Transforming The "Thurmond Rule" In 2016, Carl Tobias
Transforming The "Thurmond Rule" In 2016, Carl Tobias
Emory Law Journal Online
Senators vigorously dispute the Thurmond Rule's meaning in the 2016 presidential election year. The Rule is a peculiar tradition. The party not controlling the White House systematically invokes the custom during presidential election years to halt judicial designees' consideration until November with the hope that its standard bearer prevails and, thus, can appoint jurists. This year, Senators Grassley and McConnell characterized the tenet as 'flexible,' while Grassley declared that nominee confirmations generally end at the summer recess. Because confusion plagues definition of the stricture, and the Rule's incessant use dramatically exacerbates the vacancy crisis, its perpetuation merits scrutiny. Chronic partisanship …
Empirical Analysis Of Large Diameter Water Main Break Consequences, Sreeganesh Reddy Yerri
Empirical Analysis Of Large Diameter Water Main Break Consequences, Sreeganesh Reddy Yerri
All Theses
The recent ASCE report card gave a near failing “D” grade to drinking waterinfrastructure in the U.S. and reported that about 240,000 water main breaks occurannually. The economic, environmental and societal consequences of some of these watermain breaks have been hard to comprehend in the context of risk assessment andrehabilitation planning. In an attempt to understand the various impacts of such failuresand subsequently estimate the overall impact cost, this study synthesized the reportedconsequences of 20 large diameter water main breaks in the U.S., most of which haveoccurred in the recent past, and subsequently estimated the overall cost of the impacts …
Unmanned Aerial Vehicle (Uav)-Assisted Water Sampling, Cengiz Koparan
Unmanned Aerial Vehicle (Uav)-Assisted Water Sampling, Cengiz Koparan
All Theses
Water quality assessment programs require the collection of water samples for physical, chemical, and bacteriological analysis. Lack of personnel, accessibility of water bodies, and time constraints for water sampling, especially after natural disasters and emergencies, are some of the challenges of water sampling. To overcome these challenges, a water collection mechanism was developed and mounted on a multirotor unmanned aerial vehicle (UAV) for autonomous water sampling from water bodies. The payload capacity and endurance of the UAV (hexacopter) were verified using an indoor test station. The hexacopter was equipped with floating foam, and the electronic components were coated against water …
Property Tax Base Erosion: A South Carolina Study, Jonathan Keisler
Property Tax Base Erosion: A South Carolina Study, Jonathan Keisler
All Dissertations
Much has been learned in the literature about property tax base erosion in larger states. However for the most part, the research is limited to states with more urban populations than states like South Carolina. To address this gap, this research investigates two sources property tax base erosion in South Carolina including property tax incentives for business location and property tax exemptions for nonprofit organizations. State and local governments use several types of property tax incentives to attract new and expanding firms. The use of property tax incentives has resulted in local governments foregoing billions of dollars in tax revenue …

Abstract
La Pasionaria: The Ethos of a Leader was directed by Lois Agnew. This dissertation project inserts Latina activist Dolores Huerta into the feminist rhetorical tradition and traces the complicated ways in which ethos is constructed from multiply oppressed bodies within the context of social movements. Specifically, Huerta’s ethos formation is examined in order to identify the rhetorical strategies required when someone not only lacking power, but also purposefully silenced, is able to break through societal barriers and create change. The intent of this research is to build on the work of feminist rhetorical scholars and discover how attending to …

The Role Of Community Participation For Green Stormwater Infrastructure Development, Nicole Barclay
The Role Of Community Participation For Green Stormwater Infrastructure Development, Nicole Barclay
All Dissertations
The primary objective of this research is to understand the role of community participation in green stormwater infrastructure development. Even though the literature affirms the need for community participation to facilitate its implementation, no study in the engineering literature examines this idea with an in-depth, descriptive case study. It is important to understand how technical and non-technical factors interact to promote or hinder its implementation. This work uses the qualitative case study methodology to fulfil the objective and answer the research questions. The case study is based on the Proctor Creek Watershed, Atlanta Georgia, a rapidly growing urban area located …

