in their classrooms. These teachers provided an insight into the complexity of teaching and gave voice to managing a classroom where emotionally and physically mature students often pose a significant challenge to the classroom environment; moreover, their positive influence on the teaching space in which they inhabit also was explored …

Organizational Misconduct Within The National Collegiate Athletic Association, Khirey Bennie Walker Jan 2017

Organizational Misconduct Within The National Collegiate Athletic Association, Khirey Bennie Walker

LSU Doctoral Dissertations

Prior research on organizational misconduct within intercollegiate athletics focuses on the penalties administered by the NCAA and types of violations committed by member institutions, rather than the engagement of misconduct and the role of the NCAA as a social-control agent. Consequently, the purpose of this dissertation is to analyze the relationship between social-control agents and potential wrongdoers (i.e., organizations), in addition to how the relationship affects the evolving line separating right from wrong. A three-paper multiple method examination has been conducted, including a historical analysis of NCAA enforcement, a qualitative framing analysis on the detailing of NCAA major infractions to …

The Reinvention Of Tradition: Transformation Of Chinese Water Sleeve Dance And Tai Ji In Contemporary Performer Training And Performance Making, Min Zhu Jan 2017

The Reinvention Of Tradition: Transformation Of Chinese Water Sleeve Dance And Tai Ji In Contemporary Performer Training And Performance Making, Min Zhu

Theses: Doctorates and Masters

The aim of this practice-led research was to investigate the nature and characteristics of the notion of reinvented tradition in China through the examination of dance practices. First, this research focused on the continuity of tradition demonstrated in the development of Chinese classical dance. Second, it concentrated on the malleability and applicability of two representative Chinese cultural dance practices, water sleeve dance and Tai Ji, in contemporary performance and performer training.

The central concept behind this research was the commonly held perception in China that “tradition is a river” (P. Huang, 1990) in the context of the Chinese dance …

Chinese Diaspora And Western Australian Nature (Perth Region): A Study Of Material Engagement With The Natural World In Diasporic Culture, Li Chen Jan 2017

Chinese Diaspora And Western Australian Nature (Perth Region): A Study Of Material Engagement With The Natural World In Diasporic Culture, Li Chen

Theses: Doctorates and Masters

Based on an ethnographic study of the everyday practices of diasporic Chinese residents of Perth, this project focuses on the relationship between the ecologic environment and diasporic Chinese cultures in contemporary Western Australia.

With the acceleration of globalization, studies in diaspora have increasingly absorbed geographic ideas. Research on the relationship between ecology and humankind has thrown new light on discussions of diaspora. However, there are few in-depth studies addressing the construction of diasporic place and space with an engagement of the material world. Considering the relative absence of the natural world as a serious subject in contemporary diaspora studies, the …

The Progress Of Anomie In Australia Between 2001 And 2011, Sharan Kraemer Jan 2017

The Progress Of Anomie In Australia Between 2001 And 2011, Sharan Kraemer

Theses: Doctorates and Masters

The fundamental social structures of Australia and the Western world in the modern era differ greatly from those of fin de siècle France and the post-Depression industrialised West; yet, similar individual human responses to stressors remain. The sociological insights of Émile Durkheim and Robert Merton presented in their theories of Anomie and Strain provide a guide to understanding this. The present research considered the confluence of pressures that flowed from the changes to social structures in Australia after the attacks of September 11th, 2001, in an environment in which people felt increasingly unsettled and insecure. It positioned the changes within …

Beyond Ada Compliance: The Library As A Place For All, Jj Pionke Jan 2017

Beyond Ada Compliance: The Library As A Place For All, Jj Pionke

Urban Library Journal

In 2015, the American with Disabilities Act (ADA) celebrated its 25th anniversary. While libraries have instituted ADA compliance initiatives since the law came into effect in 1990, and new libraries are generally designed with compliance in mind, to be truly accessible for all people, libraries must incorporate principles of universal design not just into the physical building but into all aspects of the library, including our web presence and the services we provide to patrons. This paper argues that libraries are falling far short of true accessibility and that there needs to be a serious mental shift in how …

Administrator-In-Chief: President And Executive Action In Immigration Law, Ming Hsu Chen Jan 2017

Administrator-In-Chief: President And Executive Action In Immigration Law, Ming Hsu Chen

