Resistance To Institutions And Cultural Distance: Brigandage In Post-Unification Italy, Giampaolo Lecce, Laura Ogliari, Tommaso Orlando Aug 2017

Resistance To Institutions And Cultural Distance: Brigandage In Post-Unification Italy, Giampaolo Lecce, Laura Ogliari, Tommaso Orlando

Cowles Foundation Discussion Papers

We study how cultural distance affects the rejection of imposed institutions. To this purpose, we exploit the transplantation of Piedmontese institutions on Southern Italy which occurred during the Italian unification. We assemble a novel and unique dataset containing information on episodes of brigandage, a form of violent uprising against the unitary government, at the municipal level. We use geographic distance from local settlements of Piedmontese descent as a proxy for cultural distance between each municipality and the new rulers. We find robust evidence that cultural distance from the origins of the transplanted institutions is significantly associated with more intense resistance …

Situating The Corporation Within The Vulnerability Paradigm: What Impact Does Corporate Personhood Have On Vulnerability, Dependency, And Resilience, Heather Kolinsky Aug 2017

Situating The Corporation Within The Vulnerability Paradigm: What Impact Does Corporate Personhood Have On Vulnerability, Dependency, And Resilience, Heather Kolinsky

UF Law Faculty Publications

As a result of Hobby Lobby, and the seemingly expanding notion of the corporation as a person within the traditional autonomous rights paradigm, a tension has developed between corporation as subject and corporation as institution. This evolution of corporation as person also highlights the problem of providing resilience to vulnerable subjects whose competing vulnerabilities are situated in the same corporate environment. Addressing this issue is of critical importance where employment has become the conduit for the responsive state to provide resilience to so many subjects, as well as the site of social institution building because the nature of our workplace …

Global Cybersecurity, Surveillance, And Privacy: The Obama Administration's Conflicted Legacy, Peter Margulies Aug 2017

Global Cybersecurity, Surveillance, And Privacy: The Obama Administration's Conflicted Legacy, Peter Margulies

Indiana Journal of Global Legal Studies

To analyze the Obama administration's cyber efforts, this Article proposes a paradigm of stewardship with both discursive and structural dimensions. Discursive stewardship refers to the Executive's openness to dialogue with other stakeholders. Structural stewardship refers to the domestic and transnational distribution of decisional authority, including checks and balances that guard against the excesses of unilateral action. The Article concludes that the Obama administration made substantial progress in each of these realms. However, the outsized role of law enforcement agendas and dearth of clearly articulated checks on transnational surveillance drove headwinds that limited forward movement.

Alternatives To Immigration Detention, Fatma E. Marouf Aug 2017

Alternatives To Immigration Detention, Fatma E. Marouf

Cardozo Law Review

The United States places over 440,000 people each year in immigration detention, far more than any other country in the world. This Article argues that there are compelling humanitarian and financial reasons to utilize more alternatives to detention. It examines the strengths and limitations of existing alternatives, including the need to develop more community-based case management programs and to rely less on electronic monitoring. The Article then sets forth several legal arguments under the Constitution, Rehabilitation Act, and international human rights law for requiring greater consideration of alternatives to detention.

Breaking Iphones Under Calea And The All Writs Act: Why The Government Was (Mostly) Right, Steven R. Morrison

Cardozo Law Review

During the investigation of the 2015 San Bernardino shooting, the government asked a district court to order Apple to draft code that would bypass the password protection system of the iPhone of one of the shooters. This request was preceded by the holding of a United States District Court in New York, which found that the All Writs Act (A WA) and the Communications Assistance for Law Enforcement Act (CALEA) prohibited the court from issuing the order. This finding was supported by Apple, amici in support of Apple in the San Bernardino investigation, and numerous experts. Although sympathetic to Apple, …

The National Highway Traffic Safety Administration (NHTSA) statistics shows that South Carolina is one of the state with the highest number of the motorcycle fatalities and the fatal crashes. South Carolina repealed its Universal Helmet Law in 1980 which might be one of the reason for the increment of crashes and fatalities in South Carolina. Head and facial injuries are main causes of death in case of motorcycle fatal crashes. Helmet use can save number of lives and reduce the head and facial injuries. The thesis focuses on the advantages of the helmet use and necessity of Universal Helmet Law …

