Exploring The Pluralization Of Community Safety: A Qualitative Analysis Of The Perceived Operation And Implications Of Situation Tables, Taylor Knipe Jan 2017

Exploring The Pluralization Of Community Safety: A Qualitative Analysis Of The Perceived Operation And Implications Of Situation Tables, Taylor Knipe

Theses and Dissertations (Comprehensive)

Recent attention has been placed on the sustainability of policing, in that, increasing demands for public safety have been met with decreasing police budgets. The acknowledgement of this problem by Public Safety Canada has initiated the push towards new collaborative models of community safety. These collaborative models are often referred to as Situation Tables, which seek to mitigate acutely-elevated risks of crime and/or victimization in the community through multi-sectoral intervention. The present study explores how the lived experiences of those working on the frontlines of one Situation Table, the Community Partners Risk Intervention Table (CPRIT), fit within the broader community …

Using Social Disorganization Theory To Explore Neighbourhood Effects On Violent Crime: A Case Study Of The City Of Brantford, Ontario, Ni-Shan Ho

Theses and Dissertations (Comprehensive)

The purpose of this study was to explore neighbourhood characteristics related to social disorganization theory and to ascertain whether socioeconomic disadvantage, family disruption, residential instability and young population structure were predictive of neighbourhood violent crime in the city of Brantford, Ontario, as a case study. A two-step analysis was conducted using data derived from the National Household Survey (NHS), the 2011 census and the Brantford Police Service records management system (BPS-RMS). A descriptive analysis of Brantford’s 21 census tracts (CT) was conducted to explore patterns of social disorganization variables and violent crime in each of the city’s 21 CT neighbourhoods. …

Child Support Collections To Offset Out Of Home Placement Costs: A Study Of Cost Effectiveness, Trish Skophammer Jan 2017

Child Support Collections To Offset Out Of Home Placement Costs: A Study Of Cost Effectiveness, Trish Skophammer

School of Business Student Theses and Dissertations

Families experiencing out-of-home placement (OHP) are in crisis. The fact that a child has been removed from the home means the family has become involved with the child welfare or juvenile justice system. Families that experience OHP are disproportionately poor, and the reasons for OHP often stem from poverty. Because OHP is expensive, and society values parental responsibility, federal and state laws require that parents be referred to the child support system to help offset the cost of OHP through child support collections. This study explores practices around OHP cases in the child support system and adds to the small …

Trade Secrets, Safe Harbors, And International Trade, W. Keith Robinson Jan 2017

Trade Secrets, Safe Harbors, And International Trade, W. Keith Robinson

SMU Science and Technology Law Review

The Trans-Pacific Partnership (TPP) is a proposed trade agreement that establishes terms for trade and business between the United States and eleven Pacific Rim nations. The United States has withdrawn from the TPP, but interest in the agreement remains because some of its provisions serve as a template for future international trade deals. This article focuses on the TPP provisions concerning trade secrets and Internet Service Provider (ISP) Safe Harbors. While both provisions mirror U.S. law, they do lack certain "safeguards." Commentators have observed that the absence of these safeguards unfairly favor the interests of large corporations and rights holders …

A Critique Of The Uniquely Adversarial Nature Of The U.S. Legal, Economic And Political System And Its Implications For Reinforcing Existing Power Hierarchies, Areto A. Imoukuede, Jim Wilets Jan 2017

A Critique Of The Uniquely Adversarial Nature Of The U.S. Legal, Economic And Political System And Its Implications For Reinforcing Existing Power Hierarchies, Areto A. Imoukuede, Jim Wilets

Journal Publications

This article argues that the uniquely adversarial nature of the United States litigation system, rooted in the medieval English system of "trial by battle," has replicated itself in almost all aspects of American society, distinguishing the United States from even its common law counterparts that shared the genesis of their legal systems in English "trial by battle." This "trial by battle" is often characterized in the context of speech by terms such as the 'marketplace of ideas," or in the context of economics by terms such as "the law of the jungle.," Even resolution of basic Constitutional concepts are subject …

