Trademark Exhaustion And The Internet Of Resold Things, Yvette Joy Liebesman Jan 2016

Trademark Exhaustion And The Internet Of Resold Things, Yvette Joy Liebesman

All Faculty Scholarship

Over the past ten years, casual resellers have migrated from garage sales, swap meets, and classified ads to eBay and Craigslist, turning side hobbies into lucrative businesses. Today, 30 million new ads are posted on Craigslist every month, and six million new listings are posted daily on eBay.1 The explosive online market has affected the sales of new goods, troubling manufacturers2 who seek to curtail the growth of this secondary market through several avenues—some legitimate, and others not so much. For example, to combat diversion to resellers outside of its official distribution chain, Tiffany, Inc., the well-known jeweler, …

Once We're Done Honeymooning: Obergefell V. Hodges, Incrementalism, And Advances For Sexual Orientation Anti-Discrimination, Jeremiah A. Ho

All Faculty Scholarship

Undoubtedly, the Supreme Court’s marriage equality decision in Obergefell v. Hodges is the watershed civil rights decision of our time. Since U.S. v. Windsor, each recent victory for same-sex couples in the federal courts evidenced that the legal recognition of same-sex marriages in the U.S. was becoming increasingly secure. Meanwhile, momentum was growing for the visibility of sexual minorities nationally. Yet, is marriage equality the last stop in the pro-LGBTQ movement, or should we expect sexual minorities to advance in other legal arenas? Should we expect that the recent strides in marriage equality from Windsor to Obergefell can somehow leverage …

Missing The 'Target': Preventing The Unjust Inclusion Of Vulnerable Children For Medical Research Studies, Ruqaiijah Yearby Jan 2016

Missing The 'Target': Preventing The Unjust Inclusion Of Vulnerable Children For Medical Research Studies, Ruqaiijah Yearby

All Faculty Scholarship

The central purpose of medical research on children is to generate new knowledge that can improve children’s health, subject to ethical standards that promote justice. Incorporated in U.S. law, international law, and European Union law, the Justice Principle prohibits targeting in medical research, which is the selection of research subjects because of their manipulability and compromised position, rather than for reasons directly related to the problem being studied. Unfortunately, medical research studies involving children have too often violated the Justice Principle, by targeting children in a compromised position due to their health status and vulnerable to manipulability because of their …

Oh, What A Relief It (Sometimes) Is: An Analysis Of Chapter 7 Bankruptcy Petitions To Discharge Student Loans, Aaron N. Taylor, Daniel Sheffner Jan 2016

Oh, What A Relief It (Sometimes) Is: An Analysis Of Chapter 7 Bankruptcy Petitions To Discharge Student Loans, Aaron N. Taylor, Daniel Sheffner

All Faculty Scholarship

Conventional wisdom dictates that it is all-but-impossible to discharge student loans in bankruptcy. This contention, however, misstates the fact that bankruptcy discharge of student loans is possible—and it happens. This Article presents a statistical analysis of what happened when Chapter 7 bankruptcy petitioners in the First and Third federal judicial circuits filed 523(a)(8) adversary proceedings—or proceedings to discharge their student loan debt due to an “undue hardship.” In our analysis, we found undue hardship discharge rates of 54% in the First Circuit and 24% in the Third Circuit. But more significantly, we found that undue hardship determinations were relatively rare. …

Hidden From View: Disability, Segregation And Work, Elizabeth Pendo Jan 2016

Hidden From View: Disability, Segregation And Work, Elizabeth Pendo

All Faculty Scholarship

The employment provisions of the Americans with Disabilities Act of 1990 were intended to bring working-age people with disabilities into the workplace by providing options for them to seek and gain meaningful, integrated employment. Although the ADA has made significant gains, the rate of progress in employment has been disappointing. While the lack of progress of people with disabilities in the traditional workplace has received attention, the work done by many, especially those with severe disabilities in segregated workplaces, remains hidden in sheltered workshops. This chapter explores the intersection of the concepts of disability, invisibility, and work and identifies the …

Imprisonment Inertia And Public Attitudes Toward "Truth In Sentencing", Michael M. O'Hear, Darren Wheelock Jan 2016

Imprisonment Inertia And Public Attitudes Toward "Truth In Sentencing", Michael M. O'Hear, Darren Wheelock