Exploring The Barriers To Effective Federal Flood Mitigation In The Mississippi River Region., Linda Kay Bailey Aug 2017

Exploring The Barriers To Effective Federal Flood Mitigation In The Mississippi River Region., Linda Kay Bailey

Electronic Theses and Dissertations

This dissertation is a comprehensive study of flood mitigation in the Mississippi River region as it is impacted by federal flood policies and programs. The study begins with a historical narrative of flooding events and flood mitigation that provided the impetus for federal flood mitigation in the late 1920s. The historical narrative sheds light on issues related to federalism, path dependency, dynamic growth, and socio-culture influence during the development of flood mitigation policy. Growth machine theory is used to describe how inequality and disparate access to political power has worked to exacerbate flood disaster outcomes and how this dynamic is …

Characterizing Reactive Glutamines In Fibrinogen And Elucidating Factor Xiii Substrate Specificity., Kelly Njine Mouapi Aug 2017

Characterizing Reactive Glutamines In Fibrinogen And Elucidating Factor Xiii Substrate Specificity., Kelly Njine Mouapi

Electronic Theses and Dissertations

Fibrinogen is the most abundant protein involved in blood coagulation and has been associated with many pathological implications in cardiovascular disease. At the final stages of blood clot formation, the transglutaminase Factor XIIIa introduces γ-glutamyl-ε-lysinyl covalent bonds between reactive glutamines and lysines in fibrin, which results in a tighter clot network that is resistant to fibrinolysis. Factor XIIIa crosslinks specific reactive glutamines on fibrinogen, selecting more reactive glutamines in the αC region of fibrinogen than any other chain. Although crosslinking pairs in the αC region have been identified, little is known about the extent of crosslinking and the role played …

The Economic Loss Rule: Is A Building A “Product?” — Another View, Steve Siegfried, Erwin Gonzalez, H. Hugh (Terry) Mcconnell, Allen Bonner, James Czodli

University of Miami Law Review

This Article addresses how the Florida Supreme Court in Tiara Condominium Association v. Marsh & McLennan Cos. receded from its definition of “other property” in Casa Clara Condominium Association, Inc. v. Charley Toppino & Sons, Inc. In Casa Clara the Florida Supreme Court held that a building is to be treated as a “product” for purposes of applying the Economic Loss Rule’s bar to tort claims for defective building materials incorporated into the building. Although Casa Clara adopted the economic loss rule established by Seely v. White Motor Co. and East River Steamship Corp. v. Transamerica Delaval, Inc., …

Are Dhs Technology Grants For Local Police Departments An Effective Tool Against Terrorism?, Erika Mcginty

Student Theses

This paper examines the effectiveness of allocating funds to the nation’s police departments for the prevention of domestic terrorism, as is done annually through the Department of Homeland Security’s Homeland Security Grants Program. The program, administered by the Federal Emergency Management Administration, has distributed billions of dollars since its 2003 inception in equipment, software, and technology services based on the recipient police agencies’ own risk assessments of local terrorism. Much of the technology desired by police consists of systems of mass surveillance; this thesis focuses on implementations of surveillance video cameras or CCTV, license plate readers, and unmanned aerial vehicles. …

Safe Injection Facilities In The Tenderloin: Starting With Operational Plans, Bina Solanky

Master's Projects and Capstones

There are over 90 safe injection facilities (SIFs) in at least 11 countries around the world, except in the United States. SIFs are spaces where people who inject drugs (PWID) can bring their pre-obtained drugs in a hygienic space and use them under supervision. The goal of these sites is to reduce the harmful effects of injection drug use and refer PWID to other medical, social, and treatment services. The Safer Inside Coalition, a community-driven health initiative, in the Tenderloin district of San Francisco recommended opening a SIF in the Tenderloin to improve the health of the community and individual …

