Ukraine: Analyzing The Revolution And Nato Action In Light Of The U.N. Charter And Nicaragua, Matthew Emery Jan 2016

Ukraine: Analyzing The Revolution And Nato Action In Light Of The U.N. Charter And Nicaragua, Matthew Emery

Emory International Law Review

Ukraine has been subject to civil unrest and Russian aggression since early 2014. Amidst these international conflicts and pressures, NATO has made it clear that it wants the current Ukrainian government to succeed, mostly because it would establish a very pro-Western government. In this Comment, Matthew Emery argues that NATO is limited in the assistance it can provide to Ukraine, because Ukraine is not a member of NATO. Furthermore, this Comment argues that any assistance from NATO countries to the current Ukrainian government would violate the International Court of Justice's decision in Nicaragua because the government is illegitimate.

Indigenous Interpretations Of The Right To Education Incorporating Gandhi's Visionary Philosophy To Educational Reform, Anna Saraie Jan 2016

Indigenous Interpretations Of The Right To Education Incorporating Gandhi's Visionary Philosophy To Educational Reform, Anna Saraie

Emory International Law Review

Since the 1940s, there has been growing movement for the promotion of education. There is now an obligation in the international community to ensure that every child has the resources to exercise his or her right to education. Two problems have emerged from this obligation. First, international agreements define the right ambiguously but requires countries to adhere to strict and unrealistic deadlines. This has burdened developing countries. Second, there has been an increase in violent opposition groups targeting children to protest the promotion of education. To combat these problems, states should incorporate Gandhi's philosophy. Gandhi advocated that education should be …

Multifactoral Free Speech, Alexander Tsesis Jan 2016

Multifactoral Free Speech, Alexander Tsesis

Faculty Publications & Other Works

This Article presents a multifactoral approach to free speech analysis. Difficult cases present a variety of challenges that require judges to weigh concerns for the protection of robust dialogue, especially about public issues, against concerns that sound in common law (such as reputation), statutory law (such as repose against harassment), and in constitutional law (such as copyright). Even when speech is implicated, the Court should aim to resolve other relevant individual and social issues arising from litigation. Focusing only on free speech categories is likely to discount substantial, and sometimes compelling, social concerns warranting reflection, analysis, and application. Examining the …

Balancing Free Speech, Alexander Tsesis Jan 2016

Balancing Free Speech, Alexander Tsesis

Faculty Publications & Other Works

This article develops a theory for balancing free speech against other express and implied constitutional, statutory, and doctrinal values. It posits that free speech considerations should be connected to the underlying purpose of constitutional governance. When deciding difficult cases involving competing rights, judges should examine (1) whether unencumbered expression is likely to cause constitutional, statutory, or common law harms; (2) whether the restricted expression has been historically or traditionally protected; (3) whether a government policy designed to benefit the general welfare weighs in favor of the regulation; (4) the fit between the disputed speech regulation and the public end; and …

Death Of A Politician, Brian W. Sanders Jan 2016

Death Of A Politician, Brian W. Sanders

Global Tides

This paper strives to explain the remarkable efficacy of brash rhetoric, specifically analyzed through the lens of Donald Trump’s sustained popularity in the 2016 Presidential Election. Examining Trump’s rhetorically generated relationships with the media, immigrants, politicians, and women, this paper explores the increasing importance of sophistic rhetoric and rhetorical ethos. Appeals to audience identification through in-groups and out-groups are explored, followed by an examination of the appeal of violent metaphors and sanctity considerations to Trump’s voter base. Trump’s successful self perpetuating cycle of shocking statements, followed by increased news coverage and political popularity is explained. Finally, this paper analyzes the …

J.R.R. Tolkien: The Founder Of Modern Day Fantasy World Building, Shayne A. Dwyer Jan 2016

J.R.R. Tolkien: The Founder Of Modern Day Fantasy World Building, Shayne A. Dwyer

Honors Capstones

This paper explores why J. R. R. Tolkien’s works have proven so influential on modern fantasy authors through analyzing one critical, and understudied, component of his works. Among the most beloved twentieth century novels, his works have become a benchmark for measuring excellence in fantasy literature. However, there is little criticism that actually explores the reasons for his impact on the fantasy genre as most critical conversations generally focus on the contexts for his writing. I will explore one of the reasons why his works have been so influential. Epic and High fantasy worlds all partake in world building, but …

Inside And Out: The Interaction Of The U.S. Immigration System And Indian Immigrant Families In Columbus, Ohio, Madeline English

