Milkovich V. Lorain Journal Twenty-Five Years Later: The Slow, Quiet, And Troubled Demise Of Liar Libel, Leonard Niehoff, Ashley Messenger
Milkovich V. Lorain Journal Twenty-Five Years Later: The Slow, Quiet, And Troubled Demise Of Liar Libel, Leonard Niehoff, Ashley Messenger
University of Michigan Journal of Law Reform
In Milkovich v. Lorain Journal Co., the Supreme Court held that there is no separate constitutional protection for statements of opinion. It also held that an accusation that an individual lied is a statement of fact actionable in defamation. Lower courts have, correctly in our view, essentially ignored both holdings. In Part I we discuss Milkovich and the infirmities in its reasoning. In Part II we discuss the complex nature of lies and accusations of lies and argue that Milkovich failed to account for that complexity. In Part III we discuss the strategies the lower courts have used to …

The Israelite Roots Of Atonement Terminology, T. Benjamin Spackman
The Israelite Roots Of Atonement Terminology, T. Benjamin Spackman
BYU Studies
When Latter-day Saints speak of atonement, they use vocabulary drawn from the scriptures, including common verbs like atone, save, and redeem, and the corresponding nouns atonement, savior, salvation, redeemer, and redemption. There are other, perhaps more vivid, words for salvific acts, such as the Book of Mormon references to being “snatched” (Mosiah 27:28–29; Alma 26:17).1 Such rare terms in scripture have not found place in LDS discourse, which tends to use the most common terms related to atonement interchangeably. While they are indeed at some level synonymous, their distinctive meanings gesture toward …
The "Nature" Of Legal Dispute Bargaining, Robert J. Condlin
The "Nature" Of Legal Dispute Bargaining, Robert J. Condlin
Cardozo Journal of Conflict Resolution
The longstanding debate over the relative merits of adversarial and communitarian theories of legal dispute bargaining has been in somewhat of a holding pattern for several years, but recent research in the field of cognitive neuroscience may break this logjam. Laboratory experiments and case studies in that field have shown how dispositions and capacities for social cooperation inherited from natural selection and evolution predispose humans to configure disputing as a mixture of argument over factual reality, disagreement over the interpretation of normative standards, and a search for impartial resolutions that protect the interests of everyone involved equally. This neurobiological inheritance …

A Longitudinal Study Of Language Learners’ Images About Russia, L. Nikitina
A Longitudinal Study Of Language Learners’ Images About Russia, L. Nikitina
Research Publications (2016 to 2020)
Several studies in the field of applied linguistics have explored images held by language learners about a target language country. However, for the most part, these studies focused on learners of modern European languages, such as German, Spanish and French and they were conducted in Western educational contexts. Besides, none of the previous investigations attempted to conduct a systematic classification of the language learners’ images. The present longitudinal study addressed these gaps in the research literature. It explored images about Russia held by Malaysian learners of the Russian language in a large university in East Malaysia. This article reports the …

A Two Stage Adaptation Towards Automatic Speech Recognition System For Children, M. Mumtaz Begum, S. Siti Salwah, R. Feizal Dani
Research Publications (2016 to 2020)
Recently, Automatic Speech Recognition (ASR) systems were used to assist children in language acquisition as it has the ability to detect human speech signal. Despite the benefits offered by the ASR system for children, there is a lack of ASR systems for Malay-speaking children. One of the contributing factors for this is the lack of continuous speech database for Malay-speaking children. Though cross-lingual adaptation is a common solution for developing ASR systems for under-resourced language, it is not viable for children as there are very limited children's speech databases as a source model. In this research, we are proposing a …
Action Research As A Teaching Armoury For The Language Teacher, M.K. David, C.H. Kuang
Action Research As A Teaching Armoury For The Language Teacher, M.K. David, C.H. Kuang
Research Publications (2016 to 2020)
Given the easy availability of information due to social media, language teachers need to move beyond their role as mere disseminators of information to that of as an innovator, enabling learners to think critically. To do so, language teachers must make action research an indispensable part of their language teaching armoury. They must realise that the challenges of teaching, be it student disinterest, poor comprehension skills or weak performances can be tackled. One way of doing so is to conduct some research within their own classrooms so as to seek solutions to overcome these challenges. This paper highlights the importance …
Bilingual Sentiment Detection - Investigating Impact Of Tweet Translation, B. Vimala, W. Kaur
Bilingual Sentiment Detection - Investigating Impact Of Tweet Translation, B. Vimala, W. Kaur
Research Publications (2016 to 2020)
This paper looks at how translating tweets from Malay to English may impact its sentiment score, and if at all the score can be improved in case a tweet is translated compared to just translating the keywords. Tweets written in Malay were translated using an online dictionary before proceeding for analysis. An online sentiment analysis tool, Twin word was used to perform the sentiment analysis on both translated and untranslated tweets. The results of the analysis showed translating tweets did not create a significant impact on the overall sentiment score; therefore translating the whole length of the tweet would not …

