Professional Formation And The Political Economy Of The American Law School, Louis D. Bilionis
Faculty Articles and Other Publications
This article proposes that a comprehensive model for doing professional formation in law school is now in sight. The model can work for formation – which is to say that it has the right vision of the fundamentals and the appropriate program features and pedagogies to effectively support students in the development of their professional identities. The model also can work for the political economy of the typical American law school – which is to say that its strategy and approach to roles and resources makes it congenial to postulates about power, resources, work, and governance that shape relations inside …

The Successes And Shortfalls Of The Sarbanes-Oxley Act Of 2002, Brad Hopkins
The Successes And Shortfalls Of The Sarbanes-Oxley Act Of 2002, Brad Hopkins
Senior Honors Projects
The collapse of Enron and its auditor, Arthur Andersen, in 2001 marked the greatest financial scare since the Great Depression. Enron, along with several other scandals, such as WorldCom and Waste Management, sent a financial shockwave throughout the United States. As a result, the public was no longer confident in the United States’ financial markets and the work being done by independent auditors. In order to satisfy the public and ensure that a case, such as Enron, would not happen again, Congress proposed and passed the Sarbanes-Oxley Act of 2002. This paper presents an analysis of the Sarbanes-Oxley Act of …

Stop The Reach: Solving The Judicial Takings Problem By Objectively Defining Property, Steven C. Begakis
Stop The Reach: Solving The Judicial Takings Problem By Objectively Defining Property, Steven C. Begakis
Notre Dame Law Review
The future of judicial takings may rest on the ability of the Court to define property in a robust and objective way. Property has essential characteristics that make it easily identifiable, the most significant of which are the rights to exclude and use. However, even when a property right does not fit within a neat categorical definition, should that right have a long, well established pedigree in state court precedent, that property right is similarly within the capacity of the reviewing court to identify. And once it is determined that, prior to the judgment, the petitioners possessed a clearly defined …

Time, Due Process, And Representation: An Empirical And Legal Analysis Of Continuances In Immigration Court, David Hausman, Jayashri Srikantiah
Fordham Law Review
Since 2014, U.S. immigration courts have expedited the cases of many children and families fleeing persecution in Mexico and Central America. This Article conducts an empirical and legal analysis of this policy, revealing that reasonable time between immigration court hearings is necessary to protect the statutory and constitutional rights to legal representation. A large majority of immigrants facing deportation- including those part of the recent surge of children and families from Central America and Mexico-appear at their first deportation hearing without a lawyer, often because they cannot afford one. When an immigrant appears without a lawyer and does not expressly …

Are Campus Sexual Assault Tribunals Fair?: The Need For Judicial Review And Additional Due Process Protections In Light Of New Case Law, Emily D. Safko
Fordham Law Review
The pervasiveness of sexual assault on college and university campuses and the schools’ failures to take sexual assault seriously have resulted in recent reforms to college campus disciplinary proceedings. The federal government has largely prompted this wave of reform through Title IX, requiring schools to employ particular policies and procedures for investigating and adjudicating sexual assault as a condition of receiving federal funds. Although the federal government’s mandates may be properly motivated, these reforms are criticized because they encourage schools to enact procedures that are heavily stacked against those accused of sexual assault. Consequently, students alleging that they have been …

Of Grids And Gatekeepers: The Socioeconomics Of Mediation, Robert Rubinson
Of Grids And Gatekeepers: The Socioeconomics Of Mediation, Robert Rubinson
All Faculty Scholarship
Mediation scholars have long debated which mediator “style” or “model” is correct. The origin of the debate arises from a foundational piece of scholarship by Leonard Riskin. Riskin proposed a “grid” of mediator orientations comprised of what came to be known as “facilitative mediation” and “evaluative mediation.” A more recent addition to the grid—and one that is almost universally recognized as a distinct model—is “transformative mediation.” These three models are so embedded in the literature of mediation that they have been called “the big three.” The influence of Riskin’s work cannot be overstated. It has resonated within the community of …
Contributions Of The Jesuits To Human Rights In Mexico: A Case Study Of Center Miguel Agustin Pro Juarez, Luis Arriaga Valenzuela
Contributions Of The Jesuits To Human Rights In Mexico: A Case Study Of Center Miguel Agustin Pro Juarez, Luis Arriaga Valenzuela
LMU Theses and Dissertations
In Mexico, as in other parts of the world, human rights violations have deep historical roots. In the forty years before this study, these violations had been increasing, especially with respect to excluded populations and vulnerable groups, such as women, indigenous peoples, migrants, and victims of repression (Center Prodh, 2013). To reverse or at least decrease these conditions, disenfranchised people needed to become aware of their rights within civil society. Toward that end, diverse non-governmental organizations (NGOs) had taken on the task of providing education and strategic practices to disenfranchised people and communities. The Society of Jesus (the Jesuits) had …

New business formation is a powerful economic engine that creates jobs. Diverse legal issues are encountered as a start-up entity approaches formation, initial capitalization and fundraising, arrangements with employees and independent contractors, and relationships with other third parties. The endeavors of a typical start-up in the United States will likely implicate many of the following areas of law: intellectual property; business organizations; tax laws; employment and labor laws; securities regulation; contracts and licensing agreements; commercial sales; debtor-creditor relations; real estate law; health and safety laws/codes; permits and licenses; environmental protection; industry specific regulatory laws and approval processes; tort/personal injury, products …
Recommendations And Resources For Evaluating Community School Programs, Janet C. Fairman Ph.D., Amy F. Johnson Phd
Recommendations And Resources For Evaluating Community School Programs, Janet C. Fairman Ph.D., Amy F. Johnson Phd
School Improvement
The legislative definition of “community schools” is intentionally broad and anticipates the possibility that community schools might vary significantly in their locally-developed goals and intervention programs. The needs of students and their families may vary by community, as does the array of existing resources available in the surrounding area. This leads to a broad set of possible strategies that may imply different expected outcomes and evaluation processes.
The grant program requires pilot schools to meet certain application criteria. Applications require schools to submit an audit or needs assessment, a community resources assessment, an outline of plans and goals based on …
Nothing Could Be Finer? The Role Of Agency General Counsel In North And South Carolina, Elizabeth Chambliss, Dana Remus
Nothing Could Be Finer? The Role Of Agency General Counsel In North And South Carolina, Elizabeth Chambliss, Dana Remus
Faculty Publications
There is amazingly little contemporary research on the counseling function of government agency lawyers. Most research on federal government lawyers focuses on the Department of Justice, the Attorney General, or the birth of the modern administrative state during the New Deal. Much of this work focuses on the organization of federal litigation authority. At the state level, likewise, recent scholarship focuses on the litigation function of state attorneys general. Meanwhile, we know very little about the agency counseling function or the role of agency counsel in shaping agency policy and practice.
The role of state agency general counsel is an …
