The debate concerning affirmative consent consists of two camps: those who assert people must affirmatively establish a desire to engage in sexual contact and those who believe this is an unattainable standard. However, this is not where the debate should start and end. This paper argues that the movement towards affirmative consent in sexual contact will reduce the occurrence of sexual assault. Criminal law sets the backdrop for this paper, but the author recognizes the limits of criminal law. In order to combat sexual assault, there must be a multidisciplinary response. Originalist Law Reform, Judicial Departmentalism, And Justice Scalia, Kevin C. Walsh

Drawing on examples from Justice Antonin Scalia's jurisprudence, this Essay uses the perspective of judicial departmentalism to examine the nature and limits of two partially successful originalist law reforms in recent years. It then shifts to an examination of how a faulty conception of judicial supremacy drove a few nonoriginalist changes in the law that Scalia properly dissented from. Despite the mistaken judicial supremacy motivating these decisions, a closer look reveals them to be backhanded tributes to judicial departmentalism because of the way that the Court had to change jurisdictional and remedial doctrines to accomplish its substantive-law alterations. Framing Marijuana: A Study Of How Us Newspapers Frame Marijuana Legalization Stories And Framing Effects Of Marijuana Stories, Hwalbin Kim

The current study was initially designed to look at how the issue of marijuana legalization was presented in U.S. newspapers and how news frames could influence the audiences’ attitudes or behavioral intentions. To investigate these questions, two different types of research methods were employed: content analysis and experiment. Using framing theory as a theoretical framework, this study found that marijuana legalization has been largely described as a legislation issue or a law enforcement issue, and medical benefit and medical risk were most frequently mentioned attributes to support and oppose marijuana legalization. The present study explores the immigration experiences of Central American women. As violence and poverty mounts in the Northern Triangle; Guatemala, El Salvador, and Honduras, immigrants continue to migrate north. Immigrant women risk their lives seeking safety, opportunity, and reunions with loved ones. Central American women's immigration journeys are unique and they face the added dangers of gender-based violence. This exploratory, qualitative study guided by feminist standpoint theory allowed the women to tell their stories in their own language, as they saw fit. Each entry in this new edition has been updated or reviewed to provide the most current information available. Most of the data was drawn from IRS 990-PF tax returns filed by the foundations. The enormous personal, moral, and legal challenges posed by the displacement of refugees around the world reveal the dire inadequacies of our current policies toward refugee protection. Positive youth development is an approach that seeks to enhance and promote young people's developmental progress. Although there has been a shift toward asset building in rehabilitation of delinquent youth, research on positive youth development has historically focused on children at risk of adverse outcomes, rather than those who are already engaged in criminal behavior. Security breaches involving badged airport employees1 are a growing risk in today’s commercial aviation industry. Currently at almost every commercial airport in the United States, employees of airports, airlines, purveyors, and other tenants enjoy unfettered access to the airport’s Security Identification Display Area (SIDA), sterile, and secured areas. This study presented a novel methodology to estimate the life-cycle reliability of existing reinforced concrete (RC) corroded bridges under multiple hazards. The life-cycle reliability of a bridge girder under traffic load and airborne chloride hazards was compared with that of a bridge pier under seismic ground motion and airborne chloride hazards. When predicting the life-cycle reliability of existing RC corroded bridges, inspection results could be used to estimate the current material corrosion level. การศึกษาเป็นเรื่องที่มีความสำคัญอย่างยิ่งในการพัฒนาประเทศให้เจริญก้าวหน้าเพราะการพัฒนาประเทศต้องอาศัยกำลังคนที่มีความรู้ความสามารถเป็นสำคัญ ทั้งนี้การจัดบริการการศึกษาแก่ประชาชนถือเป็นหน้าที่รัฐ แต่เนื่องจากสถาบันอุดมศึกษาของรัฐไม่สามารถรองรับจำนวนผู้ที่ต้องการเข้าศึกษาได้ทั้งหมด รัฐจึงมีความประสงค์ที่จะส่งเสริมให้เอกชนเข้ามามีส่วนร่วมพัฒนาการศึกษา จึงได้ใช้มาตรการทางภาษีเพื่อส่งเสริมและสนับสนุนการจัดการศึกษาของเอกชนโดยกำหนดเป็นบทบัญญัติของพระราชกฤษฎีกาออกตามความในประมวลรัษฎากร ว่าด้วยการยกเว้นรัษฎากร (ฉบับที่ 284) พ.ศ.2538 เพื่อยกเว้นภาษีเงินได้นิติบุคคลให้แก่บริษัทหรือห้างหุ้นส่วนนิติบุคคลผู้ประกอบกิจการสถาบันอุดมศึกษาเอกชนสำหรับเงินได ที่เป็น (1) กำไรสุทธิจากกิจการ สถาบันอุดมศึกษาเอกชน (2) เงินปันผลหรือเงินส่วนแบ่งของกำไรที่ไดhจากบริษัทหรือห้างหุ้นส่วน นิติบุคคลที่ประกอบกิจการสถาบันอุดมศึกษาเอกชน ทั้งนี้ การจัดตั้งสถาบันอุดมศึกษาเอกชน พระราชบัญญัติสถาบันอุดมศึกษาเอกชน พ.ศ.2546 ได้กำหนดให้ต้องมี “ผู้รับใบอนุญาต” ดำเนินการขอจัดตั้งและเมื่อได้รับอนุญาตให้จัดตั้งแล้ว พระราชบัญญัติฉบับนี้ได้กำหนดให้สถาบันอุดมศึกษาเอกชนมีสถานะเป็นนิติบุคคล ซึ่งถือว่ามีสถานะเป็นนิติบุคคลตามกฎหมายเฉพาะ สถาบันอุดมศึกษาเอกชนจึงเป็นนิติบุคคลแยกต่างหากจากผู้รับใบอนุญาตที่เป็นบริษัทจำกัด ห้างหุ้นส่วนนิติบุคคล มูลนิธิ สมาคม ที่มีสถานะเป็นนิติบุคคลตาม มาตรา 39 แห่งประมวลรัษฎากร การบัญญัติกฎหมายยกเว้นภาษีเงินได้นิติบุคคลตาม พระราชกฤษฎีกาฯ (ฉบับที่ 284) พ.ศ.2538 ในทางปฏิบัติจึงไม่สามารถยกเว้นภาษีเงินได้นิติบุคคล สำหรับเงินได้ของบริษัทหรือห้างหุ้นส่วนนิติบุคคล ที่ได้จากกิจการสถาบันอุดมศึกษาเอกชนได้จริง เนื่องจากกรมสรรพากรและศาลฎีกา ถือว่าสถาบันอุดมศึกษาเอกชนกับบริษัทหรือห้างหุ้นส่วน นิติบุคคลผู้รับใบอนุญาตมิได้เป็นบุคคลเดียวกัน ดังนั้น ผลประโยชน์หรือผลตอบแทนที่บริษัทหรือ ห้างหุ้นส่วนนิติบุคคลผู้รับใบอนุญาตได้รับ จึงมิใช่กำไรสุทธิที่อยู่ในข่ายได้รับการยกเว้นภาษี แต่ถือ เป็นรายได้ที่ต้องนำมาคำนวณเพื่อเสียภาษีเงินได้นิติบุคคลของบริษัทผู้ประกอบกิจการ สถาบันอุดมศึกษาเอกชน ส่งผลให้การบังคับใช้พระราชกฤษฎีกาฉบับนี้ไม่เป็นไปตามเจตนารมณ์ของกฎหมายที่มุ่งประสงค์บรรเทาภาระภาษีแก่ผู้ประกอบกิจการสถาบันอุดมศึกษาเอกชน แต่กลับ ก่อให้เกิดภาระภาษีแก่บริษัทหรือห้างหุ้นส่วนนิติบุคคลผู้ประกอบกิจการสถาบันอุดมศึกษาเอกชน แทน จึงเป็นการสร้างความไม่เป็นธรรมแก่เอกชนผู้ประกอบกิจการสถาบันอุดมศึกษาเอกชน

