Hidden History: The Role Of Great Britain In The American Civil War As Told By Cultural Artifacts, Mary Griffiths Jan 2017

Hidden History: The Role Of Great Britain In The American Civil War As Told By Cultural Artifacts, Mary Griffiths

Dissertations and Theses

What do statues and songs tell us about the Civil War? If the monuments are in the United States – a marker on a battlefield for instance- it is easy to decipher the context and historical significance. Soldiers passed their time with song and their lyrics are preserved to this day, performed by both pop artists and living historians. But what if these cultural artifacts reside outside the United States? Why is there a statue of Abraham Lincoln in the city of Manchester? How does a monument dedicated to the martyrs at the Lune Street Riots on Preston, Lancashire relate …

The Origins Of Organized Crime, Danielle Hamilton Jan 2017

The Origins Of Organized Crime, Danielle Hamilton

Dissertations and Theses

This paper will illustrate the correlation between democratic and market economy transitions and the increase of organized crime. This correlation exists despite the differences in political system prior to the democratic transition. What matters the most is that these transitions either occur at the same time or within a short window of time. Organized criminal groups thrive in unstable and failed states because of the lack of government and law enforcement interference in their illegal activities. However, these groups can also make a home in countries that have relatively short periods of transition between political and economic systems, despite the …

Disillusionment And Disaggregation: Why Did Asian Americans Vote For Trump?, Catalina Huamei Huang Jan 2017

Disillusionment And Disaggregation: Why Did Asian Americans Vote For Trump?, Catalina Huamei Huang

CMC Senior Theses

In one of the most controversial and interesting election cycles in American history, Republican nominee, Donald Trump prevailed over his Democratic rival, Hillary Clinton. To many, his victory was shocking, if not completely unexpected, yet the circumstances that catalyzed such a defeat lie in the characteristics of his supporters, made up of several classes, races, and identities. Among them are the multifaceted Asian American population – diverse ethnically and politically. This thesis aims to unravel the reasons for which many Asian Americans gave their vote to Trump on November 8, 2016 through distinctions between their ethnic groups and demographics. It …

Ji Sor (1997): Self-Realization Of Women In Cinema And In History, Tong (Hilary) Lin Jan 2017

Ji Sor (1997): Self-Realization Of Women In Cinema And In History, Tong (Hilary) Lin

CMC Senior Theses

100 years ago, there was a group of women called Zishunu who stood up against the whole society and swore off marriage for life. Zishu offered an escape for many women in the Pearl River Delta area. As forerunners in female independence and liberation, Zishunu never had the chance to be the spokesman of themselves or the recognition they deserved. Ji Sor (1997), a groundbreaking work in lesbian-themed movies, beautifully depicts this special and unparalleled historical phenomenon in detail. Released a few months after the Handover of Hong Kong in 1997, this critically acclaimed movie by Hong Kong New Wave …

The Socio-Political And Economic Causes Of Natural Disasters, Nicole Southard Jan 2017

The Socio-Political And Economic Causes Of Natural Disasters, Nicole Southard

CMC Senior Theses

To effectively prevent and mitigate the outbreak of natural disasters is a more pressing issue in the twenty-first century than ever before. The frequency and cost of natural disasters is rising globally, most especially in developing countries where the most severe effects of climate change are felt. However, while climate change is indeed a strong force impacting the severity of contemporary catastrophes, it is not directly responsible for the exorbitant cost of the damage and suffering incurred from natural disasters -- both financially and in terms of human life. Rather, the true root causes of natural disasters lie within the …

2d Vector Map And Database Design For Indoor Assisted Navigation, Luciano Caraciolo Albuquerque

Dissertations and Theses

In this paper we implemented a 2D Vector Map, map editor and Database design intended to provide an efficient way to convert cad files from indoor environments to a set of vectors representing hallways, doors, exits, elevators, and other entities embedded in a floor plan, and save them in a database for use by other applications, such as assisted navigation for blind people.