Local Revenue Structure Under Economic Hardship: Reliance On Alternative Revenue Sources In California Counties, Sanghee Park Aug 2017

Local Revenue Structure Under Economic Hardship: Reliance On Alternative Revenue Sources In California Counties, Sanghee Park

Public Policy and Administration Faculty Publications and Presentations

This article investigates how a worsening economy affects local revenue structure, and whether the impact is moderated by the fiscal relationship within higher levels of government. The revenue potential of nontax sources—fees/charges and fines/forfeitures—is considerable for local governments under economic hardship. With the panel data from California counties over a period of 11 years (2000-2010), this article shows that reliance on nontax revenue largely depends on the economic and fiscal factors that vary across counties, and the effect of economy is contingent on local dependence on intergovernmental transfers. Counties are likely to raise nontax revenue when the economy worsens and …

A Cross-Sectional Exploration Of Household Financial Reactions And Homebuyer Awareness Of Registered Sex Offenders In A Rural, Suburban, And Urban County., John Charles Navarro

Electronic Theses and Dissertations

As stigmatized persons, registered sex offenders betoken instability in communities. Depressed home sale values are associated with the presence of registered sex offenders even though the public is largely unaware of the presence of registered sex offenders. Using a spatial multilevel approach, the current study examines the role registered sex offenders influence sale values of homes sold in 2015 for three U.S. counties (rural, suburban, and urban) located in Illinois and Kentucky within the social disorganization framework. Homebuyers were surveyed to examine whether awareness of local registered sex offenders and the homebuyer’s community type operate as moderators between home selling …

The Use Of Social Media Interactivity Between Nevada E-Government Agencies And The Public: An Analysis Of The Role And Impact Of Twitter Accounts, Jung Eun Song

UNLV Theses, Dissertations, Professional Papers, and Capstones

Social media platforms have extended the information and communication technology (ICT) landscape in the public sector and have been used to increase e-government transparency, participation, and collaboration in the U.S. e-government. The use of social media platforms has improved a two-way communication for the interactivity with the public, which can provide insights to understand compliance with the Open Government initiative. However, many government agencies using social media have not thoroughly measured the impact of their digital interactions. Moreover, a lack of empirical studies of social media exist for improving the interactivity between governments and the public. Furthermore, scholars have not …

From Behind The Lens: Police Officer Perceptions As Body-Worn Cameras Are Introduced Into The New York City Police Department, Kishon C. Hickman Sr.

Education Doctoral

In 2014, the U.S. District Court ordered the New York City Police Department (NYPD) to test the use of body-worn cameras (BWCs) after finding that their stop, question, and frisk practices violated the rights of some minority New Yorkers. The ruling in Floyd v. City of New York (2013) mandated the recording of future interactions to determine if behavior would be influenced. A total of 54 volunteer officers wore a BWC for a 1-year period and were assigned to six precincts, all selected due to the high frequency of stop, question, and frisk reports prepared by patrol officers. This research …

Commentators have expressed concerns that litigants are invoking the First Amendment's Free Speech Clause strategically, in order to compensate for the weakness or futility of other constitutional claims. The phenomenon has been given a label- "opportunism "-and scholars have examined some of its causes and consequences. This Article takes a closer and somewhat skeptical look at the concept offree speech "opportunism." It imagines that the Free Speech Clause will be invoked in challenges to laws or policies that restrict public restroom use based on a person's gender. Would such challenges be "opportunistic, " as the term has been defined? What …

Extending Miranda: Prohibition On Police Lies Regarding The Incriminating Evidence, Rinat Kitai-Sangero

San Diego Law Review

This Article addresses the question of whether lying to suspects during interrogations regarding the incriminating evidence against them is a legitimate deceit. The search for truth goes hand-in-hand with the human yearning for knowledge. Generally, lying is perceived as reprehensible. Certain types of lies, such as those concerning medical treatment or the sale of a house, may even result in civil or criminal liability. Despite the condemnation of lying, lying to suspects during interrogations is a common phenomenon, and has even been dubbed an “art.” Part II of the article presents how police use deceit and lies during interrogations in …