ปัจจุบันมีการนำเทคโนโลยีเข้ามาใช้ในระบบการขนส่งผู้โดยสาร โดยนำแพลตฟอร์มแอปพลิเคชันมาดำเนินการเป็นตัวกลางเชื่อมต่อระหว่างผู้โดยสารกับผู้ขับ ซึ่งประชาชนที่เป็นผู้โดยสารนิยมใช้บริการดังกล่าวอย่างมาก เนื่องจากความสะดวกสบาย ค่าโดยสารราคาต่ำกว่าและคุณภาพการให้บริการที่ดีกว่า แต่แท้จริงแล้วการให้บริการขนส่งผู้โดยสารผ่านแอปพลิเคชันในส่วนของผู้ขับเป็นการขัดต่อกฎหมายหลายประการ ถือเป็นการให้บริการที่ไม่ชอบด้วยกฎหมาย ซึ่งกระทบต่อความปลอดภัยสาธารณะ เนื่องจากการให้บริการดังกล่าวไม่ได้อยู่ภายใต้การควบคุมของรัฐ และในส่วนการดำเนินการของผู้จัดให้มีบริการขนส่งผู้โดยสารผ่านแอปพลิเคชันอาจไม่ชอบด้วยกฎหมายเช่นกัน โดยปัจจุบันยังไม่มีกฎหมายรองรับถึงรูปแบบการให้บริการดังกล่าว ดังนั้นหากเกิดความเสียหายขึ้นจากการให้บริการดังกล่าว อาจทำให้ผู้โดยสารไม่ได้ความคุ้มครองอย่างเพียงพอ ในวิทยานิพนธ์ฉบับนี้ ศึกษาการให้บริการอูเบอร์ในประเทศไทย แม้ปัจจุบันการให้บริการอูเบอร์ได้ควบรวมกิจการกับการให้บริการแกร็บคาร์แล้ว แต่การให้บริการแกร็บคาร์ยังคงมีปัญหาเช่นเดียวกับการให้บริการอูเบอร์ เนื่องการการให้บริการทั้งสองมีรูปแบบการให้บริการเช่นเดียวกัน โดยผู้เขียนมุ่งศึกษาถึงสถานะ นิติสัมพันธ์และความรับผิดของบุคคลที่เกี่ยวข้องในการให้บริการดังกล่าว และปัญหาการยกเว้นหรือจำกัดความรับผิดด้วยข้อกำหนดการใช้บริการ โดยเปรียบเทียบกับกฎหมายสหภาพยุโรป กฎหมายรัฐนิวเซาท์เวลส์ ประเทศออสเตรเลียและกฎหมายรัฐแคลิฟอร์เนีย ประเทศสหรัฐอเมริกา พบว่าการให้บริการของอูเบอร์ในประเทศไทย แม้มีบุคคลที่เกี่ยวข้องในการให้บริการดังกล่าวทั้งสิ้นสามฝ่ายคือ บริษัทอูเบอร์ ผู้ขับอูเบอร์และผู้โดยสาร แต่แท้จริงแล้วสัญญาหลักที่เกิดขึ้นจากการให้บริการดังกล่าวมีเพียงสัญญาเดียวคือ สัญญาระหว่างบริษัทอูเบอร์กับผู้โดยสารเท่านั้น โดยเป็นไปตามลักษณะของสัญญาจ้างทำของ เพราะแท้จริงแล้วผู้โดยสารเจตนาจะทำสัญญากับบริษัทอูเบอร์ไม่ใช่ผู้ขับอูเบอร์ และในส่วนการให้บริการขนส่งผู้โดยสารผ่านแอปพลิเคชันที่ผู้ขับอูเบอร์เป็นผู้ให้บริการนั้น พิจารณาได้ว่าผู้ขับให้บริการขนส่งผู้โดยสารในฐานะตัวแทนเชิดของบริษัทอูเบอร์ ทำให้นิติสัมพันธ์ระหว่างบริษัทอูเบอร์กับผู้ขับอูเบอร์เป็นไปตามลักษณะของสัญญาตัวแทน หากเกิดความเสียหายขึ้น บริษัทอูเบอร์จึงต้องเข้าร่วมรับผิดในฐานะตัวการรับผิดในการกระทำละเมิดของตัวแทน ผู้เขียนจึงเสนอแนวทางในการแก้ไขปัญหาด้วยการเสนอให้มีการบัญญัติกฎหมายเฉพาะขึ้นใหม่สำหรับรถรับจ้างไม่ประจำทาง และเสนอให้มีการพิจารณานิติสัมพันธ์ระหว่างผู้จัดให้มีบริการขนส่งผ่านแอปพลิเคชันกับผู้ขับให้เป็นไปตามสัญญาจ้างแรงงาน เพื่อเพิ่มความปลอดภัยให้แก่ผู้โดยสาร และทำให้ผู้โดยสารและผู้ขับได้รับความคุ้มครองอย่างเป็นธรรม โดยผู้ขับที่ทำงานควรได้รับสิทธิประโยชน์พื้นฐานในการจ้างแรงงาน

