Judicial Power, The Judicial Power Project And The Uk, Paul Craig
Judicial Power, The Judicial Power Project And The Uk, Paul Craig
Articles by Maurer Faculty
It is axiomatic that all power requires justification, and that is equally true for judicial power as for other species thereof. This article is primarily concerned with judicial power in the UK. The subject will be approached through consideration of the Judicial Power Project, which has been critical of the courts, much of this being sharp-edged, and fierce. There is repeated talk of judicial overreach and consequent legitimacy crisis, as the courts are said to encroach on terrain that is properly the preserve of the political branch of government.
It is by the same token important that the critics are …

Transnational Constitution-Making: The Contribution Of The Venice Commission On Law And Democracy, Paul Craig
Articles by Maurer Faculty
Commission for Democracy through Law, better known as the Venice Commission. While part of the Council of Europe, the Venice Commission is much less understood than the European Court of Human Rights (ECHR), notwithstanding the existing literature. This chapter therefore seeks to explicate and evaluate. It begins by explicating the organizational foundations of the Venice Commission, followed by analysis of its remit and role. The focus then shifts to triggering and working methodology.
The remainder of the article is concerned with evaluation of the Commission’s role in relation to constitution-making as broadly conceived, the analysis being situated within the literature …

Surveys are a critical resource for social, economic, and health research. The ability to efficiently collect these data and develop accurate post-survey adjustments depends upon reliable data about effort required to recruit sampled units. Level-of-effort paradata are data generated by interviewers during the process of collecting data in surveys. These data are often used as predictors in nonresponse adjustment models or to guide data collection efforts. However, recent research has found that these data may include measurement errors, which would lead to inaccurate decisions in the field or reduced effectiveness for adjustment purposes (Biemer, Chen, & Wang, 2013; West, 2013). …

From 1999 through 2012, a total of 541 individual rodents (jerboas of the family Dipodidae) were collected from several habitat types, primarily from the Gobi region of Mongolia, and were examined for helminth and protistan parasites. Of those rodents, 25 were identified as Pygeretmus pumilio Kerr, 1792 (Rodentia: Dipodidae), whereas 516 were other species of jerboa from the provinces of Dornogobi, Dundgobi, Omnogobi, Ovorhangai, Bayanhongor, Gobi Altai, and Hovd. During our field work, we collected several cestodes; some of which represented undescribed species, and these new species occurred in 40% of P. pumilio from four separate collecting localities. We designate …

Developmental dyslexia is a neurodevelopmental disorder with a strong genetic basis. Previous studies observed white matter alterations in the left posterior brain regions in adults and school-age children with dyslexia. However, no study yet has examined the development of tract-specific white matter pathways from the pre-reading to the fluent reading stage in children at familial risk for dyslexia (FHD+) versus controls (FHD−). This study examined whitematter integrity at pre-reading, beginning, and fluent reading stages cross-sectionally (n = 78) and longitudinally (n = 45) using an automated fiber-tract quantification method. Our findings depict white matter alterations and atypical lateralization …

Unraveling the doping-related charge carrier scattering mechanisms in two-dimensional materials such as graphene is vital for limiting parasitic electrical conductivity losses in future electronic applications. While electric field doping is well understood, assessment of mobility and density as a function of chemical doping remained a challenge thus far. In this work, we investigate the effects of cyclically exposing epitaxial graphene to controlled inert gases and ambient humidity conditions, while measuring the Lorentz force-induced birefringence in graphene at Terahertz frequencies in magnetic fields. This technique, previously identified as the optical analogue of the electrical Hall effect, permits here measurement of charge …

Colour produced by wavelength-dependent light scattering is a key component of visual communication in nature and acts particularly strongly in visual signalling by structurallycoloured animals during courtship. Two miniature peacock spiders (Maratus robinsoni and M. chrysomelas) court females using tiny structured scales (~ 40 × 10 μm2) that reflect the full visual spectrum. Using TEM and optical modelling, we show that the spiders’ scales have 2D nanogratings on microscale 3D convex surfaces with at least twice the resolving power of a conventional 2D diffraction grating of the same period. Whereas the long optical path lengths required …

