Smoke 'Em If You Got 'Em: Intellectual Property Rights In The Tobacco Industry Going Up In Smoke, Kristen Lease

The Tobacco Plain Packaging Act (TPPA) was passed in Australia in 2011 and set restrictions on the appearance of tobacco packages. The restrictions limited the use of trademarks to only the brand name, and banned any use of distinctive colors or images. Tobacco growing nations believed this restriction on trade dress violated Article 20 of the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement, which guarantees that no restriction may unjustifiably encumber intellectual property. Article 8 of the TRIPS Agreement, however, allows for encumbrances when it is intended to promote the protection of public health and safety. The tobacco growing …

This article argues that universal access to drugs requires not only collaboration between nations and patent holders, but also the creation of a neutral International Panel. Under the supervision of a Neutral International Panel, the disequilibrium, created by the current system of global intellectual property protection can be equalized to improve access to drugs without undermining pharmaceutical companies and intellectual property rights.

Public Enemy: The Public Element Of Direct And Public Incitement To Commit Genocide, Brendan Saslow

Direct and public incitement to commit genocide has been an international crime since the 1940s. The public element plays a role in each international incitement case, yet many scholars consider it straightforward and unworthy of attention. This article seeks to analyze jurisprudence, primarily developed at the International Criminal Tribunal for Rwanda, on how to determine whether inciting to commit genocide is public. This element is most problematic in cases involving speech through broadcast media such as television and radio. Moreover if ICTR case law informs future international criminal proceedings it may be an issue in a future genocide that involves …

Preparation Of Biomass Derived Porous Carbon: Application For Methane Energy Storage, Yong Sun, Guangzhi Sun

The porous carbon with high specific surface area of 3001 m2/g and pore volume of 1.59 cm3/g using corncob was prepared for methane storage. The low and high pressure adsorption equilibria were tested using the prepared carbon. The capacity of methane storage is evaluated using Tóth model with correction of fugacity using Benedict-Webb-Rubin equation of state in high pressure range. The theoretical maximum adsorption amount is achieved to be approximately 3.3 mmol/g. The adsorption process indicates physisorption dominates the adsorption with heterogeneous adsorption characteristic of sites on the surface of adsorbent at low pressure. The concept of capstone units is gaining currency within the Australian Higher Education system, with a growing focus on enhancing graduate employability and assuring graduate outcomes. The aim of this paper is to report on an 18-month study of undergraduate journalism capstone units in Australian universities. Just over half of the universities in Australia that teach journalism (16 out of 30), embed capstone units in their programmes, and the study, which began in September 2015, is part of part of an Australian Learning and Teaching Fellowship. The purpose of this action research was to explore effective management techniques in a 1:1 classroom by seeking solutions to the problem of students being distracted on their devices during class. I conducted this action research in my classroom, with twelve participants in the 8th grade at Moses Junior High School (pseudonym) in Cedar Falls, Iowa for thirty days. Global warming has been associated with an increase of mosquito-borne diseases. Mosquito-borne diseases currently have no prescription remedies. The counties across the state of Iowa will increase their fogging procedure, to supplement the increase in mosquitos and mosquito-borne diseases. This study examined which chemicals each county uses for mosquito abatement, the patterns and frequency of spraying, and what patterns of human exposure may be occurring. Although crime has continued to decline over the last decade, the incarceration of minority youth happens at higher rates compared to their white counterparts. Incarcerated youth face trauma at high rates. Trauma can impact an individual's behavior and response to stress. Many incarcerated youth have substance use disorders (SUDs) and a relapse of substance use can result in a relapse of criminal behavior. When a youth is heavily immersed within the juvenile justice system, they are often placed within residential treatment centers (RTC). On route, I examine another question – namely whether agents can, without having any relevant false beliefs, perform actions motivated by the badness of those actions. Gypsum board, an economical and durable finish material for wall and ceiling construction in the United States and worldwide, is the component with the lowest thermal performance in a typical exterior wall assembly. It also constitutes a substantial portion of construction waste in landfills, potentially creating harmful environmental effects and dangerous gases. Congenital heart defects are one of the leading causes of infant death. High maternal blood serum levels of the amino acid homocysteine and the frequency of heart defects are correlated, but the immediate cause is unknown. During early embryonic development, a distinctive population of cells arises dorsally as the neural tube closes, forming the brain and spinal cord. These are the neural crest cells, which play a crucial role in the development of the nervous system, head skeletal, certain endocrine and connective tissues, and, notably, the heart’s outflow region. A central question in the literature on customary international law (CIL) goes to method: what is the proper method for “finding” CIL – that is, for determining that particular norms qualify as CIL? The traditional method is to identify a widespread state practice, plus evidence that states believe that the practice reflects the law (opinio juris). That method has long been criticized as incoherent, unworkable, and out of touch with modern sensibilities. Thus, much of the CIL literature addresses its perceived problems. There have been demands to increase faculty and student diversity, change curricular requirements, and adopt mandatory cultural sensitivity trainings. This action research study was designed to implement flipped classroom professional development for high school teachers, and investigate whether the flipped professional development could be transferred from the teacher learning into student learning. Over three months the teachers' flipped professional development covered the flipped classroom model, differentiated group work, and the technologies needed to flip a lesson. Each of the seven participants created and delivered three flipped lessons in their classrooms.