Social and Cultural Sciences Faculty Research and Publications

In the space of a few short years in the 1990s, forty-two states adopted truth in sentencing (“TIS”) laws, which eliminated or greatly curtailed opportunities for criminal defendants to obtain parole release from prison. In the following decade, the pendulum seemingly swung in the opposite direction, with thirty-six states adopting new early release opportunities for prisoners. However, few of these initiatives had much impact, and prison populations continued to rise. The TIS ideal remained strong. In the hope of developing a better understanding of these trends and of the prospects for more robust early release reforms in the future, the …

Speaking Of Stigma And The Silence Of Shame: Young Men And Sexual Victimization, Heather R. Hlavka Jan 2016

Speaking Of Stigma And The Silence Of Shame: Young Men And Sexual Victimization, Heather R. Hlavka

Social and Cultural Sciences Faculty Research and Publications

This study addresses male sexual victimization as that which is both invisible and incomprehensible. Forensic interviews with young men following reports of suspected sexual assault reveal patterns of heteronormative scripts appropriated to make sense of sexual victimization. These scripts show that victimhood is largely incompatible with dominant notions of masculinity. Sexual coercion and assault embodied threat to boys’ (hetero)gendered selves, as they described feelings of shame and embarrassment, disempowerment, and emasculation. These masks of masculinity create barriers to disclosure and help to explain the serious underreporting of male sexual victimization. Questions of coercion and consent are addressed, as it relates …

Analysis Of Curved Composite Beam, Manish Aggarwal

Graduate Theses, Dissertations, and Problem Reports (ETD)

Composite materials are steadily replacing traditional materials in many engineering applications due to several benefits such as high strength to weight ratio and the ability to tailor the material for specific purposes. Over the last several decades the analysis of straight beams has received considerable attention while there is very little focus on curved composite beams.;In the present study, the formulation of the bending of a curved composite beam is based on the bending theory of thick shells. A variational formulation is employed to derive the governing equations. A consistent methodology is applied to reduce the two-dimensional nature of the …

Conditioning The Estimating Ultimate Recovery Of Shale Wells To Reservoir And Completion Parameters, Maher Jasim Alabboodi Jan 2016

Conditioning The Estimating Ultimate Recovery Of Shale Wells To Reservoir And Completion Parameters, Maher Jasim Alabboodi

Graduate Theses, Dissertations, and Problem Reports (ETD)

In the last years, gas production from shale has increased significantly in the United States. Therefore, many studies have been focused on shale formation in different areas such as fracturing, reservoir simulation, forecasting and so on. Forecasting production or estimating ultimate recovery (EUR) is considered to be one of the most important items in the production development planning. The certainty in EUR calculation is questionable because there are different parameters that impact production and consequently the EUR such as rock properties and well completion design.;Different methods to calculate EUR have been used in the industry. Traditionally, the decline curve analysis …

Determination Of Cost-Effective Range In Surface Finish For Single Pass Turning, Mazin Fahad Alahmadi

Graduate Theses, Dissertations, and Problem Reports (ETD)

Surface finish is considered a critical characteristic for manufacturing components when manufacturers strive to produce components with high-quality characteristics predefined by design engineers. The objective of this research is to provide a cost-effective range in surface finish for single pass turning that enables the design engineers to explore a wider spectrum of alternative solutions without significantly affecting the functionality of the part. Apart from the one optimal solution, the proposed methodology, which is based on Geometric Programming, would provide a range of cutting conditions solutions that satisfy the economic and functional needs for the designer. This can be achieved by …

Impact Of Nanoscale Pore Sizes On The Flow Of Gas Mixtures In Marcellus Shale Reservoir, Noor Mazher Alfashkhi Jan 2016

Impact Of Nanoscale Pore Sizes On The Flow Of Gas Mixtures In Marcellus Shale Reservoir, Noor Mazher Alfashkhi

Graduate Theses, Dissertations, and Problem Reports (ETD)

Pore proximity effect in shale reservoirs, unlike the conventional reservoirs, is very significant because the shale matrix contains pores in the range of nano meter that impact the phase behavior and fluid properties of the gas mixtures. The changes to the critical properties of the natural gas impacts the storage and flow in shale matrix. For optimization of gas extraction, understanding the gas properties is of great research interest.;In this research the impact of confinement on the gas viscosity and compressibility factor were evaluated using two typical composition of Marcellus shale gas. The results are to be used in formulating …

Rna-Protein Interaction Prediction: String-Based Versus Feature-Based Models, Maen Allaga Jan 2016