The index of refraction governs the flow of light through materials. At visible and near-infrared wavelengths the real part of the refractive index is limited to less than 3 for naturally occurring transparent materials, fundamentally restricting applications. Here, we carried out experiments to study the upper limit of the effective refractive index of self-assembled metasurfaces at visible and near-infrared wavelengths. The centimeter-scale metasurfaces were made of a hexagonally close packed (HCP) monolayer of gold nanospheres coated with tunable alkanethiol ligand shells, controlling the interparticle gap from 2.8 to 0.45 nm. In contrast to isolated dimer studies, the macroscale areas allow …

A detailed structural and chemical analysis of a class of self-organized surface structures, termed aggregated nanoparticle spheres (AN-spheres), created using femtosecond laser surface processing (FLSP) on silicon, silicon carbide, and aluminum is reported in this paper. AN-spheres are spherical microstructures that are 20–100 μm in diameter and are composed entirely of nanoparticles produced during femtosecond laser ablation of material. AN-spheres have an onion-like layered morphology resulting from the build-up of nanoparticle layers over multiple passes of the laser beam. The material properties and chemical composition of the AN-spheres are presented in this paper based on scanning electron microscopy (SEM), focused …

Carbohydrate-active enzymes play an important role in the honey bee (Apis mellifera) due to its dietary specialization on plant-based nutrition. Secretory glycoside hydrolases (GHs) produced in worker head glands aid in the processing of floral nectar into honey and are expressed in accordance with the age-based division of labor. Pollen utilization by the honey bee has been investigated in considerable detail, but little is known about the metabolic fate of indigestible carbohydrates and glycosides in pollen biomass. Here, we demonstrate that pollen consumption stimulates the hydrolysis of sugars that are toxic to the bee (xylose, arabinose, mannose). GHs produced in …

Annotated World Bibliography Of Host Plants Of The Melon Fly, Bactrocera Cucurbitae (Coquillett) (Diptera: Tephritidae), Grant T. Mcquate, Nicanor J. Liquido, Kelly A. A. Nakamichi
Insecta Mundi
The melon fly, Bactrocera cucurbitae (Coquillett) (Diptera: Tephritidae), is a widespread, economically important tephritid fruit fly species. Bactrocera cucurbitae infests fruits and vegetables of a number of different plant species, with many host plants in the plant family Cucurbitaceae, but with additional hosts scattered across many other plant families. Although thought to be native to India, its distribution has spread throughout many countries in Oriental Asia, into a number of Pacific Island nations, and into Africa. The documented introductions into countries outside its native distribution show that this species could establish in other countries where it does not presently occur, …

Anisotropy, Phonon Modes, And Lattice Anharmonicity From Dielectric Function Tensor Analysis Of Monoclinic Cadmium Tungstate, Alyssa Mock, Rafal Korlacki, Sean Knight, Mathias Schubert
Department of Electrical and Computer Engineering: Faculty Publications
We determine the frequency dependence of four independent Cartesian tensor elements of the dielectric function for CdWO4 using generalized spectroscopic ellipsometry within mid-infrared and far-infrared spectral regions. Different single crystal cuts, (010) and (001), are investigated. From the spectral dependencies of the dielectric function tensor and its inverse we determine all long-wavelength active transverse and longitudinal optic phonon modes with Au and Bu symmetry as well as their eigenvectors within the monoclinic lattice. We thereby demonstrate that such information can be obtained completely without physical model line-shape analysis in materials with monoclinic symmetry. We then augment the …

Honors Program Induction: Fitting Into A Community That Is Born To Stand-Out, Jennifer Drew
UReCA: The NCHC Journal of Undergraduate Research and Creative Activity
Watching, waiting, wondering—I knew that in this moment I would either sink or swim in my desire to find my place in this university. I was standing on the sidewalk looking at the open green field; however, this field was not empty. All I had to do was step out onto that grass, but my fear of the unknown held me captive. I really felt like the little freshman I was. Since I had been in college, I had searched for that “home away from home” feeling. I longed to find this feeling, but after searching in the academy . …

