Bakken Crude Oil And The Changing Logistics Of The American Oil Industry, Austin Rau
Bakken Crude Oil And The Changing Logistics Of The American Oil Industry, Austin Rau
Independent Research
The extraction of Bakken crude oil in the Williston Basin of North Dakota is transforming how petroleum is shipped. Before 2008, North American oil was carried primarily via pipeline from source regions to refineries along the Gulf Coast or to metropolitan areas close to consumers. The current pipeline system is ill-equipped to accommodate massive volumes of oil from this previously low producing region. Lack of infrastructure and high demand for “light tight oil” (LTO) led to the use of railroads as a means of moving the product to refineries across the nation. Transporting oil via rail over long distances was …

Influence Of The Patient Protection And Affordable Care Act On Small Businesses, Sean Gallman
Influence Of The Patient Protection And Affordable Care Act On Small Businesses, Sean Gallman
Walden Dissertations and Doctoral Studies
Business leaders lack strategies to implement the employer shared responsibility provision of the Patient Protection and Affordable Care Act (ACA). Small businesses pay approximately 18% more than larger companies for the same health coverage. Within a conceptual framework of management by objectives, the purpose of this qualitative multiple case study was to explore the strategies small business leaders use to implement the employer shared responsibility provision of the ACA. Data were gathered from the review of company documents, observations, and semistructured interviews with 5 senior business leaders from small business organizations in the Mid-Atlantic region of the United States. Data …
A Qualitative Case Study Of Police Officers' Perception Of Sexual Offender Registration, Tracy Lee Veri
A Qualitative Case Study Of Police Officers' Perception Of Sexual Offender Registration, Tracy Lee Veri
Walden Dissertations and Doctoral Studies
Although many research studies about sexual offender registration exist, there is no qualitative study on the perspective of police officers whose job duties include the implementation of Sex Offender Registration and Notification (SORN) laws. The purpose of this case study was to explore specific police officers' perceptions of sex offender registration. Six police officers were hand selected for face-to-face interviews based on their unique job duties that included responsibilities and training related to the implementation of the sexual offender registration and community notification protocols. Festinger's cognitive dissonance theory provided the theoretical framework for this research study. According to study findings, …
Decriminalizing Violence: A Critique Of Restorative Justice And Proposal For Diversionary Mediation, M. Eve Hanan
Decriminalizing Violence: A Critique Of Restorative Justice And Proposal For Diversionary Mediation, M. Eve Hanan
New Mexico Law Review
The movement to reduce over-prosecution and mass incarceration has focused almost exclusively on non-violent offenders despite data showing that over half of all prisoners incarcerated within the United States are sentenced for crimes of violence. As a consequence of the focus on nonviolent offenses, the majority of current and future defendants will not benefit from initiatives offering alternatives to criminal prosecution and incarceration. A discussion of alternatives to the criminal justice system in cases of violent crime must begin by acknowledging that violent crime is not monolithic. Many incidents meet the statutory elements of a violent crime, that is, the …
A Qualitative Examination Of The Perception Of Risk In Warnings For Severe Weather, Teresa Simmons
A Qualitative Examination Of The Perception Of Risk In Warnings For Severe Weather, Teresa Simmons
Walden Dissertations and Doctoral Studies
In the past decade, weather disasters have claimed thousands of lives and resulted in billions of dollars in damages. Awareness of a storm threats can occur hours or days in advance, but disaster assessments indicate many people do not heed storm warnings. This problem is old. Despite 50 years of research, and new technologies and training to improve responsiveness, the basic issue– understanding how people interpret and respond to weather warnings–persists. An exploratory study that incorporated human behavior theories and communication models not traditionally associated with severe weather analysis was conducted to learn how weather risks are perceived by nonscientists. …
Missouri Public School Administrators’ Perceived Effectiveness Of Senate Bill No. 75, Joby B. Steele
Missouri Public School Administrators’ Perceived Effectiveness Of Senate Bill No. 75, Joby B. Steele
Dissertations
In this quantitative study, the perceptions of safety and preparedness of Missouri’s high school administrators after participating in active shooter training as mandated by Missouri’s Senate Bill No. 75 were analyzed. As school shootings continue, states have passed legislation to prepare schools to provide safety for students and faculty members (Shah, 2013b). There are currently limited data about the perceived effectiveness of Missouri’s Senate Bill No. 75 and its ability to help administrators feel safe and prepared in the event of an active shooter. This study involved examination of what schools can do to prepare for a school shooting before …

