Piloting Personhood: Reflections From The First Year Of A Supported Decision-Making Project, Kristin Booth Glen Dec 2017

Piloting Personhood: Reflections From The First Year Of A Supported Decision-Making Project, Kristin Booth Glen

Cardozo Law Review

The amazing Symposium on Personhood and Civic Engagement by People with Disabilities included a variety of perspectives: legal, cultural, historical, philosophical, and educational, including a panel on "Legal Barriers to Personhood" from which this article was derived. Despite legal analysis, theory, and even description, there was little "in the weeds" discussion of how personhood can actually be protected and preserved for persons with intellectual and developmental disabilities (I/DD).1 Locating personhood within the human right of legal capacity, and positing guardianship in diametric opposition, this Article attempts to describe some of the lessons I have learned in the first year of …

With Access And Justice For All, Sagit Mor Dec 2017

With Access And Justice For All, Sagit Mor

Cardozo Law Review

The article explores the intersection of the "right to access" and "access to justice," particularly for persons with disabilities, emphasizing how these concepts interact across various legal and social dimensions. It argues that the Convention on the Rights of Persons with Disabilities (CRPD) provides a comprehensive framework for addressing these issues, focusing on legal capacity, physical accessibility, and effective participation in legal proceedings. The analysis highlights the need to move beyond formal barriers to justice and address deeper structural and ideological challenges, including biased legal norms and the exclusion of disabled individuals from lawmaking processes. Ultimately, the article advocates for …

Caring For Humanity: Non-Profit Elderly Law, Sierra Samp

Capstone Projects and Master's Theses

This Capstone was an internship that focused on care in Humanity at Legal Services for Seniors. There is a journal that includes the observations of care in the law office. I focus on how attorneys care for each clients humanness while they are working on their cases. Attorneys may be doing work that can be quite intimidating, but the care they give is quite extraordinary.

Evaluation Of Immigration And Citizenship Program (Icp), Wen Feng Yip

Master's Projects

There are many non-profit organizations which provide immigration and other legal services to immigrants in Santa Clara County. However, the capacity of legal services providers and their partners still face daunting challenges when trying to meet an overwhelming need that contrasts with limited resources (McAllister, 2015). Under these circumstances, the quality and effectiveness of immigration legal service providers in delivering their services is a subject of concern for immigrant groups. Community-based organizations are best suited to help immigrants with the legalization process (Cordero-Guzman, 2005) and their integration into the economic, political, and social mainstream in the long run.

The Immigration …

How The Collective Impact Model Can Help Hispanic Students In East Tennessee Excel In Higher Education, Edwin Soto

Electronic Theses and Dissertations

This research project focuses on helping Hispanic students in the East Tennessee region excel in higher education with existing resources from various organizations. Hispanic high school students were identified to complete a survey. Findings showed that these students are facing legal, financial and social challenges when thinking about higher education. Even though these students are facing these challenges, they still want to pursue higher education in order to make a positive impact in their communities. The collective impact idea is proposed as part of the solution for this social complex problem. Since it is impossible for an individual to solve …

How Do Accounting Practices Spread? An Examination Of Law Firm Networks And Stock Option Backdating, Teck Meng Junior Tan, Patricia M. Dechow Dec 2017

How Do Accounting Practices Spread? An Examination Of Law Firm Networks And Stock Option Backdating, Teck Meng Junior Tan, Patricia M. Dechow

Research Collection School Of Accountancy

We hypothesize that one way that accounting practices spread is through law firm connections. We investigate this prediction by examining companies that avoided reporting compensation expense by engaging in stock option backdating. We hypothesize that executives engaged in backdating because they were desensitized to its inappropriateness when they learned through their legal counsel that other companies were engaging in this practice. We identify backdating companies through backdating-related restatements of earnings. Using network analysis, we document that backdating companies are more highly connected with other backdating companies via shared law firms. Logistic regressions indicate that the odds of a company backdating …

Fashion Law: More Than Wigs, Gowns, And Intellectual Property, Mark K. Brewer Dec 2017

Fashion Law: More Than Wigs, Gowns, And Intellectual Property, Mark K. Brewer

San Diego Law Review

[T]his article frames the emerging field of fashion law and synthesizes its substance from an international perspective in order to raise the profile of fundamental areas in which the law and fashion intersect as well as identify key areas for future research. Part II examines the background on fashion law, initially focusing on its origins and then examining IP, traditionally the main area of the field. Additionally, the Article defines, frames, and justifies the emerging field of fashion law. Because an exhaustive analysis of the emerging trends in fashion law is beyond the scope of this Article, Part III only …

Parental Response To Child Sexual Abuse In Zimbabwe: Formative Research For Intervention Development, Christopher Okoth Obong'o Dec 2017

Parental Response To Child Sexual Abuse In Zimbabwe: Formative Research For Intervention Development, Christopher Okoth Obong'o

