This Comment calls for the rethinking of the international emphasis on human trafficking by looking at its neglected sister and illuminating the consequences of mis-defining two related yet distinct international criminal offenses. This Comment is an original intervention in the area of international and transnational crime. It is the first of its kind to examine the deficiencies of the Smuggling Protocol through case studies and the first to offer practical reforms and theoretical clarifications of the definition of human smuggling to serve as a useful tool in future attempts to combat human smuggling and human trafficking. The Evolution Of China’S Legislation On Reproduction, Du Yifang

This Article discusses how Chinas policy on reproduction developed from one that encouraged population growth to the very restrictive one-child policy. Part I discusses the factors underlying the establishment of the reproduction system after 1949. Part II analyzes the transition of national olicy and legislation over the period from 1980 to 2001 from encouraging to controlling childbirth. Part III discusses, in detail, the development and implementation of the one-child policy, and Part IV discusses the effects of this development. Finally, Part V explains the 2016 amendment to the Population and Family Planning Law in China, which abandoned the one-child policy.

A Rose By Any Other Name: How The United States Charges Its Service Members For Violating The Laws Of War, Chris Jenks

This chapter examines the US practice of not charging its service members with war crimes. The chapter briefly explains how the United States asserts criminal jurisdiction over its service members before turning to how the US military reports violations of the laws of war. It then sets out the US methodology for charging such violations as applied to its service members, and compares this methodology to that applied to those tried by military commissions. The chapter then discusses the varied meanings of the term ‘war crimes’ and the way in which the 1949 Geneva Conventions can provide a benchmark against …

This thesis is interested in forms of “imperfection” in Geoffrey Chaucer’s Canterbury Tales. I define “imperfection” as an authorial gesture performed to narrate an idealized virwhile depriving it from its idealism. The imperfection of a virtue, however, does not happen absolutely. It is the character’s incomplete, distorted, or decadent command of a given virtue, rather than the viritself, that makes it imperfect. Consisting of three chapters, the thesis examines Chaucer’s imperfection of things idealized within two medieval spaces: a) the ecclesiastical institution of Church and b) the secular institution of Knighthood. Institutional practices evolve to fill gaps in all constitutional blueprints. One of the underappreciated features of the initial constitutional settlement of war powers was the accountability of the executive through the process of budgetary authorization and the corresponding need for Congress to answer to the citizenry for the tax implications of military expenditures. This political accountability is more complex than often described, consisting not merely of the division of the Declare War and Commander-in-Chief Clauses of Article I and Article II, but also of the temporal limitation of the budgetary power for the army and a variety of practical and …

The Norm Against Economic Espionage For The Benefit Of Private Firms: Some Theoretical Reflections, Samuel J. Rascoff

For decades, the American intelligence community has adhered to a norm against spying for the sake of enriching private firms. More recently, the norm has figured in a prominent presidential directive as well as in various international agreements. But notwithstanding its durability and its newfound renown, the norm has largely eluded scholarly consideration. In this Essay, I aim to address that gap by showing how theories of agency capture and institutional culture can help make sense of the norm’s past and inform judgments about its future.

In the scholarly literature, colonizationists and radical abolitionists are portrayed as composing perpetually warring camps. While that may have been true at the state and national levels of the movements, the evidence suggests that the relationship between the groups was much more fluid at the grassroots. In Washington County, Pennsylvania, colonizationists and radical abolitionists cooperated on various community-development initiatives during the 1830s. Slavery was important to these community elites. But other issues were just as important to them, if not more.

Rampage School Shootings are a violation of one’s right to life, liberty, and the pursuit of individual happiness. Little children, school teachers head out to school, only to never return home at the end of the day. Idiosyncratic psycho-social behaviors drive Rampage School Shooter (RSS) violence. The fact of the matter remains true; Rampage School Shooters don’t “… ‘just snap’… They plan” (U.S. Secret Service, 2002, p. 11). This descriptive, exploratory study consists of RSS cases (N=59) derived from triangulated, retrospective, historical accounts (1995-2015). A quantitative, non-experimental research design was employed.

In her article, “Youth Voices in the War Diary Business,” Susan Honeyman argues that interviews with children and youth – although influenced by the adult population – “resist being reducible simply to war propaganda or protectionist sentimentality” (74). This is especially true for award-winning author and peace activist Deborah Ellis, whose recent nonfiction – Children of War: Voices of Iraqi Refugees (2009), Off to War: Voices of Soldier’s Children (2008), and Three Wishes: Palestinian and Israeli Children (2004) – tend to lack “imposing adult interpretation” (Honeyman 82). A reliable understanding of seafloor characteristics can have innumerous application in a variety of fields of knowledge, such as ocean mapping and defense. In the last decades, studies associating backscatter intensity to seafloor characterization has increased based on the principle that different types of seabed may provide, a priori, different reflectivity responses patterns. Those differences in intensity can be used to attempt seafloor classification.

This paper examines the symbolism of the colors black, white, and red from ancient times to modern. It explores ancient myths, the Grimm canon of fairy tales, and modern film and television tropes in order to establish the continuity of certain symbolisms through time. In regards to the fairy tales, the examination focuses solely on the lesser-known stories, due to the large amounts of scholarship surrounding the “popular” tales. For a century and a half composers have been inspired by the classic works of composers from the Baroque and Classical periods. Composers who returned to the sounds and structures of the classics and used them as a model were called neoclassicists and created a new genre of music often identified as neoclassicism. It is commonly understood that the composer Igor Stravinsky and his contemporaries created this genre of music in the 1920s.
