True Criminal?: An Analysis And Discussion Of The Crimes Committed By Detective Rustin Cohle In Season One Of Hbo’S Mini-Series True Detective, Kevin J. Cimino

Pace Intellectual Property, Sports & Entertainment Law Forum

The purpose of this Article is to identify and discuss the numerous laws that Cohle broke during the course of the eight episodes – each episode is discussed separately in Sections II through IX. Here, an extremely important point needs to be made – this Article is not intended to pinpoint exactly how many laws that Cohle would likely be convicted of violating; rather, as is the case generally in the legal profession, many of the actual offenses and charges would be subject to prosecutorial discretion and therefore reasonable minds may disagree with the exact charge. To the extent possible, …

Pace Intellectual Property, Sports & Entertainment Law Forum

This article will explore this issue by engaging in case studies of the Vick and Peterson scandals to see what would have happened had the two men taken their claims against Nike to court. Part One will discuss the cases in more depth and elaborate on how they might be viewed through the lens of cultural relativity theory and the cultural defense. Part Two will elaborate on what morals clauses are and the legal standards courts use to enforce them. In addition to examining the Mendenhall decision, several other court cases will be discussed, each of which places differing levels …

The Lived Experience Of Brazilian Immigrants In Connecticut And Crimmigration, Walter John Belsito Jr. Jun 2016

The Lived Experience Of Brazilian Immigrants In Connecticut And Crimmigration, Walter John Belsito Jr.

Doctoral Dissertations

Crimmigration, or the criminalization of immigration that intensified after the attacks of September 11, 2001, has impacted the lives of many immigrants living in the United States. After 9/11 there was an acceleration of the merger of immigration law and criminal law, and its enforcement, at the local, state, and federal levels. These restrictive laws have resulted in the increased incarceration, detainment, and mass deportation of immigrants throughout the United States. This qualitative study focused on the lived experience of Brazilian immigrants living in Connecticut.

A critical phenomenological design was used to understand how crimmigration and other factors such as …

Integrating Delivery And Financing Systems Across Sectors To Build A Culture Of Health, Glen P. Mays

Health Management and Policy Presentations

The delivery and financing systems for medical care, public health, and social and community services are powerful determinants of health and wellbeing for families and communities across the U.S. Unfortunately, these systems interact in complex and often poorly understood ways through fragmented funding streams, organizational relationships, information flows, and governance and decision-making structures. This session will feature new studies underway through the Robert Wood Johnson Foundation’s Systems for Action (S4A) Research Program to test multi-sector strategies for integrating delivery and financing systems to improve population health.

Where Is The Survivor’S Voice? An Examination Of The Individual And Structural Challenges To The Reintegration Of Immigrant Human Trafficking Survivors, Michelle Cristina Angelo Dantas Rocha Jun 2016

Where Is The Survivor’S Voice? An Examination Of The Individual And Structural Challenges To The Reintegration Of Immigrant Human Trafficking Survivors, Michelle Cristina Angelo Dantas Rocha

USF Tampa Graduate Theses and Dissertations

The United States is one of the top destination countries for human trafficking, and Florida has the third highest number of reported cases of human trafficking. Despite the severity of this issue, Florida anti-trafficking legislation, reintegration programs, and awareness campaigns tend to contribute to the invisibility of the victims and undermine their recovery and reintegration into society, especially when the victims are immigrants. This project uses a multi-method approach including content analysis of anti-human trafficking campaigns to argue that portrayals of a “perfect victim” only amplify stigmatization and discrimination against immigrant victims. Through in-depth interviews and ethnographic observation highlighting the …

Fighting Collateral Sanctions One Statute At A Time: Addressing The Inadequacy Of Child Endangerment Statutes And How They Affect The Employment Aspirations Of Criminal Offenders, Sarah Wetzel Jun 2016

Fighting Collateral Sanctions One Statute At A Time: Addressing The Inadequacy Of Child Endangerment Statutes And How They Affect The Employment Aspirations Of Criminal Offenders, Sarah Wetzel

Akron Law Review

In an age where one in four adult Americans has a criminal record, post-conviction relief measures and review of criminal statutes is on the rise. This Comment addresses the inadequacy of current child endangerment statutes around the country by providing examples of those which are too broad and result in convictions of well-meaning parents and those which are too narrow and allow other parents to harm their children without repercussion. It then places these statutes in the context of collateral sanctions that are imposed on individuals with child endangerment convictions, particularly those related to employment and professional licensing.