A graphical application as developed in C++ to allow the user to input a CAD DXF file, process the file to automatically obtain nodes and edges, and save the nodes and edges to a database for posterior …

Competition And Subsidies In Air Transport Liberalization— The Uae-North America Dispute, Rachid Tiroual Jan 2017

Competition And Subsidies In Air Transport Liberalization— The Uae-North America Dispute, Rachid Tiroual

Journal of Air Law and Commerce

Subsidy allegations against the three major Middle-Eastern carriers—Emirates Airlines, Etihad Airways, and Qatar Airways—have been brought by the three major U.S. carriers—American Airlines, Delta Air Lines, and United Airlines. The latter claim that the Gulf trio receives letters of credit and subsidies from their governments. They claim also that their rivals take passengers and revenues from U.S. carriers and force them to reduce, terminate, or forego services on international routes. This article rationalizes the ongoing debate without arguing whether the subsidy allegations are founded or not. It seeks to understand the basic rationale behind any findings and conclusions drawn by …

The Rest Of The Story: Exploring The Overall Functioning And Maturational Experiences Of Former Foster Youth In Middle Adulthood, Jessica Lynn Yang Jan 2017

The Rest Of The Story: Exploring The Overall Functioning And Maturational Experiences Of Former Foster Youth In Middle Adulthood, Jessica Lynn Yang

Electronic Theses and Dissertations

Middle adulthood as a developmental stage is often neglected in developmental research, yet it is vitally important to the cohesiveness of the life span as this is a time when integrating the experiences of the earlier developmental periods such as emerging adulthood, setting the stage for healthy aging. Emerging adulthood is but one unique stage in the life course, and situating this phase within a holistic developmental context is essential. Doing so illuminates the ways in which the past influences current functioning and the ways in which one's present developmental state sets the stage for later development. To date, no …

The Twenty-Fifth Amendment And The Establishment Of Medical Impairment Panels: Are The Two Safely Compatible?, Robert E. Gilbert Jan 2017

The Twenty-Fifth Amendment And The Establishment Of Medical Impairment Panels: Are The Two Safely Compatible?, Robert E. Gilbert

Fordham Law Review

At least two proposals have been offered by prominent members of the medical community to establish “Medical Impairment Panels” to monitor the health of Presidents of the United States and to facilitate the implementation of relevant Sections of the Twenty-Fifth Amendment. The first discussed in this Article was made by Dr. Herbert Abrams, a now deceased professor of radiology at Stanford University; the second by Dr. Bert Park, a prominent Missouri neurosurgeon. Dr. Abrams and Dr. Park spoke and wrote about their plans frequently over the years. The objective of each proposal was to ensure that the Vice President, the …

Hungary's Refugee Crisis: Why A Uniform Approach Is Not The Solution, Yvonne Kupfermann Jan 2017

Hungary's Refugee Crisis: Why A Uniform Approach Is Not The Solution, Yvonne Kupfermann

Notre Dame Journal of Law, Ethics & Public Policy

The recent refugee crisis that swept over many European nations requires an inquiry into how to balance humanitarian concerns with the resources of the respective nations involved. Oftentimes, the approach is purely humanitarian, placing much of the focus on inclusion and resettlement. However, countries that stray from this humanitarian approach are often criticized. This Note aims to offer a new theoretical framework for analyzing a refugee crisis of this scope. It uses Hungary as a case study to demonstrate how history can play a role in how a refugee crisis is handled and to provide concrete examples of a country …

Note, Minors In The Major Leagues: Youth Courts Hit A Home Run For Juvenile Justice, Christina M. Dines Jan 2017

Note, Minors In The Major Leagues: Youth Courts Hit A Home Run For Juvenile Justice, Christina M. Dines

Notre Dame Journal of Law, Ethics & Public Policy

Youth courts provide an efficient—albeit unconventional—alternative to the formal juvenile justice system. Although structures of youth courts vary, the purpose remains the same: to rehabilitate and deter youth offenders in a forum largely governed by their minor peers—one free of the stigma associated with the traditional justice system. This Note examines the expansion of youth courts; various structures of the courts; advantages and disadvantages of a system driven by peer mentorship and peer decision- making; typical sanctions imposed on a juvenile offender; and the wider implications of youth court from an economic and social justice perspective.

