Two Models Of Pre-Plea Discovery In Criminal Cases: An Empirical Comparison, Jenia I. Turner, Allison D. Redlich

Our criminal justice system resolves most of its cases through plea bargains. Yet the U.S. Supreme Court has not required that any evidence, even exculpatory or impeachment evidence, be provided to the defense before a guilty plea. As a result, state rules on pre-plea discovery differ widely. While some jurisdictions follow an “open-file” model, imposing relatively broad discovery obligations on prosecutors early in the criminal process, others follow a more restrictive, “closed-file” model and allow the prosecution to avoid production of critical evidence either entirely or until very near the time of trial. Canadian public law blurs process and substance, a result confirming the prevailing view that this dichotomy ought never to be conceived as a simplistic bright-line distinction. Recent developments have created more than just a blurring but, rather, a strong linking or even fusion of the two. This paper probes the implications of these developments in public law. Section two briefly presents the historic and jurisprudential distinctions between process and substance and assesses its current legal import. Here I argue that judicially created analytic frameworks could assist by bringing a process-substance problem to the surface and constraining its potentially pernicious effects. …

Recent developments in the area of Connected and Automated Vehicles (CAVs) have boosted the interest in Intelligent Transportation Systems (ITSs). While ITS is intended to resolve and mitigate serious traffic issues such as passenger and pedestrian fatalities, accidents, and traffic congestion; these goals are only achievable by vehicles that are fully aware of their situation and surroundings in real-time. This descriptive survey study was designed to identify the impact of being a West Virginia State FFA President elected between the years of 1955-2005 on career and personal accomplishments. The population consisted of 51 people who were elected to the office of West Virginia FFA President, the response rate was 69%. A survey which was composed of four main question sets was mailed to the accessible population.;Questions focused on their SAE and FFA experience, involvement in community and school activities, leadership skills, and demographics. While the use of criminal justice courses and law-related education programs have been shown to serve as a crime prevention and deterrence mechanism against school crime and violence, and help students to gain positive experiences and attitudes toward law enforcement, many high schools still do not offer criminal justice courses. The purpose of this quasiexperimental study was to compare the attitudes of 12th-grade students from a school district in Massachusetts who took a criminal justice course to 12th-grade students from another school district in Massachusetts who did not to determine if there is a statistically significant difference between the groups. …

The reported number of hate crimes in New Jersey continues to remain high despite the enforcement of laws against perpetrators. The purpose of this correlational panel study was to test Shaw & McKay's theory of social disorganization by examining the relationship between demographic diversity and hate crime rates. This study focused on analyzing the relationship between the level of diversity, residential mobility, unemployment, family disruption, proximity to urban areas, and population density in all 21 New Jersey counties and hate crime rates. Accounts of sexual abuse appear daily in the media. Rightfully, this issue demands attention. Juveniles may be victims; they may also be offenders who are subject to sex offender registration and notification (SORN) policies. Growing research finds that SORN policies fail to achieve intended public policy outcomes. Little is known, however, about the unintended consequences of SORN for juvenile offenders. This study contributed to a more comprehensive understanding of the effects of these policies on this population. In the past decade, much attention has focused on developmental brain research and its implications for the regulation of crime. Public and policy interest has been directed primarily toward juveniles. In light of recent research, courts and legislatures increasingly have rejected the punitive response of the 1990s and embraced a developmental approach to young offenders. Of particular importance in propelling this trend has been the framework offered by the U.S. Supreme Court in a series of Eighth Amendment opinions that have rejected harsh adult sentences for juveniles. School violence has gained attention in recent years with the rise of aggressive behavior in schools across the United States. With increased understanding of this problem, school district administrators might implement prevention strategies or assess current school violence policies and programs. Using the conceptual framework of general strain theory, a case study was conducted in an urban school district in the northeastern United States that was experiencing increased student violence. This ethnographic and phenomenological study examined the relationship between the benefits and compensation afforded to emergency responders; their perceptions of work equity, equality, justice, and risk management; and the effect of perceived equity, equality, justice, and risk management on the execution of an emergency responder's duties. The data was collected through interviews with members of the culture group, including law enforcement officers, firefighters, and emergency medical responder's (n = 24). The interviews were audio recorded, then manually transcribed by the researcher. The raw data was coded for reoccurring themes and commonalities. The U.S. Food and Drug Administration (FDA) uses the FDA Adverse Event Reporting System (FAERS) to monitor adverse events resulting from pharmaceutical drug use. However, this system has limitations such as not allowing real-time data collection. To address these limitations, the FDA launched the Sentinel Initiative in 2008. This comparative case study was conducted to describe perceptions of investigating the efficacy of the Sentinel Initiative compared with the FAERS. In the past decade, the Supreme Court has transformed the constitutional landscape of juvenile crime regulation. In three strongly worded opinions, the Court held that imposing harsh criminal sentences on juvenile offenders violates the Eighth Amendment prohibition against cruel and unusual punishment. Roper v Simmons in 2005 prohibited the imposition of the death penalty for a crime committed by a juvenile. Five years later, Graham v. Florida held that no juvenile could be sentenced to life without the possibility of parole (LWOP) for a nonhomicide offense. Then in 2012, Miller v. Alabama struck down statutes that required courts to sentence …

