Copyright And Distributive Justice, Justin Hughes, Robert P. Merges Feb 2017

Copyright And Distributive Justice, Justin Hughes, Robert P. Merges

Notre Dame Law Review

Is our copyright system basically fair? Does it exacerbate or ameliorate

the skewed distribution of wealth in our society? Does it do anything at all

for disempowered people, people at the bottom of the socio-economic hierarchy?

In this Article we engage these questions. Our goal is to begin a more

comprehensive discussion of the effect the copyright system has on the allocation

of wealth in our society.

Spatial Clustering And Ecological Crowding Of Valley Oak (Quercus Lobata, Née) Associated With Shifts In Recruitment Establishment Sites In Southern California, James J. Hayes, Shannon Donnelly Feb 2017

Spatial Clustering And Ecological Crowding Of Valley Oak (Quercus Lobata, Née) Associated With Shifts In Recruitment Establishment Sites In Southern California, James J. Hayes, Shannon Donnelly

Geography and Geology Faculty Publications

Premise of research. Valley oak (Quercus lobata, Née) has received much attention due to concerns about regeneration failure and, more recently, compositional and structural community changes associated with this foundation species. Changes in the structure and spatial distribution of valley oak stands, as examined in this article, are likely affecting ecological processes and interactions throughout communities where it is found.

Methodology. We used quadrat-based methods of spatial analysis, Morisita’s index of aggregation (IM), and a derived index (IMr ) to examine patterns of clustering, intensity of crowding, and changes in the probability of crowding as the definition of crowding (stems/area) …

The Story Pastor: A Faithful And Fruitful Identity For Pastors, Jordan Rimmer Feb 2017

The Story Pastor: A Faithful And Fruitful Identity For Pastors, Jordan Rimmer

Doctor of Ministry

Pastors are experiencing an identity crisis. Many are not sure how to process who they are and what they do. While old metaphors for ministry—like shepherd or prophet— do not connect as well with today’s culture, new metaphors—like leader or counselor— are not biblically complete. This identity crisis negatively affecting clergy health and ministry. How can pastors pursue sustainable ministries, based on an identity, that is faithful to the tradition and fruitful in the world today?

Story is a paradigm for ministry that shapes pastoral identity. Pastors benefit from thinking of their ministry in terms of story because it is …

GSCE Faculty Publications

Background: Early indication of an emerging malaria epidemic can provide an opportunity for proactive interventions. Challenges to the identification of nascent malaria epidemics include obtaining recent epidemiological surveillance data, spatially and temporally harmonizing this information with timely data on environmental precursors, applying models for early detection and early warning, and communicating results to public health officials. Automated web-based informatics systems can provide a solution to these problems, but their implementation in real-world settings has been limited.
Methods: The Epidemic Prognosis Incorporating Disease and Environmental Monitoring for Integrated Assessment (EPIDEMIA) computer system was designed and implemented to integrate disease surveillance with …

How Do Schools Affect Ethnic Saliency Levels Of Students In Bosnia And Herzegovina, Matthew Thomas Becker Feb 2017

How Do Schools Affect Ethnic Saliency Levels Of Students In Bosnia And Herzegovina, Matthew Thomas Becker

Faculty and Student Publications

This article measures the role of schools in the ethnic socialization and identity formation processes of high school seniors in Bosnia and Herzegovina (BiH) via ordinary least squares regression analysis and attempts to contribute to a better understanding of educational transitions in the postsocialist space and youth identity formation in a postconflict society. BiH has three ethnonational curricula (Bosniak, Croat, and Serb), each with an ethnocentric focus. Although nationality and school curricula are highly correlated in BiH, in the case of the Serbs, it was found that students who do not study the “appropriate” Serbian curriculum experienced a statistically significant …

Feasibility In Applying Agile Project Management Methodologies To Building Design And Construction Industry, Roy S. Moriel Feb 2017

Feasibility In Applying Agile Project Management Methodologies To Building Design And Construction Industry, Roy S. Moriel

Dissertations and Theses

During the past few decades, fundamental changes have taken place in project development, planning, and execution. This has taken form with embracing new techniques such as various agile project management methodologies to develop products, instead of using the traditional waterfall project management methodology commonly used today. Using agile has been very successful as a large portion of the IT world has integrated it within their companies. Unfortunately, professional fields such as the building design and construction industry have remained mostly with the traditional methods impacting the projects in terms of cost, scheduling, and other project elements that can benefit from …

Economic Impacts Of Electric Vehicle Adoption, Florida Solar Energy Center, Makena Coffman Feb 2017

Economic Impacts Of Electric Vehicle Adoption, Florida Solar Energy Center, Makena Coffman

FSEC Energy Research Center®

The objective of the Economic Impacts of Electric Vehicle Adoption research project was to examine the predicted levels of electric vehicle (EV) adoption, to analyze the life cycle costs of EVs compared to internal combustion engine vehicles and to evaluate EV impacts on GHG emissions for Hawaii. The results were presented in three publications. The first report evaluated EV penetration rates and provided an assessment of expected EV penetration over time. The research also assessed factors that affect EVs adoption, including regulatory mechanisms. The results estimated there will be 140,000 EVs on the road in Hawaii by the year 2040 …

Identifying The Anthropological In A Mixed- Methods Study Of Transnational Students In Mexican Schools, Edmund T. Hamann, Victor Zuniga, Juan Sánchez García Feb 2017

Identifying The Anthropological In A Mixed- Methods Study Of Transnational Students In Mexican Schools, Edmund T. Hamann, Victor Zuniga, Juan Sánchez García

Department of Teaching, Learning, and Teacher Education: Faculty Publications

Identifying surveying as more commonly sociological and semistructured interviewing as more commonly anthropological, which describes disciplinary histories more than any fixed formulas, we juxtapose transnational students’ survey answers collected in Mexican schools with their answers to interviewers several months later. From this, we consider what can be learned about research methodology and transnational student cosmology when different methods yield discrepant answers. Without claiming superiority for either mechanism, we find their combination illuminating, and it substantiates the claim that anthropological inquiry can add crucial value to mixed-methods, interdisciplinary inquiry.

