Methamphetamine Users And Gender Differences In Their Acceptance Of Long-Term Substance Abuse Treatment Programs, Kevin Garen Stepanyan

Walden Dissertations and Doctoral Studies

Methamphetamine abuse is a problem of public health importance among men and women in the United States. The two genders are affected even though the majority treatment programs are tailored for male alcohol addicts. The gender differences are prevalent in the acceptance of long-term substance abuse treatment programs. The study focuses on gender differences in methamphetamine abuse and whether both male and female addicts benefit from treatment. Respondent's suitability, participant's abuse condition, treatment, and progress questionnaires and interviews are used to collect data from 50 male and 50 female methamphetamine users at the Impact Residential Program in Montreal, Canada. Alignment Of Standards, Assessment, And Compliance For A Residential Support Provider Organization, Monique Day Jan 2016

Alignment Of Standards, Assessment, And Compliance For A Residential Support Provider Organization, Monique Day

Walden Dissertations and Doctoral Studies

Although Code of Maryland policy mandates multidisciplinary, integrated teams for residential service provider organizations (RPOs) for an intellectual/developmental disabilities (IDD) population, alignment criteria to identify and evaluate the functional characteristics of such teams do not exist. This ambiguity has resulted in potential conflict in the goals of service delivery, as well as misaligned quality assessment and policy development criteria. The intent of this general qualitative study was to use complex adaptive systems theory and Vitkiene's work on corporate ethos to determine whether the services provided by a single RPO were consistent and aligned with the regulatory mandate set by the …

Financial Distress In The Health Care Business, Firas Fathi Musmar Jan 2016

Financial Distress In The Health Care Business, Firas Fathi Musmar

Walden Dissertations and Doctoral Studies

Sixty-four United States hospitals closed for poor organizational performance during 2010 through 2016. Because of hospital closures, community members experienced delays in obtaining needed care, reduced access to specialty care, and increased travel distances. Based on the balanced scorecard model theory, the purpose of this qualitative single case study was to explore strategies that 10 health care leaders used at a healthcare organization in central Texas to prevent financial distress. Semistructured interviews were conducted and archival organizational accounting records were reviewed, including company surveys with employees and patients. Data were thematically analyzed and triangulated to ensure the trustworthiness of interpretations. …

Attitudes Of Nigerian Mothers Toward Children With Autism Spectrum Disorder, Valentine Ntoo Chukwueloka Jan 2016

Attitudes Of Nigerian Mothers Toward Children With Autism Spectrum Disorder, Valentine Ntoo Chukwueloka

Walden Dissertations and Doctoral Studies

Autism spectrum disorder (ASD) is a form of developmental disability that affects many children in the U.S. and abroad. The Center for Disease Control (CDC) has indicated that 1 out of every 68 children is diagnosed with ASD in the United States. However, there was limited literature about the attitudinal dispositions of Nigerian mothers toward children with ASD and their lived experiences with a child with autism. The purpose of this qualitative study was to explore the attitudes of Nigerian mothers toward their children with autism. The theoretical foundation of this study was the variation of the social relational understanding …

Examining How Knowledge Managers Facilitate The Process Of Knowledge Creation In Organizations, Dean Allen Call Jan 2016

Examining How Knowledge Managers Facilitate The Process Of Knowledge Creation In Organizations, Dean Allen Call

Walden Dissertations and Doctoral Studies

The problem addressed in this study was how knowledge managers facilitated the process of knowledge creation. Researchers identified this area as important because it begins to fill the literature gap in the dynamics surrounding knowledge creation. Using 4 research questions developed from the theory of dynamic organizational knowledge creation, the study investigated how knowledge managers facilitated and supported knowledge creation, promoted knowledge formation, and accounted for knowledge gaps. The theory was selected to provide a framework and an analytical perspective on the process of knowledge creation. A qualitative research design was used to learn from a sample of 12 Chief …

Creating A Safe Newborn Environment Education Program For Postpartum Registered Nurses, Melanie Myers Jan 2016

Creating A Safe Newborn Environment Education Program For Postpartum Registered Nurses, Melanie Myers

Walden Dissertations and Doctoral Studies

In the United States, sudden infant death syndrome (SIDS) is the 3rd leading cause of death for infants; other unintentional sleep injuries are the 5th. In addition, the estimated newborn fall rate in the United States is 1.6 to 6.6 falls/10,000 live births. At the project facility, postpartum registered nurses observed parents engaging in behavior that did not contribute to a safe newborn environment such as placing the infant at risk for injury from a fall or from a sleep injury. This observation led to this current project, which examined the development of an educational program for post-partum nurses to …

