An Exploratory Study On Physical Fitness Policies Among Police Departments In North Carolina, Jay H. Fortenbery
School of Criminal Justice Theses and Dissertations
The purpose of this study was to examine the existing state of physical fitness maintenance policies among police departments in North Carolina, and how those policies impact reported injuries among police officers. The research identified a sample of police departments with and without mandated physical fitness maintenance policies (n = 145) for years 2013-2015 and through collaboration with the North Carolina League of Municipalities, determined the number officer injuries per department for comparison. This information also included the cause of injury, costs, lost work days and claims by male and female for comparison. A cross-sectional analysis and purposive sampling method …

Wage Theft As Public Larceny, Elizabeth J. Kennedy
Wage Theft As Public Larceny, Elizabeth J. Kennedy
Brooklyn Law Review
Home care for the elderly and disabled is a rapidly expanding industry in which structural and regulatory factors contribute to worker vulnerability and exploitation. Systemic exclusion from core federal employment and labor laws, as well as many state and local regulations, results in minimal consequences for employers who violate standards. Despite recent movement at the federal level to create a “new mindset” of rights and regulations, home care workers must be equipped with creative ways to enforce these new rights and to challenge existing gaps in enforcement. With the understanding that two-thirds of the home care industry is financed by …

The present study compared outcome measurements on the Antisocial and Borderline scales of the Personality Assessment Inventory (PAI) with those on the Milion Clinical Multiaxial Inventory (MCMI-III) when both were used with a criminal justice population. Significant positive correlations were found between the Antisocial scales on the PAI and MCMI-III, as well as between the Borderline scales of both assessments, indicating that in an evaluation process it would be sufficient to use only one assessment. It is suggested that the MCMI-III is the better option to save costs and time while preserving the clinical accuracy of the testing protocol for …
Never Alone: Why The Inevitable Influx Of Drones Necessitates A New Fourth Amendment Standard That Adequately Protects Reasonable Expectations Of Privacy, Paul Burgin
University of Baltimore Law Review
In June 2011, North Dakota cattle rancher Rodney Brossart became the first American to be arrested with the aid of a drone (Unmanned Aircraft System(s) or UAS) operated by law enforcement. Six cows found their way onto Brossart's property, and he refused to turn them over to law enforcement officials. Brossart and a few family members chased police officers off of his property at gunpoint, and police later returned with a warrant and SWAT team. A sixteen-hour standoff ensued until police called in the assistance of a UAS to pinpoint Brossart's exact location. Shortly thereafter, SWAT officers rushed in, tased, …
The Irrelevance Of Nanotechnology Patents, Emily M. Morris
The Irrelevance Of Nanotechnology Patents, Emily M. Morris
Faculty Publications
Although scientists have for decades now had the ability to manipulate matter at the atomic level, we have yet to see the nanotechnological revolution that these scientists predicted would follow. Despite the years of effort and billions of dollars that have been invested into research and development thus far, nanotechnology has yielded surprisingly few end-user applications. A number of commentators have blamed this lack of progress on the Bayh-Dole Act and other changes to patent law, arguing that, although these laws are supposed to stimulate technological development, they have in fact had the exact opposite effect when it comes to …

Disaggregating “Immigration Law”, Matthew J. Lindsay
Disaggregating “Immigration Law”, Matthew J. Lindsay
All Faculty Scholarship
Courts and scholars have long noted the constitutional exceptionalism of the federal immigration power, decried the injustice it produces, and appealed for greater constitutional protection for noncitizens. This Article builds on this robust literature while focusing on a particularly critical conceptual and doctrinal obstacle to legal reform—the notion that laws governing the rights of noncitizens to enter and remain within the United States comprise a distinct body of “immigration laws” presumed to be part and parcel of foreign affairs and national security. This Article argues that the U.S. Supreme Court’s recent immigration jurisprudence suggests a willingness to temper, and perhaps …