The decomposition of fecal matter is critical for an ecosystem, turning matter into a form that is usable by other organisms; the removal of feces also eliminates breeding sites for pests and prevents waste from entering waterways. The aim of this study was to survey arthropod populations that are attracted to dog feces in suburban and residential settings. Due to their established role in nutrient recycling, an emphasis was placed on identifying dung beetle species present. Homelessness In Spokane: An Inquiry Into The Experience Of Homelessness In A Mid-Sized City, Jocelyn M. Brown

This study focuses on the condition of homelessness in Spokane, Washington, as compared to the same condition in larger and more frequently studied cities, using San Francisco and Seattle as a collective comparison tool for examples of large cities. By examining the neoliberalization of large American cities in a capitalist society, I draw out the similarities and differences of how homelessness is manifest and managed in these two different urban contexts. Examined are the societal factors that impact homelessness, for both those without housing and those (i.e., business owners, service providers) impacted by homelessness. Using the July 2016 federal appellate court decision in Detroit Free Press, Inc. v. U.S. Department of Justice as an analytical springboard, this article explores the expansion of Freedom of Information Act (FOIA) Exemption 7(C) in the Internet era. In Detroit Free Press, the Sixth Circuit recognized a privacy interest in mug shots under Exemption 7(C). The practical impact of the decision is to uphold the general policy of the U.S. Marshals Service not to release mug shots. In today’s world, “it is imperative . . . Steeply sloped, high relief landforms with fractured sedimentary geology in proximity to underground mine voids have the potential to produce far-field ground strains which initiate strain failure modes for cross valley dams. The Ryerson Station Dam breach in 2005 brought attention to the possibility of increased hazard to dams due to far-field ground strain phenomena from underground mining.;The mapping study found that three United States Army Corps of Engineers (U.S.ACE) owned and operated dams were within the 1-mile buffer radius, and four within the 2.7-mile buffer radius of mine permits in West Virginia.
