Resistance Exercise Training On Disease Impact, Pain Catastrophizing And Autonomic Modulation In Women With Fibromyalgia, Alaina Glasgow, Tori M. Stone, J. Derek Kingsley

International Journal of Exercise Science

International Journal of Exercise Science 10(8): 1184-1195, 2017. Women with fibromyalgia (FM) often complain of whole-body pain, and muscle fatigue, which may be related to autonomic dysfunction. Therefore, the purpose of the present study was to investigate the effects of resistance exercise training (RET) on disease impact, pain catastrophizing, and autonomic modulation in women with FM. Women with FM (n=26) and healthy control women (HC: n=9), aged 19-65 yrs, were compared at rest. Women with FM were randomly assigned to a resistance-training group (FM-RT: n=14) or a non-exercising control group (FM-CON: n=12). Women in the FM-RT group underwent 8-weeks of …

The Effect Of Task Complexity Influencing Bilateral Transfer., Dawson J. Kidgell, Ashlyn K. Frazer, Alan J. Pearce Nov 2017

The Effect Of Task Complexity Influencing Bilateral Transfer., Dawson J. Kidgell, Ashlyn K. Frazer, Alan J. Pearce

International Journal of Exercise Science

International Journal of Exercise Science 10(8): 1174-1183, 2017. Bilateral transfer is a well-known phenomenon whereby training one limb results in improvement in the untrained homologous limb. However, despite evidence across a range of motor skill paradigms, the influence of motor skill complexity on the magnitude of bilateral transfer has not yet been fully explored. The aim of this preliminary study was to compare bilateral transfer effects between three dexterity tasks with the hypothesis that the complexity of the task, the volume of time training, and the amount of improvement in the trained hand would positively influence bilateral transfer. Using a …

The Corporate Face Of The Alien Tort Claims Act: How An Old Statute Mandates A New Understanding Of Global Interdependence, Lorelle Londis Nov 2017

The Corporate Face Of The Alien Tort Claims Act: How An Old Statute Mandates A New Understanding Of Global Interdependence, Lorelle Londis

Maine Law Review

In the past thirty-five years, international human rights lawyers and, more recently, international environmental lawyers, have been invoking the Alien Tort Claims Act (ATCA) as a tool to prosecute human rights abuses committed abroad by transnational corporations (TNs) in U.S. federal courts. The ATCA provides: “The district courts shall have original jurisdiction of any civil action by an alien for a tort only, committed in violation of the law of nations or a treaty of the United States.” Although plaintiffs' lawyers have experienced some success in the human rights context, most claims of environmental abuses have failed. In all these …

Conant V. Walters: A Misapplication Of Free Speech Rights In The Doctor-Patient Relationship, Katharine M. Mccarthy

Maine Law Review

In Conant v. Walters, the United States Court of Appeals for the Ninth Circuit addressed the application of the First Amendment's right of free speech to a federal policy that prohibited the recommendation of medical marijuana by physicians. This class action suit, brought by physicians and severely ill patients, successfully enjoined the federal government from enforcing its policy revoking the federal prescriptive licenses of physicians who recommend or approve of marijuana use by patients suffering from certain severe illnesses. The federal government's policy, issued in 1996 through a statement of Barry McCaffrey, director of the Office of National Drug Control …

Who's Afraid Of Judicial Activism? Reconceptualizing A Traditional Paradigm In The Context Of Specialized Domestic Violence Court Programs, Jennifer L. Thompson Nov 2017

Who's Afraid Of Judicial Activism? Reconceptualizing A Traditional Paradigm In The Context Of Specialized Domestic Violence Court Programs, Jennifer L. Thompson

Maine Law Review

The Specialized Domestic Violence Pilot Project (Pilot Project), implemented in York and Portland in July and August 2002, is the result of the collaborative efforts of the District Court system, law enforcement, prosecutors, members of the defense bar, and various community agencies offering services to victims and perpetrators. District court judges are largely responsible for overseeing the changes in court procedures and implementing the new protocols in domestic violence cases. The Pilot Project, and the changes it is making to the role that courts play in domestic violence cases, represents a significant departure from the procedures followed by traditional court …

Cybergenics Ii: Precedent And Policy Vs. Plain Meaning, Nancy A. Haller Nov 2017

Cybergenics Ii: Precedent And Policy Vs. Plain Meaning, Nancy A. Haller

Maine Law Review

On September 20, 2002, the U.S. Court of Appeals for the Third Circuit issued a panel opinion concluding that a court may not authorize a creditors' committee to commence an avoidance action in the trustee's name, on behalf of a bankruptcy estate. The decision shocked the bankruptcy bar and raised such a stir that many commentators raised it to the status of one of the “top cases of the year.” Furthermore, within two months, the Second Circuit came down with a squarely contrary decision, reaffirming the validity of the practice within the Second Circuit and failing to even acknowledge recent …

Some Model Amendments To Maine (And Other States') Land Use Control Legislation, Orlando E. Delogu, Sam Merrill, Philip R. Saucier Nov 2017

Some Model Amendments To Maine (And Other States') Land Use Control Legislation, Orlando E. Delogu, Sam Merrill, Philip R. Saucier

Maine Law Review

This model legislation consisting of ten separate provisions is intended to clarify and/or expand existing Maine law dealing with planning and land use regulation. It expands existing statutes by addressing a number of issues not presently covered by law. The overarching purpose of the proposed legislation is to underscore that planning and the imposition of land use regulations is not exclusively the responsibility of local governments but instead is a shared duty of the state and local governments. This is clearly stated in the text and commentary of Provision I, and is a theme that pervades all ten legislative proposals. …

