JURNAL KOMUNIKASI INDONESIA

In politics, minority groups often collide with the majority group over ethnicity or religious issues. But, we have witnessed many …

Battle Of The Band: Exploring The Unconstitutionality Of Section 2(A) Of The Lanham Act And The Fate Of Disparaging, Scandalous, And Immoral Trademarks In A Consumer-Driven Market, Tanya Behnam Oct 2017

Battle Of The Band: Exploring The Unconstitutionality Of Section 2(A) Of The Lanham Act And The Fate Of Disparaging, Scandalous, And Immoral Trademarks In A Consumer-Driven Market, Tanya Behnam

Loyola of Los Angeles Entertainment Law Review

In the 2016-2017 term, the Supreme Court issued its opinion in Matal v. Tam, holding that the Lanham Act’s section 2(a) ban on disparaging trademarks—which prevents registration of any trademarks that the PTO deems to be disparaging to any groups or institutions—is unconstitutional. Although meant to only apply to section 2(a)’s ban on disparaging trademarks, the Court’s decision increases the likelihood that section 2(a)’s still-standing ban on scandalous and immoral marks are unconstitutional as well.

This Comment first reviews the basic principles of trademark law and the Lanham Act, summarizes Simon Tam’s legal battles, and briefly presents the conflicting …

Aspect Comprehension And Processing In Narratives By Native Spanish Speakers, Hannah Riddle

School of Education and Leadership Student Capstone Theses and Dissertations

Aspect is fundamental to expressing time and sequence of events in narratives. In second language acquisition literature little is known about how English aspect is comprehended. This study manipulates aspect in narratives and compares comprehension of Spanish speakers to English and Arabic speakers. English and Spanish have morphosyntactic aspect, Arabic does not. This study examines aspect comprehension in 18 native Spanish speakers, using 16 narratives to capture moment-to-moment and off-line processing. Results show that Spanish speakers comprehend aspect more like English speakers in the moment-to-moment processing, where Arabic speakers do not. Spanish speakers did not comprehend aspect like English speakers …

How To Integrate Vocabulary In A Fourth Grade Classroom Of English Language Learners To Accelerate Reading Achievement, Randi Kay Weiland

School of Education and Leadership Student Capstone Theses and Dissertations

English language learners are prevalent in modern American schools, yet educators are often still grappling with how to best teach these unique students. Unsurprisingly, vocabulary plays a fundamental role in reading comprehension. This capstone presents the existing research on the foundational relationship between vocabulary and reading comprehension as well as effective vocabulary instruction for English language learners. The research was then used to design a vocabulary curriculum for a fourth grade thematic literacy unit on Mexican Heritage. The curriculum focuses on four major aspects of vocabulary instruction: 1) the direct instruction of Tier II words, as defined by Isabel Beck; …

Transitioning From Teachers' Words To Students' Words: Strategies To Promote Comprehension During Literature Circles, Tiffany Tozke Brian

School of Education and Leadership Student Capstone Theses and Dissertations

Literature circles can be a powerful tool for motivating students to take part in discussions around text. The power of these literature circles lies in the success of the conversations students have. Those conversations are shaped by the words the teacher uses to facilitate them, and by the words students use within them. This capstone addresses how teachers can focus on words in a student-focused manner that supports students in having in conversations that deepen their understanding and connection to novels.

Acculturation, Stress And Birth Outcomes In Mexican And Mexican American Women, Paulette A. Chaponniere

Peer Reviewed Articles

Purpose: This study examined the relationships between stress, stress buffers, acculturation and birth outcomes of infants born to 81 Mexican and Mexican American women living in West Michigan.

Method: An interrupted times series design was used to collect data prior to labor and delivery. Neuman’s Systems Model was used as the theoretical framework as it illustrates how stress impacts health outcomes. Women were recruited from local health and community agencies. Interviews were conducted in English or Spanish as desired by the subject using standardized questionnaires.

Results: Acculturation was negatively correlated with age (r = -.378, p < 0.001) and social support (r = -.258, p = .02). Bicultural women had the highest mean birth weight, and very Mexican–oriented women had the longest gestation. The third trimester of pregnancy was significantly different from the second trimester for stress, coping and social support. The women least integrated in either culture, e.g. marginalized (ARSMA-II), had the most stress. Spiritual coping predicted weight (β = .278) while pregnancy distress (β = -.237) and sense of belonging (β = -.258) predicted length of gestation.

