Rights-Based And Tech-Driven: Open Data, Freedom Of Information, And The Future Of Government Transparency, Beth Simone Noveck
Rights-Based And Tech-Driven: Open Data, Freedom Of Information, And The Future Of Government Transparency, Beth Simone Noveck
Articles & Chapters
Open data policy mandates that government proactively publish its data online for the public to reuse. It is a radically different approach to transparency than traditional right-to-know strategies as embodied in Freedom of Information Act (FOIA) legislation in that it involves ex ante rather than ex post disclosure of whole datasets. Although both open data and FOIA deal with information sharing, the normative essence of open data is participation rather than litigation. By fostering public engagement, open data shifts the relationship between state and citizen from a monitorial to a collaborative one, centered around using information to solve problems together. …
Paying For Privacy And The Personal Data Economy, Stacy-Ann Elvy
Paying For Privacy And The Personal Data Economy, Stacy-Ann Elvy
Articles & Chapters
Growing demands for privacy and increases in the quantity and variety of consumer data have engendered various business offerings to allow companies, and in some instances consumers, to capitalize on these developments. One such example is the emerging “personal data economy” (PDE) in which companies, such as Datacoup, purchase data directly from individuals. At the opposite end of the spectrum, the “pay-for-privacy” (PFP) model requires consumers to pay an additional fee to prevent their data from being collected and mined for advertising purposes. This Article conducts a simultaneous in-depth exploration of the impact of burgeoning PDE and PFP models. It …
Marker Assisted Backcross Selection For Virus Resistance In Pea (Pisum Sativum L.), Amy Scegura
Marker Assisted Backcross Selection For Virus Resistance In Pea (Pisum Sativum L.), Amy Scegura
Plant Sciences
Viruses are destructive plant pathogens, which cause significant yield loss and reduced grain quality. Pea Seed-borne Mosaic Virus (PSbMV) is an economically important viral disease in pea (Pisum sativum L.) and recently detected in the Northern Great Plains (NGP) in 2012. PSbMV is aphid-transmitted from plant to plant and can be seed-borne. It causes malformed leaves, discolored or split seed, and reduced size and number of seeds. Host resistance to PSbMV-P4 is conferred by a recessive gene, sbm-1. Marker assisted backcross breeding using the 4Egenomic primers previously developed assisted in transferring the single resistance allele located on LG VI from …
Response Of Russet Burbank Seed Tubers Containing Glyphosate And Dicamba Residues, Nelson Dee Geary
Response Of Russet Burbank Seed Tubers Containing Glyphosate And Dicamba Residues, Nelson Dee Geary
Plant Sciences
The introduction of dicamba-tolerant soybean will increase the risk of potato injury to dicamba. The objective was to determine the effects of ‘Russet Burbank’ potato seed tuber emergence and yield that were exposed to dicamba and glyphosate the previous year. Field experiments were conducted in 2016 and 2017 to evaluate seed tubers from mother plants that were treated the previous year with glyphosate (8, 40 and 197 g ae ha-1), dicamba (4, 20 and 99 g ai ha-1) and glyphosate plus dicamba. The rates of 99 g ha-1 dicamba, 197 g ha-1 glyphosate and combination of rates caused 17 to …

