Amnesty Now! Ending Prison Overcrowding Through A Categorical Use Of The Pardon Power, Jonathan Simon Feb 2016

Amnesty Now! Ending Prison Overcrowding Through A Categorical Use Of The Pardon Power, Jonathan Simon

University of Miami Law Review

America’s practice of mass incarceration is coming under growing criticism as fiscally unsustainable and morally indefensible. Chronic overcrowding of prisons, a problem that epitomizes the destructive and unlawful core of mass incarceration, now afflicts the federal prison system and nearly half the states. Actual reforms, however, like President Obama’s recent grant of clemency to forty-six federal prisoners serving long drug sentences for non-violent conduct, or recent one-off sentencing reforms aimed at preventing imprisonment for minor drug or property crimes, are manifestly insufficient to end mass incarceration, or even the chronic overcrowding that represents its most degrading and destructive aspect. The …

Expanding Public Safety In The Era Of Black Lives Matter, Nicole D. Porter Feb 2016

Expanding Public Safety In The Era Of Black Lives Matter, Nicole D. Porter

University of Miami Law Review

Traditional public safety responses to crime involve interactions with the criminal justice system. However, recent killings by police of unarmed black men, women, and children have led to a national dialogue on the fundamental strategy of public safety. The narrative of “Black Lives Matter” offers a new framework for policymakers, activists, practitioners, and other stakeholders to think about a public safety strategy that is not solely defined by arrests and admissions to prison. This essay provides an overview of evidence-based approaches for public safety interventions that exist outside of law enforcement interactions.

Environmental Crimes And Imprisonment: Does Prison Work To Prevent And Punish Environmental Criminals?, Rafael Wolff Feb 2016

Environmental Crimes And Imprisonment: Does Prison Work To Prevent And Punish Environmental Criminals?, Rafael Wolff

Dissertations & Theses

Environmental degradation is a global problem. Humans need natural resources to survive and, as those resources are limited, humans’ use of these resources should respect a sustainable pace established by law. There are many approaches to addressing environmental degradation that do not honor the legal limitations and one of them is through criminal law. The question that is posed in this thesis is whether imprisonment, one of the most severe methods of punishment, is a suitable option to repress and prevent environmental crimes.

This thesis is divided in three chapters. The first chapter discusses why environmental crimes are relevant. It …

A Guide To Gathering And Using Legislative History In Massachusetts, Sean J. Kealy Feb 2016

A Guide To Gathering And Using Legislative History In Massachusetts, Sean J. Kealy

Faculty Scholarship

Lawyers must have the ability to interpret statutory language. Whether during criminal or civil litigation, advising a client on recent statutory changes or appearing before an administrative agency, the importance of statutes to the modern legal world is unquestioned. Although some jurists, notably Justice Antonin Scalia, question whether there can be such a thing as "legislative intent" and disregard materials that may be instructive to the court, most jurisdictions not only accept evidence of legislative intent, but seek it out.

Human Trafficking Victims Are Everywhere And Nowhere: A Qualitative Content Analysis Of The United States Anti-Human Trafficking Campaign, 2000-2012., Billy James Ulibarri Feb 2016

Human Trafficking Victims Are Everywhere And Nowhere: A Qualitative Content Analysis Of The United States Anti-Human Trafficking Campaign, 2000-2012., Billy James Ulibarri

Sociology ETDs

This dissertation explores the oppositional framing techniques used by actors in the United States anti-human trafficking (AHT) campaign. Theoretically based in symbolic interactionism, I conduct a frame analysis of 12 years of newspaper articles (2000-2012), which comprises the official discourse of the AHT campaign in the United States. I unpack three frame disputes, where claims are challenged and the challenges are rebutted in three primary disputes: 1) the characteristics and experiences of human trafficking victims, 2) the credibility of quantitative estimates of the prevalence of human trafficking, and 3) the justification for the development of new AHT policy tools. Using …

This is an update of the 2014 version and includes a section on roadway departure crashes.

Process Matters: Specialization In Federal Appellate Review Of Noncapital Section 2254 Cases, Jyoti Rani Jindal Feb 2016

Process Matters: Specialization In Federal Appellate Review Of Noncapital Section 2254 Cases, Jyoti Rani Jindal

Duke Law Journal

This Note assesses the need for specialized review in the federal circuit courts of noncapital habeas cases brought by state prisoners under 28 U.S.C. § 2254. It first argues that the complexity of federal habeas law, the substantial disuniformity between circuits, the conflicting visions proffered by the Warren Court’s habeas jurisprudence and Congress’s recent statutory enactments—together with the greatest stakes possible at issue, liberty—are all factors warranting the creation of a national court of appeals that would hear only habeas cases. Recognizing, however, that creating such a court is a low priority for Congress at best and simply unfeasible at …