Jargons And Pidgins And Creoles, Oh My!, Emily Gray
UReCA: The NCHC Journal of Undergraduate Research and Creative Activity
Linguistics, as defined by the Oxford English Dictionary, is “the science of studying language, including phonetics, phonology, morphology, syntax, semantics, pragmatics, and historical linguistics” (OED.com). Within this field, the study of pidgin and creole languages is the source of much controversy and disagreement. Due to their divergence from typical linguistic features and development patterns, pidgins and creoles have long been ignored by the linguistics community. Considered by many to be “inferior, haphazard, broken” versions of “older, more established languages,” these so-called “bastard tongues” were written off as unworthy of study (Todd 1). Only recently have these forms of language garnered …
Aluminum Analysis Of Water At Columbia College, Dung Golden
Aluminum Analysis Of Water At Columbia College, Dung Golden
UReCA: The NCHC Journal of Undergraduate Research and Creative Activity
Water contamination from trace metals can pose severe threats to human and environmental health. The Environmental Protection Agency (EPA) classifies aluminum as a secondary contaminant, for which it provides non-mandatory secondary maximum contaminant levels (SCML) because such contaminants are not considered to present a risk to the public. The SMCL for aluminum is between 0.05 and 0.2 mg/L or part per million (ppm). Tap water from different sources on the Columbia College campus were analyzed for aluminum content by fluorometry and visible spectrometry. The results from the fluorometry method indicated that samples from two locations on campus were higher than …

Changes In J-Soap-Ii And Savry Scores Over The Course Of Residential, Cognitive-Behavioral Treatment For Adolescent Sexual Offending, Jodi L. Viljoen, Andrew L. Gray, Catherine Shaffer, Natasha E. Latzman, Mario Scalora, Daniel Ullman
Department of Psychology: Faculty Publications
Although the Juvenile Sex Offender Assessment Protocol–II (J-SOAP-II) and the Structured Assessment of Violence Risk in Youth (SAVRY) include an emphasis on dynamic, or modifiable factors, there has been little research on dynamic changes on these tools. To help address this gap, we compared admission and discharge scores of 163 adolescents who attended a residential, cognitive-behavioral treatment program for sexual offending. Based on reliable change indices, one half of youth showed a reliable decrease on the J-SOAP-II Dynamic Risk Total Score and one third of youth showed a reliable decrease on the SAVRY Dynamic Risk Total Score. Contrary to expectations, …

Human Classifier: Observers Can Deduce Task Solely From Eye Movements, Brett Bahle, Mark Mills, Michael Dodd
Department of Psychology: Faculty Publications
Computer classifiers have been successful at classifying various tasks using eye movement statistics. However, the question of human classification of task from eye movements has rarely been studied. Across two experiments, we examined whether humans could classify task based solely on the eye movements of other individuals. In Experiment 1, human classifiers were shown one of three sets of eye movements: Fixations, which were displayed as blue circles, with larger circles meaning longer fixation durations; Scanpaths, which were displayed as yellow arrows; and Videos, in which a neon green dot moved around the screen. There was an additional Scene manipulation …

In mycobacteria, D-alanine is an essential precursor for peptidoglycan biosynthesis. The only confirmed enzymatic pathway to form D-alanine is through the racemization of L-alanine by alanine racemase (Alr, EC 5.1.1.1). Nevertheless, the essentiality of Alr in Mycobacterium tuberculosis and Mycobacterium smegmatis for cell survivability in the absence of D-alanine has been a point of controversy with contradictory results reported in the literature. To address this issue, we examined the effects of alr inactivation on the cellular metabolism of M. smegmatis. The M. smegmatis alr insertion mutant TAM23 exhibited essentially identical growth to wild type mc2155 in the …
A Raucous Entertainment: Melodrama, Race, And The Search For Moral Legibility In Nineteenth-Century America, Sarah M. Olivier
A Raucous Entertainment: Melodrama, Race, And The Search For Moral Legibility In Nineteenth-Century America, Sarah M. Olivier
Electronic Theses and Dissertations
Gathering together episodes from American theater history, my dissertation focuses on the destabilizing identities and paradoxical resolutions of so-called "Indian" and slavery plays to address nineteenth-century melodrama's fundamental engagement with race. Melodrama is a spectacular form that uses iconic images to move audiences to feel powerful emotions and to assign moral legibility to societal problems. Given the significant role of territorial expansion and chattel slavery in US history, race has always presented Americans with crucial moral dilemmas. Melodrama has long provided a dominant mode of representation for addressing such dilemmas that hinges upon racially inflected conceptions of good and evil. …

