Perceptions And Predictors Of Questionable Research Practices In The Social Sciences, Anita M. Gordon, Helen C. Harton
Perceptions And Predictors Of Questionable Research Practices In The Social Sciences, Anita M. Gordon, Helen C. Harton
Faculty Work
Conclusions
■ As expected, moral judgment, anticipated shame, and perceptions of harm were the strongest and most consistent predictors of the perceived likelihood of misconduct.
■ Perceived likelihood of detection only predicted for one scenario, and sanctions had no overall effect (sanctions did affect how strongly moral judgment affected likelihoods).
■ There were no differences in perceived likelihood of misconduct by type of university.
■ Early career faculty reported higher likelihoods.
■ Organizational justice was not related to likelihoods.
The Process Is Still The Punishment: Low-Level Arrests In The Broken Windows Era, Amanda Geller
The Process Is Still The Punishment: Low-Level Arrests In The Broken Windows Era, Amanda Geller
Cardozo Law Review
Purpose: This Article examines the experience of contemporary arrestees in New York City to identify impositions they face in the processing of charges against them. In his seminal 1979 study The Process Is the Punishment, Malcolm Feeley documented severe administrative burdens faced by arrestees before judgment of guilt or innocence. I investigate the persistence of this dynamic in light of modern "proactive policing" tactics that bring millions of people into contact with the criminal justice system.
Methods: I match records of police encounters with court data on arrest processing to construct a unique dataset tracing more than 100,000 arrests …

Adverse Childhood Experiences In The New Mexico Juvenile Justice Population, Yael Cannon, George Davis, Andrew Hsi, Alexandra Bochte
Georgetown Law Faculty Publications and Other Works
Faculty from the University of New Mexico (UNM) School of Law and the UNM School of Medicine, and New Mexico’s Children, Youth and Families Department (CYFD) initiated a joint project to look at the prevalence of Adverse Childhood Experiences (ACEs) nationally and in New Mexico. The study was intended to better establish the association between early childhood trauma and delinquency, as well as to explore the role that law and medicine can play in ensuring better health and juvenile justice outcomes for children who have experienced ACEs.

Military Contractors And International Law, Ali Deif
Military Contractors And International Law, Ali Deif
Theses and Dissertations
In the modern world, regulation is a necessity, especially on an international scale. PMSCs or Private Military Security Contractors are groups that are involved with militaries, and in conflict zones around the world. Due to their unique functions and place in international law, they essentially fall into a regulatory gap. PMSCs are non- state actors , but perform a series of roles and functions historically associated with the state. They can be used in multitudes of situations and have even been recruited in the war against drugs. Some see military contractors as, or similar to mercenaries, while others disagree. Many, …
Locked In: Melancholia In The Modern American Prison Literature Of R. Dwayne Betts And Jarvis Jay Masters, Johnna Scrabis
Locked In: Melancholia In The Modern American Prison Literature Of R. Dwayne Betts And Jarvis Jay Masters, Johnna Scrabis
Dissertations, Theses, and Capstone Projects
This thesis explores the theme of melancholia in the writing of currently and formerly incarcerated African American men during the late 20th and early 21st century. Melancholia, with its rich history in literature from ancient times to the present, is discernable in the works of many people with prison experience. In their writing, melancholia is expressed primarily as a loss and as a disconnection with time, as well as an empowering creative force. The work of Jarvis Jay Masters and R. Dwayne Betts reflects the paradox of melancholia: just as it shows the depressive element of the condition, …
Cops In Court: Assessing The Criminal Prosecutions Of Police In Six Major Scandals In The New York City Police Department From 1894 To 1994, Kevin E. Mccarthy
Cops In Court: Assessing The Criminal Prosecutions Of Police In Six Major Scandals In The New York City Police Department From 1894 To 1994, Kevin E. Mccarthy
Dissertations, Theses, and Capstone Projects
From the 1890s to the 1990s, the police department in New York City experienced six major corruption scandals that occurred at approximately twenty-year intervals. These cyclical scandals all involved intense public attention, examination by an outside agency, and a comprehensive report calling for departmental reforms to address corruption issues. The scandals resulted in turnover of police commissioners and political fallout for sitting mayors. Police officers faced transfers, administrative sanctions, dismissals, and forced retirements. Some faced criminal prosecution.
This dissertation examines prosecutions of police in the context of the city’s changing social and political circumstances surrounding the scandals, while recognizing the …

