Corporate Criminal Liability For Algorithmic Price Fixing In Canada, Theodore Milosevic Jan 2016

Corporate Criminal Liability For Algorithmic Price Fixing In Canada, Theodore Milosevic

Canadian Journal of Law and Technology

The use of computerized algorithms is increasingly common in the modern business environment. An algorithm can be defined as ‘‘a set of mathematical instructions or rules that, especially if given to a computer, will help to calculate an answer to a problem.” As noted in this definition, algorithms are particularly powerful tools when combined with computing power. The proliferation of computerized algorithms in business settings has occasionally led to unintended and injurious outcomes. This is perhaps most notable in relation to the algorithmic trading of securities. The 2010 ‘‘Flash Crash” of the United States (U.S.) financial markets, during which key …

Digital Evidence And The Adversarial System, Colton Fehr Jan 2016

Digital Evidence And The Adversarial System, Colton Fehr

Canadian Journal of Law and Technology

Scholars have observed that the adversarial system tends to provide courts with only a ‘‘small snapshot of the technological whole,” which in turn forms the record upon which broader legal pronouncements occur. As a result, they contend that legislatures should be more proactive in making rules governing complex and rapidly advancing technologies, and that courts must show deference to these rules. Other scholars retort that, in practice, legislatures often fail to update obviously flawed and outdated privacy provisions. Whether due to special interest influence, majoritarian dislike of criminal suspects, or other institutional constraints, legislative responses have been wanting. As such, …

Predictability Of Delinquency Through Psychosocial And Environmental Variables Across Three Generational Status Groups, Margaret Frances Sabia Jan 2016

Predictability Of Delinquency Through Psychosocial And Environmental Variables Across Three Generational Status Groups, Margaret Frances Sabia

Walden Dissertations and Doctoral Studies

Issues such as the rapid growth of the immigrant youth population and delinquency among adolescents generate public safety concerns among the U.S. population. However, delinquency intervention strategies for immigrant youth in the United States remain scant, which is problematic because these youth face acculturative challenges that increase their risk for maladaptive outcomes. This quantitative, cross-sectional study addressed a research gap regarding the differential influence of risk factors in predicting delinquency across 3 generational statuses. The theoretical framework guiding the study consisted of acculturation theory, the immigrant paradox, and differential association theory. Two research questions were evaluated using a stratified random …

Experiences And Perceptions Regarding Emergency Telephone Number Use Relative To Civic Engagement, Jacquetta Mccoy Jan 2016

Experiences And Perceptions Regarding Emergency Telephone Number Use Relative To Civic Engagement, Jacquetta Mccoy

Walden Dissertations and Doctoral Studies

Lack of engagement in public service awareness education programs, coupled with reduced funding to implement a diversion system such as 311 systems or 10-digit phone numbers, contribute to 911 misuse. Many local governments have invested in alternative systems, but research regarding community members' use of 911 or alternatives relative to civic engagement is lacking. Guided by Gordon's conceptualization of civic engagement, this phenomenological study bridged the gap in knowledge by exploring community members' civic involvement and their use of 911 between 2012 and 2015 in a county in the state of Georgia. A snowball sampling strategy was used to select …

The Impact Of African-Centered Psychotherapy On Depressive Symptoms And Africentric Worldview In African Americans, Larae Tillis Jan 2016

The Impact Of African-Centered Psychotherapy On Depressive Symptoms And Africentric Worldview In African Americans, Larae Tillis

Walden Dissertations and Doctoral Studies

Depression is a prominent issue in the African American community. However, there are significant gaps in the literature on the delivery and outcomes of culturally relevant mental health psychotherapy to African Americans. Cultural variables, such as worldview, have been noted to impact an individual's overall psychosocial functioning and have significant implications for mental health service delivery. The purpose of this study was to use archival data to analyze the impact of African-centered therapeutic services on depressive symptoms and on Africentric worldview among African Americans. Archival data on 38 African American adults, recorded from 2012-2015, were obtained from a community mental …

Cyber-Victimization And Delinquency: A General Strain Perspective, Ian D. Greenwood Jan 2016

Cyber-Victimization And Delinquency: A General Strain Perspective, Ian D. Greenwood

Graduate Student Theses, Dissertations, & Professional Papers

This study examines juvenile delinquency and cyber-victimization from a general strain perspective. General strain theory provides a model where strain is experienced through the (1) loss of something valued, (2) the presentation of noxious stimuli, or (3) the inability to achieve valued goals. As a coping mechanism for strain, some juveniles react through criminal or delinquent behavior. This thesis predicts that cyber-victimization increases the likelihood of physical fighting, weapon-carrying, and truancy at school. Using the 2013 National Crime Victimization Survey: School Crime Supplement, the hypotheses are analyzed using multivariate logistic regression models that include other known correlates of delinquency. Marginal …