Quantification Of Disease Expression Conferred By Three Host Gene-Necrotrophic Effector Interactions In The Wheat-Parastagonospora Nodorum Pathosystem, Amanda Rose Peters
Plant Sciences
Septoria nodorum blotch is a wheat foliar and glume disease caused by Parastagonospora nodorum, a necrotrophic fungal pathogen. Snn1-SnTox1, Snn3-B1-SnTox3, and Tsn1-SnToxA are three important interactions between wheat necrotrophic effector sensitivity genes and P. nodorum effectors. I evaluated a recombinant inbred population that segregated for these three necrotrophic effector sensitivity genes with P. nodorum isolates containing various combinations of the three corresponding necrotrophic effectors. The Tsn1-SnToxA and Snn3-B1-SnTox3 interactions explained up to 32.7 and 21.2% of the disease variation, respectively, when present. For most isolates the Snn1-SnTox1 interaction did not show a significant effect, however for some isolates, the interaction …
Soybean Response To Nitrogen And Sulfur Fertilization, Benjamin Cigelske
Soybean Response To Nitrogen And Sulfur Fertilization, Benjamin Cigelske
Plant Sciences
Soybean [Glycine max (L.) Merrill.] yields in North Dakota have not yet reached their genetic potential. Applying fertilizers may increase yields. This study was conducted to understand the impact of nitrogen (N) and sulfur (S) fertilization on soybean plant density, vigor, greenness, height, yield, test weight, protein and oil content, nodulation, vegetation, and root growth. Two varieties were planted in experiments across ten environments during 2015-2016. Yield differed between environments (up to 77%). Varieties responded differently to N and S fertilizer. Nitrogen (56 kg N ha-1) in the form of broadcast incorporated urea increased vigor (13%) and yield (3.6%) but …
Stochastic Budgeting And Input Breakeven Analysis In North Dakota Potato Production, Alan Bingham
Stochastic Budgeting And Input Breakeven Analysis In North Dakota Potato Production, Alan Bingham
Plant Sciences
Enterprise budgets were developed for non-irrigated red and irrigated russet potato production, based on North Dakota model farms. Costs and revenues vary among producers, thus budgets are intended to serve as a template for producers to use and manipulate to suit their individual circumstances. These budgets and stochastic (Monte Carlo) simulation were utilized in order to analyze and quantify financial risk in each respective enterprise. Simulated net returns for non-irrigated production ranged from -$1,324 to $2,757 per acre, while irrigated returns were between -$551 and $1,616 per acre. On farms where fumigation is a typical practice, it is one of …

Triggering Tinker: Student Speech In The Age Of Cyberharassment, Ari Ezra Waldman
Triggering Tinker: Student Speech In The Age Of Cyberharassment, Ari Ezra Waldman
Articles & Chapters
This essay challenges the common assumption that public schools have limited authority to regulate cyberbullying that originates and takes place off campus. That argument presumes a level of myopia, clarity, and literalism in the law that simply does not exist. First, even assuming it existed, a geographic requirement is an outdated creature of a preinternet age. Cyberbullying poses unique challenges to young people, educators, and schools not contemplated when the Court decided its student speech cases. If it existed then, it should adapt to today’s realities. Second, I argue that a campus presence requirement for regulating any kind of off-campus …

Persons institutionalized in psychiatric hospitals and “state schools” for those with intellectual disabilities have always been hidden from view. Such facilities were often constructed far from major urban centers, availability of transportation to such institutions was often limited, and those who were locked up were, to the public, faceless and often seen as less than human.
Although there has been regular litigation in the area of psychiatric (and intellectual disability) institutional rights for 40 years, much of this case law entirely ignores forensic patients – mostly those awaiting incompetency-to-stand trial determinations, those found permanently incompetent to stand trial, those acquitted …

In Vitro Porcine Blastocyst Development In Three-Dimensional Alginate Hydrogels, Jeremy R. Miles, Taylor D. Laughlin, Catherine Sargus-Patino, Angela K. Pannier
Department of Agricultural and Biological Systems Engineering: Faculty Publications
Appropriate embryonic and fetal development significantly impact pregnancy success and, therefore, the efficiency of swine production. The pre-implantation period of porcine pregnancy is characterized by several developmental hallmarks, which are initiated by the dramatic morphological change that occurs as pig blastocysts elongate from spherical to filamentous blastocysts. Deficiencies in blastocyst elongation contribute to approximately 20% of embryonic loss, and have a direct influence on within-litter birth weight variation. Although factors identified within the uterine environment may play a role in blastocyst elongation, little is known about the exact mechanisms by which porcine (or other species’) blastocysts initiate and progress through …

Student Perceptions Of Online Courses, Irma S. Jones, Dianna Blankenship
Teaching and Learning Faculty Publications
Presently, at the post-secondary level, digital or online education is offered in addition to traditional face-to-face courses and the number of online course offerings is rapidly growing. The Occupational Outlook Handbook reveals that employment in” computer and information technology” occupations is projected to grow 12 percent between the years 2014 to 2024, faster than the average for all other occupations. This is directly related to an emphasis on cloud computing, the collection, storage and connectivity of data to the Internet and the continued demand for mobile computing (Online Learning Consortium, 2015). This survey will describe online student perceptions and their …