Changes In The World Of Small Community Banks, Greg Mckee Feb 2017

Changes In The World Of Small Community Banks, Greg Mckee

Cornhusker Economics

Community banks hold a traditional position in financial intermediation. These provide banking services to customers, consumers and small businesses, all within “local” proximity to the bank. They’re also more likely to be privately owned than much larger banks. Local ownership provides a strong incentive to management to balance stakeholder concerns relative to the demands of capital markets. Community banks are categorized, based on asset size, by the Federal Deposit Insurance Corporation as having $10 billion, or less, in assets.

Small community banks, those with $1 billion or less in assets, are most likely to retain the original community bank conceptual …

Predictability Of Helminth Parasite Host Range Using Information On Geography, Host Traits And Parasite Community Structure, Tad Dallas, Andrew W. Park, John M. Drake Feb 2017

Predictability Of Helminth Parasite Host Range Using Information On Geography, Host Traits And Parasite Community Structure, Tad Dallas, Andrew W. Park, John M. Drake

Faculty Publications

© Cambridge University Press 2016. Host-parasite associations are complex interactions dependent on aspects of hosts (e.g. traits, phylogeny or coevolutionary history), parasites (e.g. traits and parasite interactions) and geography (e.g. latitude). Predicting the permissive host set or the subset of the host community that a parasite can infect is a central goal of parasite ecology. Here we develop models that accurately predict the permissive host set of 562 helminth parasites in five different parasite taxonomic groups. We developed predictive models using host traits, host taxonomy, geographic covariates, and parasite community composition, finding that models trained on parasite community variables were …

Global Collateral: How Financial Innovation Drives Capital Flows And Increases Financial Instability, Ana Fostel, John Geanakoplos, Gregory Phelan Feb 2017

Global Collateral: How Financial Innovation Drives Capital Flows And Increases Financial Instability, Ana Fostel, John Geanakoplos, Gregory Phelan

Cowles Foundation Discussion Papers

We show that cross-border financial flows arise when countries differ in their abilities to use assets as collateral. Financial integration is a way of sharing scarce collateral. The ability of one country to leverage and tranche assets provides attractive financial contracts to investors in the other country, and general equilibrium effects on prices create opportunities for investors in the financially advanced country to invest abroad. Foreign demand for collateral and for collateral-backed financial promises increases the collateral value of domestic assets, and cheap foreign assets provide attractive returns to investors who do not demand collateral to issue promises. Gross global …

Zone Pricing In Retail Oligopoly, Brian Adams, Kevin R. Williams Feb 2017

Zone Pricing In Retail Oligopoly, Brian Adams, Kevin R. Williams

Cowles Foundation Discussion Papers

We quantify the welfare effects of zone pricing, or setting common prices across distinct markets, in retail oligopoly. Although monopolists can only increase profits by price discriminating, this need not be true when firms face competition. With novel data covering the retail home improvement industry, we find that Home Depot would benefit from finer pricing but that Lowe’s would prefer coarser pricing. The use of zone pricing softens competition in markets where firms compete, but it shields consumers from higher prices in markets where firms might otherwise exercise market power. Overall, zone pricing produces higher consumer surplus than finer pricing …

Approaching Cyber Warfare: Geopolitics, Deterrence, And International Law, Emily Bordelon Feb 2017

Approaching Cyber Warfare: Geopolitics, Deterrence, And International Law, Emily Bordelon

Senior Honors Theses

The increased use of cyber warfare, accomplished by both state and non-state actors, raises questions about traditional approaches to security and what can be done to stop threats in a technology-driven society. This thesis analyzes how cyber actions interact with geopolitics and how that relationship can provide a foundation for states to approach creating a cyber security strategy. Specifically, there should be a strategy of deterrence and then an international system of norms and laws. The first part of this thesis will address the connections between cyberspace and geography. It will then lay out the strategy of deterrence and how …

Asymptotic Properties Of Spatial Scan Statistics Under The Alternative Hypotheses, Tonglin Zhang, Ge Lin Feb 2017

Asymptotic Properties Of Spatial Scan Statistics Under The Alternative Hypotheses, Tonglin Zhang, Ge Lin

Environmental & Global Health Faculty Research

A common challenge for most spatial cluster detection methods is the lack of asymptotic properties to support their validity. As the spatial scan test is the most often used cluster detection method, we investigate two important properties in the method: the consistency and asymptotic local efficiency. We address the consistency by showing that the detected cluster converges to the true cluster in probability. We address the asymptotic local efficiency by showing that the spatial scan statistic asymptotically converges to the square of the maximum of a Gaussian random field, where the mean and covariance functions of the Gaussian random field …