Targeting Efficiency: The Effects Of Video Modeling And Feedback On Instructors’ Acquisition And Generalization Of Behavior Analytic Skills, Maya S. Madzharova
Dissertations, Theses, and Capstone Projects
Applied behavior analysis (ABA) is a highly effective, evidence-based treatment for individuals with autism spectrum disorder. Low treatment integrity could greatly compromise the delivery of effective ABA interventions, but instructors who hold no formal training make up the larger portion of employees within the special education field. Designing efficient and effective training for these employees is important because schools have limited resources for caregiver training. This study used a non-concurrent multiple baseline design across three novice ABA instructors to evaluate the effects of a training protocol consisting of video and in-vivo modeling and feedback, a training algorithm, and multiple exemplars …

'Something On Women For the Crime Bill':
The Construction and Passage of the Violence Against Women Act,
1990-1994
By Irene Meisel
Advisor: Professor Sandi E. Cooper
'Something on Women for the Crime Bill' examines the legislative and theoretical history of the Violence Against Women Act (VAWA), signed into law in 1994. It explores the deeply intertwined relationship between the tough-on-crime and feminist movements that shaped both the bill itself and the political discussion surrounding it. The bill inherited a host of ideas about crime, criminality, and race from the 1968 Omnibus Crime Control and Safe Streets Act, leading to a …

THE CRAFT OF DYING IN EARLY MODERN ENGLISH DRAMA
AND THE CULTIVATION OF DYING-VOICE LITERACY
by
SIMON G. FORTIN
Adviser: Professor Mario DiGangi
This dissertation contends that, through their relentless dramatization of agonies, the early modern English dramatists taught their audiences how to die. Attending a play where characters devised, discussed, prepared for, plotted, inflicted, endured and witnessed death, constituted an apprenticeship I demonstrate, akin to going to school, though informal it may have been, where audiences learned about mortality, death as an event, and dying as a process. Thus, this study points to …
Delusional Disorder: Treatment And The Restoration Of Adjudicative Competence, Martin Kassen
Delusional Disorder: Treatment And The Restoration Of Adjudicative Competence, Martin Kassen
Dissertations, Theses, and Capstone Projects
Delusional disorder has long been recognized in the psychiatric nomenclature, however, low prevalence rates and prevailing clinical views about the seemingly refractory nature of delusional disorder have restricted data on clinical treatment outcomes for this illness. Similar perspectives have been noted in forensic settings where minimal data is available to guide standards of care for incompetent to stand trial (IST) delusional pretrial defendants. Rationale. While the factors explicated in Sell provide guidelines for the involuntary medication of defendants found IST, numerous questions are left unanswered regarding the restorability of pretrial delusional detainees. The proposed study investigated the competency restoration rates …
Empowerment From Within: Supporting Palestinian Women’S Struggle Against Violence, Ortal Bensky
Empowerment From Within: Supporting Palestinian Women’S Struggle Against Violence, Ortal Bensky
Dissertations, Theses, and Capstone Projects
Recent reports by the United Nations and local non-governmental organizations present a troubling increase in incidents of violence against Palestinian women in Palestine. These are cases of domestic violence, where the attackers are Palestinians, and political violence, where the attackers are Israeli settlers and soldiers. These violent incidents include attacks on body and property. Most incidents are neither dealt with by the Palestinian authorities nor by the Israeli government and judicial system. There is not sufficient international pressure to enforce justice. The purpose of this study is to offer alternative ways to prevent violent crimes, enforce relevant laws, and provide …

