In Memoriam: Judge Miriam Goldman Cedarbaum, Gerard E. Lynch

Faculty Scholarship

I must confess that I don’t read law reviews. Of course, I read law review articles, in the course of judicial research and keeping in touch with academic literature in areas of my scholarly interest, but like most judges and lawyers, I don’t have time or interest to just pick up the latest issue of a law review and read it through. I do, however, regularly read the quarterly Ballet Review, a quasi-scholarly journal of reviews and articles about dance. Only once, in some twenty years of reading that publication, has it overlapped my legal interests. The Fall …

The Impact Of Small Group Intervention Focusing On Operations With Rational Numbers On Students’ Performance In The Florida Algebra I End-Of-Course Examination, Evelyn Dopico Jan 2017

The Impact Of Small Group Intervention Focusing On Operations With Rational Numbers On Students’ Performance In The Florida Algebra I End-Of-Course Examination, Evelyn Dopico

Theses and Dissertations

In Florida, passing the Algebra I end-of-course examination (EOCE) is a graduation requirement. The test measures knowledge of basic algebra. In spring 2015, the Department of Education introduced a different version of the test. For the first two administrations of the new test, the failure rate for 9th-grade students in the state was almost 50%. In contrast, the failure rate for students in the school where this study was implemented exceeded 70%. The purpose of this study was to determine the outcome of small group intervention focusing on operations with rational numbers of high school students’ performance on the Algebra …

Parent Beliefs, Attitudes, And Needs In Preschool Age Literacy Development In A Head Start Program, Dianna Jean Mccoy Jan 2017

Parent Beliefs, Attitudes, And Needs In Preschool Age Literacy Development In A Head Start Program, Dianna Jean Mccoy

Theses and Dissertations

The topic of this applied dissertation concerns parents from low socioeconomic status (SES) backgrounds participation in support of literacy development of their preschool aged children. Evidence from the limited research on this topic suggested that some parents rely on the school to teach literacy to their children beginning in kindergarten. Consequently, little time and effort is dedicated to preschool narrative skills, letter knowledge (other than the ABC song), print awareness, phonological awareness, print motivation, and vocabulary.

Literacy development begins before children enter kindergarten. Kindergarten teachers expect children to be able to identify letters, their sounds, print their names. Children without …

A Case Study Of Collaboration Between General Education Teachers And Special Education Teachers In A Southern Rural High School, Oassie Jean Daniels

Theses and Dissertations

This applied dissertation was framed around issues associated with the inclusion of students with disabilities in the general education classroom as these issues related to teacher collaboration. Specifically, the problem on which this study focused was that according to the principal at the research site, the general education teachers and special education teacher needed to collaborate more successfully in order to be more helpful to the students. The purpose of this case study was twofold. First, the researcher wished to determine how and to what extent collaboration practices occurred between general education teachers and special education teachers in a southern …

Self-Confidence In Moroccan Women: Understanding And Implications, Bethan Owen Jan 2017

Self-Confidence In Moroccan Women: Understanding And Implications, Bethan Owen

Student Research – Stevenson Center

This research seeks to explore the theory outlined in the article “Supplemental material for age and gender differences in self-esteem—A cross-cultural window,” which states that women in developing countries are more likely than women in developed countries to have high levels of self-confidence. An observational study was conducted by the author on 30 women in the town of Imouzzer Kandar, Morocco. Based on this very limited sample size, results suggest that these women do, generally, have high rates of self-confidence. Morocco-specific cultural influences are examined, as well as results found in other studies and the author’s personal experiences in the …

Internal Administrative Law, Gillian E. Metzger, Kevin M. Stack Jan 2017

Internal Administrative Law, Gillian E. Metzger, Kevin M. Stack

Faculty Scholarship

For years, administrative law has been identified as the external review of agency action, primarily by courts. Following in the footsteps of pioneering administrative law scholars, a growing body of recent scholarship has begun to attend to the role of internal norms and structures in controlling agency action. This Article offers a conceptual and historical account of these internal forces as internal administrative law. Internal administrative law consists of the internal directives, guidance, and organizational forms through which agencies structure the discretion of their employees and presidents control the workings of the executive branch. It is the critical means for …