The Impact Of Secondary Career And Technical Education On Postsecondary Career And Educational Placement, Roy Allen Moss
Dissertations
The purpose of this research was to provide evidence of the impact career and technical education courses have on students after graduation. Numbers of Career and Technical Education (CTE) completers have continually dropped at the participating schools for the past five years. Five categories of placement after graduation were studied including the following: college, employment, postsecondary vocational training, military, and no placement. Archival data were gathered from postgraduate surveys conducted by high schools as required by the Missouri Department of Elementary and Secondary Education. Data were collected for graduates in 2011, 2012, and 2013 from four area high schools that …

Ensuring Natural Grass Sports Fields Are Safe For Athlete Participation: A Risk-Assessment Process For Assessing Field Conditions Before Sports Activity, Lauren A. Petrass, Dara M. Twomey, Caroline F. Finch
Journal of Applied Sport Management
Public safety is critical to the provision of sports fields and is dependent on maintaining natural grass surfaces and checking the safety of sports environments before play, to identify, remove and control hazards to reduce injury risk to participants. This paper presents and evaluates a Good Practice Sports Ground Inspection Form (GPSGIF), a new checklist developed to assist sports organizations, policy makers and field managers in the identification of injury hazards on natural grass fields. Use of the GPSGIF led to a consensus decision about the safety of grounds in >80% of assessments, and most items showed high levels of …
Deconstructing Public Discourse On Undocumented Immigration In The United States In The Twenty First Century, Kwadjo Owusu-Sarfo
Deconstructing Public Discourse On Undocumented Immigration In The United States In The Twenty First Century, Kwadjo Owusu-Sarfo
Department of Conflict Resolution Studies Theses and Dissertations
As the United States prepares to elect a new president, immigration continues to be one of the most controversial topics on the national agenda. While Republican presidential candidate Donald Trump announced his candidacy for president with the intent to build a wall along the border with Mexico, the Democratic presidential candidate, Hillary Clinton, has opted, instead to push for comprehensive immigration reform. The difference in approach is symptomatic of the divisiveness within the immigration debate. To explore this divide in depth, the dissertation’s research question is: What does the discourse on undocumented immigration in the United States in the 2000s …

Symposium: Environmental Accountability In An Age Of Consequences: Forword, 38 W. New Eng. L. Rev. 307 (2016), Julie E. Steiner
Western New England Law Review
The five articles in this Symposium issue each take a different approach to addressing environmental accountability. There is unequivocal evidence that the climate system is warming, caused mainly by the measurable increase in anthropogenic greenhouse gas emissions. The Symposium authors include Denis Binder, Susan Stark, Julie E. Steiner, Chris Erchull, Laura Fisher, and Daniel DePasquale. These Authors challenge all to think broadly about utilization of different accountability mechanisms to insure better environmental outcomes.
The Uneasy Case For Food Safety Liability Insurance, John Aloysius Cogan Jr.
The Uneasy Case For Food Safety Liability Insurance, John Aloysius Cogan Jr.
Brooklyn Law Review
Foodborne illnesses sicken millions and kill thousands of Americans every year, leading many to conclude that our dysfunctional government food safety system, which still relies heavily on physical inspections of food and facilities, is incapable of protecting us. As a result, many now look to the private market for solutions to our food safety crisis. One private market approach, food safety liability insurance, is gaining popularity. This article examines the benefits and drawbacks to food safety liability insurance and raises doubts about its ability to improve food safety. The market for safe food is plagued by overwhelming information problems that …

The Second Amendment In The 21st Century: An In-Depth Examination Of Firearm Freedoms And Their Relationship With Public Safety And Interests, Mathew E. Klein
Honors Undergraduate Theses
One of the most hotly contested topics in the world today revolves around an object. An object that has caused debate among all members of society both in the United States, and all across the globe. But how could an object, something that on its own does nothing, spur such heated argument? This object is the evolution of invention and the product of fighting amongst each other. This object changes the way people think and how they act. This object can be used for both good and bad. This object is a gun.
This research project will explore the Second …

