Authorizing Illicit Intimacies: Filipina–Gi Interracial Relations In The Postwar Philippines, Stephanie Fajardo Nov 2017

Authorizing Illicit Intimacies: Filipina–Gi Interracial Relations In The Postwar Philippines, Stephanie Fajardo

Philippine Studies: Historical and Ethnographic Viewpoints

Intimate relations between American servicemen (GIs) and Filipina women increased visibly following the Second World War in the Philippines. As interactions became routine, women who developed close interpersonal relationships with GIs became associated with vice and loose morals. Thisarticle analyzes the multiple forces that maintained such associations, including the US military and local government’s interconnected forms of intimate management and Philippine cultural productions’ contradictory depictions of Filipino–American intimacies. It argues that the “bar system,” which arose from businesses exploiting sexual labor, the legal system combating prostitution, and health initiatives seeking to eradicate venereal disease, effectively authorized illicit intimacies. Keywords: US military …

What Divides The Parties? Just About Everything 11/29/17, Unh Survey Center

All UNH Survey Center Polls

Most New Hampshire residents believe good diplomacy is the best way to ensure peace in the world and the U.S. is among the greatest countries in the world. Granite Staters see the U.S. economy as unfairly favoring powerful interests and generally favor government regulation of businesses and Wall Street, but a plurality also say government is almost always wasteful and inefficient. Residents express high levels of confidence in the military, the police, and the Supreme Court, but low levels of confidence in the presidency, newspapers, television news and Congress.

The Body Mass Index Of San Francisco Cold Water Swimmers - Comparisons To U.S. National And Local Populations, And Pool Swimmers, Brendan T. Crow, Ellicott C. Matthay, Stephen P. Schatz, Mark D. Debeliso, Thomas J. Nuckton

International Journal of Exercise Science

International Journal of Exercise Science 10(8): 1250-1262, 2017. To determine if cold-water swimmers have substantial differences in BMI, which might have a protective effect against heat loss during swims in cold water without wetsuits, and to determine if obesity is more or less prevalent in cold-water swimmers, we compared the body mass index (BMI) values of 103 recreational open-water swimmers (mean age 54.3 ±10.8 years) to data from various population groups. Swimmers swam consistently throughout the winter months, in the San Francisco Bay (water temperature range: 9.6° C [49.3 ° F] to 12.6° C [54.7 ° F]), without wetsuits. After …

Property Tax: A Primer And A Modest Proposal For Maine, Clifford H. Goodall, Seth A. Goodall Nov 2017

Property Tax: A Primer And A Modest Proposal For Maine, Clifford H. Goodall, Seth A. Goodall

Maine Law Review

Property taxation has been viewed for years as the perfect “dragon to be slain” and by most “as both bad and doomed.” In spite of being one of the most commonly questioned and scrutinized issues by voters and politicians, property taxation survives as the primary revenue source for local governments. Maine's experience is an example of this continuing debate. The 2005 reform attempt by the Legislature known as LD 1 is the most recent example. Municipal over-dependence on the property tax, rising property values, unfunded state mandates, loss of federal revenues, and increased spending has significantly increased the percentage of …

Who's Afraid Of Judicial Activism? Reconceptualizing A Traditional Paradigm In The Context Of Specialized Domestic Violence Court Programs, Jennifer L. Thompson Nov 2017

Who's Afraid Of Judicial Activism? Reconceptualizing A Traditional Paradigm In The Context Of Specialized Domestic Violence Court Programs, Jennifer L. Thompson

Maine Law Review

The Specialized Domestic Violence Pilot Project (Pilot Project), implemented in York and Portland in July and August 2002, is the result of the collaborative efforts of the District Court system, law enforcement, prosecutors, members of the defense bar, and various community agencies offering services to victims and perpetrators. District court judges are largely responsible for overseeing the changes in court procedures and implementing the new protocols in domestic violence cases. The Pilot Project, and the changes it is making to the role that courts play in domestic violence cases, represents a significant departure from the procedures followed by traditional court …

The False Idolarty Of Rules-Based Law, John C. Sheldon Nov 2017

The False Idolarty Of Rules-Based Law, John C. Sheldon

Maine Law Review

When the Supreme Court outlawed segregation in public schools in 1954, it acknowledged this social truth: assigning separate public facilities to separate classes of people fosters inequality among those classes. Although Brown v. Board of Education of Topeka addressed only educational facilities, the Court quickly broadened the scope of its decision, applying it to racial discrimination in or at public beaches, buses, golf courses, parks, municipal airport restaurants and state courtrooms. And although Brown addressed only racial discrimination, it quickly became the basis for condemning many forms of discrimination, including race, religion, wealth, gender, age, and disability. What gave Brown …

