Public Institutions As Defamation Plaintiffs, Hilary Young Apr 2016

Public Institutions As Defamation Plaintiffs, Hilary Young

Dalhousie Law Journal

This article focuses on public institutions' ability to sue in defamation. It has a descriptive and a normative section. The descriptive part begins with an analysis of the relevant law in several common law jurisdictions. The state of Canadian law is then examined. The normative section considers which public institutions should be prohibited from suing in defamation and why Whereas some case law suggests that a prohibition on public institution defamation actions should be grounded in the public importance of speech about such institutions, this article takes the position that that is unprincipled. Instead, the focus is on factors such …

High Time For Change: How Legalizing Marijuana Could Help Narrow The Racial Divide In The United States, Gene Taras Apr 2016

High Time For Change: How Legalizing Marijuana Could Help Narrow The Racial Divide In The United States, Gene Taras

Cardozo Journal of International and Comparative Law

The note argues that legalizing marijuana in the United States could significantly reduce the racial disparities perpetuated by the war on drugs. It traces the origins of marijuana prohibition to racially motivated policies and highlights how these laws disproportionately affect minority communities. By examining international models and domestic legalization efforts, the article suggests that ending prohibition could address systemic inequities and generate economic benefits.

To Accommodate Or Not To Accommodate: (When) Should The State Regulate Religion To Protect The Rights Of Children And Third Parties?, Hillel Y. Levin, Allan J. Jacobs, Kavita Shah Arora

Washington and Lee Law Review

When should we accommodate religious practices? When should we demand that religious groups instead conform to social or legal norms? Who should make these decisions, and how? These questions lie at the very heart of our contemporary debates in the field of Law and Religion.

Particularly thorny issues arise where religious practices may impose health-related harm to children within a religious group or to third parties. Unfortunately, legislators, courts, scholars, ethicists, and medical practitioners have not offered a consistent way to analyze such cases, so the law is inconsistent. This Article suggests, first, that the lack of consistency is a …

Appraising 9/11: 'Sacred' Value And Heritage In Neoliberal Times, Mateo Taussig-Rubbo

Journal Articles

On September 11, 2001, United Airlines Flight 93 — one of the four airplanes hijacked that day — crashed into a vacant parcel of land in rural Pennsylvania, killing all on board. For many, including family members of those killed in the attack and the Park Service that now manages the national memorial at the site, the former strip mine was transformed into ‘sacred’ ground. Unable to settle on a price with the landowner, in 2009 the government took the property through eminent domain. Focusing on the ongoing effort in United States of America v. 275.81 Acres of Land to …

The Effects Of Low Dam Removal And Kayak Run Installation On The Biodiversity Of Fish And Macroinvertebrates In The Great Miami River In Downtown Dayton, Ohio, Sarah Anne Stalder

Honors Theses

Five Rivers Metroparks and the Miami Conservancy District have made plans to remove the upper portion of the Monument Avenue low-head dam in downtown Dayton due to the hazard it poses for recreation on the river and its negative impact on water quality and biodiversity. The plans also include modifying the dam with “kayak drops” and the construction of a second kayak drop slightly upstream of the location of the current low dam to enhance recreational opportunities on the river. Typically, low dam removal alter the flow and depth of a river, especially above the dam in the impounded area …

Guns And Drugs, Benjamin Levin Apr 2016

Guns And Drugs, Benjamin Levin

Fordham Law Review

This Article argues that the increasingly prevalent critiques of the War on Drugs apply to other areas of criminal law. To highlight the broader relevance of these critiques, this Article uses as its test case the criminal regulation of gun possession. This Article identifies and distills three lines of drug war criticism and argues that they apply to possessory gun crimes in much the same way that they apply to drug crimes. Specifically, this Article focuses on: (1) race- and class-based critiques; (2) concerns about police and prosecutorial power; and (3) worries about the social and economic costs of mass …

Broken Windows On College Campuses, Bradley R. Gielow Apr 2016

Broken Windows On College Campuses, Bradley R. Gielow

Research Papers

Fear of crime is a major problem in today’s society. Much research has been devoted to neighborhood settings on the issue; however, little research has been conducted on college and university campuses. Fear of crime can result in devastating consequences on college students, as well as, campus faculty, administration, and the campus community. Before a solution can be put into effect a cause needs to be identified. Incivilities have led to fear in many settings and are believed to also cause fear on campuses.

Perspectives On The Illinois Healthcare Delivery System Challenges, Structural Issues And Opportunities For Reform, Linda Baker

The Simon Review (Occasional Papers of the Paul Simon Public Policy Institute)

As fourth year students in the program, students at SIU School of Medicine have enrolled in classes at the Institute and have spent a rotation studying public policy choices that impact the delivery of health care services and the profession itself. The choices made by these public entities will have ramifications for physicians, nurses, administrative support staff and most importantly, for patients and their families. Students have studied state healthcare policy formation up-close and have learned a great deal about the forces and factors that shape their fields of study. Common to all students’ findings and much of the literature …

Exploring The Role Of Organizational Motivations In Cross-Sector Watershed Collaboration, Luisa M. Diaz-Kope

School of Public Service Theses & Dissertations

Watersheds are complex, dynamic and nested ecological systems that span across multiple jurisdictions. The complexity of watershed pollution requires adaptive and responsive strategies that incorporate government intervention along with community stakeholder engagement. This study explores the motivational determinants that drive local cross-sector watershed collaboration. Cross-sector collaboration offers local watershed stakeholders a holistic approach to address community watershed issues. These collaborative partnerships involve the voluntary engagement of member organizations from different industry sectors directing resources and working together to address local watershed issues of mutual interest.

Improving Police-Community Partnerships: A Review Of The Literature, Portland State University. Criminology And Criminal Justice Senior Capstone

Criminology and Criminal Justice Senior Capstone Project

Our examination of community-based policing research and literature includes thirty-two articles. The articles contained original information on departmental procedure, training, and interactions, both positive and negative, between law enforcement organizations and the communities they serve. The overall goal of community-based policing is to improve the relationships between police and their local communities. Community-based policing promotes positive relationships and collaboration between the police and the citizens in communities in which they serve. In order to improve police legitimacy and community relations throughout the country, proper training and a set of new performance standards needs to be implemented nationwide. Maintaining trust with …