The False Idolarty Of Rules-Based Law, John C. Sheldon Nov 2017

The False Idolarty Of Rules-Based Law, John C. Sheldon

Maine Law Review

When the Supreme Court outlawed segregation in public schools in 1954, it acknowledged this social truth: assigning separate public facilities to separate classes of people fosters inequality among those classes. Although Brown v. Board of Education of Topeka addressed only educational facilities, the Court quickly broadened the scope of its decision, applying it to racial discrimination in or at public beaches, buses, golf courses, parks, municipal airport restaurants and state courtrooms. And although Brown addressed only racial discrimination, it quickly became the basis for condemning many forms of discrimination, including race, religion, wealth, gender, age, and disability. What gave Brown …

Consumer Class Actions: Who Are The Real Winners?, Edward F. Sherman Nov 2017

Consumer Class Actions: Who Are The Real Winners?, Edward F. Sherman

Maine Law Review

The class action is one of the most controversial procedural devices in the American legal system. In the years since an expanded class action rule was adopted in 1966, class actions have grown in scope and number, and suits by consumers have accounted for an increasing share of class actions suits. By allowing individuals to sue not only for themselves, but also on behalf of others similarly situated, the class action “empowers plaintiffs to bring cases that otherwise either would not be possible or would only be possible in a very different form.” Business critics see this as enabling “lawyers …

The Use Of The 3/2/1 Technique To Foster Students' Speaking Fluency, Mireya Molina, Mark Briesmaster Nov 2017

The Use Of The 3/2/1 Technique To Foster Students' Speaking Fluency, Mireya Molina, Mark Briesmaster

i.e.: inquiry in education

For English as Foreign Language learners (EFL), fluency is one of the most difficult aspects to develop within the speaking skill. The Chilean teaching context has witnessed a gradual shift from the more traditional grammar-translation approach to a more communicative one, so it has become necessary to discover new strategies to develop students’ speaking skills. This action research was conducted in a technical university in Chile and it investigated how the use of the 3/2/1 technique influenced students’ speaking fluency. The data was collected under a quantitative and qualitative design; the quantitative data was taken from audio recordings which were …

Gesture And Signing In Support Of Expressive Language Development, Leslie K. Baker-Ramos Nov 2017

Gesture And Signing In Support Of Expressive Language Development, Leslie K. Baker-Ramos

i.e.: inquiry in education

The purpose of this teacher inquiry is to explore the effects of signing and gesturing on the expressive language development of non-verbal children. The first phase of my inquiry begins with the observations of several non-verbal students with various etiologies in three different educational settings. The focus of these observations is to identify current sign and gesture usage and determine the students' abilities to acquire signed language as as additional form of expression and whether or not there is potential value in that acquisition. I also want to explore any differences in signed language acquisition between children with Downs Syndrome …

Investigation And Analysis Of The Effects Of Manual Lifting And Carrying Activities On Postural And Gait Stability In Normal Subjects, Mohammed Alamoudi

Open Access Dissertations

Manual material handling (MMH) contributes to a large percentage of musculoskeletal disorders. Examples of its fundamental activities are lifting and carrying tasks that can be accomplished in several strategies, with each one imposing different types of stresses on the musculoskeletal system. These types of stresses may perturb the stability of the human body and may cause falls. Therefore, the goal of this study was to investigate the effect of MMH tasks on postural and locomotion stability using motion capturing system. Postural and dynamic stability were measured using new stability measures that were introduced in this study. A point inside the …

Liar, Liar, Retaliation Claim On Fire: Egei V. Johnson: Protecting An Employee’S Right To Dishonesty (White Paper), Sarah Applegate Nov 2017

Liar, Liar, Retaliation Claim On Fire: Egei V. Johnson: Protecting An Employee’S Right To Dishonesty (White Paper), Sarah Applegate

Nebraska Law Bulletin (Selected Issues)

The United States District Court for the District of Columbia incorrectly held that an employee who lies during a Title VII proceeding is protected from retaliation on the basis of his or her lies. A better approach to Title VII participation matters is to impose a requirement that the participation be in good faith with the burden on the employer to prove with clear and convincing evidence that the employee’s participation was bad faith. This approach follows the holdings of the 7th Circuit, imposing a good faith requirement on participation clause matters. However, the 7th Circuit also imposes a reasonableness …

Wildland Resources Faculty Publications

Much interest lies in the identification of manageable habitat variables that affect key vital rates for species of concern. For ground-nesting birds, vegetation surrounding the nest may play an important role in mediating nest success by providing concealment from predators. Height of grasses surrounding the nest is thought to be a driver of nest survival in greater sage-grouse (Centrocercus urophasianus; sage-grouse), a species that has experienced widespread population declines throughout their range. However, a growing body of the literature has found that widely used field methods can produce misleading inference on the relationship between grass height and nest success. Specifically, …

Parent-Child Communication In Sport: Bridging The Gap Between Theory And Research, Marshall Xavier Grimm, Elizabeth Dorrance Hall, Charles Ryan Dunn, Travis E. Dorsch

Human Development and Family Studies Faculty Publications

Parent-child communication is integral to the acquisition of positive developmental outcomes from sport. This position paper offers useful interdisciplinary frameworks and theories for future researchers as they investigate questions pertaining to parentchild communication in organized youth sport. We propose such work is enhanced when grounded in family, human development, and interpersonal communication theory and literature. Specifically, theoretical frameworks from these areas assist researchers in determining salient research questions, choosing appropriate methodologies, and most importantly in the interpretation of findings. As researchers attempt to further understand parental influence in sport, the role of specific family processes like communication will shed light …
