Sensitizing Humans To Fish Sentience, Kelly Levenda Jan 2017

Sensitizing Humans To Fish Sentience, Kelly Levenda

Animal Sentience

Although fish can feel pain and suffer, they are not often protected legally. Jonathan Balcombe’s What a Fish Knows provides a timely and important contribution to the literature on animal cognition and sentience. By explaining their personalities and capabilities, Balcombe brings much needed public attention to fish and advances the principle that they need and deserve protection.

Netnography: Range Of Practices, Misperceptions, And Missed Opportunities, Leesa N. Costello, Marie-Louise Mcdermott, Ruth M. Wallace Jan 2017

Netnography: Range Of Practices, Misperceptions, And Missed Opportunities, Leesa N. Costello, Marie-Louise Mcdermott, Ruth M. Wallace

Research outputs 2014 to 2021

This is the first article to describe how broadening of the term netnography in qualitative research is leading to misperceptions and missed opportunities. The once accepted need for human presence in netnographic studies is giving way to nonparticipatory (passive) approaches, which claim to be naturalistic and bias-free. While this may be tenable in some environments, it also removes the opportunity for cocreation in online communities and social media spaces. By contrast, participatory (active) netnographers have an opportunity to conduct their research in a way that contributes value and a continuity of narrative to online spaces. This article examines the ways …

Pre-Service Primary Teachers' Experiences And Self-Efficacy To Teach Music: Are They Ready?, Geoffrey M. Lowe, Geoff W. Lummis, Julia Morris Jan 2017

Pre-Service Primary Teachers' Experiences And Self-Efficacy To Teach Music: Are They Ready?, Geoffrey M. Lowe, Geoff W. Lummis, Julia Morris

Research outputs 2014 to 2021

Music is essential in developing the young brain, particularly skills relating to concentration, filtering, information retrieval, verbal competencies, mental visualisation, problem solving, empathy and personal expression. With the introduction of the Australian National Curriculum and its adoption as the basis of the Western Australian P-10 music syllabus, there is cause to reflect on the effectiveness of music provision within teacher education courses and pre-service generalist teachers' abilities to deliver the new music syllabus. Accordingly, a mixed method study was conducted with first and fourth year Bachelor of Education primary students at a Western Australian university, to investigate students' music experiences …

Characterizing Groundwater Flow At Fort Leonard Wood Using Universal Cokriging With Trend Removal, Rachel Mae Uetrecht Jan 2017

Characterizing Groundwater Flow At Fort Leonard Wood Using Universal Cokriging With Trend Removal, Rachel Mae Uetrecht

Masters Theses

"Groundwater elevation interpolation is necessary for the prediction of groundwater flow direction and contaminant transport. Kriging is a geostatistical tool commonly used to interpolate groundwater elevation. Kriging requires a relatively large number of monitoring wells at the site of interest. The variogram model is a crucial element to the kriging equations. The variogram modelling process is an iterative procedure that is often very time consuming. This study presents a literature based approach that provides a point of departure for the variogram modelling process as well as other kriging parameters. A literature database is developed in order to provide insight and …

Reimagining The Stacks: Classroom Technology And Library Collaboration For Writing In The Disciplines, Jossalyn Larson, Daniel C. Reardon

Journal of Student Success in Writing (Archived)

This article details the process by which one university redesigned a first year writing course to better promote discipline-specific and best-practice research techniques. The program offers experiential learning activities through scholarly collaboration, using library staff as mentors, producing an open-access peer-reviewed student journal, and emphasizing face-to-face interaction of peer research communities. It has the potential to establish for students in high school, community colleges and universities that research writing is fundamentally about joining and contributing to a conversation.

Impact Of Framing And Priming On Users' Behavior In Cybersecurity, Kavya Sharma Jan 2017

Impact Of Framing And Priming On Users' Behavior In Cybersecurity, Kavya Sharma

Masters Theses

"This research examines the impact of framing and priming on users' behavior (i.e., action) in a cybersecurity setting. It also examines perceptual outcomes (i.e., confidence, perceived severity, perceived susceptibility, trust, and fear) associated with the users' cybersecurity action. The research draws on prospect theory in the behavioral economics literature and instance-based learning theory in the education literature to generate the hypotheses for the research. A between-subject experimental design (N=129) was used. The results suggest that priming users to cybersecurity risks reduces their risk-taking behavior associated with cybersecurity whereas negative framing of messages associated with cybersecurity has no significant effect on …

Crustal Thickness And Vp/Vs Ratio Of Yellowstone, Eastern Snake River Plain, Wyoming Province, And The Northern Basin And Range Province Through Receiver Function Analysis, Avikant Dayma Jan 2017

Crustal Thickness And Vp/Vs Ratio Of Yellowstone, Eastern Snake River Plain, Wyoming Province, And The Northern Basin And Range Province Through Receiver Function Analysis, Avikant Dayma

Masters Theses

"For decades, numerous studies have been conducted and contradictory results were achieved about the origin and evolution of the Yellowstone supervolcano and the Eastern Snake River Plain. Whether the 640 km long time-progressive chain of rhyolitic calderas was formed due to mantle-plume or a result of lithospheric extension allowing the emergence of melt on the surface is still a debate. Using receiver function analyses, this study determines the crustal thickness and the Vp/Vs ratio below the Yellowstone Plateau, Wyoming Province (WP), Idaho Batholith (IB), Eastern Snake River Plain (ESRP), and the northern Basin and Range Province (BRP). The thickness is …

Is The Future Of Law A Driverless Car? Assessing How The Data Analytics Revolution Will Transform Legal Practice, Eric L. Talley Jan 2017