Undergraduate Distinction Papers

The purpose of this study is to consider how Indian immigrant families, who come from cultures that are shaped around culturally distinct forms of family, navigate and adapt to U.S. culture and institutions that are structured based on the idealized American family form. The main research questions being considered are: How is family defined by immigration policies? How are Indian immigrant families affected by these policies? An ethnographic methodological approach, including participant observation and semi-structured interviews, is used to gather data in the Columbus metro area in order to address the above questions. Observations and semi-structured interviews were completed with …

Enhancing Cultural Humility Through Critical Service-Learning In Teacher Preparation, Alan S. Tinkler, Barri Tinkler

Anti-Poverty Service Learning Resources

Most of the teaching population is white. Additionally, many pre-service teachers grow up in increasingly segregated schools. This study analyzes the impact of exposing pre-service teachers to students who are racially different from themselves while also addressing their biases and prejudices. They found that the pre-service teachers developed cultural humility by connecting to students through stories, understanding and accommodating students' strengths, and catering their teaching through reciprocal relationships.

Developing A Dance/Movement Therapy Approach To Qualitatively Analyzing Interview Data, Tomoyo Kawano

Expressive Therapies Dissertations

The objective of this research was to develop a model for an embodied-artistic approach to analyzing interview data that could contribute to an enhanced narrative account and/or offer an alternate perspective. A new model was formulated by adapting and/or critically applying a combination of previously developed analytical frameworks. Dance/movement therapy (DMT) skills that encompass ways of listening through an embodied, empathic, aesthetic manner; and a movement observation and assessment tool, Laban Movement Analysis (LMA) were at the core of this explicatory process. The researcher’s movement preferences were identified in the preparatory phase with a certified movement analyst (CMA) as a …

Men In A Female-Dominated Profession: The Lived Experiences Of Ghanaian Male Nurses In The United States, Daniel Kwadjo Frimpong Jan 2016

Men In A Female-Dominated Profession: The Lived Experiences Of Ghanaian Male Nurses In The United States, Daniel Kwadjo Frimpong

Educational Studies Dissertations

Minority men are less than two percent of the total nursing workforce in the United States. The small presence of minority men in the nursing profession presents a challenge to healthcare providers as patients are much more responsive and open-minded to healthcare providers of the same cultural and ethnic backgrounds. This qualitative study was designed to explore the lived professional experiences of Ghanaian male nurses in the United States to shed light on the barriers minority men encounter in the nursing profession in order to make suggestions relating to strategies to appropriately support minority men in their nursing practice. This …

Navigating The New American Classroom: How Adjunct Faculty Empower Themselves To Reach Out To The New Diverse Population Of Students, Yvonne Macrae Jan 2016

Navigating The New American Classroom: How Adjunct Faculty Empower Themselves To Reach Out To The New Diverse Population Of Students, Yvonne Macrae

Educational Studies Dissertations

With widened access to higher education, and a rise in the enrollment of diverse students, it is increasingly important to understand the experiences of the adjunct faculty members who teach these students. While a number of studies have been conducted on adjunct faculty, most of them focus only on the challenges they face in higher education in general. Few studies have been conducted specifically on their experiences teaching business and management courses in a college of professional studies and/or continuing education. In this qualitative study, thirteen adjuncts with 4 to 30 years of teaching experience in two different universities were …

Voice Disorder Management Competencies: A Survey Of School-Based Speech-Language Pathologists In Nebraska, Amy F. Teten, Shari L. Deveney, Mary J. Friehe

Special Education and Communication Disorders Faculty Publications

Purpose: The purpose of this survey was to determine the self-perceived competence levels in voice disorders of practicing school-based speech-language pathologists (SLPs) and identify correlated variables.

Method: Participants were 153 master’s level, school-based SLPs with a Nebraska teaching certificate and/or licensure who completed a survey, including demographic information and a 25-item voice disorders competency checklist.

Results: Findings indicated school-based SLPs did not feel particularly competent in their ability to assess and treat students with voice disorders. Only 1 response mean was higher than a “moderately competent” level. All other item means were at or below this level. Four correlations indicated …

Claire had been worried about her son Henry for several months. He did not seem to talk like other children his age and did not say as many words as his older sister when she was a toddler. Claire consulted with Henry's pediatrician at his two-year wellness check. They discussed Henry's medical history and, other than his lack of words, neither had concerns about his development. "He really seems to understand everything we say to him or tell him to do," Claire explained, "But he barely says anything at all."