Faculty Scholarship

This Article provides a framework for understanding the role of the President as the Administrator-in-Chief of the executive branch. Recent presidents, in the face of heated controversy and political division, have relied on executive action to advance their immigration policies. Which of these policies are legitimate, and which are vulnerable to challenge, will determine their legacy. This Article posits that the extent to which the President enhances the procedural legitimacy of agency actions strengthens the legacy of the policies when corifronted regarding their substance. This emphasis on shoring up administrative procedure is a form of expertise that should be counted …

Librarian Joint Mediated Outreach On Health And Legal Information Provision In Select Communities In Akwa Ibom State, Nigeria., Kathryn James Philip Jan 2017

Librarian Joint Mediated Outreach On Health And Legal Information Provision In Select Communities In Akwa Ibom State, Nigeria., Kathryn James Philip

Library Philosophy and Practice (e-journal)

Health information activities essentially are geared towards raising people’s awareness on good health and holistic living, thereby reducing the risks of opportunistic illness. In this regard, a related health promotional activity was undertaken in four local communities in Southern Nigeria. The purpose was gingered by the compelling efforts made by various government bodies and NGOs to curb the scourging HIV/AIDS pandemic, particularly in local communities. This Paper is therefore based on a three-day health and legal information outreach programme spearheaded by this author as a volunteer librarian in one of the communities. Planning and implementation of this endeavour undertook participatory …

Employability, National Integration And Public Libraries: Case Of The Beyond Access/Irex Intervention In Nigerian Public Libraries, Nkem Ekene Osuigwe Dr, Neemat Abdulrahim Mrs Jan 2017

Employability, National Integration And Public Libraries: Case Of The Beyond Access/Irex Intervention In Nigerian Public Libraries, Nkem Ekene Osuigwe Dr, Neemat Abdulrahim Mrs

Library Philosophy and Practice (e-journal)

National integration is driven by inclusiveness, a sense of belonging and a strong confidence in the existence and future of a country. Nigeria has been bedeviled by numerous clashes, conflicts and challenges which depict the absence of national integration. Unemployment as a means of satisfaction of human basic needs as typified by Maslow’s hierarchy of needs has been fingered as one of the major causes of lack of social cohesion, feelings of marginalization and confidence in the country as an entity. Studies have pointed to a gap in the set of skills acquired in schools and what 21st century …

Employment As Fiduciary Relationship, Matthew T. Bodie Jan 2017

Employment As Fiduciary Relationship, Matthew T. Bodie

All Faculty Scholarship

Under traditional agency law doctrine, employees are agents of their employers and owe an agent’s concomitant fiduciary duties. Employers, in turn, are merely principals and have no corresponding fiduciary duties. A new wave of thinking has unsettled this approach by concluding that only high-level employees have fiduciary responsibilities to their employers. Taking this controversy as a starting point, this Article reconceives the employment relationship as a mutual fiduciary relationship in which both employers and employees are fiduciaries of one another. Even though current law does not consider employers to be fiduciaries of their employees, employers have long had significant statutory …

Shattering 'Blight' And The Hidden Narratives That Condemn, Patricia Hureston Lee Jan 2017

Shattering 'Blight' And The Hidden Narratives That Condemn, Patricia Hureston Lee

All Faculty Scholarship

Tilting at windmills is an expression used to describe Don Quixote’s battle against perceived giants that everyone else sees merely as windmills. This expression can also describe the predicament of St. Louis Place property owners who fought against a combination of case law, statutes, governmental condemnation decisions and an unflattering narrative to save their property. In the end, St. Louis Place property owners might as well have been fighting windmills.

Since Berman v. Parker, legal scholars have challenged the definition of the term blight and the manner in which condemnation takings are used as revitalization tools in distressed communities. Attempts …

Out Of Ferguson: Misdemeanors, Municipal Courts, Tax Distribution And Constitutional Limitations, Henry Ordower, J. Onésimo Sandoval, Kenneth Warren Jan 2017

Out Of Ferguson: Misdemeanors, Municipal Courts, Tax Distribution And Constitutional Limitations, Henry Ordower, J. Onésimo Sandoval, Kenneth Warren

All Faculty Scholarship

The matter of police and municipal courts as revenue producers became increasingly prominent following Michael Brown’s death from a police shooting. This article considers the use of misdemeanors, especially traffic violations, for the purpose of collecting substantial portions of the annual operating budgets in municipalities in St. Louis County, Missouri. The article argues that the revenue raising function of traffic offenses has displaced their public safety and traffic regulation functions. The change in function from public safety to revenue suggests that the governing laws are no longer valid as exercise of policing power but must be reenacted under the taxing …