Is The Future Of Law A Driverless Car? Assessing How The Data Analytics Revolution Will Transform Legal Practice, Eric L. Talley

Faculty Scholarship

Machine learning and artificial intelligence technologies (“data analytics”) are quickly transforming research and practice in law, raising questions of whether the law can survive as a vibrant profession for natural persons to enter. In this article, I argue that data analytics approaches are overwhelmingly likely to continue to penetrate law, even in domains that have heretofore been dominated by human decision makers. As a vehicle for demonstrating this claim, I describe an extended example of using machine learning to identify and categorize fiduciary duty waiver provisions in publicly disclosed corporate documents. Notwithstanding the power of machine learning techniques, however, I …

Extended Collective Licenses In International Treaty Perspective: Issues And Statutory Implementation, Jane C. Ginsburg Jan 2017

Extended Collective Licenses In International Treaty Perspective: Issues And Statutory Implementation, Jane C. Ginsburg

Faculty Scholarship

National legislation establishing extended collective licenses (ECLs) “authoriz[es] a collective organization to license all works within a category, such as literary works, for particular, limited uses, regardless of whether copyright owners belong to the organization or not. The collective then negotiates agreements with user groups, and the terms of those agreements are binding upon all copyright owners by operation of law.” Albeit authorized under national laws, collective coverage of non-members’ works may pose issues of compatibility with international norms. For example, if non-members must opt-out in order to preserve the individual management of their rights, is the opt-out a “formality” …

Cuba Libre: A Verb? A Noun? Or A Cocktail?, Brian Eiselman Jan 2017

Cuba Libre: A Verb? A Noun? Or A Cocktail?, Brian Eiselman

San Diego International Law Journal

This Article examines the nature of the history and origins of hostilities between the United States and Cuba leading up to the Embargo, and the Constitutional issue regarding the possible termination of the Embargo in view of the Helms-Burton Act. While President Kennedy enacted the Embargo unilaterally, the Helms-Burton Act usurped the power to regulate and conduct international affairs from the President, requiring a two-thirds Senate majority in order to lift or modify the Embargo.[] Arguably, this provision violates both the United States Constitution as well as International Law.[] Under the Obama Administration there was a new attitude towards Cuba, …

San Diego International Law Journal

Over the past few years, a relatively large number of cases have arisen in Israel, in which media publications have allegedly influenced criminal proceedings. The Supreme Court of Israel has issued a number of inconsistent decisions regarding such publications.

In this Article, we will study the sub judice prohibition, analyze the concern of undue influence of media publications in criminal cases in light of contemporary behavioral literature, discuss the various approaches found in contemporary Israeli case law, and propose a new and better model.

On The Precipice: Prospects For Free Labor Unions In Vietnam, Tran Thi Kieu Trang, Richard Bales Jan 2017

On The Precipice: Prospects For Free Labor Unions In Vietnam, Tran Thi Kieu Trang, Richard Bales

San Diego International Law Journal

Vietnam (officially, the “Socialist Republic of Vietnam”) is rapidly transitioning economically, in large part due to pro-trade policies that have attracted international capital. A necessary component for Vietnam to further integrate into the world economy is to develop a system of industrial relations that will ensure industrial stability and reassure international manufacturers that there is no risk of embarrassment resulting from revelations of brutal or unsafe working conditions. Positive signs for rapid labor reform were visible as recently as early 2016 with the Trans-Pacific Partnership (“TPP”), a trade agreement intended to integrate trade among twelve countries (including Vietnam), which would …

Sir, The Radar Sir, It Appears To Be . . . Jammed: The Future Of “The Right To Be Forgotten” In A Post-Brexit United Kingdom, Cory Dibene

San Diego International Law Journal

The “Right to be Forgotten” is an EU doctrine. However, now that the UK is progressing towards leaving the EU in 2019, it is important to examine what jurisprudential changes will follow. This Comment will examine the “Right to be Forgotten,” the UK’s criticism of the EU Internet doctrine, and the future of the doctrine in the UK once Brexit takes full effect.

The future is somewhat unclear since Brexit arguably jammed the “Right to be Forgotten’s” radar in the UK. Arguments can be made for abandoning the Right and creating a new jurisprudence in the UK. The House of …

Physician-Assisted Suicide: Removing Residency Requirements In The U.S. To Comport With An International Right To Health, Alexi Silverman Jan 2017

Physician-Assisted Suicide: Removing Residency Requirements In The U.S. To Comport With An International Right To Health, Alexi Silverman

San Diego International Law Journal

In 1948, the UN General Assembly passed a resolution, known as the International Bill of Human Rights. The Bill contains the Universal Declaration of Human Rights, articulating a human right to health. A subsequent treaty, the International Covenant on Civil and Political Rights states that “every human being has the inherent right to life.” Furthermore, the International Covenant on Economic, Social and Cultural Rights protects access to healthcare. However, these treaties do not explicitly recognize a “right to die,” leaving the decision of whether to allow euthanasia and physician-assisted suicide within the discretion of individual countries.

With this international background …

The use of quercetin as a bioflavonoid is becoming increasingly common in food industries even though poor water solubility, instability, absorption, and permeability have limited its application. The oil-in-water single-emulsion solvent evaporation method to synthesize highly stable and soluble quercetin-encapsulated nanoparticles (NPs), in which the reaction yield, particle size, and polydispersity of the NPs are varied greatly within the process parameters of the synthesis method, has been optimized. NPs with different initial quercetin amounts were used to determine how the quercetin amount affected nanoparticle properties and antimicrobial eficiency. Listeria monocytogenes, Salmonella typhimurium, Escherichia coli, and Staphylococcus aureus were chosen as …