Segmental Movement Compensations In Patients With Transtibial Amputation Identified Using Angular Momentum Separation, Brecca M. M. Gaffney
Electronic Theses and Dissertations
Patients with unilateral dysvascular transtibial amputation (TTA) adopt movement compensations that are required to maintain balance and achieve ambulation in the absence of ankle plantar flexion, and result in increased and asymmetric joint loading patterns. As a result, this population is at an increased risk of overuse injuries, such as low back pain (LBP). Clinical gait analysis is used to guide diagnostics in movement retraining following amputation, and is performed using instrumented (research based) or observational analyses (clinically based). However, instrumented analyses are currently impractical in most clinical settings due to expense and computational limitations. This dissertation presents the use …

Statistical Shape Modeling To Quantify Variation In The Proximal Humeral Anatomy, Paul B. Sade Sr.
Electronic Theses and Dissertations
The fit of the humeral prosthesis to the intramedullary canal and the replication of the anatomic humeral head center are important factors in Total Shoulder Arthroplasty (TSA). The objective of this thesis was to develop a Statistical Shape Model (SSM) of the cortical and cancellous bone regions of the proximal humerus, and to assess potential shape differences with gender and ethnicity, with a goal of informing implant design. An SSM was used and Principal Component Analysis (PCA) was applied to data that represented both the cancellous and cortical humeral bone of 63 healthy subjects and cadavers. Anatomical measurements and PC …

Copper in various forms has been known to have bactericidal activity. Challenges to its application include preventing mobilization of the copper, to both extend activity and avoid toxicity, and bioincompatibility of many candidate substrates for copper immobilization. Using a simple ionic liquid, butylmethylimmidazolium chloride as the solvent, we developed a facile and green method to synthesize biocompatible composites containing copper oxide nanoparticles (CuONPs) from cellulose (CEL) and chitosan (CS) or CEL and keratin (KER). Spectroscopy and imaging results indicate that CEL, CS, and KER remained chemically intact and were homogeneously distributed in the composites with CuONPs with size of 22 …

Staphylococcus aureus must rapidly adapt to a variety of carbon and nitrogen sources during invasion of a host. Within a staphylococcal abscess, preferred carbon sources such as glucose are limiting, suggesting that S. aureus survives through the catabolism of secondary carbon sources. S. aureus encodes pathways to catabolize multiple amino acids, including those that generate pyruvate, 2-oxoglutarate, and oxaloacetate. To assess amino acid catabolism, S. aureus JE2 and mutants were grown in complete defined medium containing 18 amino acids but lacking glucose (CDM). A mutation in the gudB gene, coding for glutamate dehydrogenase, which generates 2-oxoglutarate from glutamate, significantly reduced …
Detecting Overpressure Zones By Using Model Based Inversion In Kupe Field, New Zealand, Timucin Cakir
Detecting Overpressure Zones By Using Model Based Inversion In Kupe Field, New Zealand, Timucin Cakir
Dissertations, Master's Theses and Master's Reports
Overpressure is a significant parameter during a drilling process in oil exploration. This phenomenon happens when pore pressure exceeds the limit of hydrostatic pressure in a formation and causes drastic hazards such as blow outs while drilling. This thesis focuses on the determination of possible overpressure areas and studies at three wells in Kupe Field, which is considered to be a natural-gas field in Taranaki Basin. In an effort to identify potential overpressure zones at the Kupe Field, acoustic impedance responses of 3D seismic data for three wells, along with their well log responses were evaluated.
Seismic inversion plays an …
Using Lidar To Map The Geology And Morphology Of Alluvial Fans: Salton Sea Area, California, Eric Alexander Macleod
Using Lidar To Map The Geology And Morphology Of Alluvial Fans: Salton Sea Area, California, Eric Alexander Macleod
Dissertations, Master's Theses and Master's Reports
The main result of this study has been to show that detailed maps of the geology and morphology of alluvial fans can be generated from high spatial resolution (1-meter) DEM’s (Digital Elevation Models) obtained from LiDAR (Light Detection and Ranging) data. DEMs with spatial resolutions of 1-meter, 10-meters and 30-meters were all examined but it was determined that only the 1-meter LiDAR data had sufficient spatial resolution to produce satisfactory maps of the geology and morphology. A case study on an alluvial fan in the Santa Rosa mountains northeast of the Salton Sea (California) showed that 1-meter spatial resolution LiDAR …
