Should Courts Fear Transnational Engagement?, Olga Frishman
Should Courts Fear Transnational Engagement?, Olga Frishman
Vanderbilt Journal of Transnational Law
Judicial citation of foreign law worries many people, including justices of the U.S. Supreme Court, politicians, and legal academics. The critics in the United States argue that judges "cherry-pick" foreign citations and use them to import foreign norms that do not accord with the Constitution or the will of the American people. This Article argues, based on insights from organizational theory, that the critics overlook another, much greater, concern: the danger does not come from citing or looking at foreign law, but rather, from other types of interaction, such as meetings at judicial organizations, judicial delegations, or judicial conferences. The …

The Structural Choice Of A Senior Marketing Executive In The Top Management Teams In Mncs In Usa, Uk And Germany: Antecedents And Impact On Firm Performance, Kurt John Gleichauf
Theses and Dissertations
The role of the Chief Marketing Officer (senior marketing executive) has received minimal attention in the literature. Only recently has academic research investigated the position of the senior marketing executive. This dissertation uses neo-institutional and contingency lenses to extend prior theory and add cross-national perspectives on marketing management structural choices. An analysis of secondary data sources is used to clarify the key antecedents involved in the organizational choice of a senior marketing executive as a structural response in both one-tier and two-tier board governance systems. Possible mechanisms for the hypothesized effects are presented. Further, gaps in the prior literature on …
Embracing Discursive Paradox: Consultants Navigating The Constitutive Tensions Of Diversity Work, Jennifer Mease (Also Peeksmease)
Embracing Discursive Paradox: Consultants Navigating The Constitutive Tensions Of Diversity Work, Jennifer Mease (Also Peeksmease)
Department of Communication Studies: Faculty Publications
This article addresses how diversity consultants manage the dual demands of social justice and organizational goals or priorities. I suggest that navigating this “discursive paradox” is one of—if not the—defining feature of diversity work. To investigate this discursive paradox, I analyze diversity work as a process (rather than a collection of products) as evidenced in interviews with 19 diversity consultants. The results offer two derivative discursive paradoxes that emerged in consultants’ talk about diversity work: the tension between broad and narrow constructions of human differences and the tension between emphasizing change at the organizational and individual levels. Rather than …

Positive Psychology In Sales: Integrating Psychological Capital, Scott B. Friend, Jeff S. Johnson, Fred Luthans, Ravipreet Sohi
Department of Management: Faculty Publications
As positive psychology moves into the workplace, researchers have been able to demonstrate the desirable impact of positive organizational behavior. Specifically, psychological capital (PsyCap) improves employee attitudes, behaviors, and performance. Advancing PsyCap in sales research is important given the need for a comprehensive positive approach to drive sales performance, offset the high cost of salesperson turnover, improve cross-functional sales interfaces, and enrich customer relationships. The authors provide an integrative review of PsyCap, discuss its application in sales, and advance an agenda for future research. Research prescriptions are organized according to individual-level, intra-organizational, and extra-organizational outcomes pertinent to the sales field.

The Problem: While the time and place of the birth of the Academy of Human Resource Development are documented, the field of human resource development (HRD) has historical roots that began decades earlier with the emergence of training and development and organization development as fields of practice.
The Solution: This article addresses the early history of training and development and organization development, and begins with the influence of World War II on work-related education and training and ends in the mid-1990s. It traces the origins of the field up to, but not including, the founding of the Academy of Human …

Left Unsaid: The Role Of Work Expectations And Psychological Contracts In Faculty Careers And Departure, Kerryann O’Meara, Jessica Chalk Bennett, Elizabeth Niehaus
Department of Educational Administration: Faculty Publications
Faculty leave higher education institutions for many reasons, including higher salaries, more prestigious departments, lack of collegiality, a better geographic location, and to be closer to family (O'Meara, Lounder, & Campbell, 2014; Rosser, 2004; Smart, 1990; Xu, 2008). At the same time, research suggests that factors such as a higher salary and a more prestigious department are not really "pull" factors if faculty members are satisfied and thriving within their institution (Matier, 1990; O'Meara, 2014). Rather, faculty become predisposed to leave by virtue of dissatisfaction with certain aspects of their work environment (Daly & Dee, 2006; Johnsrud & Rosser, 2002; …

