The Reasonable Investor Of Federal Securities Law, Amanda Rose
The Reasonable Investor Of Federal Securities Law, Amanda Rose
Vanderbilt Law School Faculty Publications
Federal securities law defines the materiality of corporate disclosures by reference to the views of a hypothetical reasonable investor. For decades the reasonable investor standard has been a flashpoint for debate with critics complaining of the uncertainty it generates and defenders warning of the under-inclusiveness of bright-line alternatives. This Article attempts to shed fresh light on the issue by considering how the reasonable investor differs from its common law antecedent, the reasonable person of tort law. The differences identified suggest that the reasonable investor standard is more costly than tort laws reasonable person standard - the uncertainty it generates is …

Lamarck Revisited: The Implications Of Epigenetics For Environmental Law, Michael P. Vandenbergh, David J. Vandenbergh, John G. Vandenbergh
Vanderbilt Law School Faculty Publications
For generations, a bedrock concept of biology was That genetic mutations are necessary to pass traits from one generation to the next, but new developments in genetics are challenging this fundamental assumption. A growing body of scien- tific evidence demonstrates that chemical alteration of the way a gene functions, whether through exposure to chemicals, foods or even traumatic experiences, may not only affect the exposed individual, but also the individual's offspring for two generations or more. This interaction between genes and the environment, known as epigenetics, has revolutionized the understanding of how genes are expressed within an individual and how …
Private Governance And The New Private Advocacy, Michael P. Vandenbergh, Benjamin Raker
Private Governance And The New Private Advocacy, Michael P. Vandenbergh, Benjamin Raker
Vanderbilt Law School Faculty Publications
Environmentat governance today involves more than just actions by government. It involves new standards by retailers that restrict the toxic chemicals in thousands of products and private certification and standards programs directed at fish, forests, and many agricultural products. It also includes investor-driven organizations that create pressure for carbon disclosure, tender-driven requirements for environmental assessments, and private-sector initiatives that drive demand for renewable power. This is the world of private environmental governance. Private environmental governance (PEG) occurs when private organizations perform the environmental protection functions traditionally assigned to government. See Michael Vandenbergh, Private Environmental Governance, 99 Cornell L. Rev. 129, …
The New Politics Of New Property And The Takings Clause, Christopher Serkin
The New Politics Of New Property And The Takings Clause, Christopher Serkin
Vanderbilt Law School Faculty Publications
This Essay offers a broad gloss on the traditional politics of property protection and then catalogues a number of ways in which those politics have been changing. In many cases, the account is of fragmentation and fracture as once stable commitments have become much more contingent and fact dependent.' Admittedly, this characterization paints with an extremely broad brush. That is both its contribution and its weakness. This short Essay deliberately simplifies the characterization of preferences across the political spectrum. Much more nuanced definitions would better track the complexity of the underlying issues. Judges and scholars discussed below might also object …

Ukiyo-e Prints Course | Exhibition Catalogs
"Sukima is a Japanese word for a crack in a door, a narrow space that opens up when the panels of the sliding doors are pushed to the sides. ... You’ve seen enough to electrify your imagination and let it complete the picture. This is what happens when you look at a long and narrow ukiyo-e print in a pillar format – hashira-e. Or perhaps this partial sight only unleashes your curiosity and, craving a fuller view, you expand the narrow slit and can now enjoy broader vistas replete with details. For such cases ukiyo-e designers came up with …

Prey Naïveté And Predator-Prey Interactions Between Pterois Volitans, Pomacentridae, And Tetraodontidae In Two Reefs In The Guna Yala Archipelago, Panama, Jesse Garrett-Larsen
Independent Study Project (ISP) Collection
The invasion of Pterois volitans along the Atlantic coast of the Americas is one of the top marine conservation issues of the century. Prey naïveté has been suggested as a mechanism for the success of P. volitans, but conclusive field observations have not been completed. This study tested for prey naïveté in situ by comparing time spent by Pomacentridae and Tetraodontidae in close proximity to P. volitans and a native predator, Cephalopholis cruentata. Difference in time spent by Pomacentridae and Tetraodontidae in the presence of the two predators was observed. The predators P. volitans and C. cruentata were sequentially observed …