With The Best Of Intentions: First Amendment Pitfalls For Government Regulation Of Signage And Noise, Kara Consalo Jan 2017

With The Best Of Intentions: First Amendment Pitfalls For Government Regulation Of Signage And Noise, Kara Consalo

Journal Publications

A basic tenant of American jurisprudence is the protection of speech under the First, Fifth, and Fourteenth Amendments to the United States Constitution, as well as sections 4 and 9 of Article I of the Florida Constitution. While the extent of free speech is not limitless, this Article demonstrates that government attempts to regulate speech through regulation of signage and noise has been significantly curtailed by both federal and state courts in recent years. Further, a constitutional challenge to a government regulation will often be reviewed de novo as a pure question of law and is therefore subject to a …

Gun Rights And The New Lochnerism, Areto A. Imoukuede Jan 2017

Gun Rights And The New Lochnerism, Areto A. Imoukuede

Journal Publications

This Article examines the Supreme Court's recent Second Amendment cases as applications of the same libertarian bias that has undermined constitutional law's fundamental rights doctrine. The concept of a libertarian bias that is based in a New Lochnerism was previously introduced in both The Fifth Freedom and The New Due Process. The analysis here demonstrates that the recently revised doctrine regarding the Second Amendment and gun rights is driven by the current Supreme Court ("Court") hostility towards government regulation in a manner that is akin to what was seen during the Lochner Era. Regrettably, this Article is timely and is …

The Papal Encyclical Laudato Si’: A Focus On Sustainability Attentive To The Poor, Ann-Marie Kennedy, Nicholas J. C. Santos Jan 2017

The Papal Encyclical Laudato Si’: A Focus On Sustainability Attentive To The Poor, Ann-Marie Kennedy, Nicholas J. C. Santos

Marketing Faculty Research and Publications

This article seeks to reflect upon Laudato Si’, the papal encyclical on ecology and sustainable development, and uncover its apparent philosophical and practical approach to the environment. It begins with a discussion of paradigms of thought that outline the new ecological paradigm (NEP) suggested in the ecological literature, thereby helping to situate the ecosophy of Laudato Si’ within current thought. As we will show, Laudato Si’ differs from the NEP by linking the poor to our approach to sustainability and in its consideration of integral ecology. Specific principles for sustainability in business are then identified and strategic approaches are recommended, …

Predictors Of Alcohol Use Among Firefighters And Emergency Medical Technicians, Joshua A. Muniz Jan 2017

Predictors Of Alcohol Use Among Firefighters And Emergency Medical Technicians, Joshua A. Muniz

Open Access Master's Theses

A motivational model of alcohol use, developed by Cooper and her colleagues in 1995, was replicated and extended by incorporating social antecedents and motives, which were originally introduced by Read and her colleagues in 2003. Additionally, conformity motives of alcohol use and its antecedents, which were originally introduced by Cooper (1994) and an exogenous variable of relationship satisfaction were introduced to expand and test a cross-sectional model in a sample of firefighters and Emergency Medical Technicians (FF/EMTs). Participants (N ︎ 205) completed a questionnaire battery assessing alcohol use, alcohol expectancies, sensation seeking, stress factors, social influences, and drinking motives. These …

The Police-Community Partnership: Civilian Oversight As An Evaluation Tool For Community Policing., Nathan Witkin Jan 2017

The Police-Community Partnership: Civilian Oversight As An Evaluation Tool For Community Policing., Nathan Witkin

The Scholar: St. Mary's Law Review on Race and Social Justice

Citizen review boards (CRBs) tend to act as unofficial criminal courts for police misconduct. Without the binding, legal powers of the court, these civilian oversight bodies are often ineffective and draw resistance from law enforcement. “Community policing,” or community-oriented policing (COP) is a law enforcement strategy that emphasizes the use of problem-solving skills through community engagement and partnerships, but performance through arrests/citation statistics only. Without a process to evaluate public relations skills, the COP strategy encourages officers to reduce distance between them and the community while retaining a crime-fighting focus—a dynamic that increases tension and violence between police and crime-prone …

