Arresting Narratives: Incommensurability, Policing, And Settler Security, Darcy H. Brazen
Arresting Narratives: Incommensurability, Policing, And Settler Security, Darcy H. Brazen
American Studies ETDs
Settler colonialism is interrogated through the practice of arrest. Case studies of arrests at Standing Rock validate the historical salience of settler colonialism as a structure enabling Indigenous elimination and settler replacement that is dependent upon arrest to maintain and enhance settler lives and the settler project through unfettered access to Native land and resources for capital accumulation. Arrest is analyzed in relationship to statehood initiatives, the procuring of settler security, frontier feminism, and road signage in the masculine zones of travel in 1930s North Dakota. Contemporaneous reports from Standing Rock, the memoirs of Elaine Goodale Eastman and newspaper articles …
Rethinking The Americans With Disabilities Act’S Insurance Safe Harbor, Valarie K. Blake
Rethinking The Americans With Disabilities Act’S Insurance Safe Harbor, Valarie K. Blake
Law Faculty Scholarship
Despite the importance of access to healthcare for the disabled, the Americans with Disabilities Act (ADA) has made little inroads in reducing disability-based discrimination by health insurers in the United States. One reason is undoubtedly the ADA’s insurance safe harbor, which explicitly permits insurers to discriminate on the basis of disability in health insurance so long as the differential treatment is supported by actuarial data and is not just intended to disadvantage the disabled. While the safe harbor’s harms are somewhat limited by the advent of the Affordable Care Act (ACA), they are not entirely neutralized. This article argues that …

Effects Of Global Warming On Work-Rest Routines For Crop Workers In Appalachia, Ken Silver, Ying Li, Emmanuel Odame, Yuqiang Zhang
ETSU Faculty Works
Background: Workers in outdoor occupations are expected to be at high risk of increased morbidity and mortality, and diminished productivity, as a result of global warming in the 21st century. A previous modelling study of geographic variations in heat-related mortality risk in projected U.S. populations mid-century showed the states of Tennessee, Kentucky and North Carolina to be highly vulnerable. Methods: Under both the RCP4.5 and RCP8.5 emissions scenarios of IPCC AR5, we evaluate the effect of future warming on estimated Wet Bulb Globe Thermometer (WBGT) temperatures using model-simulated future climate variables that were dynamically downscaled by a regional meteorology model …

Examining Limestone Use At Byrd Hammock South (8wa30), Wakulla County, Fl, Lucie R. Berryhill
Examining Limestone Use At Byrd Hammock South (8wa30), Wakulla County, Fl, Lucie R. Berryhill
LSU Master's Theses
In this thesis, I examine the limestone deposits identified at Byrd Hammock South during the Summer 2015 excavations conducted by Louisiana State University (LSU) and Florida State University (FSU). The site under investigation is the Byrd Hammock site (8WA30) in Wakulla County, Florida. Byrd Hammock is a multi-component site located only four miles north of the Gulf Coast and is close to other Swift Creek sites including Block-Sterns (8LE484) and Harrison Ring (8BY1359) (Russo, Hadden, and Dengel 2009). Like several other sites or site complexes on the Florida panhandle, Byrd Hammock has two large burial mounds that were placed on …

Virtual Clinical Trials: One Step Forward, Two Steps Back, Lori Andrews, Kayla Kostelecky, Stephanie Spritz, Alexandra Franco
Virtual Clinical Trials: One Step Forward, Two Steps Back, Lori Andrews, Kayla Kostelecky, Stephanie Spritz, Alexandra Franco
Journal of Health Care Law and Policy
Virtual clinical trials have entered the medical research landscape. Today’s clinical trials recruit subjects online, obtain informed consent online, send treatments such as medications or devices to the subjects’ homes, and require subjects to record their responses online. Virtual clinical trials could be a way to democratize clinical research and circumvent geographical limitations by allowing access to clinical research for people who live far from traditional medical research centers. But virtual clinical trials also depart dramatically from traditional medical research studies in ways that can harm individuals and the public at large. This article addresses the issues presented by virtual …

Measuring The Impact Of Patient-Engaged Research: How A Methods Workshop Identified Critical Outcomes Of Research Engagement, Ellis C. Dillon, Leah Tuzzio, Sarah Madrid, Heather Olden, Robert T. Greenlee
Journal of Patient-Centered Research and Reviews
Purpose: While strategies to evaluate the influence of engaging patient partners in research, such as the Patient-Centered Outcomes Research Institute (PCORI) WE-ENACT surveys, are beginning to emerge, a systematic set of measures for assessing the impact of patient engagement in research (PER) on study approaches and outcomes is lacking. This article describes a workshop and process used to identify and develop Critical Outcomes of Research Engagement (COREs). It proposes preliminary measures for assessing the impact of PER on the research process and outcomes of research studies.
Methods: A group of 24 researchers and 5 patient partners participated in a PCORI-funded …
The Almost Great Escape: The Continuing Tourism Development Of Croatia As A Destination, Jennifer N. Wohlgamuth
The Almost Great Escape: The Continuing Tourism Development Of Croatia As A Destination, Jennifer N. Wohlgamuth
International ResearchScape Journal
The tourism industry in Croatia is experiencing a slower development than other European countries. Because of their current union in the communist state of Yugoslavia and the Civil War between Croatia, Serbia, and Bosnia-Herzegovina, the Croatian Tourism Board needs to recreate a stable infrastructure in which to grow their tourism. Some of the occurring issues with current Croatian tourism is high seasonality, lack of multiple foreign languages, underdeveloped transportation structures, and homogenization of Croatian culture. This paper offers a brief history of Croatian tourism, current developments, current development issues, and suggestions for a change in managerial structure to increase the …