Strategic Law Avoidance Using The Internet: A Short History, Tim Wu Jan 2017

Strategic Law Avoidance Using The Internet: A Short History, Tim Wu

Faculty Scholarship

We are now some twenty years into the story of the Internet's bold challenge to law and the legal system. In the early 2000s, Jack Goldsmith and I wrote Who Controls the Internet, a book that might be understood as a chronicle of some the early and more outlandish stages of the story. Professors Pollman and Barry's excellent article, Regulatory Entrepreneurship, adds to and updates that story with subsequent chapters and a sophisticated analysis of the strategies more recently employed to avoid law using the Internet in some way. While Pollman and Barry's article stands on its own, …

Faculty Scholarship

During the election on November 7, the voters in New York state will be presented with the allot question (as they are every 20 years), “Shall there be a convention to revise the constitutionand amend the same?” If the referendum passes, the delegates to the Constitutional Convention will be elected in November 2018, and the Convention’s proposed changes will appear on the ballot, most likely in November 2019.

Many issues are under debate: ethics reform, reorganizing the judiciary, voting rights, and several more. This column focuses on environmental rights.

Market Power And Inequality: The Antitrust Counterrevolution And Its Discontents, Lina M. Khan, Sandeep Vaheesan Jan 2017

Market Power And Inequality: The Antitrust Counterrevolution And Its Discontents, Lina M. Khan, Sandeep Vaheesan

Faculty Scholarship

In recent years, economic inequality has become a central topic of public debate in the United States and much of the developed world. The popularity of Thomas Piketty’s nearly 700-page tome, Capital in the Twenty-First Century, is a testament to this newfound focus on economic disparity. As top intellectuals, politicians, and public figures have come to recognize inequality as a major problem that must be addressed, they have offered a range of potential solutions. Frequently mentioned proposals include reforming the tax system, strengthening organized labor, revising international trade and investment agreements, and reducing the size of the financial sector.

Amazon's Antitrust Paradox, Lina M. Khan Jan 2017

Amazon's Antitrust Paradox, Lina M. Khan

Faculty Scholarship

Amazon is the titan of twenty-first century commerce. In addition to being a retailer, it is now a marketing platform, a delivery and logistics network, a payment service, a credit lender, an auction house, a major book publisher, a producer of television and films, a fashion designer, a hardware manufacturer, and a leading host of cloud server space. Although Amazon has clocked staggering growth, it generates meager profits, choosing to price below-cost and expand widely instead. Through this strategy, the company has positioned itself at the center of e-commerce and now serves as essential infrastructure for a host of other …

Social Bargaining In States And Cities: Toward A More Egalitarian And Democratic Workplace Law, Kate Andrias Jan 2017

Social Bargaining In States And Cities: Toward A More Egalitarian And Democratic Workplace Law, Kate Andrias

Faculty Scholarship

A well-documented problem motivates this symposium: The National Labor Relations Act (NLRA) does not effectively protect workers’ rights to organize, bargain, and strike. Though unions once represented a third of American workers, today the vast majority of workers are non-union and employed “at will.” The decline of organization among workers is a key factor contributing to the rise of economic and political inequality in American society. Yet reforming labor law at the federal level – at least in a progressive direction – is currently impossible. Meanwhile, broad preemption doctrine means that states and localities are significantly limited in their ability …

The View From My Window: The Roberts Court's First Amendment Symposium, Gregory P. Magarian Jan 2017

The View From My Window: The Roberts Court's First Amendment Symposium, Gregory P. Magarian

Scholarship@WashULaw

The experience of writing a book and then reading what some very smart and knowledgeable people have to say about the subject matter is humbling and a little dizzying. In Managed Speech: The Roberts Court's First Amendment, I try to make some sense of the present Supreme Court's decisions over the past decade about the First Amendment's protections for free expression.' The book argues that those decisions, taken as a whole, excessively constrain free speech within a particular managerial framework. Rather than helping speech to flourish in all its noisy, messy glory, the Roberts Court favors First Amendment claims from …

Evaluating The Attitudes Of Preservice Teachers Toward Multicultural Competence, Angela D. Marshall Jan 2017

Evaluating The Attitudes Of Preservice Teachers Toward Multicultural Competence, Angela D. Marshall

Theses and Dissertations

Changes in the ethnicity of the student population across the nation necessitated a change in teacher education curricula. This explanatory, sequential, mixed-method study examined how a group of preservice teachers viewed the importance of multicultural competence before and after student teaching. Specifically, an evaluation of preservice teachers’ attitudes about their own multicultural preparedness was made prior to and after being given full responsibility for an ethnically diverse classroom.