Electronic Theses and Dissertations Archive

Nearly 31% of females and 17% of males experienced child sexual abuse (CSA) globally in 2012. In Zimbabwe, about 33% of young women aged 18-24 years experienced sexual abuse by age 18 in 2013. Because CSA perpetrators are likely to be someone known to the victim and the abuse likely to be perpetrated at the home of the victim, parents and other adult caregivers are in a unique position to support timely CSA disclosure and reporting. The purpose of this study was to generate information for development of interventions to strengthen CSA disclosure and reporting in Zimbabwe. The primary aim was …

Report On The Texas Legislature, 85th Session: An Urban Perspective-Criminal Justice Edition, Sarah R. Guidry, Zahra Buck Whitfield, Amber K. Walker, Marshaun Williams, Grady Paris

The Bridge: Interdisciplinary Perspectives on Legal & Social Policy

In Texas, the legislature meets every 2 years and at the end of a regular legislative session, hundreds of passed bills will have been sent to the governor for approval. The large number of bills and the wide range of topics they cover can make it difficult to gain an understanding of all the new laws that were passed. At the close of each legislative session the Earl Carl Institute publishes, for the benefit of its constituents, highlights from the session in a bi-annual legislative report. In this year’s publication entitled Report on the Texas Legislature, 85th Session: An Urban …

Sex Trafficking: A Toolbox For Apn's, Nissa Berbawy Nov 2017

Sex Trafficking: A Toolbox For Apn's, Nissa Berbawy

Graduate Research Projects

Abstract

Objective: As the fastest growing crime in the world (Walker-Rodriguez, & Hill, 2011) and with sex slaves found in all 50 states (Grace et al, 2014), finding a solution to the problem of sex slavery is critical. One study showed 63.3% of sex slave survivors were treated in the emergency department while enslaved, revealing an opportunity for healthcare providers to intervene (The Emergency Nurses Association, 2015). The purpose of this review of literature is to provide evidence based resources to better equip APN’s to identify, intervene, and refer sex slaves for successful rehabilitative services. Methods: Databases searched were …

Judges, Racism, And The Problem Of Actual Innocence, Stephen J. Fortunato Jr. Nov 2017

Judges, Racism, And The Problem Of Actual Innocence, Stephen J. Fortunato Jr.

Maine Law Review

The facts and data are in and the conclusion they compel is bleak: the American criminal justice system and its showpiece, the criminal trial, harbor at their core a systemic racism. For decades, criminologists, law professors, sociologists, government statisticians, and others have been collecting and collating data on crime, punishment, and incarceration in the United States. These intrepid scholars have looked at crime, criminals, and the justice system from all angles—the race of defendants and victims; the relationship of poverty to criminality; severity of crime; severity of punishment; incarceration rates for different racial groups; sentencing and sentence disparities; and so …

When The Court Speaks: Effective Communication As A Part Of Judging, Daniel E. Wathen Nov 2017

When The Court Speaks: Effective Communication As A Part Of Judging, Daniel E. Wathen

Maine Law Review

One of my early judicial role models, Justice James L. Reid of the Maine Superior Court, was sentencing a defendant for a murder committed within the confines of the Maine State Prison. The defendant was already serving a life sentence for another murder at the time the offense was committed. Because Maine has no parole or capital punishment, the sentencing options were limited and ultimately meaningless. As Jim imposed a life sentence consecutive to the existing life sentence, the defendant rose in his manacles and uttered an early Anglo-Saxon version of “screw you.” Jim, rising from the bench and moving …

Court-Connected Alternative Dispute Resolution In Maine, Howard H. Dana Jr. Nov 2017

Court-Connected Alternative Dispute Resolution In Maine, Howard H. Dana Jr.

Maine Law Review

With these words of prophecy the Commission to Study the Future of Maine's Courts launched its discussion of alternative dispute resolution (ADR). Although conceding that “the adversary process ... has served the people of the state well” and acknowledging that “the state must continue to provide a forum for forceful advocacy that produces a definite and binding judicial decision” the Commission asked the Maine judicial and legislative branches to embrace ADR. For the last dozen years, the Author has been the Supreme Judicial Court's (SJC's) liaison to its ADR Planning and Implementation Committee and Chair of the Court's Advisory Committee …

Eat Your Vitamins And Say Your Prayers: Bollea V. Gawker, Revenge Litigation Funding, And The Fate Of The Fourth Estate, Nicole K. Chipi

University of Miami Law Review

In August 2016, Gawker.com shut down after 14 years of—more often than not—controversial online publishing. The website was one of several Gawker Media properties crushed under the weight of a $140 million jury verdict awarded to Terry Bollea (better known as former professional wrestler Hulk Hogan), in a lawsuit financed by eccentric Silicon Valley billionaire Peter Thiel. Thiel’s clandestine legal campaign was part of a vendetta against Gawker Media, a venture he confirms was singularly focused on bankrupting the company through litigation. His success sent shudders through the media world, demonstrating that determined actors with deep pockets could sue the …