From Coercion To Consent?: Governing The Formerly Incarcerated In The 21st Century United States, Karen G. Williams
Dissertations, Theses, and Capstone Projects
With over 650,000 incarcerated people returning to their home communities each year, prisoner reentry reform has recently become as an important strand of penal policy innovation intended to address the barriers that former offenders face. Through ethnographic research in four correctional institutions in the Midwest, I trace the use of evidence-based practices and policies as they relate to prisoner reentry and risk reduction. This dissertation intervenes in the debates on mass incarceration and prisoner reentry and offers insights on how evidence-based practices and policies are being mobilized to mitigate the costs of mass incarceration. I show how the scientization of …
The Effect Of Attitudes Towards The Death Penalty On Forensic Clinical Judgments Of Competency For Execution, Eugenia Garcia-Dubus
The Effect Of Attitudes Towards The Death Penalty On Forensic Clinical Judgments Of Competency For Execution, Eugenia Garcia-Dubus
Dissertations, Theses, and Capstone Projects
Capital punishment has been a part of the American Justice System since colonial times. A brief historical overview reveals a general tendency towards the imposition of restrictions on who is eligible for the death penalty (DP). In a series of decisions, the Supreme Court has held that the execution of an incompetent inmate is unconstitutional, but the topic is controversial among mental health professionals. The likelihood of clinician attitudes towards the DP affecting judgments of competency for execution (CFE) is discussed in the context of existing literature. The vagueness of the current CFE standard is thought to contribute to this …
The Effect Of Cognitive Load On Liars And Truth Tellers: Exploring The Moderating Impact Of Working Memory Capacity, Sarah Jordan
The Effect Of Cognitive Load On Liars And Truth Tellers: Exploring The Moderating Impact Of Working Memory Capacity, Sarah Jordan
Dissertations, Theses, and Capstone Projects
Two studies are presented. The purpose of the first study is to examine the moderating impact of working memory capacity (WMC) on the cognitive load produced by both the type of statement a person is making and the manner in which the person is interviewed in a mock crime scenario. The moderating impact of suspects’ WMC (measured using the automated operation span task) on this process was also assessed. Suspects were instructed to tell the truth, a relatively easy lie, or a more difficult lie. Suspects were then interviewed in a relatively easy manner, a moderately more difficult manner, or …

When Human-Leopard Conflict Turns Deadly: A Cross-Country Situational Analysis, Julie S. Viollaz
Dissertations, Theses, and Capstone Projects
Habitat destruction and pollution are two of the main causes for the decline of the planet’s biodiversity. Yet environmentalists are now recognizing that illegal wildlife killings, both poaching and retaliatory killings due to human-wildlife conflict, are perhaps the next major threat. Biologists have researched illegal killings and their effect on species conservation, but few researchers have applied criminological principles of crime reduction to them. This research will explore the situational factors that drive retaliatory leopard killings in parts of South Africa, Kenya, and India. These factors, human and environmental, include local expectations from wildlife, sensitivity to environmental issues, communication between …

Alien, Illegal, Undocumented: Labeling, Context, And Worldview In The Immigration Debate And In The Lives Of Undocumented Youth, David A. Caicedo
Dissertations, Theses, and Capstone Projects
A key element of investigating attitudes towards unauthorized immigrants in the United States has been political orientation, yet few studies have examined the influence of such orientation on labels relevant to the immigration debate. The current dissertation project examined these attitudes among young adults using survey, focus group, and interview methodologies. Level of agreement on various statements regarding unauthorized immigrants was examined in Study I, definitions given for the labels ‘illegal’ and ‘undocumented’ were explored in Study II, and the lived experience of undocumented youth in two community colleges was investigated in Study III. It was hypothesized that: I) attitudes …

Annotate The Web: Four Ways To Mark Up Web Content, Robin Camille Davis
Publications and Research
Web annotation has been a pipe dream almost since the birth of the Internet itself. Commenting in the margins of a text itself is so simple for paper and print, yet replicating the experience online remains elusive. In this article, I examine four tools for private or public web annotation. Hypothesis and Genius offer users a shareable way to annotate webpages line by line and start conversations in the margins. Pinboard and Evernote allow users to organize and save web documents and add private annotations.

