Listening To Afro-Latinidad: The Sonic Archive Of Olú Clemente, Patricia Herrera Jan 2016

Listening To Afro-Latinidad: The Sonic Archive Of Olú Clemente, Patricia Herrera

Theatre and Dance Faculty Publications

For many Puerto Ricans and other Latinos, Roberto Clemente was more than just a baseball star. Above all, he was a symbol of hope and humanitarianism, succeeding despite the overt racial discrimination he encountered as a Black Puerto Rican. Off the field, Clemente was renowned and beloved for his involvement in charity work in Puerto Rico and other Latin American countries. His final humanitarian act came about in 1972 on New Year’s Eve when the plane chartered to deliver aid to earthquake victims in Nicaragua crashed into the ocean off the coast of Isla Verde, Puerto Rico. His sudden and …

“It’S Been A Hard Day’S Night” For Songwriters: Why The Ascap And Bmi Consent Decrees Must Undergo Reform, Brontë Lawson Turk Jan 2016

“It’S Been A Hard Day’S Night” For Songwriters: Why The Ascap And Bmi Consent Decrees Must Undergo Reform, Brontë Lawson Turk

Fordham Intellectual Property, Media and Entertainment Law Journal

In order to guarantee reasonable fees for songwriters, composers, and publishers, the consent decrees must undergo critical reform to account for how music is licensed in new media. Part I of this Note will provide background on the mechanics of music licensing, both traditional and through modern mediums, in order to explain why the two largest PROs initially entered into governmental consent decrees. Part II will discuss recent judicial determinations of “reasonable” licensing rates for public performances in new media and demonstrate the discrepancy in compensation between songwriters and their sound recording counterparts, namely record companies and recording artists. Finally, …

Reflections Of A Child Of The Sixties—I Have Lived To See The Post-Constitutional Era Through Guantánamo Bay Litigation, Stewart “Buz” Eisenberg Jan 2016

Reflections Of A Child Of The Sixties—I Have Lived To See The Post-Constitutional Era Through Guantánamo Bay Litigation, Stewart “Buz” Eisenberg

Western New England Law Review

This Article provides examples of how the Constitution’s Article III courts craft ways to amplify the voice of the voiceless and are the caretakers of a delicate constitutional democracy -- a democracy specifically designed to require its protection, governed by the Rule of Law. The Author described cumulative change in the wake of the atrocities of World War II from the Sixties when he was a child through the Civil Rights Act of 1964, the Warren Court, the Voting Rights Act, post-September 11, and finally to the dreadful theatre of Guantánamo Bay. Without the judiciary’s vigilance of the delicate balance …

Gesture, Intimacy, And Violence In Contemporary Artists’ Books, Lauren Benke Jan 2016

Gesture, Intimacy, And Violence In Contemporary Artists’ Books, Lauren Benke

Reconstruction: Studies in Contemporary Culture

[First paragraph]

The problem of the archive is a problem of lost gestures. The idea of the ephemeral body has shaped the development of performance and archival studies since the 1960s, when Richard Schechner described the theater as a transient medium that has "no original artwork at all" [2] and Marcia B. Siegel wrote that dance "exists at a perpetual vanishing point [. . .] it is an event that disappears in the very act of materializing" [3]. Even as archivists constantly innovate methods for preserving the gestures of performance art and embodied experience, the shift toward digitization means that, …

Far From The Madding Crowd: A Statutory Response To Crowd Crush, Tracy Hresko Pearl Jan 2016

Far From The Madding Crowd: A Statutory Response To Crowd Crush, Tracy Hresko Pearl

Faculty Articles

Crowd-related injuries and deaths occur with surprising frequency in the United States. In recent years, crowd members in the United States have sustained significant injuries and even fatalities at concerts, sporting events, “doorbuster” sales, nightclubs, and large festivals. While some of these incidents have prompted victims to file negligence suits against event organizers and venue owners, common law has proven to be ineffective at addressing “crowd crush.” Indeed, courts have repeatedly held for defendants in these cases, making a series of scientific and legal errors in the process, and providing little incentive for organizers and owners to improve their crowd …

A Translation And Analysis Of Spring's Bride By Mohammed Dib: Creating A Space For Indigenous North African Drama, Jordan Talbot Jan 2016

A Translation And Analysis Of Spring's Bride By Mohammed Dib: Creating A Space For Indigenous North African Drama, Jordan Talbot