Rna-Protein Interaction Prediction: String-Based Versus Feature-Based Models, Maen Allaga

Graduate Theses, Dissertations, and Problem Reports (ETD)

Cellular processes are significantly influenced by the interactions between different RNAs and proteins within cells. This interaction is crucial in understanding gene expressions and gene regulations, and their role in various diseases. Empirical and experimental methods to study this interaction are hampered by the high cost and combinatorial nature of the problem. Consequently, computer science and machine learning methods were applied to predict the interaction between RNAs and proteins.;RNAs are sequences of nucleotides, while proteins are sequences of amino acids. The protein secondary structure describes how amino acids are positioned in three dimensional space. Early methods predicted the interaction between …

Novel Cell Penetrating Peptide-Adaptors Effect Intracellular Delivery And Endosomal Escape Of Protein Cargos, John C. Salerno, Verra M. Ngwa, Scott J. Nowak, Carol A. Chrestensen, Allison N. Healey, Jonathan L. Mcmurry Jan 2016

Novel Cell Penetrating Peptide-Adaptors Effect Intracellular Delivery And Endosomal Escape Of Protein Cargos, John C. Salerno, Verra M. Ngwa, Scott J. Nowak, Carol A. Chrestensen, Allison N. Healey, Jonathan L. Mcmurry

Faculty Articles

The use of cell penetrating peptides (CPPs) as biomolecular delivery vehicles holds great promise for therapeutic and other applications, but development has been stymied by poor delivery and lack of endosomal escape. We have developed a CPP-adaptor system capable of efficient intracellular delivery and endosomal escape of user-defined protein cargos. The cell penetrating sequence of HIV transactivator of transcription was fused to calmodulin, which binds with subnanomolar affinity to proteins containing a calmodulin binding site. Our strategy has tremendous advantage over prior CPP technologies because it utilizes high affinity noncovalent, but reversible coupling between CPP and cargo. Three different cargo …

Instructors' Perceptions Of Their Students' Conceptions: The Case In Undergraduate Mathematics, Wes Maciejewski Jan 2016

Instructors' Perceptions Of Their Students' Conceptions: The Case In Undergraduate Mathematics, Wes Maciejewski

Faculty Research, Scholarly, and Creative Activity

How a student conceives the nature of a subject they study affects the approach they take to that study and ultimately their learning outcome. This conception is shaped by prior experience with the subject and has a lasting impact on the student's learning. For subsequent education to be effective, an instructor must link the current topic to the student's prior knowledge. Short of assessing their students, an instructor relies on their subjective experience, intuitions, and perceptions about this prior knowledge. These perceptions shape the educational experience. The current study explores, in the context of undergraduate mathematics, the alignment of instructors' …

Predation Of A Scorpion (Scorpiones: Buthidae) By An Assassin Bug(Heteroptera: Reduviidae) In The Brazilian Atlantic Forest, André Lira, Victor Araújo, Cleide Albuquerque

Turkish Journal of Zoology

Litter-dwelling arthropods comprise about three-fourths of the total animal biomass in tropical forests. These invertebrates are involved in many interspecific interactions, from mutualism to predation. We report herein the predation of a scorpion by an immature assassin bug (Harpactorini) during a nocturnal manual search for scorpions in a fragment of the Brazilian Atlantic Forest. The specimens were found 15 cm above the ground on a seedling, and the prey was two-fold larger than the predator. The assassin bug had its rostrum inserted into the pleura of a juvenile Tityus pusillus Pocock, 1893 scorpion, between the first and second segments of …

On The Distribution And Taxonomy Of Bats Of The Myotis Mystacinus Morphogroup From The Caucasus Region (Chiroptera: Vespertilionidae), Petr Benda, Suren Gazaryan, Peter Vallo

Turkish Journal of Zoology

Due to the combination of general morphological similarity among representatives of particular populations and/or taxa, the taxonomy of the Myotis mystacinus morphogroup is traditionally considered to be one of the most complex topics of bat systematics. We used a combination of genetic and morphological approaches to identify which taxa of the morphogroup inhabit the broader Caucasus region (i.e. the territory between Crimea, Southern Russia, Northern Anatolia, and Northern Iran, incl.) and to define the relationships of these taxa to other Palaearctic populations of the morphogroup. Based on the genetic identification (complete sequence of the cytochrome b gene) of 56 specimens …