Transitioning To Performance-Based State Funding: Concerns, Commitment, And Cautious Optimism, Lindsay K. Wayt, Barbara Lacost
Department of Educational Administration: Faculty Publications
The introduction of performance-based state funding of higher education can be traced to the the late 1970s (Bogue and Hall 2003; Dougherty and Natow 2015; Dougherty, Natow, Hare, and Vega 2010; Dougherty and Reddy 2013; Long 2010; McKeown-Moak 2013). Early forms, referred to as Performance Funding 1.0, provided higher education institutions with bonuses, in addition to regular state funding, when they met certain state-defined outcomes.1 More recent forms, referred to as Performance Funding 2.0, have eliminated bonuses, and regular state funding has been replaced, in part or completely, with funding tied to achievement of state-defined performance goals, which often include …

Examining The Impact Of Leadership Styles On The Motivation Of U.S. Teachers, Katrina Franklin
Walden Dissertations and Doctoral Studies
Teachers face daily challenges in their work, which affect their ability to remain motivated and effective educators. The problem is that there is a lack of adequate research on how administrative leadership styles affect the motivation of United States teachers working within the U.S. and internationally. The purpose of this quantitative causal comparative study was to examine teachers' preferences regarding school administrators' leadership styles and gauge whether differences exist among U.S. teachers working in the United States and internationally. Herzberg's two-factor theory as well as full range leadership theory were used to quantitatively explore the relationship between leadership styles and …

Exploring The Use Of Texting Within San Antonio Texas Police Emergency Reporting, Deborah Lee Almendarez
Walden Dissertations and Doctoral Studies
The introduction of wireless device text messaging, as an alternative to a citizen placing a telephone call for police help, generates the need for new polices and processes relevant to police call-taker, police dispatcher, and police officer response to reported emergencies. Little scholarly research explores the policy issues around the use of text 9-1-1 within public safety answering point operations. Using systems theory as the foundation, the purpose of this qualitative case study was to explore the potential use of written communication via a wireless device text message for reporting a police emergency. Research questions focused on the reciprocal relationships …

Transforming Christian Schools Using Sustainable Model Of Organizational Change And Performance Improvement, Abraham Adhanom
Walden Dissertations and Doctoral Studies
Organizational failure in Christian schools is a common phenomenon affecting millions of families in the United States. In the past 2 decades alone, more than 200 Christian schools closed each year; and many continued to struggle for survival. This trend presented significant challenge for the sustainability of faith-based schools that serve over 10% of grade-level students in the country. The purpose of this study was to examine internal and external factors impacting the performance of Christian schools and analyze existing theories of institutional effectiveness leading to the development of a sustainable framework. The research question addressed what type of organizational …
Gender And Self-Care Behaviors In The Burnout Of Mental Health Professionals, Kafy-Ann Martin-Johnson
Gender And Self-Care Behaviors In The Burnout Of Mental Health Professionals, Kafy-Ann Martin-Johnson
Walden Dissertations and Doctoral Studies
Difficulties experienced at work can cause feelings of burnout that become prolonged and intensified without acts of self-care. The intense nature of mental health workers' jobs may make them, more vulnerable to burnout than other professionals. Because mental health professionals' mental and emotional wellness can significantly affect their work, adequate self-care is critical to both their well-being and that of their clients. Previous researchers have investigated the self-care behaviors of mental health professionals, but little was known about how gender affected the use of these behaviors in burnout prevention among mental health professionals. The purpose of this quantitative study was …
Preventive Health Education Media And Older Worker Health Literacy, Lori Michelle Williams-Johnson
Preventive Health Education Media And Older Worker Health Literacy, Lori Michelle Williams-Johnson
Walden Dissertations and Doctoral Studies
The United States has experienced an increase in older workers as individuals born between 1946 and 1964 have remained in the labor force. Preventive health screening education, such as an immunization flyer, is necessary to avert preventable illness among older workers. Based on previous research, there is a gap regarding age-specific methods for educating the older worker about preventive health. Therefore, the purpose of this study was to explore the relationship between various media providing preventive health screening information and the assessed health literacy of the older worker. Based on the health belief model, a quantitative, cross-sectional method was used. …