Impact Of A Music Program On Students' Standardized Test Scores, Joan Murray Jan 2016

Impact Of A Music Program On Students' Standardized Test Scores, Joan Murray

Walden Dissertations and Doctoral Studies

Administrators at the focus school had not determined if participation in a music program has influenced students' academic achievement, thereby ushering doubt about the utility of this program. The purpose of this causal-comparative study was to determine the impact of the music program on students' English language arts (ELA) and math Measure of Academic Progress (MAP) scores. The theoretical foundation for this study was Miendlarzweska and Trost's model of musical training, which indicates the impact of musical training on academic, social, and cognitive outcomes and identifies factors that mediate that impact. Archival data were retrieved on 74 Grade 5-8 students …

Army Spouses' Perception Of Support Resources During Multiple Deployments, Sharon Elish Brannon Jan 2016

Army Spouses' Perception Of Support Resources During Multiple Deployments, Sharon Elish Brannon

Walden Dissertations and Doctoral Studies

The U.S Army and support resource providers have become interested in the experiences of Army spouses during deployments. Previous research indicated that military spouses’ perceptions of support resources were integral in the usage of support services. However, little research has examined the combined effects of Army spouses’ opinions and perceptions regarding their sense of community and support resources available during multiple deployments. This quantitative study, based on the family stress theory, recorded the opinions of 174 Army Spouses using the Army Spouses’ Perception Survey and the Sense of Community Index 2. Predictor variables constituted sense of community opinions and support …

A Qualitative Exploration Of The Use Of Contraband Cell Phones In Secured Facilities, Margaret E. Henderson Jan 2016

A Qualitative Exploration Of The Use Of Contraband Cell Phones In Secured Facilities, Margaret E. Henderson

Walden Dissertations and Doctoral Studies

Offenders accepting contraband cell phones in secured facilities violate state corrections law, and the possession of these cell phones is a form of risk taking behavior. When offenders continue this risky behavior, it affects their decision making in other domains where they are challenging authorities; and may impact the length of their incarceration. This qualitative phenomenological study examined the lived experience of ex-offenders who had contraband cell phones in secured correctional facilities in order to better understand their reasons for taking risks with contraband cell phones. The theoretical foundation for this study was Trimpop's risk-homeostasis and risk-motivation theories that suggest …

How Tenure In Higher Education Relates To Faculty Productivity And Retention, Cindy Kay Manjounes Jan 2016

How Tenure In Higher Education Relates To Faculty Productivity And Retention, Cindy Kay Manjounes

Walden Dissertations and Doctoral Studies

Some public university systems are considering abolishing tenure as a cost-saving mechanism, but little is known about how this change may impact organizational outcomes related to faculty retention and research productivity. Using Almendarez' human capital theory, the purpose of this concurrent mixed methods study was to explore how tenure relates to faculty retention and productivity at a convenience sample of public universities in mid-western states. Qualitative questions focused on faculty perceptions of factors that affected retention and productivity. Quantitative data from the Integrated Postsecondary Education Data System and publicly available information from institutions was used to explore questions about relationships …

The Role And Impact Of Cyber Security Mentoring, James O. Ellithorpe Jan 2016

The Role And Impact Of Cyber Security Mentoring, James O. Ellithorpe

Walden Dissertations and Doctoral Studies

Business organizations are faced with an enormous challenge to improve cyber security, as breeches and lapses through firewalls are increasingly commonplace. The Chief Information Security Officer (CISO) and Information Technology (IT) staff are constantly challenged to identify and purge online and network structural weaknesses. The goal is to reduce overall business risk because unresolved risks are a constant concern to consumers who are uneasy about cyber security failures. The purpose of this general qualitative study was to examine the role and impact of Cyber Security Mentoring (CSM) from the perspectives of the workplace CISO, mentors, and protégés, who were randomly …

The Lived Experience Of School Bus Drivers: Bullying Prevention On School Buses, Timothy Crable Jan 2016

The Lived Experience Of School Bus Drivers: Bullying Prevention On School Buses, Timothy Crable

Walden Dissertations and Doctoral Studies

U.S. school bus drivers witness bullying on their buses on a regular basis but are often not consulted on how to prevent bullying or how to maintain a safe environment. Over 24 million U.S. student passengers ride school buses daily, yet the voices of bus drivers have been inadequately represented in the development of school bullying policies. The purpose of this phenomenological study was to examine the lived experience of 12 active school bus drivers and their perceptions of bullying on the bus, driver training programs, school antibullying policies, and other mandated procedures developed for bus drivers. The conceptual framework …