A Safety Analysis Of Spatial Phenomena About The Residences Of Drivers Involved In Crashes, Kweku Tekyi Brown
All Dissertations
This research was conducted to assist in transportation safety planning at both a macro (statewide) and micro (neighborhood) level of geography. Addressing safety issues at high crash incidence locations through crash countermeasures or better geometric design helps to make our roadways safer; however, the most influential and ever-present factor in most crashes, the human factor, is not directly addressed. Therefore, the primary goal of this research was to identify and analyze phenomena about the residences of drivers involved in crashes using spatial and statistical methods. These phenomena include socioeconomic and demographic characteristics of neighborhoods where these drivers live and the …
Civil Liability And The Response Of Police Officers: The Effect Of Lawsuits On Police Discretionary Actions, Anthony P. Chiarlitti
Civil Liability And The Response Of Police Officers: The Effect Of Lawsuits On Police Discretionary Actions, Anthony P. Chiarlitti
Education Doctoral
The purpose of this study was to determine if there is a relationship between police discretion in carrying out arrests and the fear of retaliation litigation. Quantitative methods were used to examine the concerns of 88 police officers and first-line supervisors regarding civil litigation and the impact these concerns have on the discharge of their duties. The results indicate that the police officers in the study were not significantly concerned with the deterrent effects of lawsuits on their arrest activity, but there was a difference between the opinions of the police officers and their superiors regarding civil liability. A significant …
Emergency Management Training For Transportation Agencies, Frances Edwards, Daniel Goodrich, James Griffith
Emergency Management Training For Transportation Agencies, Frances Edwards, Daniel Goodrich, James Griffith
Mineta Transportation Institute
State transportation agencies have a variety of responsibilities related to emergency management. Field personnel manage events--from day-to-day emergencies to disasters--using the Incident Command System (ICS) as their organizational basis. At the headquarters level, the Emergency Operations Center (EOC) coordinates the use of resources across the department and its districts, with other state departments and agencies, and through the federal Emergency Support Function 1. District-level EOCs coordinate with the department. In extreme events, the transportation department may only be able to deliver limited essential services in austere conditions, so a continuity of operations/ continuity of government plan (COOP/COG) is essential. This …

Miranda Overseas: The Law Of Coerced Confessions Abroad, David Keenan
Miranda Overseas: The Law Of Coerced Confessions Abroad, David Keenan
UC Law Journal
In recent years, Article III courts have become the preferred venue for the U.S. government to try terrorism suspects captured abroad. Many liberals have welcomed this development, characterizing it as a proper extension of American rule of law principles to the so-called “War on Terror.” But while many have celebrated the marginalization of the military tribunal system, few have directly acknowledged its potential costs. This Article examines one of those costs: Reduced procedural safeguards for Article III defendants against statements procured through coercive interrogation techniques. As courts have repeatedly recognized, the core purpose of the Fifth Amendment’s Self-Incrimination Clause is …

Hybrid Policing As An Alternative Model Of Policing Againts Cybercrime In The Information Society, Kisnu Widagso, Orisa Shinta Hariyani
Indonesian Journal of International Law
Crime, within this context cybercrime, has become one of emerging features of social change. This condition generally responded with or demands of different models of policing. Current attempts in policing of cybercrime cases, despite of adequate resources in information system and technology, seemingly ignoring specific characteristics of computing environment in information society. Such ignorance resulting in weak formal social control on cybercrime, reflected on increasing number of cybercrime cases and huge numbers of unsolved cases, lack of trust in police forces, including economic and social cost that follows. So that it’s important to formulate a unique model of policing – …

Assault Weapon Bans: Can They Survive Rational Basis Scrutiny?, Clayton E. Cramer
Assault Weapon Bans: Can They Survive Rational Basis Scrutiny?, Clayton E. Cramer
ConLawNOW
In the last two decades, legislatures and courts have been increasingly willing to argue that a certain class of firearms termed “assault weapons” are not protected by the Second Amendment, and may be regulated or banned even though functionally identical firearms are not generally subject to such laws. Do such underinclusive bans survive even the lowest level of scrutiny: rational basis?

Juvenile Transfer To Adult Court: Ongoing Search For Scientific Support, David Myers
Juvenile Transfer To Adult Court: Ongoing Search For Scientific Support, David Myers
Criminal Justice Faculty Publications
(From p. 3) The basic question addressed in this body of research is as follows: Does transferring juvenile offenders to the adult criminal justice system produce a specific deterrent, criminogenic, or null effect? Unfortunately, despite two decades of research and the meta-analytic techniques employed in this study, a definitive answer to this question remains unclear. Nevertheless, when the results of this meta-analysis are considered along with findings from other relevant research conducted during the past 20 years, it seems clear that the practice of treating juveniles as adults should be limited to the most serious, violent, and chronic offenders, who …

Examining Student Leader Involvement Patterns Related To Academic Success, Stephanie Reiley
Theses and Dissertations
This thesis explores the desirable limits of Astin’s Involvement Theory. Astin (1993) reports that involvement on campus is positively related to student success, however, in other portions of his work, he reports that there are certain limitations on the theory of involvement. The purpose of this study was to investigate the involvement patterns and academic impact of highly involved students at Rowan University, in Glassboro, New Jersey in the spring 2015 semester. The target population for this survey was current Resident Assistants, Orientation Staff, and members of the Student Government Association. The instrument to assess students’ patterns and levels of …
Begging For Due Process: Defending The Rights Of Urban Outcasts In An Italian Town, Giacomo Pailli, Alessandro Simoni
Begging For Due Process: Defending The Rights Of Urban Outcasts In An Italian Town, Giacomo Pailli, Alessandro Simoni
Seattle University Law Review
Adult begging in Italy has been decriminalized since a Constitutional Court decision in 1995 and an ensuing law, no. 205, in 1999. Nonetheless, beggars, particularly Roma ones, are still perceived by the public as a nuisance, like an issue that should be dealt with. Sensible to the pressure of its constituency, even Florence—a city with a tradition of openness and inclusion—has taken measures against begging and other similar street-level economic activities. Between 2007 and 2008, the first wave of city action in Florence was directed at windshield cleaners at traffic lights. Even though the policy was challenged, it produced the …
