Comment On "Error And Regulatory Risk In Financial Institution Regulation", Keith N. Hylton Jan 2017

Comment On "Error And Regulatory Risk In Financial Institution Regulation", Keith N. Hylton

Faculty Scholarship

I agree with just about everything Jonathan Macey (2017) says in his symposium contribution. His claim that bureaucratic tendencies toward regularity—specifically, treating like cases alike—generate errors in categorization seems appropriate to me. His explanations of the pathologies in financial regulation should fall in the category of essential or required reading for anyone who chooses to write on the topic. Where I differ from Macey is in the choice of framework, or perspective from which to view the pathologies. Whereas Macey adopts an “error cost” framework, which is clearly appropriate for this symposium, I would build explicitly on a “public choice” …

Accurate simulation of extreme precipitation events remains a challenge in climate models. This study utilizes hourly precipitation data from ground stations and satellite instruments to evaluate rainfall characteristics simulated by the NASA-Unified Weather Research and Forecasting (NU-WRF) regional climate model at horizontal resolutions of 4, 12, and 24 km over the Great Plains of the United States. We also examined the sensitivity of the simulated precipitation to different spectral nudging approaches and the cumulus parameterizations. The rainfall characteristics in the observations and simulations were defined as an hourly diurnal cycle of precipitation and a joint probability distribution function (JPDF) between …

Late Precontact Settlement On The Northern Seward Peninsula Coast: Results Of Recent Fieldwork, Shelby L. Anderson, Justin Andrew Junge Jan 2017

Late Precontact Settlement On The Northern Seward Peninsula Coast: Results Of Recent Fieldwork, Shelby L. Anderson, Justin Andrew Junge

Anthropology Faculty Publications and Presentations

Changing Arctic settlement patterns are associated with shifts in socioeconomic organization and interaction at both the inter- and intraregional levels; analysis of Arctic settlement patterns can inform research on the emergence and spread of Arctic maritime adaptations. Changes in late precontact settlement patterns in Northwest Alaska suggest significant shifts in subsistence and/or social organization, but the patterns themselves are not well understood. Prior research around Kotzebue Sound suggests three possible scenarios: (1) population decrease and dispersion from settlement centers after 550 cal bp, (2) population stability and dispersion after 550 cal bp, and (3) different settlement patterns in the northern …

R. V. Safarzadeh-Markhali: Elements And Implications Of The Supreme Court's New Rigorous Approach To Construction Of Statutory Purpose, Marcus Moore Jan 2017

R. V. Safarzadeh-Markhali: Elements And Implications Of The Supreme Court's New Rigorous Approach To Construction Of Statutory Purpose, Marcus Moore

All Faculty Publications

The Supreme Court of Canada’s decision in Safarzadeh-Markhali holds great significance, beyond Criminal Law, in the area of Statutory Interpretation: in Markhali, the Court decisively endorses a new rigorous approach to construing legislative purpose. Previously, while legislation itself was long-interpreted utilizing rigorous approaches, legislative purpose was typically construed ad hoc while providing only summary justification. Markhali’s new framework is distinct from prior approaches in at least four ways: (1) It expressly acknowledges the critical importance of purpose construction in many cases; (2) It is conscious of how a less-than-rigorous approach risks being self-defeating of larger legal analyses in which the …

Property And Sovereignty: An Indian Reserve And A Canadian City, Douglas C. Harris Jan 2017

Property And Sovereignty: An Indian Reserve And A Canadian City, Douglas C. Harris

All Faculty Publications

Property rights, wrote Morris Cohen in 1927, are delegations of sovereign power. They are created by the state and operate to establish limits on its power. As such, the allocation of property rights is an exercise of sovereignty and a limited delegation of it. Sixty years later, Joseph Singer used Cohen’s conceptual framing in a critical review of developments in American Indian law. Where the US Supreme Court had the opportunity to label an American Indian interest as either a sovereign interest or a property interest, he argued, it invariably chose to the disadvantage of the Indians. Within Canada, Indigenous …

The Frequency Of Texting On Middle School Students' Writing Achievement, Jennifer French Jan 2017

The Frequency Of Texting On Middle School Students' Writing Achievement, Jennifer French

Doctoral Dissertations and Projects

The purpose of this correlational study was to discover the impact of texting on writing achievement for middle school students. The theory guiding this study is Vygotsky’s Social Cognitive Theory (Newman & Holzman, 2013) as it explains that learning is influenced by one’s social environment. The data that will be collected consists of the scores of the writing portion of the 2014-2015 state standardized test (ISTEP), a student survey answering questions about texting practices, and student status information on Free and Reduced Meals. The multiple regression analysis will be used to analyze this data because as inferential statistics it can …

This study adds the descriptor heterogeneous to FTNTT faculty members’ job roles, work environments, daily engagements, and work experiences and contradicts existing literature that finds FTNTT faculty positions to be resource deficit and administratively non-supporting. …

By Need And By Name: School Leaders Fostering Environments For Grandparents Raising Grandchildren, Rebecca G. Roach Jan 2017

By Need And By Name: School Leaders Fostering Environments For Grandparents Raising Grandchildren, Rebecca G. Roach

Theses and Dissertations--Education Sciences

Children raised by their grandparents are a steadily growing demographic in schools throughout the United States. When parents are unable to care for their children, grandparents sometimes assume the role of primary caregiver. This is especially true when they are faced with the threat of placing their grandchildren in the foster care system. More often than not, these grandparents are not adequately prepared for the challenges of raising children who have lost their parent through death, drug abuse or incarceration and few resources exist to guide elementary school principals to engage this demographic. Regardless of the growing numbers of caregiving …

