Custom's Method And Process: Lessons From Humanitarian Law, Monica Hakimi
Custom's Method And Process: Lessons From Humanitarian Law, Monica Hakimi
Book Chapters
A central question in the literature on customary international law (CIL) goes to method: what is the proper method for "finding" CIL - that is, for determining that particular norms qualify as ClL? The traditional method is to identify a widespread state practice, plus evidence that states believe that the practice reflects the law (opinio juris). That method has long been criticized as incoherent, unworkable, and out of touch with modern sensibilities. Thus, much of the CIL literature addresses its perceived problems. The principal goals of this literature are to help resolve whether norms that are claimed to be CIL …

The Path To Violent Behavior: The Harmful Aftermath Of Childhood Trauma, Nicholas Michael Perez
The Path To Violent Behavior: The Harmful Aftermath Of Childhood Trauma, Nicholas Michael Perez
USF Tampa Graduate Theses and Dissertations
Adverse childhood experiences can lead to a number of harmful outcomes throughout an individual’s life, ranging from medical problems to criminal behavior. These traumatic experiences, comprised of different forms of maltreatment and dysfunctional household environments, can affect the development of a child in a variety of different ways. The multitude of developmental changes can produce compounding harmful effects on the child’s life and lead to acutely maladaptive outcomes. Under the perspective of developmental psychopathology, the ever-changing biological, psychological, and social dynamics of children who experience trauma can contribute to deficiencies in all aspects of their subsequent development. Each of these …

Am I Under Arrest? Why The U.S. Sentencing Guidelines Need A Strict Definition Of What Constitutes An Intervening Arrest, Rebekah R. Runyon
Florida Law Review
Congress provided for the creation of the U.S. Sentencing Guidelines to promote fairness and produce proportional and uniform sentences. The Guidelines provide judges with a guideline range for sentencing based on a defendant’s criminal history score and the offense level of the defendant’s criminal conduct. A defendant’s prior “intervening arrests” are considered in computing her criminal history score. But the current version of the Guidelines does not clearly define what constitutes an intervening arrest for the purposes of calculating an offender’s score. Consequently, a split has developed between circuit courts as to whether a criminal traffic citation constitutes an intervening …
What Is Federal Habeas Worth?, Samuel R. Wiseman
What Is Federal Habeas Worth?, Samuel R. Wiseman
Florida Law Review
Federal habeas review of state non-capital cases under the Antiterrorism and Effective Death Penalty Act of 1996 (AEDPA) is widely regarded as deeply flawed for producing a huge volume of costly litigation and very little relief. Many scholars have called for AEDPA’s repeal and a return to more robust federal review, but recently, several prominent commentators have suggested more dramatic change— radically limiting federal habeas in exchange for more fruitful reform efforts. In an era of limited criminal justice budgets and an increasing focus on efficiency, these proposals are likely to proliferate. This Article lays out a needed empirical and …

The School Choice Voucher: A 'Get Out Of Jail' Card?, Corey A. Deangelis, Patrick J. Wolf
Education Reform Faculty and Graduate Students Publications
In this report we examine crime rates for young adults who experienced Milwaukee's citywide voucher program as high school students and a comparable group of their peers who had been public school students. Using unique data collected as part of a longitudinal evaluation of the program, we consider criminal activity by youth initially exposed to voucher schools and those in public schools at the same time. We also consider subsequent criminal activity by the students that stayed in the voucher program through 12th grade compared to those who were in public schools for the same period. We show that the …

The Pedagogy Of Trauma-Informed Lawyering, Deeya Haldar, Sarah Katz
Faculty Publications
“Trauma-informed practice” is an increasingly prevalent approach in the delivery of therapeutic services, social and human services, and now legal practice. Put simply, the hallmarks of trauma-informed practice are when the practitioner puts the realities of the client’s trauma experiences at the forefront in engaging with the client, and adjusts the practice approach informed by the individual client’s trauma experience. Trauma-informed practice also encompasses the practitioner employing modes of self-care to counterbalance the effect the client’s trauma experience may have on the practitioner.
This article posits that teaching trauma-informed practice in law school clinics furthers the goals of clinical teaching, …