She decided to contact her local public school district for …

Biomedical Word Sense Disambiguation With Neural Word And Concept Embeddings, Akm Sabbir Jan 2016

Biomedical Word Sense Disambiguation With Neural Word And Concept Embeddings, Akm Sabbir

Theses and Dissertations--Computer Science

Addressing ambiguity issues is an important step in natural language processing (NLP) pipelines designed for information extraction and knowledge discovery. This problem is also common in biomedicine where NLP applications have become indispensable to exploit latent information from biomedical literature and clinical narratives from electronic medical records. In this thesis, we propose an ensemble model that employs recent advances in neural word embeddings along with knowledge based approaches to build a biomedical word sense disambiguation (WSD) system. Specifically, our system identities the correct sense from a given set of candidates for each ambiguous word when presented in its context (surrounding …

Cries From The Jungle: The Dialogic Linguistic Landscape Of The Migrant And Refugee Camps In Calais, France, Jo Mackby Jan 2016

Cries From The Jungle: The Dialogic Linguistic Landscape Of The Migrant And Refugee Camps In Calais, France, Jo Mackby

Theses and Dissertations--Linguistics

Since 1999, migrants and refugees from across the Middle East and Northeastern Africa have squatted in makeshift camps in and around the strategic port city of Calais, France, hoping for the opportunity to stow away on a ferry or lorry to England. The inhabitants of these camps seek to engage the world in a dialogue, and although they speak a variety of languages, the voices the refugees and migrants in The Jungle of Calais raise through their protest placards and graffiti are more homogeneous. Like in many other protests, the languages of these messages are universal; they are French and …

The Use Of Gesture In Self-Initiated Self-Repair Sequences By Persons With Non-Fluent Aphasia, Eleanor M. Feltner Jan 2016

The Use Of Gesture In Self-Initiated Self-Repair Sequences By Persons With Non-Fluent Aphasia, Eleanor M. Feltner

Theses and Dissertations--Linguistics

This study examines the relationship between types of gestures and instances of self-initiated self-repair (SISR) used by persons with non-fluent aphasia (NFA), which is a type of aphasia characterized by stilted speech or signing (Papathanasiou et al., 2013), in interactions with clinicians. Conversation repairs in this study are assessed using the framework of Conversation Analysis (CA), which is an approach for describing, analyzing, and understanding social interaction (Sidnell, 2010). Previous linguistic studies have demonstrated a distinct preference for the use of gesture during a repair by persons with aphasia (Goodwin, 1995; Klippi, 2015; Wilkinson, 2013). This study draws more conclusive …

A Culture Of Rape: In Twentieth Century American Literature And Beyond, Lisa M. Schroot Jan 2016

A Culture Of Rape: In Twentieth Century American Literature And Beyond, Lisa M. Schroot

Theses and Dissertations--English

This project examines rape culture in American literature and society, exploring factors of rape culture through the narratives of literary protagonists and current women alike. Each chapter is grounded in a work of literature, which serves as a lens through which to analyze a factor of rape culture, and is then broadened in scope to incorporate recent court cases that have had significant sociocultural impacts. The introduction includes a critical review of rape in feminist theory, from Susan Brownmiller to Ann J. Cahill. The first chapter treats the rape of Dolores Haze and victim blaming in Vladimir Nabokov’s 1955 Lolita …

Socio-Spatial Mobilities In An Immigrant Gateway City: Analyzing Latina\O Experiences In East Boston, Mitchell Beam Snider Jan 2016

Socio-Spatial Mobilities In An Immigrant Gateway City: Analyzing Latina\O Experiences In East Boston, Mitchell Beam Snider

Theses and Dissertations--Geography

This dissertation analyzes the ways in which Latino migrants in East Boston represent their material and imagined socio-spatial mobilities in the city. It considers the ways in which participants discuss the relationship of their mobilities to experiences of social exclusion and inclusion as well as feelings of belonging. The first empirical chapter specifically analyses how participants’ motility—or capacities for being mobile—interfaced with their experiences (or lack thereof) of onward migration. It finds that there is a complex relationship between onward migration and participants' motility. The second empirical chapter considers how participants represented encounters with others in the city as emotional …

A Plural And Uneven World: Queer Migrations And The Politics Of Race And Sexuality In Sydney, Australia, Derek Ruez Jan 2016

A Plural And Uneven World: Queer Migrations And The Politics Of Race And Sexuality In Sydney, Australia, Derek Ruez

Theses and Dissertations--Geography

This dissertation examines how the geographies of sexuality and race shape queer migrants’ experiences of settlement and citizenship in Sydney, Australia. Against a backdrop of economic shifts in the Asia Pacific and Australia's long history of racialized exclusion, I conducted 43 in-depth interviews with queer migrants and '2nd generation' adult children of migrants who reflect the diversity of Australia's migration streams, including historically important migration from Southern and Eastern Europe and increasingly significant movements from South, Southeast, and East Asia. Through those interviews, I examined participants' migration histories, everyday spatial trajectories in the city, and involvement with queer and ethnic …