Senior Army Women's Leader Behaviors And Their Civilian Career Transition, Sharon R. Hamilton Jan 2016

Senior Army Women's Leader Behaviors And Their Civilian Career Transition, Sharon R. Hamilton

Walden Dissertations and Doctoral Studies

Female retired Army colonels (FRACs) have significant potential to contribute to civilian organizations. To take advantage of that talent, it is important to have a better understanding of their behaviors based on their dual identities as women and leaders. The purpose of this qualitative case study was to understand the under researched factors accounting for the development of FRACs' leader behaviors and the transfer of those behaviors to civilian careers. The 4 underlying meta categories of leadership behavior formed the conceptual framework. The theory of planned behavior was used to explore potential influences on FRAC leader behavior development. The 3 …

Suppression Of Nlrp3 Inflammasome By Γ-Tocotrienol Ameliorates Type 2 Diabetes, Yongeun Kim, Wei Wang, Meshail Okla, Inhae Kang, Regis Moreau, Soonkyu Chung Jan 2016

Suppression Of Nlrp3 Inflammasome By Γ-Tocotrienol Ameliorates Type 2 Diabetes, Yongeun Kim, Wei Wang, Meshail Okla, Inhae Kang, Regis Moreau, Soonkyu Chung

Department of Nutrition and Health Sciences: Faculty Publications

The Nod-like receptor 3 (NLRP3) inflammasome is an intracellular sensor that sets off the innate immune system in response to microbial-derived and endogenous metabolic danger signals. We previously reported that γ-tocotrienol (γT3) attenuated adipose tissue inflammation and insulin resistance in diet-induced obesity, but the underlying mechanism remained elusive. Here, we investigated the effects of γT3 on NLRP3 inflammasome activation and attendant consequences on type 2 diabetes. γT3 repressed inflammasome activation, caspase-1 cleavage, and interleukin (IL) 1β secretion in murine macrophages, implicating the inhibition of NLRP3 inflammasome in the anti-inflammatory and antipyroptotic properties of γT3. Furthermore, supplementation of leptin-receptor KO mice …

The Ethos Of Cinema, Martin Seel Jan 2016

The Ethos Of Cinema, Martin Seel

Contemporary Aesthetics (Journal Archive)

The history of film has always been accompanied by a theoretical debate over its artistic potential. In the works of many theoreticians, more or less explicit anthropological speculations have played a significant role, focusing on the relation between cinema and formerly dominant modes of perception and living. Against this background, this paper addresses the position of film within the arts, and thus also the position of this art form vis-à-vis the role of art in relation to the human condition. One essential characteristic of films is that they are capable of bringing their audience into a specific state of being …

Ontology And The Aesthetics Of Cinematographic Bodies, Jean-Yves Heurtebise Jan 2016

Ontology And The Aesthetics Of Cinematographic Bodies, Jean-Yves Heurtebise

Contemporary Aesthetics (Journal Archive)

If it is true, as Bergson claimed, that the universe is the sum of images (less than “objective” things but more than “subjective” representations), and if it is correct, as Deleuze said, that this hypothesis bears direct consequences for our understanding of the cinematographic art, then the analysis of cinematographic images and, especially, of the cinematographic images of the body (this living part of matter, this incarnated form of consciousness) can provide not only interesting aesthetic comments about specific directors and films, but also a philosophical understanding of the diverse modes of the sensible incarnation of human bodies. Interestingly enough, …

The Law And Economics Of Proportionality In Discovery, Jonah B. Gelbach, Bruce H. Kobayashi Jan 2016

The Law And Economics Of Proportionality In Discovery, Jonah B. Gelbach, Bruce H. Kobayashi

Georgia Law Review

This Article analyzes the proportionality standard in discovery. Many believe the renewed emphasis on this standard contained in the 2015 Amendments to the Federal Rules of Civil Procedure has the potential to infuse litigation practice with considerably more attention to questions related to the costs and benefits of discovery. We discuss the history and rationale of proportionality's inclusion in Rule 26, adopting an analytical framework that focuses on how costs and benefits can diverge in litigation generally, and discovery in particular. Finally, we use this framework to understand the mechanics and challenges involved in deploying the six factors included in …

The Preliminary Injunction Standard In Diversity: A Typical Unguided Erie Choice, David E. Shipley Jan 2016