Representations And Discourses Of Black Motherhood In Hip Hop And R&B Over Time, Cassandra Chaney, Arielle Brown Jan 2016

Representations And Discourses Of Black Motherhood In Hip Hop And R&B Over Time, Cassandra Chaney, Arielle Brown

Journal of Hip Hop Studies

This study will examine how representations and discourses regarding Black motherhood have changed in the Hip Hop and R&B genres over time. Specifically, this scholarly work will contextualize the lyrics of 79 songs (57 Hip Hop songs; 18 R&B songs; 2 songs represented the Hip Hop and R&B genre; 2 songs represented artists who produce music in 5 or 6 genres) from 1961-2015 to identify the ways that Black male and Black female artists described motherhood. Through the use of Black Feminist Theory, and by placing the production of these songs within a sociohistorical context, we provide an in-depth qualitative …

Effect Of Case Management On Frequency Of Emergency Department Visits By Persons With Mental Illness: A Systematic Review, Allison M. Stanton, Kayla C. Osoteo Jan 2016

Effect Of Case Management On Frequency Of Emergency Department Visits By Persons With Mental Illness: A Systematic Review, Allison M. Stanton, Kayla C. Osoteo

Williams Honors College, Honors Research Projects

A problem in healthcare is the increasing number of emergency department visits by repeat users with a comorbid mental illness. These visits increase costs, patient wait times, demand for service, overcrowding, and fragmented care; they may decrease quality of care and effective treatment. The purpose of this study is to identify, review, and critically appraise the evidence about the effect of case management on repeat emergency department (ED) use in those with comorbid mental illness. A systematic review of 21 studies was performed. All explored mental illness, frequent visits to the ED, and interventions. These twenty-one studies were reviewed and …

Principals’ Perceptions Of Teacher-Student Interactions In Diversifying Suburban Middle Schools, Yolanda E. Bloodsaw Jan 2016

Principals’ Perceptions Of Teacher-Student Interactions In Diversifying Suburban Middle Schools, Yolanda E. Bloodsaw

Wayne State University Dissertations

This qualitative study examined the kinds of troublesome teacher-student interactions that principals in a large Midwestern metro community manage. Personal interview data from nine suburban middle school principals as well as a group interview with four of the nine participants followed an interpretivist paradigm. This study found that the tense teacher-student interactions are triggered by conflicting perceptions held by students and teachers as a result of racial/cultural differences and socioeconomic status. Conflicting perceptions included stereotypes, cultural insensitivity, student motivation, student survival, loud Black kids, and tardiness. The bulk of the teacher-student interactions described by participants primarily concerned interactions between the …

Distribution-Free Trends Test To Determine The Construct Validity Of An Anti-Social Criminal Attitudes Scale, Holly Ann Child Jan 2016

Distribution-Free Trends Test To Determine The Construct Validity Of An Anti-Social Criminal Attitudes Scale, Holly Ann Child

Wayne State University Dissertations

The Sawilosky's I-Test was developed to as an alternative method to evaluate construct validity, more specifically, in regards to the Multitrait-Multimethod Matrix designed by Campbell and Fiske (1959). Typically, researchers use a method by Campbell and Fiske that involves a subjective “physical” look at the matrix to determine validity. Sawilowsky’s I-Test offers a statistical approach that incorporates the current practice but removes the subjectivity involved in this process.

There are only two existing studies that look at the I-Test, Sawilowsky in 2002 and Cuzzocrea in 2007. Both studies found that although the I-Test is not a perfect statistic, it provides …

The Effect Of Gendered Spaces On The Gender Gap In Victimization: Implications For Private And Public Security, Dennis M. Savard Jan 2016

The Effect Of Gendered Spaces On The Gender Gap In Victimization: Implications For Private And Public Security, Dennis M. Savard

Wayne State University Dissertations

This research examines the gender gap in crime and how gendered spaces play a role in decreasing this gap. The gender gap in crime explains that men and women experience victimization at different rates. Gendered spaces are spaces in society that are designated for men and women. Routine activity theory and gendered spaces are two theoretical perspectives used in the study to examine how gender influences the routine activities of people and how this in turn creates gendered spaces and subsequent victimization based on perceptions an offender has of a women or men. This study utilizes secondary data from the …

Enhancing The Community Relations Service Arsenal: A Restorative Justice Solution For Community Conflicts With Local Law Enforcement That Have A Race-Relations Basis, David B. Rabbani Jan 2016