Pathogenicity And Reproduction Of Isolates Of Reniform Nematode, Rotylenchulus Reniformis, From Louisiana On Soybean And Utility Of Single Nucleotide Polymorphisms To Evaluate Genetic Variability, Herath Mudiyanselage Kularathna
LSU Doctoral Dissertations
Experiments were conducted to evaluate soybean, Glycine max (L.) Merr., responses to indigenous isolates of the reniform nematode (Rotylenchulus reniformis) in Louisiana and to understand the genetic variability of these native isolates. Microplot and greenhouse experiments were conducted to evaluate the comparative reproduction and pathogenicity of single egg-mass populations of R. reniformis isolated from West Carroll (WC), Rapides, Tensas and Morehouse (MOR) parishes of Louisiana. Data from full-season microplot trials, displayed significant differences in reproduction and pathogenicity of the nematode with the commercial soybean cultivars REV 56R63, Pioneer P54T94R, and Dyna-Gro 39RY57. Significantly low population density was observed …

The Illegal Trade Of Electronic And Electrical Waste: Should Weee Pay To Avoid The Environmental And Public Health Costs? The Case Of The United Kingdom, Abderrahim Assab, Alexandra Imirziadis, Laura Heintzman, Astrid Rahardjo
The Journal of International Relations, Peace Studies, and Development
The electrical and electronic waste generated by consumers in developed economies is often illegally exported to countries such as India, Ghana, or Nigeria, where it is inadequately treated in ways that harm local populations. A number of developed economies have constituted legislation to address current increases in electronic waste. The European Union and the United Kingdom (UK) have, for example, adopted the Waste Electrical and Electronic Equipment (WEEE) Directive. Despite this Directive, there are still significant environmental and health impacts experienced in the aforementioned recipient countries. Different approaches to address this problem are apparent; though, each approach comes with significant …
1881 - History Of The State Of California From The Period Of The Conquest By Spain To Her Occupation By The United States, John Frost
Miscellaneous Documents and Reports
Originally published in 1851 without the Appendix and with a chapter on the natural history of California, this 1881 edition covers the entire pre-United States history of California in pages 7 through 36. The remainder of the book focuses on California history following 1847 through 1853 (pages 36 through 300) with a significant emphasis on gold, mining, agriculture and other resources; the formation of the state government; routes to California; the Californians; and California Indians. This later edition excluded the natural history chapter and added a new one concerning events in California from its admission into the United States to …

Human-Environment Interactions: Sea-Level Rise And Marine Resource Use At Eleanor Betty, An Underwater Maya Salt Work, Belize, Valerie Renae Feathers
Human-Environment Interactions: Sea-Level Rise And Marine Resource Use At Eleanor Betty, An Underwater Maya Salt Work, Belize, Valerie Renae Feathers
LSU Doctoral Dissertations
Dissertation excavations were performed in the spring of 2013 at the underwater site of Eleanor Betty in Paynes Creek National Park, Belize. The marine environment preserved wooden architecture associated with the salt works. Excavation goals included: 1) excavating and defining the boundaries of the submerged shell midden; 2) collecting sediment samples for paleoenvironmental analyses; and 3) recovering cultural remains to determine the site’s purpose (residence versus production workshop).
Four transects were added to the existing transect from excavations performed during the 2011 field season. The shell midden measured 5 meters in length (north-to-south throughout all transects) by 0.5-to-1 meters in …
Alexis De Tocqueville And American Constitutional Law: On Democracy, The Majority Will, Individual Rights, Federalism, Religion, Civic Associations And Originalist Constitutional Theory, Philip C. Kissam
Maine Law Review
Count Alexis de Tocqueville's Democracy in America has been said to be "at once the best book ever written on democracy and the best book ever written on America. " This praise should perhaps be tempered by consideration of Tocqueville' s purposes and the historical circumstances within which he worked and understood both democracy and America. Yet Tocqueville's insights into American democracy as of the 1830s undoubtedly constitute a rich source of constitutional thought-either as support for particular constitutional principles or as constitutional ideas that should be contested. In a recent notable instance, John McGinnis has argued that Tocqueville's ideas …