Predicting The Mechanical Properties Of Viscose/Lycra Knitted Fabrics Using Fuzzy Technique, I. Hossain, I.A. Choudhury, A. Mamat, A. Shahid, A.N. Khan, A. Hossain
Research Publications (2016 to 2020)
The main objective of this research is to predict the mechanical properties of viscose/lycra plain knitted fabrics by using fuzzy expert system. In this study, a fuzzy prediction model has been built based on knitting stitch length, yarn count, and yarn tenacity as input variables and fabric mechanical properties specially bursting strength as an output variable. The factors affecting the bursting strength of viscose knitted fabrics are very nonlinear. Hence, it is very challenging for scientists and engineers to create an exact model efficiently by mathematical or statistical model. Alternatively, developing a prediction model via ANN and ANFIS techniques is …

The samples of this study consisted of five pupils in a primary school with different levels of dyslexic problem. Two were classified as 'mild', two 'moderate' and one quite 'serious'. The KGBK teaching-and-learning intervention process was conducted for 16 weeks in a school classroom by a teacher trained in KGBK for this purpose. Six data collection methods were used: observation and recording, interviews …
Ethics Of Love? Morality And The Meaning Of Divine Love, John C. Peckham
Ethics Of Love? Morality And The Meaning Of Divine Love, John C. Peckham
Andrews University Seminary Student Journal
While there is wide agreement on the importance of love to Christian ethics, just what an ethics of love includes and entails differs depending upon how Christian love is understood. Toward clarifying the relationship between love and Christian ethics, this essay briefly engages the highly influential agapist conception of love and questions its sufficiency as the basis of Christian ethics. Consideration of some apparent shortcomings of the agapist conception leads to the proposal that the continued quest for a more intentionally and distinctively biblical conception of divine love is integral to a compelling and faithfully Christian ethics of love.