The annual budget process is a primary financial control mechanism over community resources. However, in New Hampshire, some business school leaders do not have effective strategies for proper budget creation and execution. Adult criminals' use of minors to commit crimes associated with the support of terrorist organizations is a significant problem in the United States. Despite strict laws prohibiting adult offenders from exploiting youth, these individuals aggressively pursue minors to commit crimes associated with the support of terrorist organizations. This quasi-experimental, cross-sectional study used resource dependency theory to explore the likelihood that adult criminal offenders in the U.S. will use minors for crimes that are associated with the support of terrorist organizations, based on crime typology, country of origin, and location of crime. The use of proactive tactics to disrupt criminal activities, such as Terry street stops and concentrated misdemeanor arrests, are essential to the "new policing." This model applies complex metrics, strong management, and aggressive enforcement and surveillance to focus policing on high crime risk persons and places. The tactics endemic to the "newpolicing"gave rise in the 1990s to popular, legal, political, and social science concerns about disparate treatment of minority groups in their everyday encounters with law enforcement. After nursing school, graduate nurses complete a licensure examination to demonstrate possession of the minimal knowledge necessary to practice nursing. Even with the successful completion of the examination, many new graduate nurses still lack the competencies required for safe practice. This discrepancy between demonstrated knowledge and competent practice, which is termed a transition-to-practice gap, is a safety issue especially for persons with chronic illnesses. Early involvement in delinquent behavior coupled with large academic deficiencies increase the chances of long-term offending over a lifetime. A 2012 Texas report on recidivism rates and types of judicial-related programs offered showed that 1-year reoffense rates for youth in secure placement rose slightly from 41.9% in 2007 to 43.3% in 2010. The primary purpose of this qualitative case study was to examine how a Texas-based juvenile probation department coordinated services to address the needs of incarcerated juveniles who are at risk of school failure and recidivism. Approximately half of all incarcerated individuals in the United States are young African American men. Researchers have documented that nonincarcerated siblings may commit a crime when their sibling is in prison. The current study addressed literature regarding the experiences, and coping strategies of nonincarcerated young African American men who live in the inner city, and have a male sibling in prison. The majority of information related to the postprison experiences of exonerated individuals is frequently found in reports by journalists, or based on the findings of scholars on systematic factors that contribute to wrongful incarcerations. There is a lack of social science research on the unexplored meanings and essence of the postprison lived experiences of exonerees exclusively from their perspectives. GrowingChange is a grassroots organization dedicated to improving the futures of teenage males in the juvenile justice system. The group is working to reclaim an abandoned prison in Wagram, North Carolina in order to convert it into a sustainable farm and agricultural center for the local community. If successful, GrowingChange hopes to institute a national model for converting closed prison sites into community centers across the country. Youth involved in the program undergo unique forms of therapy to reset their paths toward more promising futures. In any emergency situation, it is paramount that communication be established between those affected by an emergency and the emergency responders. This communication is typically initiated by contacting an emergency service number such as 9-1-1 which will then notify the appropriate responders. The communication link relies heavily on the use of the public telephone network. If an emergency situation causes damage to, or otherwise interrupts, the public telephone network then those affected by the emergency are unable to call for help or warn others.