Homeschooling's Harms: Lessons From Economics, George Shepherd Jun 2016

Homeschooling's Harms: Lessons From Economics, George Shepherd

Akron Law Review

For more than two centuries, supporters of school choice programs, such as homeschooling, have attempted to invoke economic analysis. They have argued that school choice will cause public schools to improve because the public schools will no longer be monopolies; the new competition will discipline the public schools to improve. The argument is incorrect, as shown by both economic theory and empirical analysis. Economic theory indicates that, because of special characteristics of the market for education, competition will harm public schools, not help them. Likewise, empirical economic analysis confirms that competition will tend to harm public schools. Indeed, earlier school-choice …

Breaking Down Barriers: Review Of An Inside/Out Prison Exchange Program In A Jail Setting, Part 1, Tanja C. Link

Journal of Prison Education and Reentry (2014-2023)

The traditional criminal justice curriculum typically covers the three c’s – cops, courts, and corrections. In addition, students can usually choose from a variety of discipline-related special topics courses to satisfy the requirements of their major or minor in criminal justice. However, what is missing from most curricula for future criminal justice professionals is face-to-face interaction with the very individuals they will spend a good part of their careers with – those who have been accused of or sentenced for law-breaking behaviors. The current paper describes the planning and implementation of an Inside Out Prison Exchange Course in a jail …

Do Early Elementary Teacher Ratings Of Classroom Behavior Predict Similar Outcomes Across Demographic Groups? An Examination Using The Early Childhood Longitudinal Study Kindergarten Cohort (Ecls-K), Amira Conservilla Mattison Jun 2016

Do Early Elementary Teacher Ratings Of Classroom Behavior Predict Similar Outcomes Across Demographic Groups? An Examination Using The Early Childhood Longitudinal Study Kindergarten Cohort (Ecls-K), Amira Conservilla Mattison

USF Tampa Graduate Theses and Dissertations

Research suggests that how teachers perceive the behavior of individual children in the early years of elementary school has important implications for the school success of those youth over time (Darney et al., 2013; Hibel et al., 2010; Jimerson et al., 1997; Reinke et al., 2008). This may be because children who are of concern to teachers are often identified for practices such as grade retention and/or special education placement. Although these practices are intended to help children, they have not been shown to be associated with long-term positive outcomes. Rather, youth who are subject to these practices experience negative …

College Experiences: First-Generation Female Undergraduates At The University Of Northern Colorado, Andrea Rascon Jun 2016

College Experiences: First-Generation Female Undergraduates At The University Of Northern Colorado, Andrea Rascon

Ursidae: The Undergraduate Research Journal at the University of Northern Colorado

The number of women entering college and receiving degrees is continuously increasing while simultaneously first-generation students also are making up a larger portion of college students. Though numbers have increased, both populations are frequently viewed as vulnerable when it comes to succeeding in college. Much research has covered each populace separately. Minimal focus on first-generation female (FGF) students has limited the understanding of what the everyday college environment offers to enhance academic, social, and ethical experiences. Past research has focused on financing and academics; however, this study’s purpose was to explore the collegiate experiences that contribute to FGF student’s success …

Moving Beyond Miranda: Concessions For Confessions, Scott W. Howe Jun 2016

Moving Beyond Miranda: Concessions For Confessions, Scott W. Howe

Northwestern University Law Review

The law governing police interrogation provides perverse incentives. For criminal suspects, the law rewards obstruction and concealment. For police officers, it honors deceit and psychological aggression. For the courts and the rest of us, it encourages blindness and rationalization. This Article contends that the law could help foster better behaviors. The law could incentivize criminals to confess without police trickery and oppression. It could motivate police officers involved in obtaining suspect statements to avoid chicanery and duress. And, it could summon courts and the rest of us to speak more truthfully about whether suspect admissions are the product of informed, …

The current study focuses on the financial implications of the experimental strategy through a cost–benefit analysis.

Methods: The study begins by measuring the costs and benefits associated with the experimental strategy, the findings of which can inform agencies with existing CCTV infrastructure. Follow-up analyses measure the costs and benefits of the intervention for agencies absent existing CCTV infrastructure, meaning …
