How Existing Environmental Laws Respond To Climate Change And Its Mitigation, Justin Gundlach Jan 2017

How Existing Environmental Laws Respond To Climate Change And Its Mitigation, Justin Gundlach

Sabin Center for Climate Change Law

Existing environmental laws interact with public health priorities and with aspects of the changing climate in numerous and varied ways. This chapter does not attempt to catalogue those interactions, but instead focuses on two that are especially important and illustrative of the operation and limitations of existing environmental laws vis-à-vis climate change-driven challenges. The first interaction is between pollution levels boosted by climate change and pollution control laws that employ health-based standards to determine pollution limits. The second is between a wider array of existing laws and the effects of climate change mitigation measures on public health. Examining these interactions …

Appliance And Equipment Efficiency Standards: A Roadmap For State And Local Action, Peter Ross Jan 2017

Appliance And Equipment Efficiency Standards: A Roadmap For State And Local Action, Peter Ross

Sabin Center for Climate Change Law

For decades, federal energy and water efficiency standards have demonstrably saved consumers money, reduced pollution, and increased grid reliability. The U.S. Department of Energy (“DOE”) periodically reviews standards and test procedures for more than 60 products, representing about 90% of home energy use, 60% of commercial building energy use, and 30% of industrial energy use. Due in part to their incremental nature and proven track record of success, these standards have been relatively uncontroversial, and often have been reached via consensus between manufacturers seeking regulatory certainty and environmental advocates seeking greater efficiency.

Recently, however, the political winds have shifted. Immediately …

To Negotiate A Carbon Tax: A Rough Map Of Policy Interactions, Tradeoffs, And Risks, Justin Gundlach Jan 2017

To Negotiate A Carbon Tax: A Rough Map Of Policy Interactions, Tradeoffs, And Risks, Justin Gundlach

Sabin Center for Climate Change Law

Sooner or later, the federal government will assign a price to carbon dioxide emissions via legislation. The contents of that legislation will reflect negotiated agreement – built on various political tradeoffs – over a host of policy issues, ranging from taxes to energy efficiency standards. These tradeoffs would implicate not only the scope and price assigned by the carbon pricing policy, but also the policies with which it would interact. This paper anticipates that price will take the form of a carbon tax and describes interactions between that tax and various existing and proposed policies relating to climate change, energy, …

Climate Legislation And Litigation In Brazil, Gabriel Wedy Jan 2017

Climate Legislation And Litigation In Brazil, Gabriel Wedy

Sabin Center for Climate Change Law

Brazil plays a major role in the global fight against climate change, especially because of its vast forests. However, the amount of deforestation now occurring is in great dispute. Between August 2014 and July 2015, for example, deforestation in the Amazon rainforest increased by 215% according to Imazon Research Institute. Contrarily, according to the Brazil Government, the increase was only 16%.

This paper discusses the role that legislation and litigation are playing, and the roles they may and should play in the future, in combatting deforestation and other factors relevant to climate change in Brazil.

Carbon Pricing In New York Iso Markets: Federal And State Issues, Justin Gundlach, Romany M. Webb Jan 2017

Carbon Pricing In New York Iso Markets: Federal And State Issues, Justin Gundlach, Romany M. Webb

Sabin Center for Climate Change Law

Does the law permit the New York Independent Service Operator (NYISO) to incorporate, directly or indirectly, a carbon price into New York State’s wholesale electricity market? And, if so, what is the appropriate design of a carbon pricing scheme for the NYISO market? For example, at what level should a carbon price be set and when/how should it be adjusted? How should the revenues generated by such a price be used? What impact (if any) will it have on the Regional Greenhouse Gas Initiative (RGGI) and New York’s Clean Energy Standard? This working paper explores answers to those questions with …

Knowledge Activation For Patient Centered Care: Bridging The Health Information Technology Divide, Sajda Qureshi, Cherie Noteboom Jan 2017

Knowledge Activation For Patient Centered Care: Bridging The Health Information Technology Divide, Sajda Qureshi, Cherie Noteboom

Research & Publications

The provision of healthcare is a collaborative process. It follows evidence based treatments which are becoming increasingly data driven and focusing on the best clinical outcomes. Patient centered care requires participation of patients in the decision making of the best treatment options. Healthcare provision requires both evidence based and patient centered care. In practice, these two perspectives conflict with each other due to the use of an information technology designed primarily for billing purposes. Using the knowledge activation framework developed by Qureshi and Keen [25], we analyze data from two hospitals in the Midwest that aim to achieve quality of …

Simplexity: Plain Language And The Tax Law, Joshua D. Blank, Leigh Osofsky Jan 2017

Simplexity: Plain Language And The Tax Law, Joshua D. Blank, Leigh Osofsky

Articles

In recent years, federal government agencies have increasingly attempted to use plain language in written communications with the public. The Plain Writing Act of 2010, for instance, requires agencies to incorporate "clear and simple" explanations of rules and regulations into their official publications. In the tax context, as part of its "customer service" mission, the Internal Revenue Service bears a "duty to explain" the tax law to hundreds of millions of taxpayers who file tax returns each year. Proponents of the plain language movement have heralded this form of communication as leading to simplicity in tax compliance, more equitable access …

The Price Of Judicial Economy In The Us, Bruce A. Green Jan 2017

The Price Of Judicial Economy In The Us, Bruce A. Green

Faculty Scholarship

In the US, courts widely perceive that judicial scarcity is a common problem threatening the fair and timely resolution of disputes. Courts cite the attendant interest in judicial economy to justify interpreting the procedural and substantive law to reduce the judicial workload or accelerate the resolution of cases. But courts’ assumption that there are too few judges to handle the current caseload is hard to substantiate. First, it may not be possible to infer from excessive judicial backlogs or other perceived judicial deficiencies that a shortfall of judges is to blame. Second, even when one confidently perceives that a judicial …

Relationships Between Access To Mobile Devices, Student Self-Directed Learning, And Achievement, Scott R. Bartholomew, Edward M. Reeve, Raymond Veon, Wade Goodridge, Victor R. Lee, Louis Nadelson

Applied Sciences, Technology and Education Faculty Publications

Today’s students are growing up in a world of constant connectivity, instant information, and ever-changing technological advancements. The increasingly ubiquitous nature of mobile devices among K–12 students has led many to argue for and against the inclusion of these devices in K–12 classrooms. Arguments in favor cite instant access to information and collaboration with others as positive affordances that enable student self-directed learning.

In this study, 706 middle school students from 18 technology and engineering education classes worked in groups of 2–3 to complete an open-ended engineering design challenge. Students completed design portfolios and constructed prototypes in response to the …

Cyber-Security Policy Decisions In Small Businesses, Joanna Patterson Jan 2017

Cyber-Security Policy Decisions In Small Businesses, Joanna Patterson

Walden Dissertations and Doctoral Studies

Cyber-attacks against small businesses are on the rise yet small business owners often lack effective strategies to avoid these attacks. The purpose of this qualitative multiple case study was to explore the strategies small business owners use to make cyber-security decisions. Bertalanffy's general systems theory provided the conceptual framework for this study. A purposive sample of 10 small business owners participated in the interview process and shared their decision-making methodologies and influencers. The small business owners were vetted to ensure their strategies were effective through a series of qualification questions. The intent of the research question and corresponding interview questions …