Irlafarc! Surveying The Language Of Legal Writing, Terrill Pollman, Judith M. Stinson Nov 2017

Irlafarc! Surveying The Language Of Legal Writing, Terrill Pollman, Judith M. Stinson

Maine Law Review

Language, like law, is a living thing. It grows and changes. It both reflects and shapes the communities that use it. The language of the community of legal writing professors demonstrates this process. Legal writing professors, who stand at the heart of an emerging discipline in the legal academy, are creating new terms, or neologisms, as they struggle to articulate principles of legal analysis, organizational paradigms conventional to legal writing, and other legal writing concepts. This new vocabulary can be both beneficial and detrimental. It can be beneficial because it expands the substance of an emerging discipline. It also can …

Consumer Class Actions: Who Are The Real Winners?, Edward F. Sherman Nov 2017

Consumer Class Actions: Who Are The Real Winners?, Edward F. Sherman

Maine Law Review

The class action is one of the most controversial procedural devices in the American legal system. In the years since an expanded class action rule was adopted in 1966, class actions have grown in scope and number, and suits by consumers have accounted for an increasing share of class actions suits. By allowing individuals to sue not only for themselves, but also on behalf of others similarly situated, the class action “empowers plaintiffs to bring cases that otherwise either would not be possible or would only be possible in a very different form.” Business critics see this as enabling “lawyers …

The Use Of The 3/2/1 Technique To Foster Students' Speaking Fluency, Mireya Molina, Mark Briesmaster Nov 2017

The Use Of The 3/2/1 Technique To Foster Students' Speaking Fluency, Mireya Molina, Mark Briesmaster

i.e.: inquiry in education

For English as Foreign Language learners (EFL), fluency is one of the most difficult aspects to develop within the speaking skill. The Chilean teaching context has witnessed a gradual shift from the more traditional grammar-translation approach to a more communicative one, so it has become necessary to discover new strategies to develop students’ speaking skills. This action research was conducted in a technical university in Chile and it investigated how the use of the 3/2/1 technique influenced students’ speaking fluency. The data was collected under a quantitative and qualitative design; the quantitative data was taken from audio recordings which were …

“I Didn’T Know Anything About It”: Critical Pedagogy, Cultural Literacy, And (Missed?) Opportunities For Praxis, Erin N. Cue, Zachary A. Casey Nov 2017

“I Didn’T Know Anything About It”: Critical Pedagogy, Cultural Literacy, And (Missed?) Opportunities For Praxis, Erin N. Cue, Zachary A. Casey

i.e.: inquiry in education

This study seeks to theorize and contextualize what happened in an undergraduate senior capstone course focusing on cultural literacy and critical pedagogy. Through our analysis and critical dialogue we came to recognize that while each cultural literacy circle reported positive outcomes, and positive feelings from group members about how they felt participating in the circles, only one group took action in a material way meant to explicitly combat oppression. Nearly every group talked about oppression and the struggle for justice, but ultimately their work remained at the level of discourse. They thought about oppression, talked and read about oppression, but …

Gesture And Signing In Support Of Expressive Language Development, Leslie K. Baker-Ramos Nov 2017

Gesture And Signing In Support Of Expressive Language Development, Leslie K. Baker-Ramos

i.e.: inquiry in education

The purpose of this teacher inquiry is to explore the effects of signing and gesturing on the expressive language development of non-verbal children. The first phase of my inquiry begins with the observations of several non-verbal students with various etiologies in three different educational settings. The focus of these observations is to identify current sign and gesture usage and determine the students' abilities to acquire signed language as as additional form of expression and whether or not there is potential value in that acquisition. I also want to explore any differences in signed language acquisition between children with Downs Syndrome …

Liar, Liar, Retaliation Claim On Fire: Egei V. Johnson: Protecting An Employee’S Right To Dishonesty (White Paper), Sarah Applegate Nov 2017

Liar, Liar, Retaliation Claim On Fire: Egei V. Johnson: Protecting An Employee’S Right To Dishonesty (White Paper), Sarah Applegate

Nebraska Law Bulletin (Selected Issues)

The United States District Court for the District of Columbia incorrectly held that an employee who lies during a Title VII proceeding is protected from retaliation on the basis of his or her lies. A better approach to Title VII participation matters is to impose a requirement that the participation be in good faith with the burden on the employer to prove with clear and convincing evidence that the employee’s participation was bad faith. This approach follows the holdings of the 7th Circuit, imposing a good faith requirement on participation clause matters. However, the 7th Circuit also imposes a reasonableness …