The Anti-Human Condition: Violence, Identity, And Coming-Of-Age In The Painted Bird, Malcolm Conner
The Anti-Human Condition: Violence, Identity, And Coming-Of-Age In The Painted Bird, Malcolm Conner
Undergraduate Student Research Awards
Jerzy Kosinski’s first novel, The Painted Bird, (1965) remains one of the most controversial works of Holocaust fiction ever published. A dystopic coming-of-age story set on a Bosch-like backdrop of war-torn eastern Europe, the novel is loosely based off Kosinski’s experiences during World War II, when he and his family hid from the Nazis in rural Poland. (Sloan, 7-54) The nameless protagonist – known only as the boy – passes from village to village as an unwanted outsider, often abused and barely surviving. For six years, “the boy's life is an unmitigated series of horrors and atrocities, which though episodic …

The Psychology Of Neurofeedback: Clinical Intervention Even If Applied Placebo, Robert T. Thibault, Amir Raz
The Psychology Of Neurofeedback: Clinical Intervention Even If Applied Placebo, Robert T. Thibault, Amir Raz
Psychology Faculty Articles and Research
Advocates of neurofeedback make bold claims concerning brain regulation, treatment of disorders, and mental health. Decades of research and thousands of peer-reviewed publications support neurofeedback using electroencephalography (EEG-nf); yet, few experiments isolate the act of receiving feedback from a specific brain signal as a necessary precursor to obtain the purported benefits. Moreover, while psychosocial parameters including participant motivation and expectation, rather than neurobiological substrates, seem to fuel clinical improvement across a wide range of disorders, for-profit clinics continue to sprout across North America and Europe. Here, we highlight the tenuous evidence supporting EEG-nf and sketch out the weaknesses of this …

3‐Ethyl‐3‐phenylpyrrolidin‐2‐one (EPP) is an experimental anticonvulsant based on the newly proposed α‐substituted amide group pharmacophore. These compounds show robust activity in animal models of drug‐resistant epilepsy and are thus promising for clinical development. In order to understand pharmaceutically relevant properties of such compounds, we are conducting an extensive investigation of their structures in the solid state. In this article, we report chiral high‐performance liquid chromatography (HPLC) separation, determination of absolute configuration of enantiomers, and crystal structures of EPP. Preparative resolution of EPP enantiomers by chiral HPLC was accomplished on the Chiralcel OJ stationary phase in the polar‐organic mode. Using …
The Case Against Property Rights In Old Intangible Indigenous Cultural Property, Dennis S. Karjala, Robert K. Paterson
The Case Against Property Rights In Old Intangible Indigenous Cultural Property, Dennis S. Karjala, Robert K. Paterson
Northwestern Journal of Technology and Intellectual Property
This article critically reviews some of the recent literature calling for intellectual property rights in indigenous cultural knowledge. In an earlier piece, we argued generally against the notion of defining a new class of “indigenous cultural property” analogous to copyright and patent rights. Rather, we must analyze demands for more protection for old cultural property by building from the ground up, using judicial interpretation or carefully tailored statutory amendments to determine whether the work in question is one that should be protected by a new right and, if so, deciding both the scope and term of protection. Intellectual property involves …

Weaving Identity: Stories And Manifestations Of Amazigh Carpet Weavers In The Moroccan Village Of Tarmilat, Alessandra Roggero
Weaving Identity: Stories And Manifestations Of Amazigh Carpet Weavers In The Moroccan Village Of Tarmilat, Alessandra Roggero
Independent Study Project (ISP) Collection
It is in the small villages of Morocco, scattered across the North in the Rif, to the South in the Anti-Atlas Mountains, and in between, where the majority of Morocco’s celebrated and beloved Amazigh carpets are made. Their power and popularity can be attributed to the indigenous female artists who have been crafting these physical tokens of memory, protection, and Amazigh identity, for millenniums. In an attempt to connect the trade of carpet weaving in Morocco back to these women and their families, this research project will explore their narratives, and the social and spatial implications of their craft, a …