The study employed quantitative and qualitative measures to assess preservice teachers’ levels of multicultural competence as well as their awareness of self-perceptions of multicultural competence that contribute to attitudes toward teaching an …

The Acceptance And Commitment Therapy Matrix Mobile App: A Pilot Randomized Trial On Health Behaviors, Michael E. Levin, Benjamin G. Pierce, Benjamin Schoendorff

Psychology Faculty Publications

Mobile apps provide a promising format for delivering acceptance and commitment therapy (ACT) to improve diet/exercise. This pilot trial evaluated a novel ACT-based app for health behaviors based on the matrix approach. A sample of 23 community adults were randomly assigned to use the app for two weeks or to a waitlist condition. Findings indicated a high degree of satisfaction with the app and acceptable adherence. Although the intent-to-treat sample indicated few intervention effects, when focusing on program engagers only, health behaviors significantly improved in the app condition relative to waitlist. There were no differences between conditions on valued action …

Prediction Of Adverse Outcomes After Rt-Pa Treatment In Ischemic Stroke Patients, David Asuzu Jan 2017

Prediction Of Adverse Outcomes After Rt-Pa Treatment In Ischemic Stroke Patients, David Asuzu

Yale Medicine Thesis Digital Library

IV thrombolysis (rt-PA) for ischemic stroke treatment carries a substantial risk for symptomatic intracerebral hemorrhage (sICH) and adverse outcome. Our purpose was to develop a computationally simple and accurate clinical predictor of adverse outcome after rt-PA therapy.

Our derivation dataset consisted of 210 ischemic stroke patients receiving IV rt-PA from January 2009 until July 2013 at Yale New Haven Hospital. Our validation dataset included 303 patients who received IV rt-PA during the NINDS rt-PA trial. Predictive ability and goodness of fit were quantified by odds ratios (OR) and areas under the receiver operating characteristic curve (AUROC). Patient outcomes included sICH, …

Racial Disparities In Renal Cell Carcinoma: A Single Payer Healthcare Experience, Abiodun Mafolasire Jan 2017

Racial Disparities In Renal Cell Carcinoma: A Single Payer Healthcare Experience, Abiodun Mafolasire

Yale Medicine Thesis Digital Library

Introduction: Significant racial disparities in survival for renal cell carcinoma (RCC) exist between whites and blacks. Differences in access to care and comorbidities are possible contributors. To investigate if racial disparities persist when controlling for access to care, we analyzed data from a single payer healthcare system.

Methods: As part of a case-control study within the Kaiser Permanente Northern California system, pathologic and clinical records were obtained for RCC cases (2,152 white, 293 black) diagnosed from 1998 to 2008. Patient demographics, comorbidities, tumor characteristics, and treatment status were compared between whites and blacks. Overall survival and disease specific survival (DSS) …

The Application Of Small Molecule Inhibitors Of Ngr1 And Lpa1 Towards The Goal Of Neuroregeneration In The Central Nervous System, Hiam Naiditch Jan 2017

The Application Of Small Molecule Inhibitors Of Ngr1 And Lpa1 Towards The Goal Of Neuroregeneration In The Central Nervous System, Hiam Naiditch

Yale Medicine Thesis Digital Library

Disorders affecting the CNS are significantly disabling and often carry a poor prognosis of functional recovery. Pharmacotherapies that promote functional improvement via neuroregeneration have proven to be an elusive goal. Factors intrinsic to the neuronal microenvironment, particularly myelin-associated proteins such as Nogo-A, MAG, and OMgp, have been shown to be important in inhibiting such regeneration through neuronal NgR1. Additionally, LPA signaling through LPA1 has also shown to be important in inhibiting neuroregeneration through mechanisms that are currently being researched.