Ongoing, systematic research on civil legal needs and services is an essential component of improving the quality and availability of such services. Collaboration among researchers, legal services providers, and regulators will only become more important as innovations in the delivery of legal services progress. This volume brings together sixteen white papers by subject matter experts who assess "what we know and need to know" about various aspects of civil legal services delivery. The product of a partnership between the South Carolina Law Review and the ABA Commission on the Future of Legal Services, the collection is intended to serve as …

Principled Policing: Warrior Cops And Guardian Officers, Seth W. Stoughton
Faculty Publications
Policing in the United States is in crisis. Public confidence in policing is at the lowest point since the Rodney King beating. A bare majority of Americans still report confidence in the police, and an unprecedented number of people report no or very little confidence in policing. A long history of poor police/community relations in minority and low-income neighborhoods has been exacerbated by egregious acts of misconduct, some of which have been captured on video and shared on social media. Activists, politicians, and police officials themselves have called for better education and equipment, from de-escalation training to body-worn camera systems. …

The Effectiveness Of Specialized Legal Counsel And Case Management Services For Indigent Offenders With Mental Illness, Jeff Bouffard, Elizabeth Berger, Gaylene Armstrong
The Effectiveness Of Specialized Legal Counsel And Case Management Services For Indigent Offenders With Mental Illness, Jeff Bouffard, Elizabeth Berger, Gaylene Armstrong
Criminology and Criminal Justice Faculty Publications
Background: In recent years, jurisdictions have recognized the strain placed on limited existing resources by criminal offenders with mental illness who frequently cycle through local jail facilities. In response, many locales have developed and implemented specialized programs to more effectively and efficiently manage these offenders, particularly the process of assigning defense attorneys to these often indigent defendants.
Methods: The current study examined the impact of an Indigent Defense Counsel (IDC) program designed to provide specially trained defense attorneys, and enhanced case management services to 257 indigent jail inmates with a qualifying, major mental health diagnosis (e.g., major depression). These …

The Prosecutor’S Duty Of Silence, Bennett L. Gershman
The Prosecutor’S Duty Of Silence, Bennett L. Gershman
Elisabeth Haub School of Law Faculty Publications
Prosecutors enjoy broad opportunities to communicate with the public outside the courtroom. Justice Holmes’s famous dictum -- “The theory of our system is that conclusions to be reached in a case will be induced only by evidence and argument in open court, and not by any outside influence, whether of private talk or public print” – is just that – a “theory.” The reality is otherwise. Prosecutors, and defense lawyers too, engage in extrajudicial speech frequently, and often irresponsibly. But in contrast to other lawyers, prosecutors have a higher “special” duty to serve justice rather than a private client. And …
Valuing Spectrum Allocations, Thomas W. Hazlett, Michael Honig
Valuing Spectrum Allocations, Thomas W. Hazlett, Michael Honig
Michigan Telecommunications & Technology Law Review
Observing trends in which Wi-Fi and Bluetooth have become widely popular, some argue that unlicensed allocations hosting such wireless technologies are increasingly valuable and that administrative spectrum allocations should shift accordingly. We challenge that policy conclusion. A core issue is that the social value of a given spectrum allocation is widely assumed to equal the gains of the applications it is likely to host. This thinking is faulty, as vividly seen in what we deem the Broadcast TV Spectrum Valuation Fallacy – the idea that because wireless video, or broadcast network programs are popular, TV channels are efficiently defined. This …

Virtual Violence - Disruptive Cyberspace Operations As "Attacks" Under International Humanitarian Law, Ido Kilovaty
Michigan Telecommunications & Technology Law Review
Power outages, manipulations of data, and interruptions of Internet access are all possible effects of cyber operations. Unfortunately, recent efforts to address and regulate cyberspace operations under international law often emphasize the uncommon, though severe, cyber-attacks that cause deaths, injuries, or physical destruction. This paper deals with cyber operations during armed conflicts that cause major disruption or interruption effects – as opposed to deaths, injuries, or physical destruction. The purpose of this paper is to explore the consequences of these cyber operations that cause major disruption or interruption effects, and to argue that they might still constitute “acts of violence,” …