The Judge Is The Key Component: The Importance Of Procedural Fairness In Drug-Treatment Courts, Brian Mackenzie
The Judge Is The Key Component: The Importance Of Procedural Fairness In Drug-Treatment Courts, Brian Mackenzie
Court Review: Journal of the American Judges Association
Beginning in the 1960s, the United States has suffered from waves of illicit drug epidemics, which have exerted immense stress on our system of criminal justice.2 For decades, the governmental response has been to wage a “War on Drugs” that has siphoned funding away from our nation’s schools and into the budgets of our correctional systems.3 In spite of the considerable amount of taxpayer dollars that has been dedicated to enforcement and incarceration initiatives, substance abuse remains a driving force in the criminal-justice system.4 After five decades of inefficient spending and ineffective imprisonment, governments at every level are realizing just …

Conjunctive Groundwater Management As A Response To Social Ecological Disturbances: A Comparison Of Four Western U.S. States, Sonya Ziaja, Zachary P. Sugg, Edella C. Schlager

Recent severe droughts in U.S. western and Great Plains states have highlighted the challenges that socio-ecological disturbances can pose for governing groundwater resources, as well as the interconnections between groundwater and surface water and the need to manage the 2 in an integrated way. Conjunctive management recognizes these interconnections and can be used to mitigate disturbances and achieve a variety of water management goals. However, comparative studies of how and to what extent various states have implemented conjunctive management strategies are few. Here we compare and assess the use of conjunctive management practices in 4 western state —Arizona, California, Nebraska, …

Out Of The Shadows: Deferred Action For Childhood Arrivals, Deferred Action To Parents Of Americans And Lawful Permanent Residents, And Executive Prosecutorial Discretion In Immigration Law, Olga Y. Kuchins
UC Law Constitutional Quarterly
Currently, more than eleven million undocumented immigrants live and work in the United States unlawfully. The Administration's effort to bring undocumented immigrants out of the "shadows" under the deferred action programs, while constitutional, is merely a Band-Aid-a temporary solution to Congress' unsuccessful efforts to pass legislation that addresses the issue of undocumented immigrants head on. This Note contextualizes the Obama Administration's deferred action programs within the larger framework of prosecutorial discretion in immigration law.
Section I lays the foundation for the Administration's decision to implement Deferred Action for Childhood Arrivals ("DACA") by discussing some of the major developments in United …
It’S Up In The Air! Potential Criminal Liabilities For Drone-Associated Issues In The Great State Of Texas, Anthony Pax
It’S Up In The Air! Potential Criminal Liabilities For Drone-Associated Issues In The Great State Of Texas, Anthony Pax
Texas A&M Journal of Property Law
“Look! Up in the sky! It’s a bird! It’s a plane!” No, it’s a drone! Private and commercial drone use is expanding as quickly as the technology can be developed to fulfill the various needs of different users. As new ways to use drones are conceived every day, the potential for conflict is ever increasing. This Article will argue that, in the absence of any real federal guidance on the subject, the state of Texas must apply its current criminal law framework to any drone-related conflicts that may arise. This will provide clear guidelines for resolving the multitude of issues …

The Doctrinal Toll Of Information As Speech, Kyle Langvardt
The Doctrinal Toll Of Information As Speech, Kyle Langvardt
Loyola University Chicago Law Journal
Courts over the past two decades have reached a near consensus that computer code, along with virtually every flow of data on the Internet, is “speech” for First Amendment purposes. Today, newer information technologies such as 3D printing, synthetic biology, and digital currencies promise to remake other spheres of non-expressive economic activity in the Internet’s image. The rush to claim First Amendment protections for these non-expressive but code-dependent technologies has already begun with a lawsuit claiming First Amendment privileges for the Internet distribution of 3D-printable guns. Many similar suits will surely follow, all pursuing the common dream of a future-shocked …

Student retention is a concern for many higher education institutions and there are many techniques that can be used to increase student retention. Previous research has used student personality data to customize interventions aimed at increasing student success and retention. In this study, prudence levels of incoming students was assessed, and a customized email intervention was designed and administered to students with students having low prudence levels. A variety of outcome measures were used to assess the usefulness of the intervention, including GPA, academic and behavioral citations, and use of campus resources. Results indicate that prudence levels are positively related …