Community Management And Governance Of Comatsa-Sud New Protected Area (Ambalamanasy Ii Commune), Allison Tennant
Independent Study Project (ISP) Collection
Community-based natural resource management is an increasingly more popular choice for governments to delegate power back to local communities to conserve the resources they rely on. In Madagascar, where much of the rural population provides for their livelihoods by using natural resources, this governance structure, in cooperation with delegated manager for assistance, presents an opportunity for economic development in cooperation with conservation efforts. This paper aims to better understand the role of community, NGO, and governmental actors in creating and executing community management structures. Through Participatory Rural Analysis and structured and semi-structured interviews, it explores what management transfers look like …

Land Insecurity In Gulu, Uganda: A Clash Between Culture And Capitalism, Zachary Slotkin
Independent Study Project (ISP) Collection
This paper presents the causes and consequences of land insecurity in Gulu, Uganda. In order to address this important and often sensitive issue, the paper analyzes the role of the Lord’s Resistance Army (LRA) insurgency and the government’s policy of forced encampment during the insurgency in contributing to land insecurity, causing widespread displacement among former internally displaced persons (IDPs). It further explores the importance of land ownership in providing economic productivity to rural landowners, as well as the nature of customary land tenure in Acholi culture and the government’s efforts to privatize communal land, to give a background on the …

Treating A 20 Mm Hg Gradient Alleviates Myocardial Hypertrophy In Experimental Aortic Coarctation, David C. Wendell, Ingeborg Friehs, Margaret M. Samyn, Leanne Harmann, John F. Ladisa
Biomedical Engineering Faculty Research and Publications
Background
Children with coarctation of the aorta (CoA) can have a hyperdynamic and remodeled left ventricle (LV) from increased afterload. Literature from an experimental model suggests the putative 20 mm Hg blood pressure gradient (BPG) treatment guideline frequently implemented in CoA studies may permit irreversible vascular changes. LV remodeling from pressure overload has been studied, but data are limited following correction and using a clinically representative BPG.
Materials and methods
Rabbits underwent CoA at 10 weeks to induce a 20 mm Hg BPG using permanent or dissolvable suture thereby replicating untreated and corrected CoA, respectively. Cardiac function was evaluated at …

The genus Thiomicrorhabdus (Tmr) in the Piskirickettsiaceae in the Thiotrichales of the Gammaproteobacteria contains four species of sulfur-oxidising obligate chemolithoautotroph with validly published names, all previously classified as Thiomicrospira (Tms) species. Here we demonstrate that Thiomicrospira hydrogeniphila, a recently published hydrogen-utilising chemolithoautotroph closely related to Thiomicrorhabdus frisia (type species of Thiomicrorhabdus) should be classified as a member of the genus Thiomicrorhabdus and not Thiomicrospira, as Thiomicrorhabdus hydrogeniphila comb. nov., on the basis of comparative physiology and morphology as well as 16S rRNA (rrs) gene identity of Tms. hydrogeniphila MAS2T being closer to that of Tmr. frisia JB-A2T (99.1 …

Variation in venom toxicity and composition exists in many species. In this study, venom potency and venom gland gene expression was evaluated in Centruroides vittatus, size class I-II (immature) and size class IV (adults/penultimate instars) size classes. Venom toxicity was evaluated by probit analysis and returned ED50 values of 50.1 μg/g for class IV compared to 134.2 μg/g for class I-II 24 hours post injection, suggesting size class IV was 2.7 fold more potent. Next generation sequencing (NGS and qPCR were used to characterize venom gland gene expression. NGS data was assembled into 36,795 contigs, and annotated using BLASTx …

The Role Of Cyclin-Dependent Kinase 8 In Vascular Disease, Desiree Leach
The Role Of Cyclin-Dependent Kinase 8 In Vascular Disease, Desiree Leach
Theses and Dissertations
In response to injury, mature vascular smooth muscle cells (SMCs) undergo dedifferentiation, also known as phenotype modulation or switch. This process is characterized by a downregulation or loss of expression of contractile genes and concomitant with an increase in cell proliferation, migration, and extracellular matrix production, thereby leading to vascular lesion formation. However, the underlying molecular mechanism is not fully understood. The objective of my study was to determine whether cyclin-dependent kinase 8 (CDK8), a transcription-regulating kinase, plays a mediator role in vascular SMC dedifferentiation and lesion formation. Our results from immunochemical staining and Western blot revealed that CDK8 expression …