Representing The United States Government: Reconceiving The Federal Prosecutor's Role Through A Historical Lens, Scott Ingram Jan 2017

Representing The United States Government: Reconceiving The Federal Prosecutor's Role Through A Historical Lens, Scott Ingram

Notre Dame Journal of Law, Ethics & Public Policy

For nearly 100 years courts and legal scholars have held prosecutors to the “justice” standard, meaning that the prosecutor’s first duty is to ensure that justice is done. With this command, prosecutors have increased their discretion. The modern prosecutor’s power is unrivaled in the criminal justice system. Judges and defense attorneys have ceded some of their power to prosecutors. The prosecutor’s power has led a host of commentators to critique prosecutorial use of power for a variety of reasons. Rather than add to this voluminous literature by defending or critiquing prosecutorial power, this Article challenges the underlying assumption of prosecutorial …

Analysis Of Statutory Religious Accomodations For State-Employed Religious Objectors To Same-Sex Marriage Solemnization, Nicholas J. Schilling Jr. Jan 2017

Analysis Of Statutory Religious Accomodations For State-Employed Religious Objectors To Same-Sex Marriage Solemnization, Nicholas J. Schilling Jr.

Notre Dame Journal of Law, Ethics & Public Policy

The Supreme Court’s landmark decision in Obergefell v. Hodges legalized same-sex marriage. The decision aggravated a tension between advocates of protection of religious beliefs that reject as wrong same-sex marriage and sponsors of the new legal norm of same-sex marriage as a fundamental right.

Prior to—and in response to—the Supreme Court’s decision in Obergefell, at least ten state legislatures debated bills that would provide exemptions for state officials who, on religious grounds, objected to the certification of marriage licenses for same-sex couples. Unless otherwise established by state law, officials who swear an oath to protect and defend the Constitution must …

Can Armed Drones Halt The Trend Of Increasing Police Militarization?, Ian Thresher Jan 2017

Can Armed Drones Halt The Trend Of Increasing Police Militarization?, Ian Thresher

Notre Dame Journal of Law, Ethics & Public Policy

Following presidential declarations of “war” on drugs and terror, domestic law enforcement agencies were saddled with difficult and dangerous new duties. They responded to the danger by becoming more dangerous themselves; increasingly adopting the training, tactics, and equipment of the United States military. This “militarization” of domestic police officers has, predictably, led to a breakdown in community policing, almost one thousand fatal shootings by police officers per year, and growing rifts between law enforcement agencies and the communities they are sworn to protect. In this essay, I examine whether police drones armed with non-deadly force might, perhaps paradoxically, help to …

The Chancery Bank Of Delaware: Appraisal Arbitrageurs Expose Need To Further Reform Defective Appraisal Statute, Stanley Onyeador Jan 2017

The Chancery Bank Of Delaware: Appraisal Arbitrageurs Expose Need To Further Reform Defective Appraisal Statute, Stanley Onyeador

Vanderbilt Law Review

A dark pool, a form of Alternative Trading System ("ATS"), is a private securities trading platform that-unlike public exchanges such as the New York Stock Exchange-allows participants to execute large block trades with delayed public disclosure. As neither party in a dark market transaction is trading on the public, or "lit," market or knows the identity of its counterparty, dark market trades allow participants to trade anonymously and keep trade strategies from competitors. Further, because dark market trades do not have to be publicly disclosed in real time, the price of a given security will, theoretically, stay relatively stable as …

The Sum Is More Public Domain Than Its Parts: Us Copyright Protection For Works Of Applied Art Under Star Athletica's Imagination Test, Jane C. Ginsburg Jan 2017

The Sum Is More Public Domain Than Its Parts: Us Copyright Protection For Works Of Applied Art Under Star Athletica's Imagination Test, Jane C. Ginsburg

Faculty Scholarship

In Star Athletica v. Varsity Brands, the Supreme Court granted certiorari to resolve confusion in the lower courts regarding the "separability" predicate to copyright protection of decorative features of useful articles. Adopting the Gordian imagery evoked by other appellate courts, the Sixth Circuit in Varsity Brands lamented "[c]ourts have twisted themselves into knots trying to create a test to effectively ascertain whether the artistic aspects of a useful article can be identified separately from and exist independently of the article's utilitarian function." Star Athletica involved the "surface decorations" of stripes, chevrons, and color blocks applied to cheerleader uniforms. While the …

Ladd Looking Forward - A Reading Group, Krystie Wilfong, Christina Bell

ILS Scholarship

In the summer of 2017, the staff of Ladd Library and Muskie Archives at Bates College embarked upon a semester-long, bi weekly reading group. Facing the upcoming search for new leadership, we spent the Fall 2017 semester discussing a broad array of topics relevant to the profession as a whole and what we might consider for our own future. We asked all participants to engage with a growth mindset, and set down rules to push the conversation beyond “this is the way we’ve always done it” as a justification against change.