Assessing The International Criminal Court With The Organizational Effectiveness Approaches, Heba Yehia Abdel Megeed
Theses and Dissertations
The International Criminal Court (‘the ICC’), located in the Hague, Netherlands, the first permanent court tasked with prosecuting the most severe crimes happening internationally. It is critical to assess the effectiveness of the ICC while in reality, there is no consensus on the criteria that should be employed to that end. There are no standards that its stakeholders and observers can refer or agree to in order to assess the Court’s effectiveness. The purpose of this research is to develop a new approach to this issue. It proposes to use the approaches of Organizational Effectiveness Theory in order to gain …
Terrorism:An Analysis Of The International Legal Framework, International And Regional Responses Case Study: Syria., Sara Ayman Mohamed Hassan
Terrorism:An Analysis Of The International Legal Framework, International And Regional Responses Case Study: Syria., Sara Ayman Mohamed Hassan
Theses and Dissertations
International law, as a discipline, is obsessed with crises, requiring reinterpretation of its basic principles to cope with them. Through this process of reinterpretation, it also creates new rules. Terrorism is one such ‘crisis’ which has impacted the international legal framework on the use of force, making it deviate from its basis established by the United Nations Charter. This thesis conducts a macro analysis of the changes in the legal framework for combating terrorism after 9/11 and the Arab Spring. It focuses on the Syrian conflict as a case study, analyzing the major actors and their different legal justifications. The …

How Bad Arrests Lead To Bad Prosecution: Exploring The Impact Of Prior Arrests On Plea Bargaining, Besiki Luka Kutateladze, Victoria Z. Lawson
Cardozo Law Review
Arrests and arrest records play an important role in the criminal justice system. Police agencies customarily use suspects' prior record for investigative purposes, and courts use this information to set bail. Yet many arrest practices, and particularly stop-and-frisk, have long been criticized for disproportionately targeting young black and Latino men, and for their overall negative effect on communities of color. Not surprisingly then, arrest practices have received much attention, including among legal scholars and social scientists. However, what effect a prior arrest record has on other decision points, including prosecutorial decision making, is relatively unknown. In particular, we have a …

Investing Wisely In Investigative And Competitive Research, Suzanne R. Graham
Continuing Legal Education Presentations
Law is a social science with many variables, not the least of which is the “human” element, and the work requires knowledge of the actors involved. This requirement leads to different kinds of research: investigative research and competitive or business intelligence research. While much personal and business data can be found online, it is not always current, reliable or free. This paper reviews rules governing what kinds of information can be found, some best-bet places to find information, and cautions about the many sites that promise big results.

Trust In Immigration Enforcement: State Noncooperation And Sanctuary Cities After Secure Communities, Ming H. Chen
Chicago-Kent Law Review
The conventional wisdom, backed by legitimacy research, is that majority of people obey most of the laws, most of the time. This turns out to not be the case in a study of state and local participation in immigration law enforcement. In the five years following initiation of the Secure Communities program, through which the federal government requests that local law enforcement agencies hold immigrants beyond their scheduled release upon suspicion that they are removable, a significant and growing number of states and localities have declined to cooperate with federal immigration detainer requests—ultimately leading to the demise of the Secure …

Obama's National Security Exceptionalism, Sudha Setty
Chicago-Kent Law Review
The label of national security exceptionalism fits the Obama administration in two ways: first, although the administration has actively sought to address and improve the protection of human rights and civil rights of racial minorities suffering disparate negative treatment in a variety of contexts, those moves toward rights protection generally do not extend to the realm of counterterrorism abuses, although almost all of those who have suffered from violations of human and civil rights in the post-9/11 counterterrorism context are racial and/or religious minorities. One of the justifications for this exceptionalism is based on the widespread view that national security …