"A World To Suit Themselves": Student-Constructed Narratives And The Hidden History Of College Life, David M. Brown Jan 2017

"A World To Suit Themselves": Student-Constructed Narratives And The Hidden History Of College Life, David M. Brown

Theses and Dissertations--Educational Policy Studies and Evaluation

An individual’s years in college are a time of trial and transformation. This dissertation examined college students’ self-created accounts of their time in college in order to identify students’ significant meaning-making activities during those years. Four primary areas of student life were investigated: the rules that students were expected to adhere to, the ways in which students and their class cohorts antagonized one another, hazing, and class competitions.

A comparative historical approach was used to analyze student-created accounts of college life in the years 1871-1941. Archival research at a geographically diverse sample of fourteen colleges and universities provided primary source …

Do Intercollegiate Athletics Subsidies Correlate With Educational Spending? An Empirical Study Of Public Division-I Colleges And Universities, Michael J. Rudolph Jan 2017

Do Intercollegiate Athletics Subsidies Correlate With Educational Spending? An Empirical Study Of Public Division-I Colleges And Universities, Michael J. Rudolph

Theses and Dissertations--Educational Policy Studies and Evaluation

Intercollegiate athletics are a prominent feature of American higher education. They have been characterized as the “front door” to the university due to their unique ability to draw alumni and other supporters to campus. It is often supposed that the exposure from high-profile athletics produces a number of indirect benefits including greater institutional prestige. Such exposure comes at a cost, however, as most Division I athletics programs are not financially self-sufficient and receive institutional subsidies to balance their budgets. At present, it is unclear how institutions budget for athletics subsidies or whether the recent increases in subsidies have impacted the …

Lost Esi Under The Federal Rules Of Civil Procedure, Jeffrey A. Parness Jan 2017

Lost Esi Under The Federal Rules Of Civil Procedure, Jeffrey A. Parness

Faculty Articles, Papers, and Other Scholarship

In 2006, Federal Rule of Civil Procedure (FRCP) 37(e) came into effect, declaring that lost electronically stored information (ESI) could not prompt “sanctions … on a party” absent “exceptional circumstances.” Sanctions were limited to losses resulting from “the routine, good-faith operation of an electronic information system.” Effective December, 2015, Rule 37(e) now contemplates limited “measures … to cure the prejudice” caused by lost and irreplaceable ESI due to a party’s failure “to take reasonable steps to preserve,” as well as sanctions for more culpable conduct. The rule was amended in 2015 because the 2006 norm had “not adequately addressed the …

The Effects Of An Intervention Program (Voyager) Through Response To Intervention Framework On 4th Grade Reading Achievement, Lisa Harris Jan 2017

The Effects Of An Intervention Program (Voyager) Through Response To Intervention Framework On 4th Grade Reading Achievement, Lisa Harris

Doctoral Dissertations and Projects

The ability to read fluently has been confirmed as an indicator of good comprehension and thus academic success. Studies have shown that most students in the U.S. are reading below their grade levels. The U.S. has demanded continuously that the education system increase the outcomes of education for all children. In order to improve children’s reading educational needs, effective screening, assessments, and intervention tools need to be implemented properly in U.S. school curriculum. The purpose of this nonequivalent control group study is to investigate the effectiveness of an intervention program in improving the oral reading fluency rates of fourth graders …

A Self-Regulatory Perspective Of Work-To-Home Undermining Spillover/Crossover: Examining The Roles Of Sleep And Exercise, Larissa K. Barber, Shannon G. Taylor, James P. Burton [email protected], Sarah F. Bailey Jan 2017

A Self-Regulatory Perspective Of Work-To-Home Undermining Spillover/Crossover: Examining The Roles Of Sleep And Exercise, Larissa K. Barber, Shannon G. Taylor, James P. Burton [email protected], Sarah F. Bailey

Faculty Articles, Papers, and Other Scholarship

Research demonstrating that employees who are undermined at work engage in similar behavior at home suggests this connection reflects displaced aggression. In contrast, the present study draws on self-regulation theory to examine the work-home undermining spillover/crossover process. We propose that poor sleep quality transmits the influence of workplace undermining to home undermining per self-regulatory impairment, and exercise moderates this indirect effect per self-regulatory improvement. Using matched data from 118 employees and a member of their household to test our model, results demonstrated that undermining experienced from supervisors increased subjective (i.e., self-reported) but not objective (i.e., actigraph-recorded) sleep difficulties, which in …

Sunlight Therapy As A Strategy To Improve Vitamin D Status In Skilled Nursing Facility Older Adult Patients: A Pilot Study, Ashwini Wagle, Clarie Hollenbeck, Jesus Dimas

Faculty Research, Scholarly, and Creative Activity

Widespread avoidance of sun exposure and the use of sunscreens have increased the prevalence of vitamin D inadequacy among Americans and worldwide. Older adults with limited access to sunlight in the Northern Hemisphere are at greater risk for vitamin D deficiency and insufficiency. Researchers have found vitamin D deficiency and insufficiency in institutionalized older adults despite the use of vitamin D supplementation. Positive attitudes in institutionalized older adults toward outdoor activities and sun exposure suggest the potential for effective outdoor sun exposure programs.
