Tailoring Class Actions To The On-Demand Economy, Joseph Seiner

In O’Connor v. Uber Technologies, Inc., a federal district court permitted a class action case to proceed on the question of whether 160,000 drivers were misclassified by their employer as independent contractors rather than employees. The case has garnered widespread interest, making headlines across the country. Yet, it represents only one of many class action cases currently pending against technology companies in the modern economy. Indeed, similar systemic claims have already been brought against Yelp, GrubHub, Handy, CrowdFlower, Amazon, and many others.

The post World War II American Occupation of Japan was a huge programmatic success. Its disarmament, repatriation, land reform, and health programs put a defeated Japan on the road to recuperation, while providing a military shield that enabled Japan to focus on recovery from the War and rebuilding the country and economy. Perhaps its most enduring legacy was its Enlightenment-based, American-drafted, rights-oriented Constitution of 1947 [hereinafter “the Constitution”]. Drafted in English, the Constitution was promulgated in Japanese, resulting in some substantive changes. Among the most important of these were changing the English word “people” into the Japanese “kokumin” …

Health Professional Students As Providers Of Behavioral Health Services To Uninsured Immigrants, Juan Gabriel Rodriguez Guzman

Using the principles of lay counseling, health professional students were trained to deliver psychosocial educational interventions and administer substance use screenings to uninsured monolingual Spanish-speaking Latino immigrants with symptomatic depression and/or substance use disorders. Changes in depressive symptoms were assessed with the PHQ-9. Twenty-five patients enrolled in the lay counselor program for depression. PHQ-9 data were available from the 15 individuals who completed the program, among whom the mean baseline score was 11.7 (SD = 6.2) and mean final score was 4.6 (SD = 4.2) (p

Twenty years ago, President Clinton signed the Health Insurance Portability and Accountability Act of 1996 (HIPAA) into law. Over the past two decades, the federal Department of Health and Human Services (HHS) has published several sets of rules implementing the Administrative Simplification provisions within HIPAA as well as the Health Information Technology for Economic and Clinical (HITECH) Act within the American Recovery and Reinvestment Act (ARRA). Background: We aimed to investigate the impact of a referral-based intervention in a prospective cohort of women disclosing intimate partner violence (IPV) on the prevalence of violence, and associated outcomes psychosocial health, help-seeking and safety behaviour during and after pregnancy.

Methods: Women seeking antenatal care in eleven Belgian hospitals were consecutively invited from June 2010 to October 2012, to participate in a single-blind randomized controlled trial (RCT) and handed a questionnaire. Participants willing to be interviewed and reporting IPV victimisation were randomised. The experience of depression and overall well-being for multi-ethnic individuals is influenced by numerous factors including immigration experience, acculturative stress, English language proficiency, perceived discrimination, and ethnic identity. Multi-ethnic individuals are at a heightened risk for mental health difficulties due to limited access to resources within the community and mental health stigma. Lack of social support and culturally appropriate services magnify this disparity for this population. This study evaluates the impact of the Multi-ethnic Collaborative of Community Agencies (MECCA) Outreach & Engagement (O&E) program, a community-based program that provides culturally-responsive services, support, and resources for marginalized ethnic specific communities. Concentrating on Canadian experience, specifically litigation under the Canadian Charter of Rights and Freedoms (the ‘Charter’), this article seeks to reconcile the access to justice benefits of summary procedures with the government litigant’s duty to act in the public interest (or as a ‘model litigant’) and uphold the rule of law. Though acknowledging the benefits that can result from the use of summary procedures to end litigation, the authors observe that compliance with strict requirements in procedural law are frequently dispensed with in the Charter context. Queer Women's Sexual Experiences After Sexual Violence In A Non-Heterosexual Relationship, Amee Catalano

This quantitative study explores the sexual experiences of queer women after sexual violence perpetrated by a previous intimate partner in a non-heterosexual relationship. Sixty individuals identifying as queer women with a sexual violence experience completed an anonymous online survey consisting of questions related to help-seeking behaviors and sexual distress. The Female Sexual Distress Scale-Revised (FSDS-R) (Derogatis et al., 2008) was adapted to assess levels of sexual distress amongst the sample population.

This study found three themes: 1.) current sexual experiences carry anxiety and posttraumatic stress symptoms, 2.) sexual violence experience(s) as impacting libido, desire, and behavior, and 3.) current sexual …