The Preliminary Injunction Standard In Diversity: A Typical Unguided Erie Choice, David E. Shipley

Georgia Law Review

The standard for granting preliminary injunctions in some states is not the same as the preliminary injunction standard that is followed in the federal district courts in the federal circuit where the state is located. For example, the interlocutory injunction standard in Georgia's superior courts is not as demanding as the preliminary injunction standard in Georgia's federal courts. Although state and federal courts in Georgia consider four similar factors in deciding whether to grant or deny provisional injunctive relief, a balancing or sliding scale approach can be used in Georgia's courts; the moving party need not prove all four of …

Miscarriage Of Justice: The Cognizability Of § 2255 Claims For Erroneous Career Offender Sentences, Matthew B. Rosenthal Jan 2016

Miscarriage Of Justice: The Cognizability Of § 2255 Claims For Erroneous Career Offender Sentences, Matthew B. Rosenthal

Georgia Law Review

Career offender sentencing enhancements present difficult questions for courts. One of the most difficult of these questions is deciding what crimes warrant the application of these serious enhancements. Federal courts sentencing defendants often must decide, with little guidance, what offenses constitute a "crime of violent" or "violent felony." On a few occasions, the Supreme Court has stepped in and told lower courts that certain crimes do not fit within these categories, and that their interpretation of the career offender enhancement is incorrect. Often, the recognition of this misapplication of the enhancements occurs years after an individual defendant has been convicted, …

A New "Prospective" On Advance Waivers Of Conflict In Georgia, Charles G. Spalding Jr. Jan 2016

A New "Prospective" On Advance Waivers Of Conflict In Georgia, Charles G. Spalding Jr.

Georgia Law Review

As law firms and their corporate clients continue to expand into different legal jurisdictions, and since the conflict of one attorney is imputed to the attorney's firm, the potential for conflicts of interest increases. A law firm retained to advise a corporate subsidiary in a minor matter in one state may be disqualified from another, more significant matter in a different jurisdiction if the potential client is adverse to the parent company in the initial representation. Without a method for prospective waiver of conflicts, a law firm's only recourse is seeking the consent of the currently represented client. To avoid …

Employer Escape Hatch Closed In Georgia: How The Interpretation Of Georgia's Apportionment Statute In Zaldivar Prohibits Employers From Using Respondeat Superior To Eschew Direct Negligence Claims, Michael D. Alfano Jr. Jan 2016

Employer Escape Hatch Closed In Georgia: How The Interpretation Of Georgia's Apportionment Statute In Zaldivar Prohibits Employers From Using Respondeat Superior To Eschew Direct Negligence Claims, Michael D. Alfano Jr.

Georgia Law Review

In Zaldivar v. Prickett, Prickett (plaintiff)was working on behalf of his employer (Overhead Door) when he collided with Zaldivar (defendant). Zaldivar filed a "Notice of Fault of Nonparty" under Georgia's apportionment statute; this had to effect of requiring a jury to consider the fault of Overhead Door, which had recently received three anonymous phone calls complaining about Prickett's driving. The Georgia Supreme Court held that Georgia's Apportionment statute required that fault be assigned to Overhead Door, despite Prickett's inability to recover from Overhead Door. In this Note, I vary the facts of Zaldivar: Zaldivar becomes Klutzy Kellie; Prickett becomes Prudent …

Best To Be Seen And Heard: A Child's Right To Appeal Termination Of Parental Rights, Anne E. Goodgame Jan 2016

Best To Be Seen And Heard: A Child's Right To Appeal Termination Of Parental Rights, Anne E. Goodgame

Georgia Law Review

Children are extremely vulnerable members of society, especially when they are involved in family court cases, such as dependency or termination of parental right's hearings. Fortunately, a growing awareness of the legal rights of children has led to children being deemed parties to these family court cases, being appointed an attorney, and being granted the right to be present and voice their opinions. However, children are still being denied the ability to take complete advantage of the rights due to them as parties to the legal proceeding, specifically the right to appeal the family court judge's order to terminate the …

A Most Precious Right: Equal Protection, Voter Photo Identification, And The Battle Brewing In Texas, Emily V. Cox Jan 2016

A Most Precious Right: Equal Protection, Voter Photo Identification, And The Battle Brewing In Texas, Emily V. Cox