Conclusion: Pregnancy-related distress was …

The Phenomenology Of Medico-Legal Causation, Nicholas Hooper Oct 2017

The Phenomenology Of Medico-Legal Causation, Nicholas Hooper

Dalhousie Law Journal

The language of counterfactual causation employed from the bench obscures the analytical vacuity of the "butfor" test. This paper takes issue with the consistent recourse to "common sense" as a methodological tool for determining the deeply complex issue of causality. Despite manifestly empty gestures to, e.g., robust pragmatism, the current approach imposes the dominant values of the judiciary in a manner that perpetuates the current distribution of power. Whatever the merits of counterfactual inquiry, its legal iteration requires judges to construct a hypothetical narrative about "how things generally happen." This, in turn, impels a uniquely comprehensive brand ofjudicialcreativity. The results …

Reading Research For Struggling And Reluctant Readers, Rebecca Griffin

Master's Theses & Capstone Projects

Reading instruction is an important part of a child’s education. Reading is essential in their academic career. Students who read well are able to perform at high standards but students who struggle with reading can experience many difficulties, ranging from doing poorly in all subjects to behavior issues. Many researchers are reporting successful studies in closing the achievement gap in reading. Teachers need this information to best support students who need interventions when learning to read. This literature review looks at how best to instruct students who struggle to read.

Can You Improve Phonological Awareness With Skill Boxes Through A Five-Minute Daily Routine?, Lisa Holland

Master's Theses & Capstone Projects

Phonological awareness is a necessary component in order to learn how to read. These skills have to be taught to children. Children who have deficits in phonological awareness are at risk for a learning disability such as dyslexia. This is why explicit instruction in phonological awareness is crucial for development. Due to this, it is important to start assessing children on these skills in preschool and start interventions if they are needed. The purpose of this action research was to shed light on how crucial phonological awareness skills are for development and how if a child is deficient in this …

Solomon Northup’S Singing Book, Lara Langer Cohen Oct 2017

Solomon Northup’S Singing Book, Lara Langer Cohen

English Literature Faculty Works

This essay examines the musical score included at the end of Solomon Northup’s Twelve Years a Slave (1853), a setting of a song called “Roaring River” that Northup earlier recounted enslaved people singing as they patted juba. I argue that “Roaring River” stages questions that the narrative itself cannot ask about how to represent the experience of slavery once one is outside of it. In particular, it asks how to love what’s made in the shadow of slavery—the intimacies forged, and especially the music borne of them.

"Our Rights Are Getting More & More Infringed Upon": American Nationalism, Identity, And Sailors' Justice In British Prisons During The War Of 1812, Elizabeth Jones-Minsinger Oct 2017

"Our Rights Are Getting More & More Infringed Upon": American Nationalism, Identity, And Sailors' Justice In British Prisons During The War Of 1812, Elizabeth Jones-Minsinger

Staff Scholarship

American maritime prisoners during the War of 1812 took seriously their government's assertion of "free trade and sailors' rights," but when the United States government failed to make this rhetoric a reality, imprisoned sailors clashed with both British and American officials. The U.S. government lacked effective mechanisms to challenge impressment, influence prisoner exchange, or meet the daily needs of its imprisoned citizens, who often interpreted this inefficacy as indifference to their situation. However, the relative absence of government support gave American prisoners space to create a form of nationalism that stressed self-reliance, cooperative action, aggressive masculinity, and occasional violence and …

Using The Focus On Form Method To Create A Grammar Resource Book For Ell Teachers, Julia Milne

School of Education and Leadership Student Capstone Projects

The research conducted in this capstone discusses appropriate methods of teaching grammar to ELL students. The project arose from the author’s realization that explicit grammar instruction was seldom taught and in many cases omitted completely during instructional time. Furthermore, the author realized that there was a great deal of confusion about the appropriate role of grammar within the curriculum. This led the author to study the history of grammar instruction in order to understand the various methodologies that have been implemented throughout the years. The goal was to try and gain a better understanding of the different schools of thought …
