"Should" Or "Must"?: Distinguishing Mandates From Guidelines In Tort Claims Contexts, A.G. Harmon Jan 2016

"Should" Or "Must"?: Distinguishing Mandates From Guidelines In Tort Claims Contexts, A.G. Harmon

Scholarly Articles

This Article intends to bring some order to the discussion, both by

means of explaining what the science of the language arts—linguistics—says

about the matter, and by explaining how that science comports with what courts

think they are doing when they determine a government statement is, or is not,

a mandate. Linguists have considered language crimes before, relating to

perjury, bribery, and criminal threats, and I myself have conducted a linguistic

analysis with regard to the civil law Tarasoff context (i.e., “duties to warn”),

but a linguistic analysis of mandates as opposed to guidelines has not yet been

attempted.

Transforming Teacher-Family Relationships: Shifting Roles And Perceptions Of Home Visits Through The Funds Of Knowledge Approach, Kristin Whyte, Anne E. Karabon

Teacher Education Faculty Publications

Education has embraced the idea of an ‘asset approach’ to working with families and children, creating a focus on developing collaborative relationships with families by building on what they bring to the table. In this paper we explore what happened when early childhood teachers entered homes to learn from families and identify their Funds of Knowledge. The findings show how issues of power and perception surfaced when teachers attempted to shift their role from that of teacher to learner. In analyzing teachers’ experience before, during, and after ethnographic home visits we saw their general desire to adopt an asset-based mentality. …

Association Of Secondhand Tobacco Smoke And Abdominal Adiposity In The United States Population, Omar T. Tahtamooni Jan 2016

Association Of Secondhand Tobacco Smoke And Abdominal Adiposity In The United States Population, Omar T. Tahtamooni

Master of Public Health Program Student Publications

Background: Secondhand smoke (SHS) exposure occurs when people inhale smoke from tobacco products or inhale smoke that has been expelled by other smokers. Exposure to SHS increases the risk of many metabolic and chronic diseases, such as cardiovascular disease.

Purpose: To evaluate the association between SHS and abdominal adiposity in US adults. Methods: Data from 2011-2012 National Health and Nutrition Examination Survey (NHANES) was used to examine the relationship between SHS exposure and abdominal adiposity, Sagittal Abdominal Diameter [SAD]), after adjusting for covariates (age, gender, ethnicity, and income) (n=4,012). Univariate linear regression analyses were used to predict association of smoking …

Eat Well, Keep Moving: Decreasing Childhood Obesity In Fulton County, Kentucky, Sandra Onekhena

Theses and Dissertations--Public Health (M.P.H. & Dr.P.H.)

With the high rates of childhood obesity in Fulton County, the Purchase District Health Department proposes the implementation of the Eat Well and Keep Moving Program in all the county’s elementary schools among fourth and fifth graders. It is an interdisciplinary, evidence-based program that will be aimed at our short-term goal of increasing knowledge about nutrition and physical activity and inspiring positive behavioral change. It works by integrating lessons and activities about proper nutrition and activity into various aspects of the children’s lives — in the classroom, cafeteria, at home and in the community. We hope to see children move …

A Further Note On Federal Causes Of Action, John F. Preis Jan 2016

A Further Note On Federal Causes Of Action, John F. Preis

Law Faculty Publications

In the article, I argue that federal causes of action ought to be treated as (1) distinct from substantive rights, (2) synonymous with the availability of a remedy (but not whether a remedy will in fact issue) and (3) distinct from subject matter jurisdiction (unless Congress instructs otherwise). This thesis is built principally on a historical recounting of the cause of action from eighteenth century England to twenty-first century America. In taking an historical approach, I did not mean to argue that federal courts are bound to adhere to centuries-old conceptions of the cause of action. I merely used history …

Talking Through The Problems: A Study Of Discourse In Peer-Led Small Groups, Michelle D. Repice, R. Keith Sawyer, Mark C. Hogrebe, Patrick L. Brown, Sarah Luesse, Daniel J. Gealy, Regina F. Frey

SIUE Faculty Research, Scholarship, and Creative Activity

Increasingly, studies are investigating the factors that influence student discourse in science courses, and specifically the mechanisms and discourse processes within small groups, to better understand the learning that takes place as students work together. This paper contributes to a growing body of research by analyzing how students engage in conversation and work together to solve problems in a peer-led small-group setting. This qualitative study evaluates video of Peer-Led Team Learning (PLTL) sessions in general chemistry, with attention to both the activity structures and the function of discourse as students undertook different types of problems across one semester. Our findings …

Economists As Arbitrators, J. Gregory Sidak Jan 2016

Economists As Arbitrators, J. Gregory Sidak

Emory International Law Review Recent Developments

In this Essay, J. Gregory Sidak examines the use of economists as arbitrators or tribunal-appointed neutral experts in international arbitration in effort to raise the standard of party-expert testimony and expedite the determination of quantum. Mr. Sidak argues that either approach would expedite arbitration by causing parties to submit more realistic estimates of quantum and to explain in a more systematic and helpful manner the robustness of those estimates and the assumptions underlying them. Gregory Sidak draw insights from his experience as a court-appointed neutral economic expert on damages for Judge Richard Posner in two patent litigations. Sidak concludes that …