Trial And Error: Lawyers And Nonlawyer Advocates, Anna Carpenter, Alyx Mark, Colleen Shanahan
Faculty Articles
Nonlawyer advocates are one proposed solution to the access to justice crisis and are currently permitted to practice in some civil justice settings. Theory and research suggest nonlawyers might be effective in some civil justice settings, yet we know very little, empirically, about nonlawyer practice in the United States. Using data from more than 5,000 unemployment insurance appeal hearings and interviews with lawyers and nonlawyers, this article explores how both types of representatives learn to do their work and what this means for their effectiveness. Building on recent research regarding the importance of procedural knowledge and relational expertise as elements …

Rulemaking Ex Machina, Melissa Mortazavi
Rulemaking Ex Machina, Melissa Mortazavi
Faculty Articles
Emerging technologies promise to expedite administrative rulemaking by analyzing public input through computerized natural language rather than clunky, old human brains. Moving far beyond software that keyword searches and deduplicates content, natural language processing (as a type of predictive coding) employs artificial intelligence that adapts and modulates depending on inputs, rendering it fluid and dynamic. With the current concerted push to streamline agencies, the question of how and when to use automation in rulemaking will likely be decided in the next year. Considering that recently, a single proposed rule garnered over 3.7 million public comments, mechanisms that can make comprehending …

It begins by briefly discussing the partnership’s historical origins and ongoing negotiations. It then examines the latest leaked draft of the RCEP intellectual property chapter, highlighting the key provisions concerning copyright and related rights, trademarks, patents, trade secrets and undisclosed information, and intellectual property enforcement. This article concludes by exploring three scenarios concerning the future of this chapter--namely, the lack of an intellectual property …
Unilateral Corporate Regulation, William Magnuson
Unilateral Corporate Regulation, William Magnuson
Faculty Scholarship
Corporations today wield unprecedented power in politics and society, and they have a tremendous effect on human welfare around the globe. At the same time, they are increasingly difficult to regulate. Corporations are savvy and mobile, and they can relocate to avoid burdensome domestic regulation with surprising ease. The agility of corporations creates a dilemma for government decisionmakers seeking to balance the need to attract the wealth that corporations create with the desire to pursue other policy priorities. One potential approach that governments have used to address this dilemma is international cooperation, and a growing number of scholars have argued …

Narrow atomically precise graphene nanoribbons hold great promise for electronic and optoelectronic applications, but the previously demonstrated nanoribbon-based devices typically suffer from low currents and mobilities. In this study, we explored the idea of lateral extension of graphene nanoribbons for improving their electrical conductivity. We started with a conventional chevron graphene nanoribbon, and designed its laterally extended variant. We synthesized these new graphene nanoribbons in solution and found that the lateral extension results in decrease of their electronic bandgap and improvement in the electrical conductivity of nanoribbon-based thin films. These films were employed in gas sensors and an electronic nose …

Oxidation of bromide in aqueous environments initiates the formation of molecular halogen compounds, which is important for the global tropospheric ozone budget. In the aqueous bulk, oxidation of bromide by ozone involves a [Br•OOO−] complex as intermediate. Here we report liquid jet X-ray photoelectron spectroscopy measurements that provide direct experimental evidence for the ozonide and establish its propensity for the solution-vapor interface. Theoretical calculations support these findings, showing that water stabilizes the ozonide and lowers the energy of the transition state at neutral pH. Kinetic experiments confirm the dominance of the heterogeneous oxidation route established by this precursor …

Indole-Induced Reversion Of Intrinsic Multiantibiotic Resistance In Lysobacter Enzymogenes, Yong Han, Yan Wang, Yameng Yu, Haotong Chen, Yuemao Shen, Liangcheng Du
Department of Chemistry: Faculty Publications
Lysobacter species are a group of environmental bacteria that are emerging as a new source of antibiotics. One characteristic of Lysobacter is intrinsic resistance to multiple antibiotics, which had not been studied. To understand the resistance mechanism, we tested the effect of blocking two-component regulatory systems (TCSs) on the antibiotic resistance of Lysobacter enzymogenes, a prolific producer of antibiotics. Upon treatment with LED209, an inhibitor of the widespread TCS QseC/QseB, L. enzymogenes produced a large amount of an unknown metabolite that was barely detectable in the untreated culture. Subsequent structural elucidation by nuclear magnetic resonance (NMR) unexpectedly revealed that …

