Why The Renewable Energy Credit Market Needs Standardization, Lisa Koperski
Why The Renewable Energy Credit Market Needs Standardization, Lisa Koperski
Washington Journal of Law, Technology & Arts
Renewable Energy Credits (RECs) are a relatively new financial instrument that help to stimulate the renewable energy market through capturing the premiums for environmental attributes associated with electricity, hopefully, encouraging investment in new renewable energy projects. However, lack of standardization in both the definition of RECs and the ways that RECs can be exchanged and administered has led to confusion on the parts of all concerned—the REC seller, the REC buyer, regulators, and the public at large—stymying investment in renewable energy projects and creating market inefficiency. Much like inconsistent accounting definitions or divergent requirements for providing investment guidance to consumers …

Increasing Diversity By A New Master's Degree In Legal Principles, Joni Hersch
Increasing Diversity By A New Master's Degree In Legal Principles, Joni Hersch
Vanderbilt Law School Faculty Publications
Students who leave their JD program before graduation leave empty handed, without an additional degree or other credential indicating that their law school studies had any professional, educational, or marketable value. The absence of such a credential combines with the substantial risks and costs associated with law school education to discourage risk averse students from applying. The adverse impacts of these risks may be especially great for lower income students who have fewer financial resources to draw on and less information about their fit with legal education and the legal profession. I propose that law schools award a master’s degree …

Smu Pro Bono Centre’S New Premises Officially Unveiled, Singapore Management University
SMU Press Releases and News
“Pro bono legal services represent the highest form of social work that the legal profession can perform in service to the public. Everyone needs some form of legal assistance or advice at one time or another. It is not just free work, but free work for our poor ‘neighbours’ without expectation of any kind of material reward – it is the work of the Good Samaritan. It is free work, given from the heart,” said Mr Chan Sek Keong, former Chief Justice and current Senior Judge at the Singapore Supreme Court, at the official opening of the SMU Pro Bono …
Las Consejerías Estatales Y No Estatales Para Las Mujeres Víctimas De Violencia De Género: Un Estudio De Caso De La Asociación Civil Corriente La Colectiva / The State And Non-State Councils For Women Victims Of Gender Violence: A Case Study Of La Asociación Civil Corriente La Colectiva., Elizabeth Millar
Independent Study Project (ISP) Collection

Quem Ama Não Mata: Brazilian Feminicide And Odara’S Black Feminist Luta, Jair Oballe
Independent Study Project (ISP) Collection
This Community Development Project paper discusses my work with Odara, a black feminist organization within Salvador, Brazil. There, I spent one month studying different forms of gender-based violence, with a particular focus on feminicide. I also examined state response such as Lei Maria da Penha and Lei do Feminicídio, and how this legislation impacted violence from a qualitative perspective.
My studies are centered around news articles I read on various forms of violence within Bahia, which were then developed into a database that catalogues each incident based on a variety of categories. Additionally, I read a large assortment of books …

Evaluating Frameworks For Multilateral Investor-State Dispute Settlement, Danielle Rosenthal
Independent Study Project (ISP) Collection
Utilizing both empirical studies of investor-state dispute settlement (ISDS) regimes and the accounts of both public and private practitioners of these processes, this study aims to inform public policymakers, multinational corporation leadership, and academic researchers on some of the key issues to consider when developing a multilateral friendly ISDS regime. By analyzing the procedural and functional details of both traditional arbitration (via the International Centre for Settlement of Investment Disputes and the United Nations Commission on International Trade Law) and investment dispute courts (via those proposed in the Trans-Atlantic Trade and Investment Partnership and the EU Canada Comprehensive Economic and …
Professional Responsibility Of The Criminal Defense Lawyer Redux: The New Three Hardest Questions, Todd A. Berger
Professional Responsibility Of The Criminal Defense Lawyer Redux: The New Three Hardest Questions, Todd A. Berger
St. Mary's Journal on Legal Malpractice & Ethics
In 1966, Professor Monroe Freedman authored Professional Responsibility of the Criminal Defense Lawyer: The Three Hardest Questions, a work that occupies an important place in the cannon of legal ethics. Freedman believed that the three hardest questions facing a criminal defense attorney relate to whether it is ethical to discredit a truthful witness; whether it is proper to knowingly allow a client to testify falsely; and whether a lawyer may provide a client with legal advice when the lawyer suspects the client may use that advice to commit a crime. Beyond Freedman’s queries there are other important, yet largely unaddressed, …

Life After Daca: Immigration Reform In The Age Of Trump, Hasan Shafiqullah, Martin Batalla, Michael Wildes, Anthony Enriquez, Javeria Ahmed
Cardozo Journal of Equal Rights & Social Justice
The symposium examines the revocation of the Deferred Action for Childhood Arrivals (DACA) program by the Trump administration, its legal challenges, and the ongoing debate over immigration reform. It highlights the impact on approximately 900,000 DACA recipients and the lawsuits arguing the revocation was arbitrary, capricious, and motivated by racial discrimination. The analysis emphasizes the need for comprehensive immigration reform, advocating for a "clean" Dream Act to provide a pathway to citizenship without compromising the rights of other immigrants or increasing enforcement measures. The discussion also underscores the historical and cultural significance of immigration in the U.S., urging collective action …

Active And Public Transportation Connectivity Between North Temple Tod And Jordan Park River Trail, Ivis Garcia Zambrana, Christie Oostema
Active And Public Transportation Connectivity Between North Temple Tod And Jordan Park River Trail, Ivis Garcia Zambrana, Christie Oostema
TREC Final Reports
The project seeks to capitalize on existing community assets—several TOD stations and a regional bike and pedestrian trail system—by studying how these can be linked. The overarching goal of this project is to increase scholarship on networking safe routes that can encourage public and active transportation choices and thus, encourage a healthier lifestyle and advance sustainability. By expanding pedestrian, bicycle and transit connections to green space and offering the most potential for TOD, this proposal clearly demonstrates the greatest priorities of NITC. Moreover, nationwide, communities like Salt Lake’s West Side are in greater need of sustainable transportation choices that foster …

Brief Of The National Association For Public Defense As Amici Curiae Supporting Petitioner, Stein V. United States Of America (U.S. September 15, 2017) (No. 17-250)., Janet Moore
Faculty Articles and Other Publications
Petitioner’s case asks a basic but fundamental question: Will our criminal justice system permit convictions obtained through the knowing use of false testimony, simply because the prosecutor has not also suppressed evidence indicating the testimony was false? The Eleventh Circuit answered this question in the affirmative, but for decades this Court has known a very different justice system, one in which the knowing, uncorrected use of false testimony by the prosecutor could never be countenanced. And for good reason. As this Court has long recognized, the knowing use of false testimony is “as inconsistent with the rudimentary demands of justice …