Responsible Resource Development And Prevention Of Sex Trafficking: Safeguarding Native Women And Children On The Fort Berthold Reservation, Kathleen Finn, Erica Gajda, Thomas Perin, Carla Fredericks Jan 2017

Responsible Resource Development And Prevention Of Sex Trafficking: Safeguarding Native Women And Children On The Fort Berthold Reservation, Kathleen Finn, Erica Gajda, Thomas Perin, Carla Fredericks

Publications

In 2010, large deposits of oil and natural gas were found in the Bakken shale formation, much of which is encompassed by the Fort Berthold Indian reservation, home to the Mandan, Hidatsa, and Arikara Nation (“MHA Nation” or “Three Affiliated Tribes” or “the Tribe”). However, rapid oil and gas development has brought an unprecedented rise of violent crime on and near the Fort Berthold reservation. Specifically, the influx of well-paid male oil and gas workers, living in temporary housing often referred to as “man camps,” has coincided with a disturbing increase in sex trafficking of Native women. The social risks …

Administrative Dissents, Sharon B. Jacobs Jan 2017

Administrative Dissents, Sharon B. Jacobs

Publications

Commissioners, like judges, dissent. They do so at length, with vigor, and with persistence. Yet while separate judicial decisions are the subject of a rich literature, their administrative counterparts have long languished in obscurity. A closer look is warranted, however, because studying administrative dissent can enhance our understanding of internal agency operations as well as the relationships between agencies and other actors. This Article presents the results of an original review of separate statements at the Federal Energy Regulatory Commission and the Nuclear Regulatory Commission dating back four decades. It uses these findings to move beyond two common generalizations about …

Government Speech And The War On Terror, Helen Norton Jan 2017

Government Speech And The War On Terror, Helen Norton

Publications

The government is unique among speakers because of its coercive power, its substantial resources, its privileged access to national security and intelligence information, and its wide variety of expressive roles as commander-in-chief, policymaker, educator, employer, property owner, and more. Precisely because of this power, variety, and ubiquity, the government's speech can both provide great value and inflict great harm to the public. In wartime, more specifically, the government can affirmatively choose to use its voice to inform, inspire, heal, and unite -- or instead to deceive, divide, bully, and silence.

In this essay, I examine the U.S. government's role as …

Examining Perceptions Of Crime And Disorder In A Rural University Setting, Ana C. Alcala Jan 2017

Examining Perceptions Of Crime And Disorder In A Rural University Setting, Ana C. Alcala

All Master's Theses

The present study responds to the gap in our understanding of perceptions of crime and disorder in younger age groups, and in a rural setting. A survey was administered to collected students’ perception of crime and disorder on campus, of those surveys 655 students responded. A factor analysis using a varimax rotation was used to group similar variables into latent variables. Three factors emerged: (1) general perception of crime and disorder, (2) traffic congestion, and (3) alcohol and drug abuse. Various analytical techniques were also used, such as OLS (ordinary least squares) regression, difference of means, and analysis of variance …

Driverless Seattle: How Cities Can Plan For Automated Vehicles, Matthew Bellinger, Ryan Calo, Brooks Lindsay, Emily Mcreynolds, Mackenzie Olson, Gaites Swanson, Boyang Sa, Feiyang Sun

Tech Policy Lab

The advent of automated vehicles (AVs)—also known as driverless or self-driving cars—alters many assumptions about automotive travel. Foremost, of course, is the assumption that a vehicle requires a driver: a human occupant who controls the direction and speed of the vehicle, who is responsible for attentively monitoring the vehicle's environment, and who is liable for most accidents involving the vehicle. By changing these and other fundamentals of transportation, AV technologies present opportunities but also challenges for policymakers across a wide range of legal and policy areas. To address these challenges, federal and state governments are already developing regulations and guidelines …