Georgia Law Review

On a Tuesday in November, millions of Americans show
up and cast their votes, even in the face of cynicism,
perceived futility, and disappointment with the politicians
in Washington. It is the birthright of every citizen, and
there is simply nothing more fundamentally American.
The future of this right is now uncertain in the wake of the
United States Supreme Court decisions Crawford and
Shelby County. This Note suggests finding certainty by
re-framing the current test for the constitutionality of state
voting restrictions, the Anderson-Burdick Balancing Test.
This new imagining of the current test hinges on
identifying the nature of …

Privileging Professional Insider Trading, Sarah Baumgartel Jan 2016

Privileging Professional Insider Trading, Sarah Baumgartel

Georgia Law Review

This Article explores insider trading law's increasing
focus on personal relationships, and the way in which the
law has come to privilege professional over
nonprofessional insider trading. The Article discusses
how, in an effort to expand insider trading liability, the
government has sought to impose legal duties of loyalty
and confidentiality on a host of personal relationships not

otherwise subject to law-effectively basing civil and
criminal penalties on "corruption" in purely personal
relationships. At the same time, courts have adopted a
business property rationale regardingthe use of nonpublic
information and declined to prevent companies from
disclosing valuable nonpublic information to …

Talking Textualism, Practicing Pragmatism: Rethinking The Supreme Court's Approach To Statutory Interpretation, Robert J. Pushaw Jr. Jan 2016

Talking Textualism, Practicing Pragmatism: Rethinking The Supreme Court's Approach To Statutory Interpretation, Robert J. Pushaw Jr.

Georgia Law Review

The Supreme Court's general approach to statutory
interpretation is analytically incoherent. On the one
hand, the Court has expressly endorsed "textualism":
enforcing the plain meaning (i.e., ordinary usage) of a
statute's words, and therefore refusing to consider non-
textual evidence unless the language is unclear. On the
other hand, the Court has implicitly applied
'oragmatism"-reaching the best practical result after
examining not only a statute's text but also Congress's
intent (as revealed by legislative history), its overall
purposes, precedent, and policy.
The two cases upholding the Affordable Care Act (ACA)
illustrate this practice of purporting to follow textualism,
but then …

Let My People Grow: Putting A Number On Strict Scrutiny In The Wake Of Holt V. Hobbs, Dana A. Schwartzenfeld Jan 2016

Let My People Grow: Putting A Number On Strict Scrutiny In The Wake Of Holt V. Hobbs, Dana A. Schwartzenfeld

Georgia Law Review

Beards have always played an important role in human
society, especially in the religious context. One man's
beard even got him in front of the United States Supreme
Court. In Holt v. Hobbs, the Court decided that a prisoner
had a constitutional right to grow a one-half-inch beard
for religious purposes. In making the decision, the Court
made clear that the prisoner's religious interest far
outweighed any security threat that such a short beard
could pose to the prison. The Court declined to go any
further, however, in clarifying the beard length at which
the scales would begin to tip …

Cybersecurity On My Mind: Protecting Georgia Consumers From Data Breaches, Maggie L. Mcmichael Jan 2016

Cybersecurity On My Mind: Protecting Georgia Consumers From Data Breaches, Maggie L. Mcmichael

Georgia Law Review

In a world where vast amounts of personal information
are obtained and stored by countless organizations and
businesses in the public and private sector, data breaches,

due to negligence or nefarious hacking, are a far too
common occurrence. The results of a data breach can be
serious and widespread, from public humiliation to
identity theft and national security crises. In an effort to
protect consumers from the potentially devastating effects
of data breaches, the Federal Trade Commission has
begun to take enforcement action against businesses whose
data security practices are alleged to be unfair and
deceptive. Theoretically, states can take …

Poached Eggs: The Misclassification Of Egg Donors As Independent Contractors And How Egg Donors Can Contribute To The Argument For A New Category Of Worker-The Dependent Contractor, Carol L. Williamson Jan 2016

Poached Eggs: The Misclassification Of Egg Donors As Independent Contractors And How Egg Donors Can Contribute To The Argument For A New Category Of Worker-The Dependent Contractor, Carol L. Williamson

Georgia Law Review

As the growth in demand for egg donors is met with an
increasing number of women willing to supply their eggs,
changes need to be made to the way egg donors, and other
similarly situated workers, are classified in the
employment context. Most donor contracts are employer-
created forms that designate the donors as independent
contractors and thus spare the clinic the duty of providing
employment benefits. Unlike other on-demand service
providers, such as Uber-drivers, that have recently sought
re-classification as employees, women who donate eggs are
subject to physically invasive procedures and long-term
health risks that particularly obviate the …