Tunable Dimensional Crossover And Magnetocrystalline Anisotropy In Fe2p-Based Alloys, I. A. Zhuravlev, V. P. Antropov, A. Vishina, M. Van Schilfgaarde, Kirill D. Belashchenko
Department of Physics and Astronomy: Faculty Publications
Electronic structure calculations are used to examine the magnetic properties of Fe2P-based alloys and the mechanisms through which the Curie temperature andmagnetocrystalline anisotropy can be optimized for specific applications. It is found that at elevated temperatures the magnetic interaction in pure Fe2P develops a pronounced two-dimensional character due to the suppression of the magnetization in one of the sublattices, but the interlayer coupling is very sensitive to band filling and structural distortions. This feature suggests a natural explanation for the observed sharp enhancement of the Curie temperature by alloying with multiple elements, such as Co, Ni, …

Sola Scriptura Statuat Lex Orandi: Toward A Transcultural Theology Of Liturgy, David A. Williams
Faculty Publications
The Seventh-day Adventist church is one of the most diverse religious groups. With this diversity comes a preponderance in worship practices. Calling upon the Reformation principle, sola scriptura, the Bible alone should establish the rule for liturgy. How do we apply the Bible as the rule for liturgy, with so many worship preferences and diversity of cultures within the Adventist church? In this paper, I seek to articulate a way forward, developing a transcultural theology of liturgy to be applied in every Adventist culture, allowing room for a rich variety of local cultural contextualizations.
Uncovering Behavioural States From Animal Activity And Site Fidelity Patterns, Peter J. Mahoney, Julie K. Young
Uncovering Behavioural States From Animal Activity And Site Fidelity Patterns, Peter J. Mahoney, Julie K. Young
United States Department of Agriculture Wildlife Services: Staff Publications
1. Space use by animals has important implications for individual fitness. However, resource requirements often vary throughout the course of a lifetime and are a reflection of the demands associated with daily tasks or specific life-history phases, from food acquisition to reproduction, and emphasize the need to classify resource selection relative to specific behavioural states. Site fidelity is often indicative of behaviours important for individual maintenance (e.g. foraging), species’ life history (e.g. seasonal site selection), social communication (e.g. scent-marking) and species interactions (e.g. predation, competition). Thus, resolving site fidelity patterns associated with key behaviours is essential to accurately quantify behavioural-dependent …

The detection of aerosolized viruses can serve as an important surveillance and control tool in agriculture, human health, and environmental settings. Here, we adapted an anion exchange resin-based method, initially developed to concentrate negatively charged viruses from water, to liquid impingement-based bioaerosol sampling. In this method, aerosolized viruses are collected in a 20 ml liquid sample contained within widely used impingers, BioSamplers (SKC Inc., Eighty Four, PA), and further concentrated via adsorption to an anion exchange resin that is suspended within this liquid. Viral nucleic acids are then extracted from the resin to facilitate molecular analyses through a reduction in …

Ecological Potential For Rabies Virus Transmission Via Scavenging Of Dead Bats By Mesocarnivores, Tad C. Theimer, Annie C. Dyer, Brian W. Keeley, Amy T. Gilbert, David L. Bergman
United States Department of Agriculture Wildlife Services: Staff Publications
Multiple species of bats are reservoirs of rabies virus in the Americas and are occasionally the source of spillover infections into mesocarnivore species. Although rabies transmission generally is assumed to occur via bite, laboratory studies have demonstrated the potential for rabies transmission via ingestion of rabid animals. We investigated the ecological potential for this mode of transmission by assessing mesocarnivore scavenging behavior of dead bats in suburban habitats of Flagstaff, Arizona, US. In autumn 2013, summer 2014, and autumn 2015, we placed 104 rabies-negative bat carcasses either near buildings, in wildland areas, or in residential yards and then monitored them …
Control Of Invasive Rats On Islands And Priorities For Future Action, Quiterie Duron, Aaron B. Shiels, Eric Vidal
Control Of Invasive Rats On Islands And Priorities For Future Action, Quiterie Duron, Aaron B. Shiels, Eric Vidal
United States Department of Agriculture Wildlife Services: Staff Publications
Invasive rats are one of the world’s most successful animal groups that cause native species extinctions and ecosystem change, particularly on islands. On large islands, rat eradication is often impossible and population control, defined as the local limitation of rat abundance, is now routinely performed on many of the world’s islands as an alternative management tool. However, a synthesis of the motivations, techniques, costs, and outcomes of such rat-control projects is lacking. We reviewed the literature, searched relevant websites, and conducted a survey via a questionnaire to synthesize the available information on rat-control projects in island natural areas worldwide to …