All Master's Theses

The Ubu Repertory Theatre Script Collection, which is located in the archives at New York University, contains numerous manuscripts in the French language from dramatists all over the world. One of those manuscripts, La fiancée du printemps by Mohammed Dib, is my own translation of the text from French into English, now titled Spring’s Bride. The text operates as a plea for postcolonial solidarity in the face of an increasingly fragmented community. The characters of the play must confront their deeply held beliefs and their possible destructive power. The translation of this text presents the postcolonial perspective to an …

Women In Prison: Liberty, Equality, And Thinking Outside The Bars, Debra Parkes Jan 2016

Women In Prison: Liberty, Equality, And Thinking Outside The Bars, Debra Parkes

All Faculty Publications

This article considers the potential of rights-based advocacy to respond to the troubling reality of a growing women's prison population, and it makes an attempt to sketch out an approach to advocacy and scholarship that seeks both liberty and substantive equality for criminalized and imprisoned women. It proceeds in four parts. First, it documents some of the legislative and policy changes made to sentencing and penal law in the last decade. Next, it identifies some of the ways that these changes have an impact on women and on particular groups of women. It then suggests some ways that academics, lawyers, …

The Limits Of Statutory Interpretation: Towards Explicit Engagement, By The Supreme Court Of Canada, With The Charter Right To Freedom Of Expression In The Context Of Copyright, Graham Reynolds Jan 2016

The Limits Of Statutory Interpretation: Towards Explicit Engagement, By The Supreme Court Of Canada, With The Charter Right To Freedom Of Expression In The Context Of Copyright, Graham Reynolds

All Faculty Publications

In its post-2002 copyright jurisprudence, the Supreme Court of Canada has clarified that the Copyright Act grants a significant degree of latitude to non-copyright owning parties to express themselves using copyrighted works. This outcome is attributable neither to the SCC having interpreted provisions of the Copyright Act according to Charter values nor to the SCC having weighed provisions of the Copyright Act against the section 2(b) right to freedom of expression. Rather, it has resulted from the SCC interpreting provisions of the Copyright Act through the lens of the purpose of copyright, as re-articulated by the SCC. The author argues …

Merit Aid As A Predictor Variable Of Undergraduate Student Enrollment, Joseph P. Bagnoli Jr. Jan 2016

Merit Aid As A Predictor Variable Of Undergraduate Student Enrollment, Joseph P. Bagnoli Jr.

Theses and Dissertations--Educational Policy Studies and Evaluation

Merit-based financial aid has long been utilized by college and university enrollment managers to attract the most academically qualified applicants for admission. Considerable research has been done to illustrate the impact of state-based merit aid programs and other scholarly pursuits have drawn attention to the consequences of merit aid on institutional investments in need-based aid. Less is known about the efficacy of merit aid to achieve college student enrollment objectives. The purpose of this study was to evaluate the relationship between merit aid values and the likelihood of undergraduate student enrollment yield on offers of admission. The primary research question …

The Right-Of-Publicity Challenges For Tattoo Copyrights, Yolanda M. King Jan 2016

The Right-Of-Publicity Challenges For Tattoo Copyrights, Yolanda M. King

Faculty Articles, Papers, and Other Scholarship

This Article is the third and final piece of a series of articles that examine the applicability of intellectual property law to tattoos. The second article in the series, The Enforcement Challenges for Tattoo Copyrights, concluded that copyright owners can and should enforce their rights against users outside of the tattoo artist-customer relationship. This Article explores a different source of intellectual property protection for tattoos: the right of publicity. As tattooing has become increasingly prevalent among celebrities, tattoos have become “one” with the persona of the tattoo bearer. A tattoo that carries the meaning of a celebrity tattoo bearer serves …

Strengthening Archival Digitization Efforts With An Interdepartmental Approach: A Case Study, Jessica Hayden, Jane Monson, Emory J. Trask

University Libraries Publications

This case study details how the University of Northern Colorado (UNC) Libraries made the shift from a centralized model where digitization took place largely within the archives department, to a decentralized one that encompasses multiple library units. This shift came about as the result of the addition of a digital initiatives librarian position and the formation of a digitization steering committee comprised of employees representing different departments from throughout the Libraries. The result was a marked increase in the number of objects that could be digitized and made available online within a given period of time.
