The California S.T.E.P. Act: Prosecuting Fraternities As Criminal Street Gangs, Courtney Lee Spears Apr 2016

The California S.T.E.P. Act: Prosecuting Fraternities As Criminal Street Gangs, Courtney Lee Spears

Undergraduate Honors Theses

This thesis project examines the similarities in structure, initiation processes, af liations, and motivations for joining both criminal street gangs and fraternities. These similarities serve as the foundation for the central idea of the thesis: using California’s street gang legislation, mainly the S.T.E.P. Act, to more severely prosecute fraternities for their crimes. My application of the legislation is supported through both comprehensive gang data, as well as case studies of fraternity crimes, as comprehensive data for this group does not exist. My research has important implications, as recent legislation serves to protect fraternity offenders from facing punishment for their crimes, …

Translation, Codification, And Transplantation Of Foreign Laws In Taiwan, Tay-Sheng Wang Apr 2016

Translation, Codification, And Transplantation Of Foreign Laws In Taiwan, Tay-Sheng Wang

Washington International Law Journal

Taiwan is an excellent example for rethinking the significance of translation and codification of law in the process of transplantation of modern law in East Asian countries. Regardless of its strangeness to the general public, the translation of Western laws was always codified in Meiji Japan for the purpose of “receiving” modern law. Those Westernized Japanese legal codes also took effect in Taiwan during the later period of Japanese colonial rule, although Japanese colonialists initially applied Taiwanese customary law, created by Western legal terminology, to the Taiwanese to decrease their resistance to the new regime. Using foreign Japanese language to …

Healing Sex-Trafficked Children: A Domestic Family Law Approach To An International Epidemic, Melissa L. Breger Apr 2016

Healing Sex-Trafficked Children: A Domestic Family Law Approach To An International Epidemic, Melissa L. Breger

West Virginia Law Review

Children who have been trafficked into and within the United States for commercial sexual exploitation endure significant psychological and physical trauma. Because there is a salient nexus between the inherent violence of trafficking and that of family violence and childhood sexual abuse, this Article explores how the United States might assist victimized children by utilizing governmental systems that are already in existence. Specifically, the therapeutic foster care ("TFC") model is an established model of care that is flexible enough to meet the numerous and complicated issues associated with the reintegration and treatment needs of child sex-trafficking survivors. This Article recommends …

Confidence Through Consultation: Lessons From Northern Ireland's Dpp/Pcsp Model, Kyle F. Kennedy

Capstone Collection

This project presents a case study of Northern Ireland’s District Policing Partnership (DPP)/Policing and Community Safety Partnership (PCSP) model. The case study relies on analysis of statues, government reports, public perception surveys, and governing documents, as well as relevant literature and scholarship. Through analysis of its structure, function, and efficacy of the model, key features of the model will be identified. These key features fit into the three conceptually distinct, but functionally inseparable, threads: buy-in, influence, and composition. The ways in which these three threads interact and impact the legitimacy of the model will be explored, as well as how …

The Transformation Of South African Private Law After Twenty Years Of Democracy, Christopher J. Roederer Apr 2016

The Transformation Of South African Private Law After Twenty Years Of Democracy, Christopher J. Roederer

Northwestern Journal of Human Rights

In The Transformation of South African Private Law after Ten Years of Democracy, 37 Colum. Hum. Rts. L. Rev. 447 (2006), I evaluated the role of private law in consolidating South Africa’s constitutional democracy. There, I traced the negative effects of apartheid from public law to private law, and then to the law of delict, South Africa’s counterpart to tort law. I demonstrated that the law of delict failed to develop under apartheid and that the values animating the law of delict under apartheid were inconsistent with the values and aspirations of South Africa’s democratic transformation. By the end of …

To Seek A Newer World: Prisoners’ Rights At The Frontier, David M. Shapiro Apr 2016

To Seek A Newer World: Prisoners’ Rights At The Frontier, David M. Shapiro

Michigan Law Review First Impressions

Prisoners’ rights lawyers have long faced a dismal legal landscape. Yet, 2015 was a remarkable year for prison litigation that could signal a new period for this area of law—the Supreme Court handed down decisions that will reverberate in prison jurisprudence for decades to come. New questions have been asked, new avenues opened. This piece is about what the Court has done recently, and what possibilities it has opened for the future. More broadly, I suggest that the Court may be subjecting prison officials to greater scrutiny and that this shifting judicial landscape reflects an evolving social discourse about prison …

Investigating The Intersection Of Whiteness And Racial Allies, Tyler Rife Apr 2016

Investigating The Intersection Of Whiteness And Racial Allies, Tyler Rife

Masters Theses & Specialist Projects

Through a critical qualitative approach, four focus groups of exclusively white or non-white participants were conducted in order to discover the ways in which individuals enact and navigate whiteness in discussions of racial allies. Further, this study attempted to capture how white and non-white individuals may differ in their approach to this subject matter and in their recommendations for racial allies. Findings revealed that eight themes defined these interactions: “Whiteness”, “Experience & Voice”, “Whitewashing Advocacy”, “Polite Protest”, “(Dis)Comfort”, “White Fragility”, and “The Complexity of Allyship”. The study finds that while whiteness is frequently perpetuated throughout this dialogue and white and …

Stand Your Ground In Florida: The Effect Of Race, Location And Weapons On Convictions, Kevin M. Wagner, Dukhong Kim, Jeremy C. Hagler

Ralph Bunche Journal of Public Affairs

The implications of laws allowing citizens to respond with deadly force when they believe they are threatened is the subject of significant conjecture in the media and scholarship. The adoption of “Stand Your Ground” laws has increased across the nation despite little data or findings that attempt to capture the ramifications of enacting this policy. This research explores the effect of the “Stand Your Ground” legal defense on criminal convictions in Florida. After exploring the historic assumptions and motivations behind the adoption and use of the Stand Your Ground law in Florida, we use data gathered from local newspapers, the …

The Fight Or Flight Response: A Look At Stand Your Ground, Andrea Headley, Mohamad G. Alkadry Apr 2016

The Fight Or Flight Response: A Look At Stand Your Ground, Andrea Headley, Mohamad G. Alkadry

Ralph Bunche Journal of Public Affairs

In addressing the historical importance—or lack thereof—of the Stand Your Ground law, this article discusses the evolution of self-defense laws. Specific landmark cases are discussed as they relate to establishing the foundation of self-defense. The article also examines various issues that have been inherent within the Stand Your Ground debate. Statistical analysis of Stand Your Ground data from the State of Florida is conducted using binary logistic regression model to test the relationship between case outcomes and a number of other variables involving demographics, and the nature of the confrontation that led to the crime