Enhancing The Community Relations Service Arsenal: A Restorative Justice Solution For Community Conflicts With Local Law Enforcement That Have A Race-Relations Basis, David B. Rabbani

Cardozo Journal of Conflict Resolution

This Note proposes that restorative justice should be incorporated by the CRS to promote fairness and to foster a change in the definition of success for the agency to include more permanent and inspiring solutions that have the potential to prevent conflict in other parts of the country. Part A of Section II provides background on the shooting of Michael Brown and the reaction in both Ferguson and the U.S. in general along with perceptions and facts about race-relations in Ferguson. Part B of Section II focuses on the CRS and its creation, history, and methods. Part C of Section …

Reducing Recidivism Of Violent Offenders Through Victim-Offender Mediation: A Fresh Start, Laura Ravinsky Jan 2016

Reducing Recidivism Of Violent Offenders Through Victim-Offender Mediation: A Fresh Start, Laura Ravinsky

Cardozo Journal of Conflict Resolution

This Note will examine how VOM between victims and violent offenders improves the criminal justice system and reduces recidivism. The Note will propose that there is a better remedy for violent crime than punitive prison sentences absent genuine efforts to reform. In Section II, this Note will discuss the breakdown of the U.S. criminal justice system, particularly the excessive incarceration rate and the ineffectiveness of the current retributive scheme, followed by a history and overview of VOM. Next, it will discuss the issue of prison recidivism, how it affects our society on both a social and economic level, and the …

Funneled Into Prison: Race And Behavior Modification At A Mississippi Alternative School, Daniela Alexandria Griffin Jan 2016

Funneled Into Prison: Race And Behavior Modification At A Mississippi Alternative School, Daniela Alexandria Griffin

Electronic Theses and Dissertations

African American youth are 3.5 times more likely than their white counterparts to be expelled from traditional public schools and sent to an alternative school—an exclusionary disciplinary setting focused on behavior modification. Yet how administrators and faculty supervise students’ behavioral achievement in these settings is seldom examined. This research investigates how faculty and administrators define and implement a behavior modification program at Richmond Learning Center, an alternative education setting in Mississippi, and places African American boys as young as 12 years old on a path to prison. To understand how faculty and administrators perceive and practice this program, I performed …

Black Students Resisting And Coping With Racism At Predominately White Institutions, Latierney Frazier Jan 2016

Black Students Resisting And Coping With Racism At Predominately White Institutions, Latierney Frazier

Electronic Theses and Dissertations

Black students attending predominately white institutions (pwis) have many obstacles to overcome while navigating their college career. Black students at pwis experience micro-aggressions and different forms of racial discrimination. Various studies have focused on the experiences of black students and some focused on the responses to their experiences in terms of coping; however, literature is lacking when it comes to how students of color at pwis are also effectively simultaneously resisting racism through their coping mechanisms. My research question is "how do black students at pwis cope with and resist the micro-aggressions found within the structure of new racism?" To …

Can We Forgive Those Who Batter? Proposing An End To The Collateral Consequences Of Civil Domestic Violence Cases, Joann M. Sahl Jan 2016

Can We Forgive Those Who Batter? Proposing An End To The Collateral Consequences Of Civil Domestic Violence Cases, Joann M. Sahl

Akron Law Faculty Publications

Domestic violence is the most common tort committed in our country, involving nearly 1.3 million victims. When a domestic violence incident occurs, the press regularly reports it. Highlighted in these articles is the name of the perpetrator. Perpetrators identified as committing an act of domestic violence face public outrage, contempt, and stigma. This is particularly true if a court determines that the act of domestic violence necessitates a civil protection order (CPO) that bars the perpetrator from having any contact with the victim. Nearly 1.2 million people receive a CPO each year. More people use this civil remedy than those …

Can Law Stop Prosecution Of Afghanistan's Women And Girls For Moral Crimes? Searching For An Effective, Practical Legal Methodology, Tara S. Neal Jan 2016

Can Law Stop Prosecution Of Afghanistan's Women And Girls For Moral Crimes? Searching For An Effective, Practical Legal Methodology, Tara S. Neal

Intercultural Human Rights Law Review

As a woman working in rule of law in Afghanistan, I was confronted on a daily basis by what it means to be female and the severity of those constraints. This realization began every morning with the choice of what to wear. The daily task of dressing myself in a manner that protected my safety, security, and reputation gave me a tiny glimpse into the lives of Afghan women. I discovered how law is used to reinforce traditional and cultural beliefs and the grave injustices served on Afghanistan's women and girls. I also discovered how vast sums of foreign money …