It has been previously shown that application of a NgR1 decoy receptor (AA-NgR(310)ecto-Fc) increases sprouting below the site of the lesion …

Longitudinal Assessment Of Blood Brain Barrier Disruption In Primary Hiv Infection And Effect Of Cart Therapy, Elham Rahimy Jan 2017

Longitudinal Assessment Of Blood Brain Barrier Disruption In Primary Hiv Infection And Effect Of Cart Therapy, Elham Rahimy

Yale Medicine Thesis Digital Library

Abnormal blood brain barrier (BBB) permeability has been implicated in the neuropathogenesis of chronic HIV infection. As neurocognitive impairment can persist despite effective combination antiretroviral therapy (cART), it is possible that irreversible central nervous system (CNS) processes are initiated in early infection, before cART is typically initiated. We analyzed the natural history of BBB permeability in primary HIV infection (PHI), and the effects of cART initiated during this period. CSF:Serum albumin quotient (QAlb), a marker of BBB permeability, was measured in longitudinal observational studies of PHI. We analyzed trajectories of QAlb pre- and post-cART using mixed-effects models, and associations between …

Prioritizing Primary Prevention Strategies For Cardiovascular Disease At The Clinic Population Level, Giulio Cesare Rottaro Castejon Jan 2017

Prioritizing Primary Prevention Strategies For Cardiovascular Disease At The Clinic Population Level, Giulio Cesare Rottaro Castejon

Yale Medicine Thesis Digital Library

Cardiovascular Disease remains the number one cause of mortality in the United States with atherosclerotic cardiovascular disease (ASCVD) being a major component. Lifestyle interventions remain the first line treatment for the prevention of ASCVD, and clinic- based interventions effectively improve rates of healthy lifestyle choices. However, these programs require additional resources and there is currently no guidance for clinic directors to understand what lifestyle intervention(s) have the highest value for their unique population. We propose a novel application of the 10-year ASCVD risk calculator to a clinic patient cohort, thereby acting as a tool for providers and administrators to develop …

PCOM Scholarly Works

Here, we review and discuss the records and taxonomy of the Ypresian (Eocene) chondrichthyans from the famous Bolca Konservat-Lagerstätte in northeastern Italy. Despite the outstanding diversity and the numerous studies focusing on the actinopterygian faunas from Pesciara and Monte Postale, the current knowledge about the systematics, taxonomy and phylogenetic relationships of the cartilaginous fishes from these Eocene sites remains elusive and largely inadequate. The celebrated Eocene Bolca Lagerstätte has yielded several exquisitely preserved articulated remains of chondrichthyan fishes in which delicate structures and soft tissues are preserved, as well as isolated teeth. The cartilaginous fish assemblage of Bolca comprises at …

PCOM Scholarly Works

The neopterygian fish Enchodus was a widespread, speciose genus consisting of approximately 30 recognized species that were temporally distributed from the late Early Cretaceous through the Paleocene. Many Enchodus specimens are fragmentary cranial remains or isolated dental elements, as is the case for previously reported occurrences in Egypt. Here, we present the most complete specimen of Enchodus recovered from the Late Cretaceous of northeast Africa. The specimen was collected from the upper Campanian Duwi Formation, near the village of Tineida (Dakhla Oasis, Western Desert, Egypt). The new species, Enchodus tineidae sp. nov., consists of right and left dentaries, a partial …

Critical Communication Pedagogy And Its Relationship To Time, Labor, And Capitalism, Yvet Youssef Jan 2017

Critical Communication Pedagogy And Its Relationship To Time, Labor, And Capitalism, Yvet Youssef

Research Papers

As a GTA working in a critically oriented Communication Studies department at Southern Illinois University, Carbondale, I am encouraged to be(come) an instructor whose teaching methods are steeped in the principles of critical pedagogy. One of the most inhibiting things I have come across as I have made attempts to uphold such principles of critical pedagogy is the issue of time.

This research report is about the problematic tension of trying to uphold a critical pedagogy in a system – a capitalist system – in which time is hard to come by. How can we perform an ethic of …

The Anticancer Effects Of The Different Analogs Of Cysteine Deleted Tachyplesin On A549 Lung Cancer Cells, Nathan Riley Hendrickson Jan 2017

The Anticancer Effects Of The Different Analogs Of Cysteine Deleted Tachyplesin On A549 Lung Cancer Cells, Nathan Riley Hendrickson

Master's Theses and Doctoral Dissertations

It has been previously shown that cysteine-deleted tachyplesin (CDT) and its many analogs display antibacterial effects. However, little has been said about its possible anticancer effects and which analogs serve as the best inhibitors of the growing cancer cells. This research focused on CDT and four of its analogs: All D-CDT, Reverse DCDT, Reverse CDT, and Serine-Control CDT. MTT assays against the A549 adenocarcinoma lung cancer cell line showed All D-CDT to be the most effective analog in preventing cancer cell growth. Hyaluronidase and apoptosis assays were performed to better understand the mechanism by which the All D-CDT is preventing …