Emotional Intelligence, Leadership Style, And Job Satisfaction In Contrasting Workplace Environments, Jason Allen Downing
Walden Dissertations and Doctoral Studies
Managers in direct contact with employees in operational and organizational settings have a profound effect on employee satisfaction and performance. The Bureau of Labor Statistics (BLS) indicated distinctly different levels of occupational stress between blue- and white-collar workers. A quasi-experimental design tested if the levels of emotional intelligence and transformational leadership style of managers had different effects on employee job satisfaction between blue- and white-collar workers. The theories of emotional intelligence, transformational leadership, and employee job satisfaction grounded the framework of the study. Data was collected using the Multifactor Factor Leadership (MLQ) questionnaire, the Job Satisfaction Survey (JSS), and the …

Toward Excellence: A Study Of Public Sector Department Of Defense Teams, Denise Marie Miller
Walden Dissertations and Doctoral Studies
The Department of Defense's (DoD's) budgetary and personnel challenges are affecting readiness, thus encouraging the use of effective teams to improve efficiency. This qualitative, descriptive case study examined how public sector DoD members experienced characteristics of high-performing teams (HPTs), defined by their members' shared sense of purpose, interdependent commitment, and exceptional team effectiveness. The documentation of these experiences may aid other DoD teams seeking to improve performance. Lewin and Sherif's theories on group dynamics, Johnson and Johnson's theory on groups, Katzenbach and Smith's theory of HPTs, and Edmondson's work on teams comprised the theoretical framework. Thirty-nine public sector DoD members …

Knowledge Sharing In Multicultural Organizations, Stephen Joseph Mcgrane
Walden Dissertations and Doctoral Studies
Knowledge management is critical to achieving competitive advantage in the marketplace. The prominence of multicultural organizations also requires an understanding of knowledge-sharing behavior in multicultural teams. In spite of the need to accommodate these new conditions, a gap exists in the research on knowledge sharing in multicultural organizations. The purpose of this study was to examine factors that affect knowledge sharing in a multicultural context. In the research questions I examined the role that culture, monetary rewards, social units, and diversity play in knowledge sharing in a multicultural environment. This study used Hofstede's cultural dimension theory, Sveiby's knowledge-based theory, and …

A Curriculum On Culturally Competent Practices To Prevent Retraumatization In Diverse Survivors, Luana Rodriguez
Walden Dissertations and Doctoral Studies
This DNP project addresses the healthcare issue of intimate partner, domestic, and sexual violence (IPDSV), its impact on survivors, and reducing the potential for retraumatization by those who care for them in the clinical, behavioral, and social settings. Trauma-informed care interventions are designed to address the sequelae of trauma, promote recovery, and support resilience. Since IPDSV is a global health issue, supporting cultural needs of all clients is an essential aspect of trauma-informed care. This project was guided by a central research question that examined if trauma-informed, culturally competent curriculum be viewed by community stakeholders as an appropriate intervention for …
Penalty Enhancement Laws And The Reporting Of Patient Assaults On Emergency Department Nurses, Thomas Runkle
Penalty Enhancement Laws And The Reporting Of Patient Assaults On Emergency Department Nurses, Thomas Runkle
Walden Dissertations and Doctoral Studies
Assaults on emergency department nurses by patients are higher than any other occupation in the private sector. Professional nursing organizations have lobbied for penalty enhancement laws that increase the categorization of assaulting a nurse on duty from a misdemeanor to a felony. As of 2015, 32 states have implemented these laws. Yet, low assault reporting rates by nurses remains a problem, and little is known about whether penalty enhancements improved reporting rates. The purpose of this correlational study was to evaluate the impact of penalty enhancement laws on self-reporting of assault on emergency department nurses in 6 Mid-Atlantic cities. Constructs …