In Loco Aequitatis: The Dangers Of 'Safe Harbor' Laws For Youth In The Sex Trades, Brendan M. Conner Feb 2016

In Loco Aequitatis: The Dangers Of 'Safe Harbor' Laws For Youth In The Sex Trades, Brendan M. Conner

Faculty Publications

This Article provides the first critical analysis of safe harbor laws, which rely on custodial arrests to prosecute or divert youth arrested for or charged with prostitution related offenses under criminal or juvenile codes to court supervision under state child welfare, foster care, or dependency statutes. This subject is a matter of intense debate nationwide, and on May 29, 2015 the President signed legislation that would give preferential consideration for federal grants to states that have enacted a law that "discourages the charging or prosecution" of a trafficked minor and encourages court-ordered treatment and institutionalization. Nearly universally lauded, the sound …

Parent Training To Reduce Problem Behaviors Over The Transition To High School: Tests Of Indirect Effects Through Improved Emotion Regulation Skills, W. Alex Mason, Stacy-Ann A. January, Charles B. Fleming, Ronald W. Thompson, Gilbert R. Parra, Kevin P. Haggerty, James J. Snyder

Department of Child, Youth, and Family Studies: Faculty Publications

Adolescent problem behaviors are costly for individuals and society. Promoting the self-regulatory functioning of youth may help prevent the development of such behaviors. Parent-training and family intervention programs have been shown to improve child and adolescent self-regulation. This study helps fill gaps in knowledge by testing for indirect effects of the Common Sense Parenting® (CSP) program on reduced substance use, conduct problems, and school suspensions through previously identified short-term improvements in parents’ reports of their children’s emotion regulation skills. Over two cohorts, 321 low income families of 8th graders were enrolled and randomly assigned to either the standard CSP …

Protecting Juveniles In Adult Facilities From Sexual Abuse: Best Practices For Implementing The Youthful Inmate Standard, Brenda V. Smith Feb 2016

Protecting Juveniles In Adult Facilities From Sexual Abuse: Best Practices For Implementing The Youthful Inmate Standard, Brenda V. Smith

Research Reports & White Papers

Housing youth who are prosecuted and convicted as adults in adult facilities is challenging and creates significant dilemmas for correctional agencies. In particular, should such “youthful inmates” be treated as part of the regular adult population or should these youth be housed in facilities still under the purview of the adult corrections agency but in facilities designated for youth? More narrowly, should youthful inmates who remain in an adult facility be held in separate housing blocks? Or, should youthful inmates in adult correctional facilities be housed in protective custody or solitary confinement for their protection? How should agencies provide required …

Internalizing Private Prison Externalities: Let's Start With The Ged, David M. Siegel Feb 2016

Internalizing Private Prison Externalities: Let's Start With The Ged, David M. Siegel

Notre Dame Journal of Law, Ethics & Public Policy

Prison education is a remarkably good investment for society, yet an increasing proportion of inmates have no access to it because the operators of the prisons in which they are held have a powerful incentive not to provide it: they make more money that way. Critics and analysts of private prison operators have suggested various incentive structures to improve their performance, but most jurisdictions focus on the operator’s cost to the contracting entity. The social costs imposed by foregoing prison education are not part of the arrangement between a private prison operator and a jurisdiction with which it contracts. Although …

A Wolf In Sheep's Clothing? Transitional Justice And The Effacement Of State Accountability For International Crimes, Laurel E. Fletcher Feb 2016

A Wolf In Sheep's Clothing? Transitional Justice And The Effacement Of State Accountability For International Crimes, Laurel E. Fletcher

Fordham International Law Journal

If international atrocity crimes are acts so egregious that their impunity cannot be legally tolerated, why don’t we punish States that commit them? The rise of international criminal law is celebrated as an achievement of the international rule of law, yet its advance effectively may come at the expense of holding States accountable for their role in mass violence. Transitional justice has emerged as the dominant normative framework for how the international community responds to mass violence. Liberalism strongly influences transitional justice, which has produced individual criminal accountability as the desired form of legal accountability for atrocities. Transitional justice rejects …

Through The Gateway: Marijuana Production, Governance, And The Drug War Détente, Michael Polson Feb 2016

Through The Gateway: Marijuana Production, Governance, And The Drug War Détente, Michael Polson

Dissertations, Theses, and Capstone Projects

Since the 1996 voter approval of medical marijuana laws in California, marijuana policy has become increasingly liberalized. Producers, however, have remained in the greyest of grey market zones. Federal anti-drug laws and supply-side tactics have intensively targeted them even as marijuana has become more licit. In this legally unstable environment, marijuana patient-cultivators and underground producers have articulated and asserted themselves politically and economically, particularly as the likelihood of full legalization has increased. This dissertation explores how producers navigated the nebulous zone between underground and medical markets. I argue that even as producers supplied marijuana to a formalizing, regulated medical industry …