Sovereignty And Indigenous Peoples In North America, Kent Mcneil Jan 2016

Sovereignty And Indigenous Peoples In North America, Kent Mcneil

Articles & Book Chapters

This article examines the concept of sovereignty and its application in the context of European colonization of North America. It seeks to define sovereignty so as to avoid Eurocentric notions that denied sovereignty to Indigenous peoples. The article does this by distinguishing between defacto and de jure sovereignty: the former depends on actual possession and control of a territory, whereas the latter depends on the application of a particular legal system. Unlike de facto sovereignty, which is empirical, de jure sovereignty depends on a choice of law. Because more than one legal system can be applied to territories occupied by …

Narratives Of Adult Esol Learners: Successfully Finding Their Way, Lucy Bunning Jan 2016

Narratives Of Adult Esol Learners: Successfully Finding Their Way, Lucy Bunning

Journal of Pedagogy, Pluralism, and Practice

This article examines narratives about successful uses of English, told and written by adult learners in a beginning-level class of English for speakers of other languages (ESOL). The learners told stories of using English to solve a problem of getting lost by asking for and receiving directions. In their narratives, we see where they were going, their path to get there, their use of English, and their evaluation of these experiences. An analysis of the structure of the stories indicates learners’ inclusion of essential elements of narratives and raises questions about how the learners related to each other’s stories. The …

Life In The Dominican Republic’S Sugar Fields: Resistance From The Bateyes, Andréa Nunes Jan 2016

Life In The Dominican Republic’S Sugar Fields: Resistance From The Bateyes, Andréa Nunes

Journal of Pedagogy, Pluralism, and Practice

This paper addresses the manipulation of the relationship between the people of the Dominican Republic and Haiti and how this distortion used for political power currently affects the status of Haitians living and working within the Dominican Republic. This paper explores the use of Haitian labor in the Dominican agricultural sector, and the widespread human rights violations these workers face, particularly in the country’s sugar cane batey communities. Resistance movements that challenge the systemic human rights abuses of Haitian migrants are also explored. Finally, suggestions for how U.S. consumers can stand in solidarity with Haitian workers in the Dominican Republic …

Accessing Freedom: Culturally Responsive Restorative Justice Practice In Schools, Estelle E. Archibold Jan 2016

Accessing Freedom: Culturally Responsive Restorative Justice Practice In Schools, Estelle E. Archibold

Journal of Pedagogy, Pluralism, and Practice

Restorative justice in schools is becoming an essential set of practices and strategies taken on by schools and school districts to address the disproportionate academic and social-emotional outcomes among students within individual schools and across districts. Restorative justice in schools supports building healthy and supportive relationships among students and adults that serve as the bedrock of growth and development for students, their families and practitioners. While aiming to develop and restore positive and relationships among the most vulnerable and marginalized students (and their families), educators and schools bear the heaviest burden of re-visioning how these students gain access to rigorous …

The Effects Of Structural Violence On The Well-Being Of Marginalized Communities In The United States, Rakhshanda Saleem, Akansha Vaswani, Emily Wheeler, Meredith Maroney, Marta Pagan-Ortiz, Madeline Brodt Jan 2016

The Effects Of Structural Violence On The Well-Being Of Marginalized Communities In The United States, Rakhshanda Saleem, Akansha Vaswani, Emily Wheeler, Meredith Maroney, Marta Pagan-Ortiz, Madeline Brodt

Journal of Pedagogy, Pluralism, and Practice

Structural violence refers to injustices embedded in social and institutional structures within societies that result in harm to individuals’ wellbeing (Galtung, 1969; Farmer, 2004). Using the structural violence framework, our research proposes to investigate its impact on marginalized communities through an intersectional analysis. Traditional academic scholarship in psychology demonstrates notable absence of voices and stories of individuals from such communities due to the lack of linguistic, class and other privileges that provide opportunities for research participation. Our data will come from interviewing members from three communities, “undocumented” Latinos (as) immigrants, Muslims (immigrants and non-immigrants), and LGBTQ+ persons who have experienced …

The Historical Superscriptions Of Davidic Psalms: An Exegetical, Intertextual, And Methodological Analysis, Jerome L. Skinner Jan 2016

The Historical Superscriptions Of Davidic Psalms: An Exegetical, Intertextual, And Methodological Analysis, Jerome L. Skinner

Dissertations

The significance of the historical superscriptions (h/ss) that refer to David’s life (Pss 3, 7, 18, 34, 51, 52, 54, 56, 57, 59, 60, 63, 142) has been a matter of interest over the past century of Psalm Studies. An investigation into the structural and theological role1 of the thirteen Davidic h/ss and their psalms in the Psalter, as well as the role of David expressed in them reveals the nature of their origin, authorship, structural function, and theological import. While their historicity forms a large part of the discussion, at its core is the question of meaning. The literary …