Introduction : Translingual Work., Min-Zhan Lu, Bruce Horner
Faculty and Staff Scholarship
This issue both reflects and builds on the efforts prompted by the 2011 College English essay “Language Difference in Writing: Toward a Translingual Approach,” by Bruce Horner, Min-Zhan Lu, Jacqueline Jones Royster, and John Trimbur. Contributions to this symposium contextualize the emergence of a translingual approach, explore the tension and interconnections between a translingual approach and a variety of fields, and explore the viability of a translingual approach in light of existing academic structures.
Cultivating Trust In Gmo Science: Moving Past The Deficit Model To Productive And Participatory Science Education, Kate Crowley , '16
Cultivating Trust In Gmo Science: Moving Past The Deficit Model To Productive And Participatory Science Education, Kate Crowley , '16
Senior Theses, Projects, and Awards
Most scientists believe GMOs are safe for human consumption, but a majority of the American public remains unconvinced. I argue that this lack of trust stems from scientists' outdated approach to science communication, namely the deficit model. Instead of seeing the public as empty vessels waiting to be filled with scientific knowledge, the scientific community must recognize that many strongly held beliefs about science issues are socially situated. Only through genuine attempts at participatory, two-way conversations with the public can the scientific community come to understand how public values influence GMO acceptance. While these actions will necessitate a redefining of …
Through The Alice Corp. Looking Glass: Using Pragmatic Arguments To Bring Predictability To Patent Law, Jason B. Portis
Through The Alice Corp. Looking Glass: Using Pragmatic Arguments To Bring Predictability To Patent Law, Jason B. Portis
Northwestern Journal of Technology and Intellectual Property
Within the last four years, multiple institutional actors that have largely remained dormant in the scope of innovation policy and patents have undertaken a surprisingly interventionist reform of patent law. Congress, administrative agencies, and the Supreme Court have all recently shaped patent law to be more pragmatic and less overtly formalistic. Conversely, the Court of Appeals for the Federal Circuit has staunchly defended a formalist approach to patent law, advocating consistently for bright-line rules.
The Federal Circuit has been charged with bringing predictability to patent law since its creation in 1982. The Federal Circuit attempts to bring predictability and uniformity …
Taking Patents, Gregory Dolin, Irina D. Manta
Taking Patents, Gregory Dolin, Irina D. Manta
Hofstra Law Faculty Scholarship
The America Invents Act (AIA) was widely hailed as a remedy to the excessive number of patents that the Patent & Trademark Office issued, and especially ones that would later turn out to be invalid. In its efforts to eradicate "patent trolls" and fend off other ills, however, the AIA introduced serious constitutional problems that this Article brings to the fore. We argue that the AIA's new "second-look" mechanisms in the form of Inter Partes Review (IPR) and Covered Business Method Review (CBMR) have greatly altered the scope of vested patent rights by modifying the boundaries of existing patents. The …
Domestic Violence In Lac Su’S I Love Yous Are For White People: A Sociological Criticism Approach, Quan-Manh Ha
Domestic Violence In Lac Su’S I Love Yous Are For White People: A Sociological Criticism Approach, Quan-Manh Ha
Asian American Literature: Discourses & Pedagogies
This article employs sociological criticism to examine domestic violence, parenting, and communication behavior in Lac Su’s Vietnamese American memoir. The book debunks the seemingly positive myth of Asian Americans as a model minority, substantiates certain negative stereotypes of Asian men, and challenges some of the classic Asian values that apparently have shaped the Asian American identity. I argue that Su’s memoir is a critique of structural inequalities, urban poverty, unemployment, inaccessibility to a support network, and the intersection between class, gender, and race in the contexts of war and its aftermath.
Utopia And The Law And Literature Movement, Michael P. Malloy
Utopia And The Law And Literature Movement, Michael P. Malloy
McGeorge School of Law Scholarly Articles
The year 2016 marks the quincentennial of the publication of Thomas More’s novel Utopia. In addition to being an important literary milestone and cultural artifact, Utopiarepresentsa significant marker in the history of political and legal philosophy. I would argue that it also provides an important contribution to the law and literature movement that has flourished in recent decades. It is that contribution that I wish to explore.
This paper begins with a brief introduction to the law and literature movement, in which I identify some of the objectives of the movement and the relationship of More’s novel to those objectives. …
Police Stories, Helen A. Anderson
Police Stories, Helen A. Anderson
Articles
As lawyers and judges know, the facts, and the stories created with those facts, make the law: “[A] case well stated is more than half argued.” The police narrative is one of the most common narratives in legal writing, simply because there are so many criminal cases, as well as numerous civil cases, involving police. For the most part, these narratives tell the familiar story of the hardworking, careful police officer in a challenging situation with dangerous criminals.
These narratives do much of the work of an appellate argument, just as Chief Justice Robert’s story about Officer Devlin makes the …
Exploring The Quality And Inequality In The Literacy Development Opportunities Of South African Preschoolers, Annalene Van Staden
Exploring The Quality And Inequality In The Literacy Development Opportunities Of South African Preschoolers, Annalene Van Staden
Papers from the International Association for Cross-Cultural Psychology Conferences
According to the South African Constitution and Bill of Rights, with their emphasis on a culture of civil liberties and the democratic values of liberty, equality and human rights, the country’s education system should be inherently capable of meeting the diverse needs of every child and preventing the breakdown and exclusion of any learner. In reality, however, the South African education system fails to address the literacy needs of many South African children. National literacy surveys suggest that the country is ‘headed for a national education crisis’ (Bloch, 2009:12), because we ‘barely produce literate and numerate children’. Against this disturbing …

Making The "Moves" More "Modal", Thomas Henry
Making The "Moves" More "Modal", Thomas Henry
The Utah English Journal
We live in a multimodal world. Almost every piece of information that we receive on computers and mobile devices is multimodal. For those new to this term, multimodality refers to multiple modes of communication: the textual, the visual, the written, the aural/oral, and the gestural (Kress, 2000). Although seemingly appearing in isolation, these modalities are often expressed in pairs simultaneously. For instance, pictures may include text, videos often include audio, and even speakers and actors use gestures in their performances. In everyday online communication via Facebook, Instagram, and/or Twitter, we convey and respond to both textual and visual information working …
